Yusoff Rawther trial: Prosecution closes case, decision June 12
Judge Datuk Muhammad Jamil Hussin set the date after Deputy Public Prosecutor Mohd Sabri Othman informed the court that the prosecution had closed its case today after calling 13 prosecution witnesses during the trial, which began on April 7.
'The parties must file written submissions on or before May 13, and the court has set June 12 for the decision,' the judge said.
Earlier, Mohd Sabri informed the court that a total of 13 prosecution witnesses had testified, and the prosecution had offered seven witnesses to the defence.
Among the witnesses called during the trial were chemist Harlisa Haidhir Harminder, investigating officers, and police officers.
Meanwhile, lawyer Muhammad Rafique Rashid Ali, representing Muhammed Yusoff, said the defence team would interview the witnesses offered by the prosecution.
Earlier, investigating officer Insp Muhammad Zuhairi Md Zuhir, 36, who served in the Narcotics Criminal Investigation Division of the Dang Wangi Police Headquarters, told the court that the police found a lump suspected to be cannabis in a Nissan Teana vehicle belonging to Muhammed Yusoff when they searched the vehicle in front of the surau at the Kuala Lumpur Police Contingent Headquarters (IPKKL) last year.
The 13th prosecution witness said that the initial search of the vehicle was to find ammunition for firearms that had already been discovered. However, further inspection uncovered the drugs.
'My investigation found that there was no information regarding drugs received by the complainant (Insp Wan Muhammad Wan Ali) about the accused or the vehicle the accused was in.
'The drugs were found after further inspection by the complainant in the parking area in front of the surau at IPKKL,' he said during examination-in-chief by Deputy Public Prosecutor Mohamad Shahrizzat Amadan.
When questioned on the recorded statement regarding Ops Laras and whether he investigated the tip-off, Muhammad Zuhairi said he had inquired, and Wan Muhammad stated it involved information about an individual possessing a firearm in a vehicle.
'The complainant (Insp Wan Muhammad) received a call while in the office, but the caller's identity could not be verified. After observing, he saw an individual approach the vehicle, leading to a raid where the firearm was found as per the tip-off,' the witness said.
In earlier proceedings, Wan Muhammad, from the Kuala Lumpur Police Contingent Intelligence division, testified that at 5 am on Sept 6, 2024, an unidentified male caller reported a weapon in a vehicle parked near a condominium. However, the caller did not identify himself, speaking only in Malay.
Muhammed Yusoff is charged with trafficking 305 grammes of cannabis in his vehicle near the IPKKL at 10.15 am on Sept 6 last year, under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and punishable by mandatory life imprisonment and a minimum of 12 strokes of the cane.
He also faces charges for possessing two imitation pistols near a condominium in Jalan Bukit Kiara at 9.25 am on the same day, under Section 36(1) of the Arms Act 1960, carrying a maximum one-year jail term, a fine up to RM5,000, or both.

Court of Appeal reduces welder's jail term for stepdaughter sexual assault
PUTRAJAYA: The Court of Appeal has reduced a welder's prison sentence from 24 years to 16 years for sexually assaulting his stepdaughter on four separate occasions. A three-member bench led by Justice Datuk Azman Abdullah allowed the 57-year-old man's appeal and reduced each charge's sentence from six years to four years. The court ordered the sentences to run consecutively from the date of his arrest on March 21, 2022. Justice Azman stated that while the gravity of the offences was not in doubt, the Sessions Court's original sentence of 24 years would have a 'crushing effect.' He said the bench accepted the defence counsel's submission that the principle of totality must be applied. In April 2022, the Sessions Court sentenced the man to 24 years' imprisonment after he pleaded guilty to four counts of sexually assaulting his 11-year-old stepdaughter, who is now 15. The offences were committed at a house in Padang Besar, Perlis, on several occasions in July 2021, early and late December 2021, and March 5, 2022. Both the accused and the prosecution filed cross-appeals to the High Court challenging the sentence, but the High Court dismissed them in January last year. Defence counsel Mohamad Zaidan Daud urged the appellate court to consider his client's age, contending that a lengthy custodial term would have a 'crushing effect.' He further requested that the sentences run concurrently, which would have resulted in a six-year term. Zaidan also argued that under Section 14(a) of the Sexual Offences Against Children Act 2017, the maximum penalty is 20 years' imprisonment, and therefore the 24-year sentence imposed by the Sessions Court exceeded the statutory limit. Deputy public prosecutor Iznina Hanim Hashim opposed the request, stressing that the offences were distinct acts committed on different occasions and therefore warranted consecutive sentences. SIBU (Aug 21): The High Court here today set Sept 25-26 for a man to enter his defence against a charge of trafficking 717.67 grammes of methamphetamine nearly two years ago. Judge Wong Siong Tung set the dates after ruling that the prosecution had successfully established a prima facie case against Wong Kieng Li, 32, at the end of the prosecution's case. During the prosecution led by deputy public prosecutor Mark Kenneth Netto, seven witnesses were called to testify. 'After hearing the testimonies of the prosecution's witnesses, subject to maximum evaluation and after considering the submissions from both the deputy public prosecutor and the accused's defence lawyer, the court finds that the prosecution has presented credible evidence to establish a prima facie case against the accused under Section 39B(1)(a) of the Dangerous Drugs Act (DDA) 1952, involving 747.67 grammes of methamphetamine. 'The evidence shows that the accused had custody or control of the drugs, thereby triggering the presumption under Section 37(d) of the same Act that he possessed and had knowledge of the drugs,' ruled Siong Tung. The judge said further evidence also proves that the accused was trafficking the drugs at that time. Kieng Li, represented by lawyer Darren Ling, chose to give sworn testimony and will be called along with his mother as defence witnesses and any other necessary witnesses as informed by the prosecution. Ling also requested two days for the defence to present their case, which the court then set for Sept 25-26. Kieng Li was charged with trafficking 717.67 grammes of methamphetamine inside a vehicle by the roadside at Jalan Oya on Dec 12, 2023, around 5pm.
