Wage talks between Samwu and City of Tshwane break down, leaving workers in limbo

The recent CCMA-led talks between Samwu and the City of Tshwane failed to reach an agreement over the outstanding 3,5% wage increase for the 2021/22 period.

The Commission for Conciliation, Mediation and Arbitration (CCMA)-facilitated talks between the South African Municipal Workers Union (Samwu) and the City of Tshwane on June 10 and 23, 2025, broke down without an agreement over the outstanding 3.5% wage increase for the 2021/22 period.
The talks followed a May 9 Labour Court ruling, which sent the matter back to the South African Local Government Bargaining Council for a new hearing on the 3.5% wage increase after the city initially sought an exemption.
In the same breath, the court ruled that the city is exempt from implementing a 5.4% wage increase for the 2023/2024 financial year after it cited financial constraints.
The city approached the court after its application for exemption from a wage agreement with the unions was rejected by the bargaining council.

Samwu regional secretary Donald Monakisi said the union has formally appealed against the ruling on the 5.4% salary increase and is waiting for the Labour Appeal Court to schedule a hearing date.
Regarding the outstanding 3.5% salary increase, he said both the union and the city failed to reach an agreement during the recent CCMA-led negotiations regarding the process to finalise such an increase for municipal workers.
He said the bargaining council has scheduled the exemption hearing for July 21, 2025.
Monakisi explained that the CCMA-facilitated talks were held ahead of the upcoming exemption hearing at the bargaining council, in an effort to narrow down the issues in dispute and explore possible settlement options that could be formalised as a bargaining council award.
However, the meetings failed to yield consensus between the two parties, but they agreed on the value of ongoing dialogue before the scheduled hearing.
Monakisi said Samwu remains committed to these discussions, hoping to reach a mutually beneficial resolution in the best interest of workers.
'The union remains relentless in its position that the 3.5% salary increase, owed to workers from 2021, must be honoured. The prolonged delay in payment has imposed significant financial strain on municipal workers, who continue to provide essential services under increasingly difficult conditions. In this regard, Samwu's legal team is diligently preparing for the exemption hearing, with the aim of securing a just outcome for our members,' he said.
Monakisi emphasised that the City of Tshwane has confirmed the availability of funds to meet its obligations to employees.
He was referring to Mayor Nasiphi Moya's State of the Capital Address two months ago, where she noted Tshwane's improving financial outlook due to decisive actions and increasing resident support.
'We are proud to report that our cash reserves are projected to reach R2.86 billion in the 2025/26 financial year. This marks an important step toward financial stability, with our liquidity coverage improving from 23 days to 43 days over the next two years,' she said.
The Independent Municipal and Allied Trade Union demanded transparency and accountability, arguing that the city cannot claim financial stability for the public while citing financial distress as a reason for not paying its workforce.
Last month, the city and both unions jointly acknowledged the strain the ongoing wage dispute had placed on municipal employees.
'The city reaffirmed its appreciation for the dedication of its workforce and its commitment to working collaboratively with organised labour to find a fair and sustainable resolution,' parties said in a statement.

