Delays in AKA-Tibz murder case as extradition process unfolds in eSwatini

The murder case involving five men accused of killing rapper Kiernan 'AKA' Forbes and Tebello 'Tibz' Motsoane has been postponed to next month.
Lindokuhle Thabani Mkhwanazi, Lindani Zenzele Ndimane, Siyanda Eddie Myeza, Mziwethemba Harvey Gwabeni, and Lindokuhle Mhlaliseni Mkhwanazi appeared at the KwaZulu-Natal (KZN) High Court in Durban on Thursday for a pre-trial conference.
The case was transferred from the Durban Magistrate's Court in February, following the defence's receipt of the indictment.
Two more suspects, Siyabonga Ndimande and Malusi Ndimande, are in custody in eSwatini, awaiting extradition to South Africa.
AKA-Tibz murder case postponed
During proceedings, state prosecutor Advocate Lawrence Gcaba informed Judge Jacqueline Henriques that the five accused have appointed new legal counsel.
The men will now be represented by Advocate Simphiwe Cyril Mlotshwa.
Gcaba also confirmed the appointment of Sibusiso Dlamini as the instructing attorney.
'My understanding is that Advocate Mlotshwa will be instructed for all five,' the prosecutor said.
He explained that the attorneys were not present in court because they were attending the extradition appeal in eSwatini, where the Ndimande brothers are challenging a ruling that approved their return to South Africa.
'They are not here today because they are also attending to the extradition appeal in the Swaziland Supreme Court.'

The extradition ruling was issued by the Manzini Magistrate's Court in August 2024.
The prosecution previously stated that if the Ndimande brothers are not extradited in time, the trial will proceed without them.
Gcaba requested that the pre-trial conference be postponed to 12 June, a date that the defence and Gcaba mutually agreed upon.
'The state has already disclosed the contents of the dockets,' he added.
The judge granted the postponement, and the accused will remain in custody.
Accused's charges
The five men are facing multiple charges, including conspiracy to commit murder, murder, unlawful possession of firearms, and possession of unlicensed ammunition, all in connection with the deaths of Forbes and Motsoane.
In addition, Mkhwanazi, Ndimande, Myeza, and Gwabeni face charges of money laundering.

They are also charged with the attempted murder of Tshediso 'Don Design' Mokoko, Thotloetso Kutlwano Mogotsi, Lusaso Buthanani Ngcobo, Siyabonga Makhosative Mdluli, and Kerwyn Clive Patrick Jackson.
All the accused were denied bail in May 2024.
Earlier this year, in January, Gwabeni and Ndimande were denied bail for a second time.
Background
Forbes and Motsoane were gunned down outside the now-closed restaurant Wish, located on Durban's Florida Road, on 10 February 2023.
According to the state, CCTV footage and other evidence allegedly show the suspects tracking Forbes at King Shaka International Airport on the day of the murder.
The suspects were allegedly paid R800 000 for their involvement.

