Khayelitsha couple faces bail opposition in horrific rape and murder case of seven-year-old girl

The case against a Khayelitsha couple accused of the rape and murder of seven-year-old Lolitha Kowa has been postponed to next week for verification of a new residential address after their Kuyasa home was allegedly set alight.
Odwa Jack and his girlfriend, Nokuthula Matyesini, appeared in the Khayelitsha Magistrate's Court on Friday morning, where the State confirmed its intention to oppose bail.

The pair was arrested on July 23, hours after Lolitha's body was discovered about 1.5 kilometres from her home.
The child had gone missing the previous day after telling her family she was going to play with Matyesini's daughter.
Her body was later found dumped in another section of Kuyasa.
A screwdriver was lodged in her head, her stomach was bloated, and a sock had been stuffed down her throat.
The prosecutor told the court that both accused face a Schedule 6 charge, the most serious category of offences under South African law, which includes premeditated murder and requires exceptional circumstances for bail to be granted.
He detailed Jack's criminal history, submitting that the State now had access to his full bail profile.
'Odwa Jack has four previous convictions,' he said. 'In 2016, he was convicted of robbery with aggravating circumstances and received a five-year suspended sentence. In 2022, he was convicted twice – once for being in possession of drugs, and another time in Mitchells Plain for being in possession of a stolen motor vehicle. He was also convicted in 2015 for selling liquor without a licence. He has no outstanding warrants or pending matters.'
The prosecutor said Matyesini had no current convictions, pending cases, or warrants, but added: 'She was arrested and charged with assault with the intent to cause grievous bodily harm in 2013. That matter was subsequently withdrawn.'
He informed the court that, following consultation with the investigating officer, the State would oppose bail.
He also confirmed that the couple's home had been torched following their arrest, and this formed part of the State's opposition, as it meant that they were a flight risk because they had no place to stay.
In response, the defence said the accused now have an alternative address and requested the court to allow time for the new location to be verified and assessed for safety and community acceptance.
The matter was postponed to August 8 for this process to be completed.
Outside the court, hundreds of community members expressed anger and sorrow over the murder.
Cape Organisation for the Democratic Taxi Association (Codeta) chairperson Thobile Ndwalaza said Jack had been banned from driving their vehicles.
'We are going to start screening new drivers because of what happened. Even if Odwa came out today, he will never touch our vehicles again. We are very shocked by this incident – it has us on high alert,' he said.
Harare Community Police Forum chairperson Mthetho Mahomba condemned the accused in strong terms.
'They have demonstrated that they are not human beings, and we now regard them as animals. We don't have space for them in our community – animals belong in the zoo. This is all because of the brutal and inhumane manner in which they killed her.'
Community activist and CPF member Funeka Soldaat called for consistent action against gender-based violence beyond high-profile cases.
'We are grateful that communities are supporting each other and mobilising, but we must do this daily and not only when something shocking happens. We need to return to the values we were taught growing up. It can't be that women are protecting men. The accused could have gone to the community and reported the boyfriend instead of protecting him.'
The community is expected to return to court next week when the bail matter resumes.

Letsike emphasised the need for greater vigilance from adults, including parents and teachers, in identifying warning signs and addressing problems promptly. 'Learners must feel safe at school. Parents and other adults can help learners who suffer at the hands of bullies,' she said, adding that schools should be free from violence and GBV. Witness reveals cocaine purchases at Tees Tavern during High Court trial

Image: File A victim of the violence that took place in Phoenix during the July 2021 unrest has told the Durban High Court on Tuesday morning that he used to buy cocaine from Tees Tavern. However, he told the court that he does not know Trevor Gopal, who allegedly incited violence against black Africans. Gopal is on trial with Ravine Naidoo, Tyreece Govender, and Timothy Govender for the murder of Njabulo Allen Dlamini, two counts of attempted murder, public violence, and malicious property damage. Next Stay Close ✕ The victim, who is a State witness, Nkosikhona Madlala, 27, has told the court that before July 12, 2021, the day when he was allegedly assaulted together with his two friends, he had gone to Tees Tavern. Madlala, who started leading his evidence on Tuesday, stated that on the day of the incident, July 12, 2021, Dlamini, Sandile Sambo, Sanele Merase, Mthobisi Ntuli, and Linda Khawula came to fetch him at his home in iNanda. He said the driver was Merase. 'They came in a Toyota Quantum with a written logo on its rear and above the windscreen, Touch Africa,' Madlala explained. He said that as his friends came to fetch him from his home, they told him 'that we must go to Tees' Tavern to buy'. Madlala said he went inside the house to take money, and they then drove to Phoenix. Additionally, he mentioned that some roads had been closed with plastic barricades. Moreover, Madlala has so far told the court that he knows Naidoo, Tyreece, and Timothy from the scene on July 12. He, however, said he does not know Gopal. 'It is the first time seeing him here,' Madlala told the court. According to the State, Dlamini, Madlala, and Sambo were hit with golf sticks, baseball bats, and sjamboks. It also alleges that wooden pallets were placed on their bodies and liquid fuel was poured on them with the intent to burn them to death. Dlamini later died at the Mahatma Gandhi Memorial Hospital due to blunt force head injuries. The previous State witness told the court that Gopal ordered that Madlala, Sambo, and Dlamini be burnt together with their taxi after they were assaulted. He also stated that Tyreece and Timothy assaulted Dlamini with a hammer and a rock on the head. The trial continues.

494 illegal miners in court as 24 more emerge from hiding at Sheba Mine in Mpumalanga
As 494 illegal miners who were arrested last week appear in the Barberton Magistrate's Court in Mpumalanga on Tuesday, a further 24 have surfaced at the Sheba Mine. The suspects, who appeared in groups of 50 in the dock, face charges of trespassing, possession of gold-bearing materials, and the contravention of the Immigration Act. The arrests stem as a result of the South African Police Service's (SAPS) national Operation Vala Umgodi, which tackles the scourge of illegal mining within the borders of South Africa. The suspects, foreign nationals, are from eSwatini and Mozambique and include minors. Of the 494 suspects, the court granted 26 suspects with fixed South African addresses R2,000 bail. The others have been remanded in custody. The provincial police spokesperson, Donald Mdluli said the illegal miners resurfaced on Monday and this came after police cut off access to their food supply. 'Twenty-four suspects have been arrested at the same mine where the 494 were arrested. Now, we have about 518 suspects who have since been arrested. The other interesting one is that there is a firearm that has been confiscated from one of the suspects. We are expecting more [to resurface], but that is dependent on the re-planning, re-assessing, and ensuring more resources are brought to ensure they resurface,' Mdluli told the media.
