Pune Porsche crash: Prosecution says drunk teen must face trial as an adult
In the Pune Porsche crash case that claimed two young lives in Pune last year, the prosecution has urged the Juvenile Justice Board (JJB) to allow the 17-year-old accused to be tried as an adult. The prosecution argued that the teen was fully aware of the consequences of driving under the influence and called the incident a 'heinous offence', reported The Indian Express.
The crash took place in the early hours of May 19, 2024, when the speeding Porsche car, allegedly driven by the minor in an inebriated state, rammed into a motorcycle in Kalyani Nagar. The impact killed two IT professionals, Aneesh Awadhiya and Ashwini Koshta, both 24, and originally from Madhya Pradesh.
On Monday, Special Public Prosecutor (SPP) Shishir Hiray appeared before the JJB, stressing that the minor was booked under Indian Penal Code (IPC) Sections 304 (culpable homicide not amounting to murder) and 467 (forgery), both carrying punishments of ten years or more — making the case fall under the 'heinous offence' category as per Section 2(33) of the Juvenile Justice (Care and Protection of Children) Act, 2015.
'He knew the consequences'
Hiray argued that the teen had not only consumed alcohol but also ignored warnings from the actual driver of the Porsche. 'Still, the minor drove the Porsche after consuming liquor and committed the crime. He knew the consequences of driving under the influence,' said Hiray.
He further alleged that the minor was present at Sassoon Hospital when his blood samples were swapped — an act he said proves the teen understood the legal consequences of his actions. 'He was aware that this was a crime. He should be tried as an adult,' Hiray added.
According to police submissions, under Section 15(1) of the JJ Act, in cases involving heinous offences, the JJB must assess the minor's mental and physical ability to commit such a crime, his understanding of the consequences, and the circumstances around the act. If the Board is satisfied, it can order an adult trial under Section 18(3).
Defence argues for rehabilitation
On the other side, senior defence lawyer Prashant Patil opposed the prosecution's request. He argued that the incident, though tragic, stemmed from a moment of recklessness, not criminal intent.
'The child in conflict with law [CCL] has no prior record. He lacked full comprehension of the legal and moral impact of his actions,' Patil said, stressing that the objective of the Juvenile Justice Act is 'reformative' rather than 'punitive'.
He further cited the Supreme Court's judgement in Shilpa Mittal vs State of Delhi, asserting that the charges may not legally fall within the ambit of a 'heinous offence' as defined under the JJ Act.
Court to assess minor's mindset
Patil further submitted that per Section 2(12) of the Act, anyone under 18 is considered a child. 'Even if the act was grave, the law aims to rehabilitate, not punish, the child like an adult,' he said, arguing that the emotional and mental maturity of the accused is not comparable to that of a grown-up.
The Juvenile Justice Board is yet to pass an order and will consider psychological evaluations and counselling reports before taking a decision. The next hearing is scheduled for July 15.

Justice Bhuyan also noted the "gruesome manner" in which the Commando allegedly choked his wife to death and said this was not a case for exemption. Justice Vinod Chandran noted that the High Court had denied relief to the Commando. The Commando is accused of killing his wife under Section 304B of the Indian Penal Code, which deals with dowry deaths. The Commando's counsel said the only allegation against him is that he demanded a motorcycle in dowry and this charge was made by two witnesses closely related to his dead wife. The counsel said these witnesses are "highly discrepant". The court, however, refused to grant relief. It issued a notice, seeking a response from the prosecution on the Special Leave Petition. "We decline the prayer for exemption from surrendering. Issue notice on the SLP returnable in six weeks." When the Commando's counsel sought time to surrender, the court granted him two weeks.

During her studies, she said she came into contact with Chandrashekhar Azad, and they were allegedly in a relationship for three years. 'We were in regular conversation from 2021. During this time Chandrashekhar assured me that he was unmarried and was looking for a life partner like me. He emotionally developed a relationship with me by promising marriage. On his assurance, I not only accepted him personally, but also actively supported him in his political campaigns. When I came to India, especially in Delhi, Chandrashekhar called me several times to a hotel and his residence in Dwarka and had physical relations with me by saying that he would marry me soon. He consistently deceived me from the beginning by claiming he was unmarried. Under the false promise of marriage, he had physical relations with me multiple times against my will," she wrote in her complaint. In several posts on X, the woman made serious allegations against the MP and referred to herself as 'Victim No. 3'. 'For him, the honour of sisters and daughters has no value…I made a big mistake by trusting him. Now I will not be able to trust any man," she wrote. She claimed that she was emotionally exploited and later abandoned. Chandrashekhar Azad initially established himself as the founder and leader of the Bhim Army, an organisation dedicated to advocating for Dalit rights. He gained significant attention during the clashes between Thakurs and Dalits in Saharanpur, Uttar Pradesh, in May 2017. In the 2019 Lok Sabha elections, he filed a nomination to run against Prime Minister Narendra Modi from Varanasi but eventually withdrew. Woman sexually assaulted by another patient at Delhi hospital
A female patient was allegedly sexually assaulted by another patient inside Jag Pravesh Chandra (JPC) Hospital in Delhi, the police said on Monday. Further investigation is underway, said officials.(Representational/Screengrab/X/@ANI) According to officials, information regarding the molestation of a female patient in JPC Hospital was received at the New Usmanpur Police Station. "On reaching the spot, the police team found that a female patient admitted in the hospital had been sexually assaulted by another patient, identified as Mohd. Faiz, a resident of Kachchi Khajuri, aged 23 years," they said. They said a case under relevant sections has been registered at PS New Usmanpur, and the accused has been arrested. Further investigation is in progress, they added. More details are awaited. Earlier this month, a minor girl died due to injuries on her face at a hospital after she was allegedly sexaully assaulted in the National Capital, Delhi police said in a statement. Police said they received a call regarding the sexual assault of a minor on June 7 at 8:41 pm at Dayalpur police station. The girl was brought to JPC Hospital by her father in an unconscious state, where doctors declared her dead on arrival. Medical staff observed visible injuries on her face and suspected sexual assault, police said. Crime and forensic science teams are inspecting the location. A case has been registered under sections 103(1), 66, and 13(2) of the Bharatiya Nyaya Sanhita (BNS), along with relevant sections of the Protection of Children from Sexual Offences (POCSO) Act. Teams have been deployed to collect evidence and trace the accused.
