Working from home – with Big Brother watching

Five years after the pandemic spread over the world, it's not clear if the employee or the employer is the winner from the prevalence of working from home.
Screen-bound employees working remotely can avoid the time and expense of commuting, and companies can hire staff without the expense of paying for office space, but employees are also isolated, often disconnected, and occasionally tempted to wag during work hours.
History suggests pandemics empower workers. In the Middle Ages, the Black Death shrunk the labour pool in Europe, giving the working class an awareness of its bargaining power.
Today, however, technology may reverse the power balance. Digital tools used by employees working remotely are a source of endless information on their own activities. And it's information employers can track – often without an employee's awareness.
The post-COVID office arrangement has left some companies snooping on their staff's productivity out-of-office. A 2021 global poll of 375 senior leaders found that in Australia, 91 per cent of respondents said they used monitoring software to keep tabs on employees working remotely. The poll commissioned by the law firm Herbert Smith Freehills found only 5 per cent of business leaders instead required employees to self-report.
The reason employees can work from home – the laptop, the internet, mobile phones, Teams meetings – is also why they are so easily watched. Keyboard strokes, time in front of the computer, mouse movements, eye movements, and now, with the help of AI, even the tone of messages sent can be monitored.
Kira Bomberg, marketing director for Mimecast Australia, said that before the pandemic lockdowns, her cybersecurity company looked for unusual email activity out of hours. This could be a potential sign of unauthorised access of information.

Three years since lockdowns ended, people have switched to hybrid work and their hours are adjusting, so looking for 'time-based' inconsistencies alone no longer captures cybersecurity risk, Bomberg says.
Still, the company scans 98 million emails a day in Australia and New Zealand, and a full 1.1 billion a day globally.
'COVID saw the use of collaborative tools across businesses, the rise of Teams, Zoom, Slack,' she said. Those tools involve sharing documents and links, often with people outside the business. 'So the industry had to catch up with security on collaborative tools.'
The company homes in on behavioural activities, looking for intruders who have harvested credentials, which is a very common activity. But the company also looks for 'disgruntled employee insiders'.
The systems track movements of employee data and then, using a risk-scoring model looking for 'insider risk indicators', flag the employee's action for attention with the employer. Mimecast's Incydr product 'continuously' collects metadata as events are detected, the company's video says.
'Using artificial intelligence, we look for anomalies in speech patterns' of employees, Bomberg says. 'We ask: would a certain employee use this kind of language? Would he send questions to the finance team? Are these his normal greetings?'
The monitoring means that every employee is subject to 24-seven surveillance – in their office and also, increasingly in the post-COVID era, in their home office, if they have one.
Relying on AI to sift content can create 'false positives', Bomberg says – situations, events, exchanges are flagged as being suspicious when they are just outside normal patterns.
Mimecast APAC field chief technology officer Ryan Economos says false positives aren't 'the most frequent result' and don't happen often.
The company's 'focus is on identifying all forms of insider risk from employees, with the knowledge that most incidents are more often unintentional rather than stemming from disgruntled individuals', he says.
While Mimecast is a human 'risk management platform' designed to provide cybersecurity, performance software does exist. In a separate, widely publicised case, Suzie Cheikho was fired from IAG insurance in February 2023 after 'the company's keystroke monitoring software detected low levels of activity while she was working remotely'.
Draconian response
A world of remote work has placed employers in a fog, which some have met with a Draconian response. In March, about 2000 staff at wealth management giant AMP were told to sign contracts that the finance union alleged would enable the company to carry out continuous video surveillance of them. After coming under fire for the clause, AMP eventually backtracked.
In two cases that predate the pandemic, Sydney-based veteran IT executive Peter Croft says he discovered that a full-time tech employee was working a second job.
'They were doing the same job as the job they were doing for my company, in breach of their employment contract.'
One employee's output was patchy, and the other simply spoke 'openly' about having a second job – to the point where the employee discussed needing to schedule meetings around it. The situation became unacceptable, he said. 'Funnily enough, they were quite willing to be very open about it.'
Croft, however, says he doesn't see employees secretly holding two jobs as a 'huge trend'.
Yet the reality of hybrid work further enables such HR capers. One WA-based IT consultant related a story on Reddit that occurred at a small start-up: 'We literally had a client escalate a case to us ... where an employee joined a company all-hands meeting from her company Teams account, on her company-provided laptop, with her camera background set to the corporate branding of what turned out to be her new employer, who was a major competitor, and she was yet to even provide notice.'
The legality and acceptance of employer surveillance of employees working from home is a matter of debate.

