Former Neggiri rep withdraws suit over Bersatu membership termination
KUALA LUMPUR: Former Nenggiri assemblyman Mohd Azizi Abu Naim has withdrawn the originating summons he filed at the High Court here challenging the termination of his membership in Bersatu.
His lawyer, Nur Irdina Syahirah Mohammad Wardi, told Judge Roz Mawar Rozain that the suit was being withdrawn as it had become moot following the Nenggiri by-election, which has since produced a new assemblyman.
Meanwhile, lawyer Awang Armadajaya Awang Mahmud, representing the Kelantan State Assembly Speaker Datuk Mohd Amar Nik Abdullah as defendant, requested that Mohd Azizi be ordered to pay RM250,000 in costs, citing the case's public interest and complexity.
"Our side has worked hard to prepare for this case as it involves the speaker, an important position that can impact the country's legislative body, and touches on the electoral landscape concerning elected representatives," he said.
Lawyer Chetan Jethwani, representing Bersatu president Tan Sri Muhyiddin Yassin and secretary-general Datuk Seri Hamzah Zainudin as defendants, also requested that Mohd Azizi pay RM250,000 in costs to his two clients.
"This suit had no basis and would ultimately have failed. This is proven by its withdrawal," said Chetan.
Judge Roz Mawar then struck out the suit and ordered Mohd Azizi to pay RM50,000 in costs to Mohd Amar and RM50,000 to Muhyiddin and Hamzah.
As the plaintiff, Mohd Azizi had filed the originating summons on June 24 last year, naming Muhyiddin, Hamzah, and Mohd Amar as defendants.
He sought a declaration that his dismissal and termination of membership from Bersatu through a notice dated June 12, 2024, were null, void, and unlawful.
Mohd Azizi also sought a declaration that the notice of termination was invalid and that his dismissal from Bersatu was made in bad faith.
According to the plaintiff, the amendment to Clause 10 of the Bersatu Constitution, which stipulates that a member's membership is terminated if they support a political rival, was unconstitutional. – BERNAMA

[UPDATED] Anwar files application to stay civil suit proceedings
KUALA LUMPUR: Prime Minister Datuk Seri Anwar Ibrahim has filed an application to stay trial proceedings in connection with a sexual assault suit filed against him in 2021 by former research officer, Muhammed Yusoff Rawther. Anwar's lawyer, Datuk Seri Rajasegaran Krishnan, confirmed the filing to the New Straits Times. "We filed the stay application last night. Case management will be held online this afternoon, during which a hearing date will be fixed," he said. This came after High Court judge Roz Mawar Rozain dismissed Anwar's bid to refer eight constitutional questions to the Federal Court, which included whether he possessed immunity from a civil suit filed by Yusoff. Roz Mawar had also rejected Anwar's application to stay trial proceedings in the sexual assault suit, which she will preside over beginning June 16. The suit was filed before Anwar's appointment as prime minister on Nov 24, 2022. One of the main grounds in Anwar's stay application was that the High Court decision relied on two cases which had already been overruled by the Federal Court. It also said the judge erred in law by relying on overruled and discredited Federal Court precedents, resulting in a decision that lacks legal foundation and breaches the principle of constitutional fidelity. Rajasegaran had said a notice of appeal against Roz Mawar's entire decision had been filed on Wednesday. Roz Mawar, in her decision, ruled that Anwar's referral application on the eight constitutional questions was speculative and did not meet the requirements under Section 84 of the Courts of Judicature Act. Anwar had sought the apex court to rule whether Articles 5,8,39,40 and 43 of the Federal Constitution grant him qualified immunity from Yusoff's suit. Anwar had asked the court to decide whether Yusoff's suit would impair the effective discharge of his executive duties and undermine the constitutional separation of powers. He had also requested the court to consider whether the lawsuit impacts his ability to carry out executive duties and undermines the principle of separation of powers guaranteed by the Constitution.

What's new in the expanded SST starting July 1?
KUALA LUMPUR: The government is expanding the Sales and Service Tax (SST) to make the system more targeted and fair, focusing on those who spend more on non-essential goods and services. Here's what's changing: 1. More services will be taxed Six new categories of services will be subject to the service tax, namely leasing and rental, construction, finance, private healthcare, education, and beauty services. These will be taxed at varying rates between six and eight per cent, with thresholds and exemptions in place to safeguard lower-income groups and small businesses. 2. Essentials stay tax-free Basic goods like rice, cooking oil, sugar, milk, medicines, books and even building materials such as cement and sand remain under the zero per cent sales tax. No changes there, your everyday needs won't cost more because of SST. 3. Luxury items face higher tax Goods like imported fruits, king crab, truffle mushrooms, silk fabric, racing bikesand antique paintings will now be taxed at five or 10 per cent, depending on the item. These are considered non-essential. 4. What's taxed and what's not, in the new service categories • Leasing and rental: Taxed at eight per cent if annual income exceeds RM500,000. But residential rentals and small businesses are exempt. • Construction: Taxed at six per cent for contracts above RM1.5 million. Public housing and residential buildings are exempt. • Finance: Fee-based services taxed at eight per cent, but basic banking, Islamic finance and remittances are not affected • Private healthcare: Only non-citizens will pay a six per cent tax. Malaysians are exempt, including for traditional medicine like Chinese, Malay and Indian therapies. • Education: A six per cent tax applies to private schools charging over RM60,000 per student annually and higher education for international students. Malaysians and persons with disabilities are exempt. • Beauty services: Taxed at eight per cent if a business earns over RM500,000 a year. This includes facial treatments and hair salons. 5. Grace period for businesses No penalties or enforcement until Dec 31, 2025, giving businesses time to adapt.
