Delays in AKA-Tibz murder case as extradition process unfolds in eSwatini

The murder case involving five men accused of killing rapper Kiernan 'AKA' Forbes and Tebello 'Tibz' Motsoane has been postponed to next month.
Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimane, Siyanda Eddie Myeza, Mziwethemba Harvey Gwabeni, and Lindokuhle Mhlaliseni Mkhwanazi appeared at the KwaZulu-Natal (KZN) High Court in Durban on Thursday for a pre-trial conference.
The case was transferred from the Durban Magistrate's Court in February, following the defence's receipt of the indictment.
Two more suspects, Siyabonga Ndimande and Malusi Ndimande, are in custody in eSwatini, awaiting extradition to South Africa.
AKA-Tibz murder case postponed
During proceedings, state prosecutor Advocate Lawrence Gcaba informed Judge Jacqueline Henriques that the five accused have appointed new legal counsel.
The men will now be represented by Advocate Simphiwe Cyril Mlotshwa.
Gcaba also confirmed the appointment of Sibusiso Dlamini as the instructing attorney.
'My understanding is that Advocate Mlotshwa will be instructed for all five,' the prosecutor said.
He explained that the attorneys were not present in court because they were attending the extradition appeal in eSwatini, where the Ndimande brothers are challenging a ruling that approved their return to South Africa.
'They are not here today because they are also attending to the extradition appeal in the Swaziland Supreme Court.'

The extradition ruling was issued by the Manzini Magistrate's Court in August 2024.
The prosecution previously stated that if the Ndimande brothers are not extradited in time, the trial will proceed without them.
Gcaba requested that the pre-trial conference be postponed to 12 June, a date that the defence and Gcaba mutually agreed upon.
'The state has already disclosed the contents of the dockets,' he added.
The judge granted the postponement, and the accused will remain in custody.
Accused's charges
The five men are facing multiple charges, including conspiracy to commit murder, murder, unlawful possession of firearms, and possession of unlicensed ammunition, all in connection with the deaths of Forbes and Motsoane.
In addition, Mkhwanazi, Ndimande, Myeza, and Gwabeni face charges of money laundering.

They are also charged with the attempted murder of Tshediso 'Don Design' Mokoko, Thotloetso Kutlwano Mogotsi, Lusaso Buthanani Ngcobo, Siyabonga Makhosative Mdluli, and Kerwyn Clive Patrick Jackson.
All the accused were denied bail in May 2024.
Earlier this year, in January, Gwabeni and Ndimande were denied bail for a second time.
Background
Forbes and Motsoane were gunned down outside the now-closed restaurant Wish, located on Durban's Florida Road, on 10 February 2023.
According to the state, CCTV footage and other evidence allegedly show the suspects tracking Forbes at King Shaka International Airport on the day of the murder.
The suspects were allegedly paid R800 000 for their involvement.

Zikhali is charged with conspiracy to commit murder, three counts of murder, seven counts of attempted murder, two counts of possession of a fully automatic firearm, possession of a firearm without a licence, and possession of ammunition. According to the State, Zikhali committed the offences with 25-year-old Sphelele Gumede from Pietermaritzburg. Gumede was first arrested, and his matter is now in the High Court. Additionally, the State alleges that the pair, along with others, planned to kill members of the taxi association operating from the Midway Crossing taxi rank. 'On January 11, 2024, the accused men drove to the taxi rank in a VW Polo, armed with rifles. When they got to the rank, they opened fire on people who were there,' the State said.