There is generally more public acceptance of monitoring of people in transportation, construction roles or jobs that could physically endanger people, says University of Technology Sydney labour lawyer and academic Dr Joellen Riley Munton.
For that reason, the law generally accepts the employer monitoring of employees, but with limits.
In NSW, workplace surveillance legislation basically 'says the employer just needs to notify people that it is, in fact, watching them and how it's watching them, and then it can do so', Munton says.
Employers have always monitored employees
People forget that employers have always monitored employees, she says, looking back at the industrial era, when workers toiled in factories under the gaze of bosses. 'They've always harnessed our energies, and they've controlled our time. To some extent, we've become freer of that level of monitoring by being able to earn an income without necessarily fronting up at the factory and being strapped to machines.
'But by the same token the understandable desire of employers to want to make sure you're actually earning your salary means that they're introducing surveillance means. And some of those surveillance means are more intrusive than they would have once been.'
The question is: just how intrusive, especially when phones, apps and gadgets produce endless streams of information to audit.
Employee data can be mined and analysed on an anonymised basis, which is the business model for US-based Worklytics. The company says it does not provide employee-level monitoring services to clients, but instead tracks 'hundreds of real-time metrics' from Slack, Office 365 and Google workplace 'across meetings, emails, online interactions, document management and more'.
This data, compiled and presented by the company, allows clients to understand manager effectiveness, wellbeing and burnout and sales effectiveness. Worklytics has no clients in Australia.
Disconnect in expectations
As working from home moves from a contingency plan to a way of life, companies are adjusting to the new reality.
There appears to be a disconnect in expectations, even within companies. One social media poster said he received a 'work-from-the-office-or-else' email from management while working in an empty office. The manager who sent the email 'was himself working from home'.
Distance allows more misunderstandings, too. In another case, an employee misinterpreted their manager's announcement of working from home as authorisation for them to also work remotely.
By many indications, hybrid work (some in office, some from home) is here to stay.
A recent report from the Australian HR Institute shows 'return to office' requirements are declining. The same polling found the top disadvantage of hybrid working was 'a feeling of disconnection between colleagues'.

In the hybrid arrangement, employees can fall through the cracks of management visibility, leaving them feeling disconnected. The already-unclear boundaries of employee surveillance are poised to become even blurrier as work and personal time blend.
Writing in The Conversation, RMIT lecturer Melissa Wheeler describes a paradox between surveillance and performance. 'When surveillance is enforced, employers have greater control over the work that can be accomplished by employees. But it can also signal a lack of trust,' she said. 'By definition, seizing greater control is incompatible with communicating trust.'
With so many employees working at distance, fostering and maintaining a level of trust is essential, she says.
But trust, as well as commitment, may be in short supply as remote working becomes standard. Croft, the veteran executive, says that 'one of the byproducts of larger scale work from home is to prove the use-case that if things can be performed outside the office, they can be performed from anywhere'.
There is no longer any 'real practical difference' between working from the suburbs of Sydney or working from the Philippines, Croft said. 'Potentially you're going to be competing with people who are based in some other part of the world for a role,' he said. 'I think everybody's aware of that.'

