Aadhaar, voter id valid for SIR in Bihar, says SC

New Delhi: Observing there should be "en masse inclusion" instead of "en masse exclusion' in the ongoing Special Intensive Revision (SIR) of voters' list in poll-bound Bihar, the Supreme Court on Monday asked the Election Commission to continue accepting Aadhaar and voter ID documents. Underscoring the "presumption of genuineness" of the two documents, the top court also refused to stay the publication of the draft electoral roll in Bihar.
The draft roll is scheduled to be published on August 1 and the final roll on September 30 amid Opposition claims that the ongoing exercise will deprive crores of eligible citizens from their right to vote.
The remarks by the apex court came on a day when several MPs of the INDIA bloc parties, including Congress chief Mallikarjun Kharge and Congress parliamentary party chairperson Sonia Gandhi, protested in the Parliament House complex the EC's voter roll revision and demanded its rollback.
The Rajya Sabha was disrupted once again as Opposition MPs continued to protest over the SIR issue. The Opposition's demand on the SIR issue also held up the scheduled discussion on the Pahalgam attack and Operation Sindoor in the Lok Sabha for a couple of hours, prompting the government to accuse it of betrayal after initially agreeing to the debate.
A bench of Justices Surya Kant and Joymalya Bagchi while asking the poll panel to continue accepting Aadhaar and voter ID for the SIR exercise in Bihar in compliance with its order said both documents had a "presumption of genuineness".
"As far as ration cards are concerned we can say they can be forged easily but Aadhaar and voter cards have some sanctity and have presumption of genuineness. You continue accepting these documents."
The bench would on July 29 fix the time schedule to conduct the final hearing of the matter. Senior advocate Gopal Sankaranarayanan, appearing for NGO Association for Democratic Reforms, said the electoral rolls should not be finalised in the interim, pressing for an interim stay on the publication of the draft rolls on August 1.
The bench, however, referred to the top court's previous order noting the petitioners did not press for an interim relief, which couldn't be allowed now and said the matter would be interpreted once and for all. The bench noted the election commission's statement that the enumeration forms for the SIR could be submitted even after the publication of draft rolls. "Don't undermine the power of the court. Trust us. If the court agrees with your submission and if any illegality is found, then this court will quash everything then and there."
On July 10, a bench headed by Justice Sudhanshu Dhulia asked the EC to consider Aadhaar, voter ID and ration cards as valid documents as it allowed the poll panel to continue with its exercise in Bihar. The top court on Monday said it prima facie agreed with the July 10 order and the Election Commission of India (ECI) accepted in its counter affidavit that Aadhaar, voter cards and ration cards could be accepted.
While expressing its reservation on ration cards, the bench endorsed the "presumption of genuineness" of the other two documents. Sankaranarayanan said despite the ECI's assertion in the counter affidavit of accepting Aadhaar and voter cards, ground reports suggested otherwise.
Justice Kant said the election commission suggested the list of 11 documents for the SIR exercise was not inclusive but exhaustive and they were using both Aadhaar and voter IDs for the purpose of identification.
Senior advocate Rakesh Dwivedi, appearing for the ECI, said Aadhaar was not a proof of citizenship and voter card was not relied upon as it was a revision exercise or else there was no use of such an exercise. Justice Kant then remarked, "Any document on earth can be forged.
The election commission can deal with cases of forgery on a case to case basis. Instead of en masse exclusion it must be en masse inclusion."
Justice Bagchi, on the other hand, referred to the ECI's position that none of the 11 documents referred for SIR were conclusive and asked why couldn't someone uploading only Aadhaar be included. Dwivedi said the poll panel was accepting both Aadhaar and voter IDs but with certain supporting documents.
The bench then asked the lawyers appearing for different parties to submit the timeline and the time they required for arguments by July 29.