Nelson Mandela Bay's acting executive director of electricity and energy, Tholi Biyela, was forcibly removed from his office at the Munelek building on Tuesday by disgruntled officials who accused him of undermining them and ruling with an iron fist. A large group of officials, accompanied by leaders of the South African Municipal Workers Union (Samwu), stormed Biyela's office, demanding his resignation from the position. His removal was preceded by a union meeting. During the meeting, officials voiced their dissatisfaction with Biyela, and a resolution was passed to remove him from office. Acting city manager Ted Pillay has since called a top-level management meeting for Wednesday to discuss the issue and workers' grievances. Samwu shop steward Ayanda Solani said Biyela allegedly undermined engineers who had worked in the city for years by starting a process to appoint Eskom as an independent contractor. 'On top of this, Eskom will also bring its service providers to work on the municipal infrastructure,' Solani said. 'It is as if we are not capable of doing the work we studied for and have been doing all our professional lives. 'This partnership means that Eskom will be procuring material on behalf of the municipality and will attend to electricity faults at a cost. 'This will cost the municipality twice for the same job.' Solani said Biyela wrote a memorandum and prepared a service level agreement that just needed Pillay's approval. 'The turnaround strategy [for the electricity directorate] has not been presented and agreed with the unions, but Biyela is ready to present it at the next standing committee.' Solani said they were unhappy with Biyela calling a meeting to address workers without Samwu, in which he bashed the union. Biyela has been at odds with some officials in the directorate who have previously accused him of threatening their lives when he said in a meeting that 'lives will be shed'. On the other hand, Biyela opened a case with the police in July after receiving an anonymous phone call from a stranger who said 'You won't see the sun rise tomorrow'. Working relations between Biyela and staff have created unfavourable conditions for all parties involved. Biyela did not respond to a request for comment. Electricity and energy political head Ziyanda Mnqokoyi said, based on information they had received, the only concern raised with Biyela was that staff did not want him in the post. 'The Eskom issue is new to me. 'However, if this concern was raised by the workers regarding the involvement of Eskom in certain technical operations, it has been noted. 'It is important to clarify that the municipality, like many others across the country, occasionally engages with Eskom or other entities when specialised or high-risk technical assistance is required, particularly in instances where the stability of the local grid or resident safety may be at stake. 'This is not a reflection on the competency of our internal teams but rather a strategic step to augment capacity and ensure service continuity.' Regarding allegations about Biyela's management style, Mnqokoyi said they would be investigated through the proper channels. 'I will work closely with the city manager and labour representatives to restore calm, address underlying concerns and ensure that the interests of the residents remain the top priority.' When the reporter arrived at Munelek, one of the workers who spoke at the gathering said Biyela made their work harder and would confront subordinates over office gossip. 'Biyela is entertaining gossip and threatening to suspend people,' the worker said. 'He has a bullying kind of leadership style. 'His appointment as acting executive director with only five months in the metro was a huge disaster. 'He comes from a small local municipality in Knysna and has no experience of running a metro department. 'To add to that, he doesn't have experience and is not mature.' A second worker said Biyela, by bringing Eskom in, was saying they could not do their jobs. 'Many of our colleagues are on leave because they can't deal with his leadership style of threatening people. 'We can't continue like this. 'He must go and we will continue doing our jobs as we have been all along.' Municipal spokesperson Sithembiso Soyaya condemned Biyela's removal. He said such conduct undermined the law, workplace discipline and institutional processes to resolve disputes. 'We can confirm that an unlawful incident involving the forceful removal of Biyela occurred this morning,' Soyaya said. 'This is being investigated and dealt with through the appropriate legal and disciplinary channels. 'Security and legal measures are being put in place to ensure Biyela's safety and to prevent any recurrence of such incidents. 'Leadership appointments follow formal governance processes and decisions cannot be made through unlawful or coercive means. 'Biyela's acting contract remains valid until further notice or formal review by the city manager, who has the delegated authority in this regard.'

