Karnataka High Court raps Nirmiti Kendra, says RTI Act applicable

BENGALURU: The Karnataka High Court ruled that the Right to Information (RTI) Act is applicable to Nirmiti Kendra. 'Nirmiti Kendra would be a public authority in terms of Section 2(h) of the RTI Act,' the court said, imposing a cost of Rs 50,000 on it for suppressing information sought by the applicant.
Justice Suraj Govindaraj passed the order while dismissing the petition filed by the Public Information Officer (PIO) and project director of Nirmiti Kendra in Chitradurga district.
The petition was filed against the order dated August 29, 2017, passed by the Karnataka Information Commission, which directed the petitioner to furnish information sought by applicants, while also imposing a cost of Rs 25,000 on it.
It was contended in the petition that Nirmiti Kendra is a private society, and not financed or aided by the state or central government.
The court said the direction issued by the Karnataka Information Commission to furnish the document sought by the applicant cannot be faulted. It is not expected of a government authority and officers of Nirmiti Kendra, who are government officers, to have taken such a stand that Nirmiti Kendra would not come within the purview of the RTI Act.
'All government officers and departments are subject to the RTI Act and required to make available the information sought. The attempt made by officers of Nirmiti Kendra to suppress such transparency leaves much to be desired, and does not inspire confidence. The petitioner has successfully avoided disclosure of information and details. In view of this, cost of Rs 50,000 is imposed,' the court said.

The government is set to target the next big phase of reforms under the Goods and Services Tax (GST) regime by Diwali, Prime Minister Narendra Modi said in his Independence Day speech on Friday. Tax burden for smaller businesses and common people is going to be reduced as the government looks at reducing rates on daily-use items and removal of the 12 per cent slab. 'This Diwali, I am going to make it a double Diwali for you…we have undertaken a big reform of GST over the last eight years. We reduced the burden of tax across the country…eight years later, time demands that we review it. We started the review through the formation of a high-powered committee, held discussions with states,' Modi said. 'We are coming with next generation GST reforms by this Diwali,' he said, adding that tax burden will be reduced significantly, and MSMEs will benefit greatly. Sources said multiple meetings of the GST Council, the overarching federal body with members from both the Centre as well as states, will be held in the run-up to Diwali since decisions involving rate reductions that could potentially result in revenue losses will need to be discussed threadbare. The last meeting was held in December 2024. The government is looking at reducing the multiplicity of rates as well as public welfare services such as health and life insurance. The proposal to do away with the 12 per cent slab would involve shifting some items to the lower 5 per cent slab, and some others to the higher 18 per cent slab. Though this would simplify the multiple rate structure, it is estimated to result in significant revenue losses of Rs 70,000-80,000 crore for the Centre and states combined, The Indian Express had reported last month. In its last meeting held in Jaisalmer in December 2024, the GST Council had held discussions on lowering rates on several items. However, it decided to defer a key decision to lower the tax rate on health and life insurance premiums. The potential revenue losses from the major tweaks in GST rates are likely to be met by resistance from states as it may strain their fiscal health. This rate rationalisation proposal has been unpalatable to many states, both BJP-ruled and Opposition, as several attempts to simplify or reduce rates on consumer-focused items were stalled earlier in the GST Council. To build consensus and resolve contentious outstanding issues, Union Home Minister Amit Shah is learnt to have initiated discussions with all stakeholders — states as well as Central ministries, The Indian Express had reported last month. GST, the biggest indirect tax reform in recent years, was introduced in July 2017. But it is riddled with a multiplicity of rates — zero, 5 per cent, 12 per cent, 18 per cent and 28 per cent, in addition to the cess rates for luxury and sin goods, and special carve outs for precious metals. The GST rate rationalisation has been talked about for over four years now. In its 45th meeting held in September 2021 in Lucknow, the GST Council discussed the need to undertake rate rationalisation including correction of inverted duty structure, to reduce classification related disputes, and enhance GST revenues. The Council then approved changes in GST rates to correct inverted duty structure in many sectors, including textiles and footwear that were brought into effect from January 2022.

BENGALURU: The Karnataka High Court directed the state government to implement the notification prohibiting Plaster of Paris (PoP) Ganesha idols with full seriousness. 'Undisputedly, the issue is a serious one. We expect the state to implement the order (prohibiting PoP idols) with full seriousness,' said a division bench of Chief Justice Vibhu Bakhru and Justice CM Joshi, while disposing of the petition filed by the Karnataka State Pollution Control Board (KSPCB). The petitioner has highlighted the impact of PoP idols on the environment, especially water bodies. The petitioner alleged that the order of prohibition of the PoP idols is not complied with, and two persons, M Sridhar and Srinivas, who have industries in Hulimavu of Kumbalgodu, are illegally manufacturing the idols, and are evading the order and continuing to market them. The government advocate submitted that certain FIRs have been lodged and necessary action would be taken in accordance with the law. Recording the submission, the court said, 'We do not pass any order as the government order is already issued prohibiting PoP idols, and the same needs to be implemented.'

This scheme has saved Rs. 6790 crores for women. Recently, crossing the milestone of 200 crore zero tickets is another milestone in our achievements, the CM said that the previous government left us with mounting debts and arrears of Rs 8,21,652 crore when the People's Government assumed power. Out of this, Rs. 6, 71, 757 crore are debts. Rs 40,154 crore dues are related to the payments of the employees and other schemes. Rs 1,09,740 dues are SC, ST sub plan, Singareni, Electricity and other departments. From total debt, we have completed the debt service of Rs 2,20,676 crore which included Rs 1,32,498 crore principal amount and Rs 88, 178 crore interest amount till the date. Despite facing financial burden, the state government is working hard to take the state forward from zero to the top level. We are moving forward with the inspiration of the Father of the Nation Gandhiji and the builder of a new India, Pandit Jawaharlal Nehru, and the support of the people.
