Parliamentary panel urges law for OBC, SC, ST quotas in private universities

New Delhi: A Parliamentary panel on Wednesday flagged the 'considerably low' enrolment of Other Backward Classes (OBC) students and the 'abysmally low' presence of Scheduled Caste (SC) and Scheduled Tribe (ST) students in India's three private universities with Institution of Eminence (IoE) status and recommended a law making reservations mandatory in private higher educational institutions—27% for OBCs, 15% for SCs, and 7.5% for STs—in line with government norms. The central government has granted IoE status to 20 institutions (10 public and 10 private), thereby giving them special recognition, greater autonomy, and financial support to achieve world-class standards.
The Parliamentary standing committee on education, women, children, youth and sports, chaired by Congress MP Digvijaya Singh in its report on the necessity for reservations for OBC, SC, and ST students in private higher educational institutions, reviewed the latest students' strengths from O.P. Jindal Global University, Sonipat; Shiv Nadar University, Greater Noida; and Birla Institute of Technology and Science (BITS) Pilani.
Citing various Supreme Court's orders, the Parliamentary standing committee on education, women, children, youth and sports, headed by Congress MP Digvijaya Singh in its report submitted to Parliament said that reservation for SCs, STs and OBCs in private educational institutions is 'constitutionally permissible.'
To introduce reservations for SCs, STs, and OBCs in private higher education institutions, the Committee asked the government to follow the Right to Education (RTE) Act's 25% quota in private schools model – where fees are reimbursed by the government.
Private educational institutions are currently not bound by law to implement reservation policies, as no statute mandates them. The panel called the absence of reservations in private educational institutions an 'impediment to attaining social justice in this country.'
'The committee, therefore, recommends that Article 15(5) of the Indian Constitution be implemented in full across the country through legislation by parliament. The committee recommends that 27%, 15% and 7.5% seats should be reserved for OBCs, SCs, and STs respectively in private higher educational institutions,' added the report.
Article 15(5) of the Constitution, inserted through the 93rd Constitutional amendment in 2006, allows the government to mandate reservations for SC, ST, and OBC students in private educational institutions. In May 2014, in Pramati Educational and Cultural Trust v Union of India, the Supreme Court upheld the entirety of Article 15(5) of the Indian Constitution.
Citing All-India Survey of Higher Education (AISHE) 2021-22 data, which lists 517 private universities, 240 central institutions and 445 state institutions, the panel noted that public institutions alone cannot meet demand, making private HEIs crucial for accommodating students from all sections of society.
Congress general secretary (communications) Jairam Ramesh in a statement said it is 'no longer possible to ignore' the demand of SC, ST and OBC communities for reservations in private higher education. Stating that the panel report has given 'renewed impetus' to the demand which was also mentioned in the party's 2024 'Nyay Patra' manifesto, he said, 'The ball is now in the Modi government's court.'

Rajya Sabha NEW DELHI: Ministry of personnel on Thursday said 63 appointments made in central government departments since 2018 through lateral entry, were not subject to reservation as they were made for specific assignments, keeping in view the candidates' specialised knowledge and domain expertise. In reply to a written question in Rajya Sabha, junior minister for personnel Jitendra Singh said "since each of these appointments were made against single-post cadre, reservation is not applicable in view of Supreme Court judgement in the case 'PGIMER, Chandigarh vs. Faculty Association and Ors'." "Accordingly category-wise data of the appointed officers has not been maintained," he added. The minister said of the 63 officers appointed in three cycles (2018, 2021 and 2023) so far at the level of joint secretary, deputy secretary and director, 43 are currently in position across various ministries/departments. Following a political row over the policy for reservation of SCs, STs and OBCs not being followed in lateral appointments, UPSC had in Aug last year cancelled an advertisement for recruitment to 45 posts through this route. The UPSC action followed a communication from Singh, urging the commission to cancel the advertisement as "this (reservation) aspect needs to be reviewed and reformed in context of PM's focus on ensuring social justice".

New Delhi, Aug 21 (UNI) Delhi Congress chief Devender Yadav on Thursday claimed that the audit conducted during the Aam Aadmi Party (AAP) regime in 2022-23 after the Municipal Corporation of Delhi (MCD) was reunited has revealed a revenue loss of Rs 312 crore to the civic body due to alleged irregularities in tax collection. Yadav has demanded that the Lieutenant Governor should get the alleged corruption in the MCD investigated by a retired judge of the High Court, for the year 2022-2023, so that the whole truth could be brought out. He claimed that due to the alleged corruption, the MCD was pushed into a debt of Rs 14000 crore, adding that the audit report has shocking findings that the corporation lost crores of rupees due to non-collection of user charges and improper collection of revenue from advertising. He said that the AAP, which was in power at the civic body, and the BJP that ruled the corporation 15 years ago are responsible for the losses. Yadav alleged that APP leader and former CM Arvind Kejriwal had made lofty promises that if his party came to power in the MCD, it would banish contract employment and improve civic services, however, the same never happened and the AAP allegedly exploited the corporation. Yadav has also claimed that the audit report has also made a shocking revelation that Rs. 155.1 crore was lost due to non-compliance of Solid Waste Management Bye-Laws, Rs 9 crore lost due to non-collection of one-time parking fee and conversion fee for residential properties to commercial, Rs.142 crore due to lapses in Outdoor Advertising Policy, and Rs. 40.42 crore loss due to short collection from the transport company for advertisement on Bus Queue Shelter. The Congress leader pointed out that the MCD also suffered a loss of Rs. 81.97 crore on advertisement charges under the revenue sharing policy at IGI Airport. The Congress leader said that corruption during the AAP rule had been exposed in the audit report when irregularities in the work of almost all the departments in the Delhi government were found.
