Senate OKs Mehlhaff's eminent domain bill
The proposal from Sen. Jim Mehlhaff would affect all eminent domain proceedings. It proposes that a developer of any transmission project couldn't start any condemnation action against a landowner until after receiving a permit for the project from the South Dakota Public Utilities Commission.

Democratic Sen. Jamie Smith switched from a no to a yes, and that proved decisive. The Senate's 18-17 vote on Monday for the latest version of SB 198 sets up a conflict with the House, where legislation has passed that would prohibit CO2 pipelines from using eminent domain. House Bill 1052 awaits a hearing in the Senate State Affairs Committee that Mehlhaff chairs.
The House is also scheduled to debate on Tuesday a proposed moratorium on CO2 pipelines in South Dakota unless certain conditions are met.
Several representatives from Glacial Lakes Energy, an ethanol producer, watched the Senate debate from the upstairs gallery on Monday.
Summit Carbon Solutions has an application pending at the PUC for a state permit for a pipeline that would collect CO2 from ethanol plants in South Dakota and transport it to central North Dakota for burial.

The Finnish leader has broken the ice with Trump, bonding over a shared love of golfing while leading a country with a significant land border, and apprehension toward, Russia. Zelensky's previous visit to the White House in February ended in disaster, descending into a public show of fractured relations between Kyiv and Washington. "Most likely, there will be little mutual understanding between Trump and Zelensky," Oleg Dunda, a Ukrainian MP who is part of Zelensky's Servant of the People party, told Newsweek. "Zelensky has already firmly rejected any proposals regarding territories." Trump told European leaders after meeting Putin that he backed a plan in which Ukraine would cede territory it still controlled to Russia, The New York Times reported, citing two senior European officials. Reuters reported that Russia had said it would offer slivers of land it currently controls in Ukraine in exchange for Kyiv giving up chunks of land in the east that Russia does not currently control, citing sources briefed on the Kremlin's thinking. Under the proposal, Ukraine would fully withdraw from Donetsk and Luhansk, with the current front lines in the Kherson and Zaporizhzhia regions to the south frozen in place, according to the report. Kyiv has said it will not reward Russia's invasion with territory, and to cede these areas would go against the country's constitution. Russia has tried to frame European nations as stumbling blocks to the peace agreement the Trump administration has pledged to broker. Following the Anchorage summit, Putin urged European politicians to "not make attempts to disrupt the planned progress through provocations and behind-the-scenes intrigues," or to become "obstacles." Trump's special envoy, Steve Witkoff, said on Sunday that despite the Alaska summit yielding no deal, Ukraine would have "Article 5-like" protections to ward off any future attempt by Russia to attack its neighbor. Article 5 is the provision in NATO's founding treaty that means that an attack on any member country in the alliance is treated as an attack on all. Moscow has insisted Ukraine cannot become a member of NATO, while Kyiv sees joining the alliance as a way to make sure Russia cannot attack the country again. "Now it is really up to President Zelensky to get it done," Trump told Fox News following the Alaska summit. "I would also say the European nations have to get involved a little bit." 'Destroying democracy' — the latest theme of the left — can be defined in many ways. How about attempting to destroy constitutional, ancient and hallowed institutions simply to suit short-term political gains? So, who in 2020, and now once again, has boasted about packing the 156-year-old, nine-justice Supreme Court? Who talks frequently about destroying the 187-year-old Senate filibuster — though only when they hold a Senate majority? Who wants to bring in an insolvent left-wing Puerto Rico and redefine the 235-year-old District of Columbia — by altering the Constitution — as two new states solely to obtain four additional liberal senators? Who is trying to destroy the constitutionally mandated 235-year Electoral College by circumventing it with the surrogate 'The National Popular Vote Interstate Compact?' When have there ever been two near-miss assassination attempts on a major party presidential candidate during a single presidential campaign? Who destroyed the southern border and broke federal law to allow in, without criminal or health background audits, some 10 million to 12 million illegal aliens? Who created 600 'sanctuary jurisdictions' for the sole purpose of nullifying federal immigration law, in the eerie spirit of the renegade old Confederacy? Who allowed tens of thousands of rioters, arsonists and violent protesters over four months in 2020 to destroy over $2 billion in property, kill some 35 people, injure 1,500 police officers and torch a federal courthouse, a police precinct and a historic church — all with de facto legal impunity? How do the purported destroyers of democracy find themselves winning 60% to 70% approval on most of the key issues of our times, while the supposed saviors of democracy are on the losing side of popular opinion? How does a president 'destroy democracy' by his party winning the White House by both the popular and Electoral College vote, winning majorities in both the Senate and House by popular votes and enjoying a 6-3 edge in the Supreme Court through judges appointed by popularly elected presidents? So what is behind these absurd charges? Three catalysts: One, the new anguished elitist Democratic Party alienated the middle classes through its Jacobin agenda and therefore lost the Congress, the presidency and the Supreme Court, and now has no federal political power. Two, the Democratic Party is polling at record lows and yet remains hellbent on alienating the traditional sources of its power — minorities, youth and Independents. Three, Democrats cannot find any issues that the people support, nor any leaders to convince the people to embrace them. So it is no surprise that the panicked Democrats bark at the shadows — given that they know their revolutionary, neo-socialist agenda is destroying them.
