Three sentenced to 7 years in Bengaluru's DJ Halli-KG Halli riot case after confessing guilt

The National Investigation Agency (NIA) Special Court in Bengaluru has sentenced three individuals to seven years of rigorous imprisonment in connection with the violent mob attack on DJ Halli and KG Halli police stations in August 2020. The trio, Syed Ikramuddin (alias Syed Naveed), Syed Atif, and Mohammed Atif, pleaded guilty before NIA Special Court judge Kemparaju, becoming the first in the high-profile riot case to be convicted. Their admission of guilt led to the sentencing, even as trials for the remaining accused are yet to begin.
These three men were listed as the 14th, 16th, and 18th accused in the chargesheet. In total, 199 individuals were named in the case, of whom 187 were arrested. While four others surrendered later, one accused died. The prosecution has so far filed a formal chargesheet against 138 people.
The sentencing relates to the mob violence that broke out on August 11, 2020, when a large group—estimated at 25 to 30 people—assembled near the KG Halli police station around 9 pm. The protesters were demanding immediate action against a relative of the then Pulakeshinagar MLA Akhand Srinivasa Murthy, who had allegedly posted derogatory remarks about Prophet Mohammed on social media.

The protest was reportedly led by Syed Ikramuddin, one of the now-convicted individuals. As tensions escalated, police imposed Section 144 of the CrPC to maintain order. However, the mob turned violent, triggering a riot that resulted in extensive damage to public and private property.
During the chaos, 13 vehicles were vandalized, including one Innova, five two-wheelers, and seven other vehicles.

A witness in the 2008 Malegaon blast case who turned hostile claimed he was illegally detained and forced to implicate Uttar Pradesh Chief Minister Yogi Adityanath, besides four others linked to the Rashtriya Swayamsevak Sangh (RSS). In its over 1,000-page judgment, special judge A K Lakhoti of a National Investigation Agency (NIA) court mentioned Milind Joshi Rao's testification that he was pressured by the Maharashtra Anti-Terror Squad (ATS) officials to falsely name Mr Adityanath, RSS member Indresh Kumar, former Bharatiya Janata Party (BJP) MP Sadhvi Pragya Singh Thakur, Hindu seer and former RSS member Swami Aseemanand, and Professor Deodhar in the case. Besides, Mr Rao also said the ATS illegally kept him in custody for a week and told him he would be freed only if he named the above five people. Six people were killed when a bomb planted in a motorcycle exploded in a busy market in Malegaon, around 300 km from Mumbai, on September 29, 2008. The blast was initially probed by the state ATS before the case was handed over to the National Investigation Agency (NIA), the country's top anti-terror body. All seven accused, including Ms Thakur, were acquitted by the court on Thursday on the grounds that there was "no reliable and cogent" evidence against them. On Friday, a former probe officer alleged that the ATS was ordered to arrest RSS chief Mohan Bhagwat during the course of investigation. Mehboob Mujawar, who was a part of the ATS team that investigated the blast, also claimed there was an attempt to take the probe in the "wrong direction" and that false cases were registered against him for objecting to the plan. "Mohan Bhagwat was going to be included in the case to make it appear like a saffron terror case," Mr Mujawar said. The BJP has in the past alleged that the investigation into the case was carried out with an intention to defame and frame right wing leaders and target the Hindu community. "There was an attempt to conduct a fake probe into the Malegaon bomb blast but I was not ready for it. False cases were registered against me in this case but my name was cleared later," he said. The NIA court, however, dismissed the claims. The blast in Malegaon took place during the holy month of Ramzan, just before the Navratri festival, the NIA pointed out, claiming the intention of the accused was to strike terror in a section of the Muslim community. The trial, which started in 2018, got over on April 19 this year. The prosecution presented 323 witnesses, of whom 37 turned hostile. The special court, on Thursday, observed that while the prosecution had proven a bomb blast did occur, it failed to establish that the explosive was planted on the motorbike.

A special court in Bilaspur on Friday has reserved its order on the bail applications of three people including two Catholic nuns from Kerala who were arrested on charges of human trafficking and forced religious conversion. The complainant alleged that the trio had trafficked and forcibly converted three young tribal women from Narayanpur district. The hearing took place on Friday in the court of Principal District and Sessions Judge (NIA Court) Sirajuddin Qureshi. Public Prosecutor Dauram Chandravanshi opposed the bail applications, citing the early stage of the investigation. The court is expected to deliver its order on Saturday. Defence counsel Amrito Das argued that the accused were detained solely on the basis of unverified allegations, and no significant materials were recovered from them. 'The prosecution has not even sought their custodial interrogation. The alleged victims are all adults, already practicing Christianity, and have been sent back home,' he said. He also pointed out that the statements of the women's parents confirmed that they were not being taken away forcibly or fraudulently. The case has taken on political overtones, with a high-profile delegation from the Kerala unit of the All India Congress Committee (AICC) visiting Chhattisgarh on Friday to meet the arrested nuns. The team included MPs Hibi Eden and Kodikunnil Suresh, who alleged that referring the case to a National Investigation Agency (NIA) court by the Durg sessions court was a deliberate attempt to delay bail. 'There is a conspiracy behind shifting the case to the NIA court. It's intended to prolong the legal process and keep the nuns behind bars,' said Suresh, speaking to reporters at Raipur airport. He added that protests were already underway in Kerala, condemning the arrests. MP Hibi Eden questioned the legality of the detention: 'If it's not the jurisdiction of local police or the sessions court, and the NIA is taking over, then why are the nuns still in jail after five days?' He described the arrests as 'unlawful and unjust' and blamed the ruling BJP for targeting Christians. Eden also alleged that in some northern states, Christians have to seek approval from right-wing groups to conduct religious services. 'This is unacceptable in a secular country,' he said, adding that the Congress delegation had also approached the Union Home Minister and written to the Prime Minister regarding the case. The arrest has sparked a political row, with both the Congress and the CPI(M) slamming the move. Chhattisgarh Chief Minister Vishnu Deo Sai, however, has accused the opposition of politicising the matter and interfering with a police investigation. Adding another twist to the case, one of the women allegedly being trafficked, 21-year-old Kamleshwari Pradhan, has claimed she was coerced by Bajrang Dal activists into giving a false statement. She also alleged that the police failed to properly record her version of events. According to Pradhan, her family has been practicing Christianity for the last four to five years.

Mujawar had at the time also claimed that senior ATS officers had ordered him to arrest Bhagwat, but he had refused to obey such illegal orders.(ANI) Special NIA Judge A K Lahoti, in his over 1000-page judgment, said it did not find any force in the contentions raised by the advocate for accused Sudhakar Dwivedi, who had relied on the claims made by Mehboob Mujawar, a former ATS officer. Mujawar had at the time also claimed that senior ATS officers had ordered him to arrest Bhagwat, but he had refused to obey such illegal orders as he did not find any role of Bhagwat in the alleged offence. The court, in its order, rejected the defence lawyer's contention based on a statement made by ACP Mohan Kulkarni, the then chief investigating officer, that Mujawar was never asked to arrest any member of RSS and was only sent out to trace the two absconding accused — Ramji Kalsangra and Sandeep Dange.
