Prayagraj: The Allahabad high court ruled that interfaith marriages without religious conversion are illegal and refused to quash criminal proceedings against a man accused of marrying a minor at an Arya Samaj temple, reports Rajesh Kumar Pandey.
The Allahabad High Court directed the state home secretary to investigate how Arya Samaj temples are issuing marriage certificates without following rules and submit a compliance report. The court declined to set aside the criminal proceedings against the man who married a minor after allegedly kidnapping her.
In his order dated July 24, Justice Prasant Kumar made it clear that the investigation has to be made by an officer not below the rank of deputy commissioner of police.
Before passing the above directions, the court found that the applicant and the victim belong to different religions. "There is averment in the application that they have solemnized marriage in Arya Samaj Mandir at Prayagraj. However, the same could not have been done without proper conversion as per the existing law," added the court.
With these observations and directives, the court dismissed the petition filed by one Sonu alias Shahnur, who had moved the court to quash summoning order dated September 12, 2024 issued against him as well as the entire proceedings of criminal case going on against him under section 363 (punishment), 366 (kidnapping a woman to compel her to marry) 376 (rape) of IPC and sections 3/4 of the Protection of Children from Sexual Offence (Pocso) Act at Nichlaul police station of Maharajganj district.
During the course of hearing, the counsel for the applicant submitted that Shahnur had solemnized marriage with the victim on February 14, 2020. He further submitted that since the girl was minor, she was sent to Nari Niketan and when she became an adult, she started living with the applicant.
On other hand, the government counsel submitted that the girl is minor as per her high school certificate and she could not have solemnized marriage with the applicant.
He submitted that the applicant and the victim come from different religions, as such, their marriage cannot be considered valid until and unless proper conversion is carried out in accordance with the provisions of the UP Prohibition of Unlawful Conversion of Religion Act, 2021.
He further submitted that the marriage certificate has been issued by Arya Samaj Mandir, which seems to be a fabricated document.
In support of his arguments, the state counsel quoted an earlier order passed by this court, in which the court pointed out that certain people who claim themselves of Arya Samaj and are getting marriages solemnized illegally with mala fide intentions without even verifying the age of the couple.
The court will hear the case next on August 29.

Two sub-inspectors attached to Hulimavu police station knew details about allegations of child abuse against him. The team led by deputy commissioner of police (Electronics City) M Narayana is verifying whether Gurumurthy killed the boy after sexually assaulting him. Nischith was kidnapped by Gurumurthy when he was returning home from tuition on July 30 and his half-burnt body was found in the dense forest of Bilawaradahalli near Bannerghatta on the evening of July 31. The driver's co-accused Gopi, alias Gopi Krishna, 27, technician with a private cable operator firm, stole the sim card used to make ransom calls to Nischith's parents from an old-age home in Koramangala. Assigned to attend a complaint at the old-age home in the first week of July, Gopi swiped a basic handset belonging to a 75-year-old inmate and gave the sim to Gurumurthy and kept the handset. No complaint of the mobile phone theft was filed by the septuagenarian woman's family. Police said Gopi has no criminal antecedents. Gurumurthy, a journalism course dropout, used the sim to register WhatsApp on a spare mobile phone and then removed it so that it appeared switched off when someone tried to call the number. This account was used by Gurumurthy to make ransom calls and send messages to Nischith's family by using VPN or VoIP on connecting to the internet by converting his own mobile phone connection to a hotspot. Police suspect Gurumurthy learnt about the technology from his elder brother, an assistant security officer at an Indian embassy in West Asia. Gurumurthy, who along with Gopi, was shot at by police in the legs near Bannerghatta on Aug 1, has been shifted to a hospital ward from the ICU. "We'll take the accused into police custody once doctors give their opinion," an officer said.

