Witness reveals cocaine purchases at Tees Tavern during High Court trial

A victim of the violence that took place in Phoenix during the July 2021 unrest has told the Durban High Court on Tuesday morning that he used to buy cocaine from Tees Tavern.
However, he told the court that he does not know Trevor Gopal, who allegedly incited violence against black Africans.
Gopal is on trial with Ravine Naidoo, Tyreece Govender, and Timothy Govender for the murder of Njabulo Allen Dlamini, two counts of attempted murder, public violence, and malicious property damage.
Gopal, the owner of Tees Tavern, is also charged with incitement to commit public violence.

The victim, who is a State witness, Nkosikhona Madlala, 27, has told the court that before July 12, 2021, the day when he was allegedly assaulted together with his two friends, he had gone to Tees Tavern.
Madlala, who started leading his evidence on Tuesday, stated that on the day of the incident, July 12, 2021, Dlamini, Sandile Sambo, Sanele Merase, Mthobisi Ntuli, and Linda Khawula came to fetch him at his home in iNanda. He said the driver was Merase.
'They came in a Toyota Quantum with a written logo on its rear and above the windscreen, Touch Africa,' Madlala explained.
He said that as his friends came to fetch him from his home, they told him 'that we must go to Tees' Tavern to buy'.
Madlala said he went inside the house to take money, and they then drove to Phoenix. Additionally, he mentioned that some roads had been closed with plastic barricades.
Moreover, Madlala has so far told the court that he knows Naidoo, Tyreece, and Timothy from the scene on July 12. He, however, said he does not know Gopal.
'It is the first time seeing him here,' Madlala told the court.
According to the State, Dlamini, Madlala, and Sambo were hit with golf sticks, baseball bats, and sjamboks. It also alleges that wooden pallets were placed on their bodies and liquid fuel was poured on them with the intent to burn them to death.
Dlamini later died at the Mahatma Gandhi Memorial Hospital due to blunt force head injuries.
The previous State witness told the court that Gopal ordered that Madlala, Sambo, and Dlamini be burnt together with their taxi after they were assaulted. He also stated that Tyreece and Timothy assaulted Dlamini with a hammer and a rock on the head.
The trial continues.

Molefe's bail application was postponed to next Friday, and he will remain behind bars.

Madlala said Naidoo was among the people in the crowd who were telling them to get out of the taxi. He added that Naidoo beat him up with a sjambok. He said Tyreece was carrying a golf club. 'He was using a golf stick to beat me all over my body. He even kicked me,' Madlala explained. Additionally, Madlala said Timothy was carrying a hammer. He said that when he was lying on the ground after refusing to get inside the burning taxi, he saw that Sambo was not moving; he said it looked like he had fainted.

The victim has also pointed out three of the four men charged with murder and public violence in Phoenix during the unrest. Nkosikhona Madlala told the court that Ravine Naidoo, 67, Tyreece Govender, 21, and 46-year-old Timothy Govender were among the people who assaulted him on July 12, 2021, when he and his friends went to Tees Tavern to purchase cocaine. The owner of Tees Tavern, Trevor Gopal, 52, is an accused in this matter. All four of them are charged with the murder of Njabulo Dlamini and the attempted murders of Madlala and Sandile Colin Sambo. They are also charged with public violence and malicious damage to property. He said they were traveling in a Toyota Quantum that had a written logo, Touch Africa. He said after they had bought cocaine from Tees Tavern and got inside the quantum, a white bakkie, a Ranger, blocked them. He said a group of people walking and some alighting from vehicles carrying weapons, shouted and told them to get out of the taxi. Madlala said they got out of the taxi, but Dlamini remained inside as he was sleeping in the front passenger seat. 'They told us to sit down. We refused until one guy took out a firearm and fired a shot,' Madlala said. State Prosecutor advocate Thabani Buthelezi asked him who the guy was who fired the shot. Madlala replied by saying the guy was the one driving a white Ranger. He said that after the gunshot was fired, they all ran in different directions. He said as they ran away, a crowd of about 40 people ran towards them. At this stage, he said Sambo was running ahead of him. He said the crowd was pursuing him, and he kept on running away and found himself back where the taxi was parked, and it was burning. He stated that those burning the taxi ordered him to get inside. 'They were pointing at me forcefully, with their weapons, shouting that I had to get inside the taxi. I refused. I lay down and they beat me with sjambok, golf stick, and baseball bats,' Madlala added. That time, according to him, the taxi was burning and the windows were exploding. The trial continues.