Qantas has been hit with a landmark $90 million fine for illegally sacking more than 1800 ground workers five years ago, after a Federal Court judge expressed the airline had shown the 'wrong kind of sorry'. Justice Michael Lee ordered Qantas to pay $50m to the Transport Workers Union — which brought the case — saying it 'would facilitate and promote' unions to take on similar cases where the Fair Work Ombudsman fails to act. In a statement, Qantas said the company accepted the penalty and judgement which held it 'accountable for our actions that caused real harm to our employees'. It concludes a saga that began in 2020, when Qantas outsourced baggage handlers, cleaners and other ground staff, axing more than 1800 staff, as COVID-19 took a toll on aviation. Qantas' appeal to the High Court was unsuccessful, paving the way for the penalty to be awarded. 'Although the outsourcing decision was a single act, it was a carefully planned act directed at, and affecting, a very large number of employees,' Justice Lee said. He accepted that Qantas was sorry for the illegal outsourcing, but wasn't convinced the measure of regret was 'significant' and described it as 'the wrong kind of sorry'. The fact former Qantas boss Alan Joyce's name was kept out of direct involvement in the outsourcing decision also left Justice Lee 'with a sense of disquiet and uncertainty as to precisely what went on within the upper echelons of Qantas leading up to the outsourcing decision'. The union sought the maximum penalty of $121m, while Qantas urged Justice Lee to impose a 'mid-range' fine of between $40m and $80m. At $90m, the penalty represents 75 per cent of the maximum and is the biggest employer penalty in Australian corporate history. The remaining $40m is yet to be allocated, but could go back to the 1820 workers who lost their jobs. Qantas late last year reluctantly agreed to pay $120m in compensation to the sacked workers, taking the overall bill for its wrongdoings to $210m. 'It will send a message to Qantas and other well-resourced employers that not only will they face potentially significant penalties for breaches of the (Fair Work act), but those penalties will be provided to trade unions to resource those unions in their role as enforcers of the (FWA),' Justice Lee said on Monday. He also criticised Qantas chief Vanessa Hudson for failing to appear before the court. Justice Lee noted Qantas chief people officer Catherine Walsh during the hearings apologised for the company's behaviour, but 'it seemed to me obvious that the person who could give the most direct and compelling evidence of corporate change and contrition' was Ms Hudson. 'Going back to the issue as to whether Qantas is truly contrite, I have hesitation in reaching a conclusion,' he said. Ms Hudson on Monday apologised for the 'genuine hardship' it caused its former team and their families. 'Over the past 18 months we've worked hard to change the way we operate as part of our efforts to rebuild trust with our people and our customers. This remains our highest priority as we work to earn back the trust we lost,' she said. The national carrier is working to regain the public's trust after a raft of scandals left the airline's reputation in tatters. These included a botched COVID-19 credits program and and a post-pandemic restart of domestic and international services marred by poor customer service, lost luggage, flight delays and cancellations. Maurice Blackburn principal Josh Bornstein, who represented the TWU in the case, said the record penalty meant corporate Australia was on notice that courts would not tolerate blatant attacks on workers' rights.

