How new regulations will reshape what you watch and listen to

South Africans can expect a change in their media consumption habits, as the Department of Communications and Digital Technologies (DCDT) proposes to overhaul the nation's outdated media regulatory framework.
The newly published Draft White Paper on Audio and Audiovisual Media Services and Online Safety signals a shift from regulations designed for the "analogue broadcasting era" to one that looks at global streaming platforms, user-generated content, and "non-linear media consumption".
According to the department, this update is important as the existing Electronic Communications Act (ECA) is "no longer fit for purpose" in the digital age.
Why the old rules don't work anymore
For decades, South Africa's media landscape was all about the principle of "scarcity rationale". Simply put, radio frequency spectrum was a limited resource, so this meant strict regulation of broadcasters.
This framework, established by legislation like the Independent Broadcasting Authority Act (IBA Act) and continued in the Electronic Communications Act (ECA), focused on "broadcasting" as a unidirectional, one-to-many service delivered over traditional networks.
Under the old rules, services like Internet Protocol Television (IPTV) offered on managed networks were considered broadcasting services requiring a licence. What complicated matters was that the TV programming and Video-on-Demand (VOD) services offered over the public internet fell outside the Independent Communications Authority of South Africa's (ICASA) jurisdiction and did not require a licence.
Authorities noticed this created a regulatory imbalance, as traditional broadcasters faced "considerable obligations" for local content and stringent advertising rules, while new online players such as Netflix largely operated without these requirements.

What changes will affect South Africans?
The proposed White Paper introduces what it calls a "forward-looking approach". It seeks to "balance media freedom with public interest" and ensure regulatory fairness across all platforms.
So how will this directly impact what you watch and listen to?
The new framework will abandon the narrow, outdated definitions and will make up of three broad categories: traditional broadcasting services, on-demand content services (OCS) (think Netflix and BritBox), and video-sharing platform services (VSPs) (like YouTube and TikTok).
What this means for South Africans is that for the first time, global streaming platforms and social media video platforms will be formally acknowledged and potentially regulated in South Africa.
The policy aims for a "technology-neutral approach," meaning similar services will be regulated similarly, regardless of how they are delivered.
A core focus is enhanced online safety and protection, especially for children. The White Paper aims to "strengthen protection against digital harms".
For services like YouTube and TikTok and Very Large Online Platforms (VLOPs), you can expect: Mechanisms to report harmful content (e.g., incitement to violence or hatred, terrorist content).
Age verification systems for content that "may impair the physical, mental, or moral development of minors".
Parental control systems to help adults manage what children see.
A prohibition on advertising in content specifically provided for children.
Measures to combat "mis- or disinformation". This means a safer online environment, particularly for younger viewers, and a clearer route to flag inappropriate content.

Currently, traditional broadcasters have "considerable obligations" for local content, while OTTs (Over-The-Top services) have none.
The policy indicates that "South African content obligations may also apply to On-demand Content Services (OCS)" in the future.
What this suggests is that it could lead to a significant increase in local films, series, and music available on streaming services.
Another key change is the implementation of a new online ombudsman for complaints.
The White Paper proposes to "establish an ombudsman for online safety and media regulation". This will aim to provide an "easily identifiable and accessible route to resolution" for complaints that don't have a clear 'complaint box', so to speak, so there will be a dedicated avenue for dispute resolution, instead of just contacting a general helpline.
The listing of "national sporting events which are in the public interest" will be "extended to include the broadcasting of these in the broader AAVMS market".
Significant national events, like presidential inaugurations or state funerals, and potentially major sporting events, could become more widely accessible across various platforms, rather than being confined to traditional broadcasters who hold exclusive retransmission rights.
Advertising rules would also see change. Currently, there's a "regulatory imbalance" where online advertisers have more leeway than those on traditional radio or television.
The policy seeks to harmonise rules for misleading and comparative advertising, and address political advertising and disinformation across all platforms. This could lead to more consistent and transparent advertising practices across all media you consume. What is next?
The department has outlined a three-stage implementation plan, spanning up to 24 months, to allow for careful consideration, research, and consultation.
This phased approach aims to build consensus and ensure that the new framework effectively benefits South African citizens, businesses, and the creative industries.
This overhaul will take time. Compare the process to upgrading a city's entire water supply system.
While the old pipes (in this case, analogue broadcasting) served their purpose, they can't handle the demands of modern consumption (the streaming and user-generated content needs).
The new plan involves not only laying new, larger pipes (technology-neutral regulation) but also installing new filtration systems (the proposed online safety and ombudsman), ensuring local water sources are prioritised (local content), and connecting every home, regardless of location, to clean, accessible water (universal access).