Sources said Parliamentary Affairs Minister Kiren Rijiju and a few BJP national general secretaries are likely to be coordinating with allies for the vice presidential poll. Since the 2024 Lok Sabha elections, when the BJP lost its majority but comfortably crossed the halfway mark with allies, the sessional meeting of the party's MPs was expanded to include its allies. PM Modi had addressed the first such meeting on July 2. However, no meeting has been held in the last few sessions. When an employee is removed from service for a condition he did not choose, and where viable alternatives are ignored, the Court is not crossing a line by intervening, it is upholding one drawn by the Constitution itself,' said a bench of justices JK Maheshwari and Aravind Kumar, in a significant reaffirmation of the constitutional right to dignity and equality in employment. The August 1 judgment came as the bench directed the Telangana State Road Transport Corporation (TSRTC) to reinstate a driver who was compulsorily retired in 2016 after being diagnosed with colour blindness. Coming down hard on TSRTC for its failure to consider alternative roles for the driver, who had expressed willingness to be reassigned to a non-driving post, the court held that this omission was not just an administrative lapse, but a violation of both statutory obligations and constitutional principles. The judgment drew upon the principle that public employers are duty-bound to provide 'reasonable accommodation' to employees who acquire disabilities during service. Retirement on medical grounds, the court said, must be a measure of last resort, only after all viable options for redeployment have been exhausted. 'The obligation to reasonably accommodate such employees is not just a matter of administrative grace, but a constitutional and statutory imperative, rooted in the principles of non-discrimination, dignity and equal treatment,' noted the bench. The judgment further drew strength from a consistent line of rulings to reaffirm that beneficial legislation must be interpreted purposively to protect the rights of disabled employees. 'Employment security is central not only to individual dignity but also to familial survival,' said the court, emphasising that livelihood cannot be severed 'by the stroke of a medical certificate' without first exhausting all avenues for reassignment. The court cited the example of the driver seeking reassignment to the post of Shramik (helper) , a job that did not require normal colour vision. However, the Corporation did not even attempt to assess his suitability for such a role. According to the bench, the burden lies on the employer, not the employee, to prove that no suitable post exists or can be reasonably created. The court also referenced the pertinent provisions of the Industrial Disputes Act and a binding memorandum of settlement signed by TSRTC in 1979, which explicitly mandated alternate employment for colour-blind drivers with pay protection and continuity of service. The court ruled that TSRTC failed to comply with this binding obligation, adding that internal circulars cited by the Corporation in denying alternate employment, were merely administrative instructions and could not override statutory service conditions created by an industrial settlement. The bench further made it clear that even in the absence of such a settlement, constitutional and statutory principles demand the accommodation of employees who develop disabilities. 'This obligation is not rooted in compassion, but in constitutional discipline and statutory expectation,' it stated. The bench thus ordered the Corporation to appoint the driver to a suitable post consistent with his condition, at the same pay grade he held in 2016, within eight weeks. It also directed payment of 25% of arrears from the date of retirement until reinstatement and held that the intervening period must be treated as continuous service. 'In doing so, we not only vindicate the appellant's rights but also reaffirm our constitutional commitment to a just and humane employer-employee relationship,' the bench concluded.

NEW DELHI: As the stalemate over Bihar SIR continues to paralyse Parliament proceedings, the government on Monday said that it will be forced to press for the passage of crucial bills if the Opposition parties don't budge from their adamant position. The Speaker cited the precedent of former speaker Balram Jakhar, who turned down a demand for a discussion in the House on the Election Commission's functioning, given that the poll panel is conceived as an independent entity. Despite the opposition suggesting that if the government is unwilling to discuss SIR, discussions can be had on electoral reforms, voter deletion etc, the government refused to concede to the demand. Later, speaking to reporters, Parliamentary Affairs Minister Kiren Rijiju insisted that the government wants a thorough discussion in Parliament over its bills but will be compelled to push for their passage from Tuesday in 'national interest' as the proposed legislations are important for governance. Hitting out at the opposition parties, he said that they had agreed to a two-day discussion over the National Sports Governance Bill and National Anti-Doping (Amendment) Bill, both of which were scheduled to be taken up together for consideration and passage in the Lok Sabha on Monday, but they disrupted proceedings. The minister, however, made it clear that a debate on SIR cannot take place in Parliament as the exercise is part of the Election Commission's administrative action and functioning. Parliament can discuss electoral reforms but not the EC's functioning, he said, adding that the poll watchdog has carried out SIR earlier as well. Speaking to this paper, Congress chief whip Manickam Tagore said that the government has shut doors for the opposition on the issue. He asserted that the Law Minister and Parliamentary Affairs Minister must answer why the government is blocking discussion on SIR, an issue directly linked to millions of Indian citizens' right to pointed out that Parliament has always exercised oversight on Constitutional Bodies. He said that Parliament has debated issues such as electoral bonds, voter ID–Aadhaar Linking, appointment of Election Commissioners, Model Code of Conduct, role of CAG after the 2G report, Conduct of UPSC exams and Reports of NHRC, but no Speaker stopped that.