Following the Marabastad Retail Market shutdown last week, traders have since been ordered by the Gauteng Division of the High Court to submit their licensing applications by August 8. The court handed down the decision on July 31, after Mayor Nasiphi Moya led a by-law operation which led to the shutdown of the market. Over 30 applicants were listed on the court's order, and presiding Judge Elmarie van der Schyff said this decision was taken to ensure traders adhere to the metro's by-laws. 'All traders and occupants of the market are to submit any and all required applications to the City of Tshwane by no later than Friday, August 8. 'These submissions and applications are required to ensure compliance with any required legislation, by-laws, regulations, and policies which govern the City of Tshwane,' the judge said. Since the order was announced, MMC for Economic Development and Spatial Planning, Clr Sarah Mabotsa, has expressed gratitude for the High Court's decision. 'The Department of Economic Development and Spatial Planning reminds traders and businesses, and especially those businesses dealing with food products, that permission to trade or operate a business is not granted through a lease agreement between a landowner and a trader or business owner,' Mabotsa said. During the market's shutdown last week, the mayor said that the private entity leasing the property was illegally subleasing to vendors without any licenses to conduct business in the metro. The MMC says traders must attend a workshop before being able to trade in the city. 'Trading permits and compliance with fire and health safety are required for approved trading. [Permission] to trade or operate a business within the City of Tshwane requires applicants to attend a compulsory workshop on street trading in Tshwane,' Mabotsa said. Traders are required to bring the following for their licensing applications: – Certified copy of their identity document – A copy of their lease agreement for the trading space – The applicant must approach the Health Department and Fire Division to complete the compliance processes by paying for food handling training at the Health Department before the certificate of acceptability can be issued Any person seeking to trade must approach the Economic Development and Spatial Planning Department on the 3rd Floor, Middestad Building, to apply for trading permits. The fresh produce market has since been reopened after criticism of the metro's move to shut it down in the first place. Tafelberg site redevelopment: A new era for social housing in Sea Point

Image: Armand Hough / Independent Media The controversial Tafelberg site in Sea Point is expected to give birth to social housing, with a proposal of up to 252 units and public comment by 2026, while social development is keen for it to be utilised for older persons. In February, judgment was reserved in the Constitutional Court following housing activist group Ndifuna Ukwazi's plight of spatial apartheid against the City, Western Cape Government, the Premier and MEC of Transport and Public Works. In the same breath, in January, Infrastructure MEC Tertuis Simmers and MEC for Social Development, Jaco Londt, announced the province's proposal to redevelop a portion of 353 Main Road in Sea Point, known as the 'Tafelberg site". Brett Herron, GOOD Party Secretary-General and MPL said various proposals were under way but that enough time had been wasted over the years. 'Where the initial proposals tabled two months ago offered as few as 63 social housing units, the preferred new design could deliver up to 252 social housing units, alongside 139 open market units and 92 affordable housing units. This marks a significant improvement and shows that sustained civic engagement can influence government decisions,' he said. In response to plans going forward, Simmers office told the Cape Argus that various phases were under way which include draft concepts, designs and public participation by 2026. Advertisement Next Stay Close ✕ Ad loading 'The professional team is currently finalising the draft conceptual design based on stakeholder input, feasibility testing, and various impact assessments and specialist studies including traffic, infrastructure, storm water, visual and heritage assessments, are still under way and inform the development concept as well as the possible number of social housing opportunities on the site. The preferred feasible and viable concept is expected to be released in October 2025,' they said. 'Additional engagements will take place during the statutory application processes, targeted for March 2026, which will include opportunities for public comment.' Londt's office added the site would be feasible for much-needed older persons and low-income housing. The Sea Point Fresnaye and Bantry Bay Residents and Ratepayers Association said they supported social and affordable housing. 'However, the SFB is profoundly disappointed that our broader inputs, concerns and suggestions for community benefit in the development of the site have been summarily dismissed," they said. 'In prior public participation meetings, the participants were informed that the school building had been given over to the Provincial Department of Social Development, for their exclusive use. But even worse, the entire Tafelberg site would be fenced off and rendered impenetrable to the Sea Point community and the public in general which begs the question: why invite the community and affected residents to participate in the consultation exercise when the residents and the community will not even be allowed to access the site?' During an interview with the Atlantic Sun, Nathan Adriaanse, director of the public information and stakeholder relations for DOI said income of social housing, a state-subsidised, rental housing option, targeting low to medium income households ranging from R1850 to R22 000 per month. The property is over 1.7 hectares in size and has a legacy of forced removals. Up until June 2010, a portion of it was used as the WCED's Tafelberg Remedial School and a portion known as erf 1675 and 1424 was used by the Provincial Department of Human Settlements as affordable state-rental housing known as the Wyngard Mansions site. The application was prompted following the sale of the site, ' to the highest bidder, the Phyllis Jowell Jewish Day School at the price tag of R135 million in 2015.