According to gold trading platform ISA Gold, the year-on-year price of gold has surged, reaffirming its role as a strategic hedge against economic instability. Those who bought bullion in July 2024, amid a weakening rand and turbulent global markets, are now enjoying double-digit returns. "Clients who secured Krugerrands or gold bars through our platform last July are seeing portfolio gains that outpaced inflation and equities, proof that physical gold remains an essential part of any diversified investment strategy," said Aziz Moti, COO at ISA Gold. The yellow metal has gained about 42.33% in a year. Moti believes the rally is underpinned by global uncertainty, geopolitical tensions, a weakening US dollar, and strong central bank purchases. "Central banks have been on a buying spree, and that has only added to gold's momentum," he noted. Goldman Sachs recently raised its year-end 2025 forecast for gold to $3,700 per troy ounce, up from the current $3,305, citing sustained central bank buying and ongoing safe-haven demand. In a more bullish scenario – should central banks ramp up purchases or the US slip into recession – the price could hit $3,880 per ounce, said Moti. By Thursday afternoon, gold was already up 6.25% for the year. 'There continues to be a notable uptick in gold investment through exchange-traded funds, digital platforms, and physical bullion. This is not a short-term reaction. Investors are looking for security, legacy, and tangible value,' Moti said. While gold remains the ultimate safe haven, data from BrokerChooser shows that market anxiety is spreading across asset classes. Searches for 'is Trump good for the stock market' have jumped 170% in the past month, while 'should I sell Tesla stock now' soared by more than 5,000% after Trump publicly clashed with Elon Musk. South Africans are also closely watching the so-called 'Magnificent Seven' tech stocks. Nvidia, Tesla, and Tencent – partly owned by local giant Naspers – dominate interest, with Microsoft and Meta also winning favour after strong quarterly results. None of that happened – at least, not yet.' PPS Investments warned that while the full effect of Trump's tariffs is unclear, growth in the US could slow as higher import costs push up inflation. It favours domestic cash and yield-enhancing floating-rate notes while maintaining a neutral stance on offshore equities and fixed income, with gradual diversification away from the US. This, it says, should help investors limit the whipsaw effect of market reactions to tariff headlines. For Moti, gold's appeal is rooted in its track record. 'Gold has outperformed currencies for decades and weathered world wars, recessions, and a pandemic. Even as cryptocurrencies grow in popularity, gold continues to hold its ground as the traditional safe-haven asset,' he said. Bloomberg Intelligence supports this view, noting that institutional investors still regard gold as a hedge against long-term inflation and geopolitical risk, while crypto remains a high-risk, speculative play. South Africa braces for hefty 30% export tariff from the US
South Africa will be hit with a 30% tariff on all its exports to the United States from August 1, following a formal letter from US President Donald Trump to President Cyril Ramaphosa demanding action on trade imbalances and long-standing market restrictions. Image: Lee Rondganger/IOL South Africans are bracing themselves for the ramifications of the hefty 30% export tariff to the US that is expected to come into effect on Friday. South Africa exports billions of rands' worth of goods to the US each year, including fruit, vegetables, meat, and wine. These sectors employ thousands of workers, and the 30% tariff will render their products uncompetitive in the American market, placing immense pressure on producers and exporters. South Africa has been trying to negotiate a trade deal with the US since May but is yet to agree on terms. The US tariffs are a stress test for South Africa's economic resiliency. Image: Doctor Ngcobo / Independent Newspapers The Department of Trade, Industry and Competition (DTIC) said it remains committed to the cause and awaits substantive feedback from the US on the final status of the country's framework deal. The department said it has been in a period of intense negotiations with the US and had signed a condition precedent document and 'have readied our inputs for entry into the template which is to follow from the US'. 'Despite the challenges that have been presented by this period, we have put our best foot forward, bringing together the subject specialists within our ranks that have dug deep to ensure that our country is adequately prepared for a number of potential scenarios,' DTIC said. According to estimates, the tariffs will add roughly $3.5 billion (R63bn) to the cost of exports to the US, based on South Africa's 2023 export value. The DTIC's proposed deal features a number of areas, including importing 750-100 petajoules of Liquified Natural Gas for a 10 year period, unlocking $12 billion; and enabling agricultural market access by simplifying US poultry exports under the 2016 tariff rate quota and unlocking approximately $91m million in trade. South African firms committed to invest $3.3bn in US industries such as mining and metals recycling, while both governments agreed to pursue joint investment in critical minerals, pharmaceuticals and agri-machinery. Thys van Zyl, CEO of Everest Wealth Advisory, said South Africa was facing severe economic consequences without any formal agreement in place with its second-largest bilateral trading partner. 'It is almost unthinkable that, on the eve of such far-reaching tariffs, we still do not have a formal agreement – or even a timeline for when one can be expected. This is not only deeply concerning – it is negligent,' Van Zyl said. Despite discussions between the relevant stakeholders, there are no confirmed exemptions, no concessions, and no sign of progress in negotiations with the US government. The government has denied claims of a trade imbalance between South Africa and the US, maintaining that the 30% reciprocal tariff was not an accurate representation of available trade data. Minister of Trade, Industry and Competition, Parks Tau, this week said they were working with other government departments on a response plan that also focuses on demand side interventions in the impacted industries. Meanwhile, Foord Asset Management portfolio manager Farzana Bayat said a 30% tariff wall on South African exports to the US would be catastrophic and escalate trade risk. 'That would be a seismic shock. Even traditional US allies like the EU and Japan have negotiated reduced 15% tariffs - South Africa may not be so lucky,' Bayat said. She said the stakes were high as the expiry of the African Growth and Opportunity Act in 2025 was already clouding the medium-term trade outlook. Bayat said the immediate risk was acute as the South African Reserve Bank Governor Lesetja Kganyago recently warned that up to 100 000 jobs were at risk, and the automotive and citrus industries were especially exposed. Car exports to the US have already collapsed by more than 80% due to earlier tariff pressures. 'This economic stress comes at a time when South Africa is already contending with low growth, power insecurity, and shaky investor confidence,' Bayat said.