He might not have imagined a future behind bars, but Present Sibuyi will have to face that reality after he was sentenced to 25 years direct imprisonment for murder. The High Court in Mbombela, Mpumalanga, recently found the 31-year-old guilty of five offences in connection with the brutal killing of Nonewell Nkuna, 33, over allegations relating to a Road Accident Fund (RAF) payout. The charges include murder, robbery with aggravating circumstances, kidnapping, possession of a prohibited firearm, and possession of ammunition by the High Court in Mbombela, Mpumalanga. Sibuyi ambushes deceased The conviction follows an incident that occurred on 6 January, when Sibuyi and an unknown accomplice followed Nkuna and other victims from Mbumber Taven in Buyisonto, Bushbuckridge. National Prosecuting Authority (NPA) regional spokesperson Monica Nyuswa said the pair ambushed Nkuna and company at gunpoint when they stopped their vehicle on the side of the road. Sibuyi and his accomplice forced them into the car; they followed them in and drove to a secluded location. Nkuna declared dead at scene 'During the ordeal, Sibuyi accused one of the victims of having received an RAF payout, robbed them of a cellphone and R1 800 in cash, and fired multiple shots at them,' Nyuswa said in a statement on Friday. Guilty plea In court, Sibuyi admitted his actions were unlawful and entered into a Section 105A plea and sentence agreement with the state. The agreement allows the accused to negotiate a resolution with the state without having to go to trial. State Advocate Fedile Tsotetsi argued that the murder was premeditated and committed violently without any provocation. 'The court accepted the plea and imposed the sentence,' Nyuswa said. 'The NPA remains committed to ensuring that perpetrators of violent crimes face the full might of the law and that justice is served for victims and their families,' she added. In addition to the 25-year term, the court declared Sibuyi unfit to possess a firearm in terms of Section 103 of the Firearms Control Act 60 of 2000. Twins denied bail in Durban court for the murder of Prasa manager Jacob Khoaele

Image: File Twin brothers, who are accused of killing Jacob Khoaele, the regional manager of Passenger Rail Agency of South Africa (Prasa), over a tender, had their bail application denied by the Durban Magistrate's Court on Friday afternoon. The court found that the twins failed to provide exceptional circumstances warranting their release. Khoaele was shot dead on January 22, 2025, at La Lucia, while returning from his grandchild's school meeting. Vukani Mchunu, Vukile Mchunu, Sandile Sakhile Ngcobo, and Mthandeni Cele are charged with his murder. Their lawyer, Musawenkosi Mkhize, said the twins are married, with Vukani having six children and Vukile having five. He said they also co-own a property worth R700,000 and cars, which include a Ford Ranger bakkie and a Mercedes-Benz. They both stated that they are breadwinners who earn approximately R35,000 a month. He said their employees were not paid their salaries due to their incarceration, and that is why they should get bail. Mkhize said it was an exceptional circumstance that his clients were running a company. Additionally, he said his clients were traditional healers who also ran a church. Mkhize said his clients should get bail because the State has a weak case against them. 'How are the two applicants linked? The incident occurred around January this year. The number of months has lapsed, arrests were only made in July,' he said. Mkhize said, judging by what the investigating officer is saying in his affidavit, the State relied on one witness, Shange. As he was arguing, Magistrate Siyanda Mlaba asked Mkhize to tell him about the exceptional circumstances of his clients. Senior State prosecutor, Calvin Govender, said it is the onus of the applicants to prove that they have exceptional circumstances, and they have failed to do so. He reminded the court that this was a bail application and that all evidence would be led during the trial. Govender said the police wanted to get their ducks in a row before making an arrest. 'That is why there was a delay,' he explained. He submitted that the State is of the view that there would be interference with the witnesses should the twins get bail. He said the previous manager from Prasa had to resign because of the twins, who wanted to be paid for work that Prasa was not satisfied with. He said Khoale paid with his life because he also refused to pay the twins for work that Prasa was not satisfied with. 'Everyone at Prasa is afraid of the applicants due to the known fact that they threatened their colleague and killed the other,' Govender added. Delivering his ruling, Magistrate Mlaba reminded that the bail was under Schedule 6 of the Criminal Procedure Act. He said the accused were facing serious allegations, and further emphasised that this was not a trial but a bail application. Mlaba criticised Mkhize, saying that he said a lot of things but failed to tell the court why his clients should get bail. 'I remember asking him to hit the nail in the hand. I even asked him the definition of exceptional circumstances. But the attorney was not giving what I was expecting. I ended up just keeping quiet,' he said. He said the worst part was that there was no alternative address for the twins should they receive bail. He said the defence failed to tell the court those exceptional circumstances. The matter has been postponed to September 29 for further investigation.
