Funds under Right to Education need not be linked to National Education Policy: Madras HC to Centre

Funds payable by the Union government to state governments under the Right to Education Act need not be linked to the implementation of the National Education Policy, the Madras High Court said on Tuesday, according to Live Law.
A bench of Justices GR Swaminathan and V Lakshminarayanan urged the Centre to release to Tamil Nadu the funds under the Right to Education Act.
'It is true that implementation of the Samagra Siksha Scheme is aligned to NEP 2020, but the obligation under RTE is independent by itself,' Live Law quoted the bench as saying.
The Samagra Shiksha scheme, implemented in 2018, is the scheme through which the Union government provides support for elementary and secondary school education.
In April, the Union Education Ministry had told the Rajya Sabha that Tamil Nadu, Kerala and West Bengal received no funds under the central education scheme for 2024-'25.
Data shared in the Upper House by Minister of State for Education Jayant Choudhary showed that while Kerala was allocated Rs 328.90 crore, Tamil Nadu Rs 2,151.60 crore and West Bengal Rs 1,745.80 crore from the Centre for the current fiscal year under the scheme, no funds had been released to these states as of March 27.
The halt in funding to Kerala, Tamil Nadu and West Bengal came against the backdrop of these states refusing to comply with the PM Schools for Rising India, or PM SHRI, scheme.
The centrally-sponsored scheme aims to upgrade the infrastructure of schools managed by central, state or regional bodies. However, to avail the scheme's benefits, state governments must first sign a memorandum of understanding with the Centre to implement the 2020 National Education Policy.
Tamil Nadu has repeatedly expressed opposition to the three-language formula in the National Education Policy. The state government said it will not change its decades-old two-language policy of teaching students Tamil and English.
Of the total funds pending to be paid to the state, the Right to Education component amounts to Rs 200 crore, according to The Hindu.
On Tuesday, the High Court pointed out that under section 7 of the Right to Education Act, states and the Union government have concurrent responsibility for providing funds to carry out its provisions.
'Therefore, funds payable to the state governments representing the central government share towards discharging the RTE obligations need not be linked to NEP 2020,' said the bench.
It also took note that the state government had moved the Supreme Court against the Centre withholding funds under the Samagra Shiksha scheme.
'We are not in a position to issue any binding direction in this regard,' said the bench, urging the Union government to consider delinking the Right to Education component from the Samagra Siksha Scheme.
The court was disposing of a public interest litigation petition seeking directions to the Tamil Nadu government to begin admissions under the Right to Education Act for 2025-'26.

Union government's transfer of funds to TN is higher than the State's revenue generated for the Centre, says Annamalai

For every rupee paid by Tamil Nadu to the Union government through the Central GST and Income and Corporate Taxes, the Centre has given the State the same amount through devolution of funds, grant in aid, subsidies, and funds for projects such as roads and airports, contended K. Annamalai, former BJP State president on Thursday. He told journalists in Coimbatore that in 2021-2022, the CGST and Income and Corporate Tax paid by Tamil Nadu was ₹1,10,453 crore and in FY 23, it was ₹1,34,425 crore. In the 2021-2022 fiscal, the Centre gave the State ₹72,510 crore and in 2022-2023, ₹76,465 crore through devolution of funds and grant-in-aid. In 2021-2022, as an instance, the Centre also gave ₹30,456 crore as subsidies (food, fertilizer, etc) apart from funds for projects such as roads and airports. 'So, for every ₹1 paid to the Central government by the State, ₹1 was given back,' he claimed. In the last four years, Tamil Nadu paid the Centre ₹4,36,136 crore and the total transfer to the State by the Centre was ₹5,47,380 crore. Further, the Tamil Nadu government has launched schemes similar to the Vishwakarma scheme and the Janaushadhi schemes of the Union government. But, there are very few beneficiaries registered for the credit-linked subsidy scheme for artisans (Kalaignar Kaivinai Thittam) and the government should share the number of beneficiaries registered for it so far. Similarly, in the case of Mudhalvar Marundhagam, the State government is trying to procure medicine from the Centre and thus blocking the medicines to be supplied to the Janaushadhi outlets in the State, he claimed. Mr. Annamalai said there will be a day when there will be a political change in Tamil Nadu. 'It is inevitable and I am waiting for it,' he said. On the Anna University case, he said he welcomed the defamation case filed by former PRO of Anna University and will not apologise as demanded by him. There should be a CBI inquiry into the case, he said.

L-G gives nod to initiate action against PWD ex-engineer over irregularities in construction of classrooms in Delhi

Lieutenant Governor Vinai Kumar Saxena has approved a proposal from the Directorate of Vigilance to start disciplinary proceedings against a former executive engineer of the Public Works Department (PWD) over alleged irregularities and fund mismanagement in the construction of 226 classrooms under the Samagra Shiksha Abhiyan. According to a statement shared by the L-G house on Thursday, the engineer has been transferred out of Delhi and is currently posted with the Central Public Works Department (CPWD) in Amritsar, Punjab. This decision follows alleged irregularities identified in the implementation of the Samagra Shiksha Abhiyan, a Centre-sponsored initiative aimed at enhancing educational infrastructure in Delhi, which was allocated Rs 38.37 crore for the construction of 226 classrooms across various schools, said officials. 'The situation escalated when a public interest litigation titled Social Jurist, a Civil Rights Group v/s GNCTD and Ors. was filed in the Delhi High Court on June 11, 2019, seeking a directive for the government to hand over possession of six newly constructed school buildings…,' an official added. After the PIL was filed, officials said, the then Chief Secretary probed the matter, during which significant 'irregularities in construction practices and fund management' were uncovered. A committee was also constituted in this matter last year in March to examine the matter. 'The committee's findings, reported last year in May, revealed several lapses on the part of the PWD, including the diversion of funds intended for the construction of 20 classrooms at Trinagar School to Rani Bagh School and the construction of a multi purpose hall without obtaining the necessary approvals. Furthermore, the PWD failed to promptly address site issues, making decisions that lacked proper authority and oversight,' said officials. 'The misconduct in question dates back to 2019, but the case against another officer is considered time-barred due to his retirement from government service. The DOV's proposal has received endorsement from both the Principal Secretary (Vigilance) and the Chief Secretary,' the official added.