Picture: Gallo Images/ER Lombard President Cyril Ramaphosa says there is no state capture within the National Prosecuting Authority (NPA) amidst growing criticism over its handling of several high-profile cases. This follows recent remarks by National Director of Public Prosecutions (NDPP) Shamila Batohi, who alleged that the NPA had been 'infiltrated' by rogue elements. Her comments came in the wake of criticism directed at the NPA, particularly over its handling of a special plea concerning Moroadi Cholota, the personal assistant to former Free State premier Ace Magashule. In addition to the Cholota matter, the NPA has faced scrutiny for bungling several cases, including the corruption case against former Cabinet minister Zizi Kodwa and the rape trial of Nigerian Pastor Timothy Omotoso. Ramaphosa to meet with Batohi over NPA claims Speaking to the media in Saulsville, Pretoria, during an engagement with beneficiaries of government employment programmes on Tuesday, Ramaphosa confirmed plans to meet Batohi. The president noted that Batohi walked back her claim about infiltration following a meeting with Justice and Constitutional Development Minister Mmamoloko Kubayi last week. 'The NDPP did make that statement, and she has later said she used the wrong word about the infiltration. 'I'm going to have a meeting with her so she can really take out of her chest some of the challenges she is facing,' Ramaphosa said. 'The NPA has really done considerable work to stabilise itself as well as to go on with various prosecutions. 'Quite often we look at those where there is failure or where there are mistakes, and we think the whole system is not working,' Ramphosa said. 'I don't believe that there is state capture now that is underway in the NPA 'I do believe that there are some really good prosecutors in the NPA, and there are those [who] are putting in a lot of effort. A number of cases are being prosecuted, including those that came out of the Zondo Commission,' he added. Response to Higher Education minister controversy Ramaphosa also addressed recent controversy involving Higher Education Minister Dr Nobuhle Nkabane, who faced criticism over her conduct and the contentious Sector Education and Training Authority (Seta) board appointments. Nkabane appeared before parliament's portfolio committee on higher education and training on 30 May, where she was questioned about the appointments. The list, which leaked to the public, drew criticism for including ANC-affiliated figures such as former KwaZulu-Natal (KZN) premier Nomusa Dube-Ncube, former ANC KZN deputy chairperson Mike Mabuyakhulu, and Buyambo Mantashe, son of Mineral and Petroleum Resources Minister Gwede Mantashe. She also came under scrutiny after videos surfaced showing her chewing during the meeting. In response, Ramaphosa requested that Nkabane submit a detailed report on the appointment process and her conduct. 'She is meant to give me a report. She has received a clear letter from me, so that is still underway. When it happens, we will be able to communicate that and what it is we need to do going forward,' the president told reporters on Tuesday. Teacher assistant programme Ramaphosa spoke about the government's ongoing commitment to the teacher assistant programme, saying the employment initiative was in need of expansion. He highlighted the programme's positive impact and reiterated efforts to make such positions permanent. 'We would want it to be much longer than what it is now. It is a question of not having sufficient resources to be able to extend it beyond.' He acknowledged weaknesses in the Expanded Public Works Programme (EPWP), but claimed that the teacher assistant initiative has remained free of corruption. TWO of the three men who were involved in the murder of Durban lecturer Chanlall (Shan) Dwarika were sentenced to life imprisonment in the Durban High Court recently. Thobani Mhlongo (25) and Kwanele Makhaye (32) were convicted of kidnapping, robbery with aggravating circumstances, and murder and were sentenced to five years for the kidnapping, 15 years for robbery and life imprisonment for murder. Related story: Men appear in court for lecturer's murder Their co-accused, Siyabonga Freeman Mahaye (37), will spend 15 years in jail for robbery with aggravating circumstances and five years for kidnapping. Dwarika was kidnapped from his rental property in Sea Cow Lake on May 28, 2023 where he was busy with renovations. His body was found partially decapitated in the cane fields in Inanda a week later. The court heard that Chanlall had asked Mahaye, Mhlongo and Makhaye to live on the property following a request from Pastor Miya who would be purchasing the property. 'Building material was going missing so this was done on condition that the accused would live rent-free on the property to safeguard the material while they assisted with the renovations. They also received some spending money on a casual basis. Despite the accused living on the property, items were still going missing so Chanlall asked them to leave on May 26, 2023,' said Natasha Ramkisson-Kara, NPA regional spokesperson. Read also: Decomposing body found in bushes in Cornubia 'He returned to his property on May 28, 2023 to complete some repairs and install a security gate – that's when the trio forced him into his vehicle and drove off. They forced him to hand over his bank card and to surrender his Pin, thereafter making several withdrawals and card payments. They then drove to a cane field in Inanda where they murdered Chanlall before setting his vehicle alight,' she added. The victim impact statement, handed in by Advocate Krishen Shah, stated: 'The deceased's wife described her husband as a helping and giving person who was her pillar of strength. She said that he was her financial and emotional security. Following his demise, she has become anxious and tense. The deceased's daughter said that the loss of her father has left her with a deep sadness and grief.
