
Ex-teacher found guilty of historical abuse of boys at Edinburgh Academy
A judge sitting at Edinburgh sheriff court ruled on Monday that John Young, known widely as Jake Young, deliberately and gratuitously assaulted boys as young as 10 while he was head of physical education at Edinburgh Academy.
Sheriff Iain Nicol said in one case Young, now 91 and a former international rugby referee, carried out a 'harrowing' assault on a boy whom he repeatedly kicked and punched while the child was recovering from a spinal injury.
The boy, who was 12 and walked with a visible limp because of the injury, pleaded with Young during a PE class that he was unable to pick up some weights as ordered, prompting Young to lash out at his head and kick him, causing 'substantial pain'.
Young's assaults, which took place between 1966 and 1993, included twisting and squeezing boys' genitals, striking them with a cricket bat, a wooden implement or a clipboard, and looking at their genitalia under their shorts.
Despite the guilty verdicts, Young will not face punishment because he was found too ill and infirm to stand trial. He is close to death, the sheriff said, so could not appear in court or mount a defence.
Scotland's court service agreed instead to hold an examination of the facts hearing, a rare process in criminal cases where the allegations are made without a jury present for the judge to weigh up.
The courts used the same process last year to find another former Edinburgh Academy master, John Brownlee, guilty of more than 30 assaults against boys at the school without a formal trial. The cases have come to light during a public inquiry into systematic abuse in Scottish schools and care homes, leading to a flood of compensation cases.
Brownlee's 'sadistic' violence, often against pre-pubescent boys he was supposed to care for in a school boarding house, took place during the same decades as Young's assaults. Four of the 24 complainants in the Young case, who are all now adult men, were also among Brownlee's victims.
Nicol cleared Young of 28 charges, mainly breaches of the peace and indecent assaults where the former master was accused in court of 'perving' on young boys by routinely watching them showering.
The sheriff ruled there was strong evidence Young often did so to ensure the boys were showering and changing quickly to ensure they reached their next classes on time.

A spokesperson for Young's victims said the verdict would provide some comfort. Many were not believed at the time. The decision to hear the case had confirmed 'the significant passage of time is no barrier in holding those guilty to account', they said.
The case had shown that Young 'committed acts of cruelty and to have physically and mentally terrified many boys that he was entrusted to look after.
'The fact that numerous men came forward, many decades later, shows the severity and lifelong impact that childhood abuse has had throughout their lives, with many waiting over 50 years for justice to be served.'

Controversial vigilante cyclist Cycling Mikey returned to the scene where he pushed his bike in front of a car to perform the same stunt again. The biker, whose real name is Michael Van Erp, this week uploaded a five-minute clip showing him wheeling his bicycle into a car as the driver tried to pass roadworks on Paddenswick Road in Hammersmith. As his bike lay smashed into several pieces on the road, Cycling Mikey continued to block cars with his body to prevent another driver passing through. Today, he returned to the same spot again to stop drivers getting past, blocking the road and wagging his finger at anyone who disobeyed him. As one grey car travelled down the road, Cycling Mikey drove in front of it to act as a barrier, forcing the driver to turn around as he told them off with a hand gesture. At one point, a Tesco delivery lorry spotted the vigilante cyclist and decided to turn back, receiving a thumbs up from a pleased Cycling Mikey as a result. The lorry driver then shouted back 'are you Cycling Mikey?' to which the cyclist replied, 'I am, you're all good mate, you're all good'. At the end of the clip, he wrote: 'These drivers were all a lot more reasonable than the crazy Fiat driver you all saw Sunday and yesterday. 'They're still in the wrong and should not be driving like this. The good thing is that there were quite a few drivers who did not even try to run the No Entry. Well done and a high five to those!' Mr Van Erp, 52, rides through London with his GoPro as he attempts to catch drivers on their phones - before confronting them on video and taking their number plate. The road safety warrior claims to have caught more than 2,000 offenders since first strapping on his 'helmet-cam' back in 2006 - with his motoring victims including Frank Lampard and Chris Eubank. But the cyclist - who works as a carer and roller-skating instructor - was last year caught out by his own cameras as he pedalled over a London crossing despite the lights being red. Farmer 'raped wife, underage daughter and a cow... and made his partner watch other acts of bestiality with calves'
A farmer who is accused of raping his wife and underage stepdaughter over two decades has also been charged with committing sexual acts with cows and calves. The dairy farmer allegedly told his wife about having sex with his cows and made her watch as he made the calves perform sexual acts on him. The man, whose name cannot be reported to protect the identity of his accusers, is on trial in New Zealand where he faces 38 charges of sexual assault, including 15 of rape, one of bestiality involving cows and one of performing indecent acts on calves. His stepdaughter said the offending began when she was under 10 years old and escalated to near-nightly rapes for the next decade, Whangārei District Court heard. She claims she was raped nearly 300 times, Crown Prosecutor Geraldine Kelly told the jury. The victim said she felt relief when her stepfather got a vasectomy, The New Zealand Herald reported. Kelly said: 'Getting pregnant had been a concern for her before she was 12.' The girl did not speak about the offending out of love for her stepfather as well as 'confusion' over her body's response to the abuse, Kelly said. The court heard the man had a 'daily requirement' for sex which also led to his alleged sexual offending against his wife. He allegedly believed rape did not exist, saying that all women give in eventually and enjoy sex. He also told his wide that 'no means yes', Kelly told jurors. The man allegedly admitted to his wife that he had been having sex with some of the cows and showed her how he did it. During calving season, the man allegedly made the calves perform oral sex on him, which his wife also saw. Kelly said that on at least 20 occasions he would make his wife have sex with him after the act with the calves. Kelly added: 'She told him she found it repulsive but he would just do it'. The farmer's lawyer Matthew Ridgley said the alleged bestiality with the cows was nonsense. He told the jury it was for them to decide whether what happened was indecent. He said the farmer acknowledged he had sex with his stepdaughter but argued it was consensual and when she was over the age of 16. Ridgeley said that any sex with the man and his wife was also consensual The trial is expected to last three weeks.