Why more businesses are taking control of their supply chains

'As a business, you do not want to spend too much money holding products because storage takes up space and ties up capital. Just-in-time means you only order as needed and save on storage and capital costs,' he says. But for that to work, you need a reliable supply. 'The issue is that Australia manufactures very little. You cannot just say, 'I need something, make it now,' and expect it within a day or two,' says Linn. 'Almost everything has to be imported, and the lead time is often one, two, or three months. Air freight is also too expensive.' 'For just-in-time to work in Australia, you need companies like Livingstone International that carry large volumes of stock and can provide immediate supply,' Linn says. During COVID, many suppliers came up short. With no inventory on hand and no contingency in place, they simply had nothing to offer. Linn says his firm became a critical supplier for a broad customer base during this period, largely because it had invested in depth of inventory and domestic warehousing well before the crisis hit. That strategy is now being formalised through guaranteed availability programs – including a no backorder program that hinges on long-term investment in stock and space. 'The idea of eliminating backorders is simple. If you have enough stock, you will not have backorders,' says Linn. 'But achieving that is not so simple because it requires significant investment. A supplier needs to invest heavily in inventory and warehouse space. Without those, backorders are inevitable. 'Livingstone has made that investment. We are a national company with capital behind us, and that allows us to support our clients properly.' Rather than simply promise low prices, the firm makes volume commitments to strategic customers, often holding a full year's supply of inventory on their behalf. Linn says this level of support builds trust and fosters long-term relationships, particularly among organisations that experienced supply failures during the pandemic. Those industries – hospitals, aged care providers, schools and large service operators – are now shifting their behaviour. Where price once ruled, continuity and certainty are now paramount. 'We serve essential industries such as healthcare, aged care, beauty, and education,' says Linn. 'These are not luxury categories. When people in these sectors need supplies, they need them immediately. You cannot afford to wait. Delays mean disruptions to patient care, halted procedures, or paused operations. That is not acceptable in critical environments. 'Now, clients want strategic relationships, not just price-based transactions. They are asking us to commit to them, and in return, they commit to us. They share their consumption volumes, and we invest in holding that inventory specifically for them.' It's not only B2B customers driving this change. Livingstone's scale and stockholding capacity also benefit everyday consumers, especially via its tiered pricing model. 'Our system allows customers to buy more and save more, regardless of order size,' Linn says. 'It ties back to our core value of passing savings directly to customers.' The company's IT infrastructure is also driving visibility and growth across B2C platforms. 'Our IT infrastructure is so good that major retailers have invited us to join them as a merchant,' Linn says. 'This has driven significant customer uptake for them by leveraging our wide range of brands and products. 'By expanding into new portals, we're making it simpler for customers to discover and purchase Livingstone International's trusted range of products through their preferred platforms.' JIT is a model that demands mutual trust – and a significant capital outlay from the supplier. But Linn says it pays off by reducing the kind of reactive scrambles that defined the early days of the pandemic. Cost pressures, meanwhile, are being offset through scale and automation. Linn says the firm's warehouse network spans millions of cubic metres, and its use of radio frequency systems, barcoding and precision picking drives efficiency throughout the fulfilment process. 'As a large importer and distributor, we have strong buying power. That allows us to work with manufacturers at scale, which brings their production costs down. They pass on the savings to us, and we pass it on to our clients,' he says. 'We also operate large warehouses, which makes our cost per pallet or cubic metre lower than smaller suppliers. Because we work with millions of cubic metres of warehouse space, we are much more efficient.' While the conversation about sovereign capability often centres on energy or defence, logistics insiders argue that procurement strategies are just as critical. Having inventory available locally – even if it means carrying more stock – is no longer seen as wasteful. It's insurance. In a recent submission to the Productivity Commission, the Australian Logistics Council (ALC) the nation's peak logistics industry body, described resilient supply chains as 'essential to safeguarding the productivity and sovereignty of Australia's economy'. The ALC warned that regulatory and infrastructure gaps were leaving businesses exposed to supply shocks and fuelling inefficiencies. The council called on governments to adopt a 'risk-based, forward-looking regulation that anticipates disruption scenarios,' enabling long-term investment in resilience. And it urged policy reforms to support 'domestic stockholding and distribution capability', noting that 'a diversified freight network … ensures greater continuity when specific corridors are compromised'. These structural shifts are already underway in parts of the private sector. Linn says many of Livingstone's major customers are now moving away from transactional supply relationships. Instead, they're seeking longer-term guarantees backed by inventory depth, which in turn requires a significant outlay by the supplier. 'We trust our clients to honour their commitments, and they trust us to carry the stock. It's mutual,' he says. 'If you visit our warehouse, you will see we hold significant stock for our key customers. Many of them operate just-in-time models, but they can only do that successfully because we have the infrastructure and inventory behind it.' The ALC agrees that the old model must evolve. In its submission, it said governments and business should plan for 'disruption as the default, not the exception,' and treat 'supply chain risk like financial risk – priced, insured against, and mitigated through redundancy and transparency'. The group also called for consistent regulatory co-ordination to support these shifts, arguing that 'Australia's freight sector is limited by fragmented regulation… and weak national co-ordination.' It warned that 'delays and duplication in freight infrastructure planning' were slowing down industry-led efforts to build resilience. Among its top recommendations: establish a National Supply Chain Resilience Framework, accelerate infrastructure approvals, and provide incentives for warehouse investment. These, it said, were not just productivity levers – but prerequisites for economic security. 'If Australia does not prioritise supply chain resilience,' the submission says, 'it risks becoming a less attractive place to invest, and less capable of protecting its own communities in a crisis.' As the world remains in flux, supply certainty has become a competitive advantage. For many Australian businesses, the ability to deliver on time and at scale is no longer just a procurement decision – it's a business-critical strategy. Livingstone difference today.