Raichur: The women police apprehended an individual on Aug 3, concerning the sexual assault of a minor girl whom he married. According to SP G Puttamadaiah, the police took Tatappa, 22, son of Narasayya from Shaktinagar, into custody. The women police filed a case against 10 individuals, including Tatappa, on July 21, following a complaint from Ravikumar, the panchayat development officer of Devasugur, who verified the documents related to the girl's age. Taking the matter seriously, the Karnataka State Commission for Protection of Child Rights directed the Yadgir police to urgently detain the father-in-law who married the minor. The FIR indicates that accused No.2 to 10 — Gaddemma, Sumangala, Geetha, Anjaneyya, Gaddeppa, Renuka, Sadanand, Mahadevi, and Ramanagouda — conducted the marriage of Tatappa with the minor girl on April 18, at Shaktinagar, fully aware that she was underage. Additionally, the FIR noted, citing the victim's testimony, that Tatappa sexually assaulted her twice at his residence, despite being aware of her minor status. The police initiated a case under sections 9 and 10 of the Prevention of Child Marriages Act, Sections 64 r/w 3(5) of the Bharatiya Nyaya Samhita 2023, and Sections 6 and 17 of the Protection of Children from Sexual Offences Act (Pocso) 2012. In his comments on the arrest, Commission member Shashidhar Kosambe stated: "To promote the education of the minor, prompt action should be taken under the applicable schemes, and a report should be sent to the commission concerning this matter."

Allahabad HC judge has made a mockery of justice, says Supreme Court

The Supreme Court has passed a scathing order reprimanding an Allahabad High Court judge, choosing to name him while saying that he not only 'cut a sorry figure for himself but has made a mockery of justice'. The order brought to fore the Supreme Court's apprehensions about the High Court judiciary's performance. 'We are at our wits' end to understand what is wrong with the Indian judiciary at the level of the High Court. At times we are left wondering whether such orders are passed on some extraneous considerations or it is sheer ignorance of law. Whatever it be, passing of such absurd and erroneous orders is something unpardonable,' a Bench of Justices J.B. Pardiwala and R. Mahadevan wrote in a 19-page order dictated in open court on August 4 and published on Tuesday. The apex court recorded that the High Court judge in question, Justice Prashant Kumar, found nothing wrong in a litigant filing a criminal case against a buyer in a purely civil dispute over an unpaid balance of money in a sale transaction. In fact, the Bench said the High Court judge had found that registering a criminal case for 'criminal breach of trust' would be a quicker way to get the unpaid balance. A civil suit would be too laborious and time-consuming. 'The judge has gone to the extent of saying that asking the complainant to pursue civil remedy for the purpose of recovery of the balance amount will be very unreasonable as civil suit may take a long time… It was expected of the High Court to know the well-settled position of law that in cases of civil dispute a complainant cannot be permitted to resort to criminal proceedings as the same would amount to abuse of process', the Supreme Court noted. Justice Pardiwala, the lead judge on the apex court Bench, asked how the ingredients of the offence of 'criminal breach of trust' would apply to a sale transaction. The offence would only arise if there was a fraudulent misappropriation of an 'entrusted' property. 'Mere transaction of sale cannot amount to an entrustment,' the apex court explained. Interestingly, even the local police had refused to lodge a criminal case, saying the nature of the dispute was purely civil. However, the Magistrate had gone ahead to register a criminal case, oblivious of the point that the dispute concerned only a sale transaction and payment of a balance amount. Justice Kumar had seconded the Magistrate's point of view, refusing to quash the criminal case. 'We are not taken by surprise with the Magistrate exhibiting complete ignorance of law as to what constitutes cheating and criminal breach of trust … However, we expected at least the High Court to understand the fine distinction between the two offences and the necessary ingredients to constitute the offence of cheating and criminal breach of trust,' the apex court rued. It further asked the Allahabad High Court Chief Justice to remove Justice Kumar from the criminal roster and not assign any criminal case to the latter till he demitted office. 'The Chief Justice shall make the judge concerned sit in a Division Bench with a seasoned senior judge of the High Court,' the Supreme Court noted.
