Policing has been left in a "hopeless position" after a High Court ruling said forces cannot dismiss officers by removing their vetting clearance, Met Police Commissioner Sir Mark Rowley has warned.
The court ruled against the force in what has been described as a "test case" that will have major implications for the sacking of police officers accused of misconduct.
It was decided the force was wrong to remove the vetting of Sergeant Lino Di Maria, who had faced rape allegations.
Supported by the Metropolitan Police Federation, he brought a legal challenge claiming the process was unlawful.
On Tuesday, the High Court ruled the vetting clearance decision regarding Mr Di Maria be "quashed and reconsidered".
This means the UK's police forces cannot dismiss officers by removing their vetting after the High Court ruling.
This had been a key part of the Met's efforts to clean up the force after scandals like the murder of Sarah Everard.
Concerns have been raised that the ruling "opens the gates" to police officers "accused of horrific crimes", like rape and violence against women, remaining as officers.
'Hopeless position'
Sir Mark warned the ruling left policing in a "hopeless position" and said he would seek leave to appeal it.
He added: "We have no mechanism to rid the Met of officers who are not fit to hold vetting.
"It is absolutely absurd we cannot sack them."
Sky News correspondent Matthew Thompson described it as a "potentially seismic" case.
In the ruling, Mrs Justice Lang explained the decision, saying she did not believe the Met Police's powers extended to dismissing officers "by reason of withdrawal of vetting clearance".
She said an "anomaly" existed in the system that should be resolved by new government regulations.
Existing procedures she added were not "fit for purpose".
In his statement, Sir Mark repeated his calls for the government to introduce the new regulations with "extreme urgency", saying the judge had "identified a clear gap in the law".
A spokesperson for the Home Office said the government was working "rapidly" to introduce "new, strengthened rules that will help forces dismiss officers who cannot maintain vetting clearance."
London Mayor Sir Sadiq Khan said he was "really disappointed" by the ruling.
Operation Assure
The Met Police began reviewing the status of officers who were alleged to have committed sexually violent crimes under a system it called Operation Assure.
Assure was put in place after the Met suffered a series of scandals, including the murder of Sarah Everard by Wayne Couzens, to try and clean up the police.
Some were removed after the emergence of serious accusations, including one officer who is alleged to have tried to form a relationship with a 13-year-old girl in the US, though authorities were unable to prove this.
In some cases, officers had their vetting clearance removed and were dismissed from the force, without proving whether the allegations against them were true.
But the latest court ruling is a blow to the force's clean-up efforts.
Sir Mark said there were currently 29 officers who have had their vetting removed who remain on paid leave, and 96 who have been sacked or resigned under the clean-up efforts.
Around 100 were in the early stages of vetting reviews, he added.
Allegations against Mr Di Maria
Mr Di Maria will remain on vetting special leave Sir Mark said, describing it as a "ridiculous waste of money" but the "least bad option".
He joined the force in 2004, Mrs Justice Lang said, and was accused of rape in 2019, with a second allegation made in 2021.
In the same year, it was alleged he had also been inappropriate towards female colleagues.
Mr Di Maria had denied the allegations against him.
Due to insufficient evidence, he was found to have no case to answer regarding the rape allegations.
In a meeting in 2022, no action was taken against him, but some matters were recorded as "adverse information" the judge said.
His vetting was removed in September 2023 and his initial appeal against this was refused last year.

A BUS driver who knocked down and killed a nine-year-old girl when he fell asleep after taking drugs has been jailed for four years. Martin Asolo-Agogua, 23, had been up all night at a social event when he struck Ada Bicakci with the double decker in Bexleyheath, South East London. 3 3 3 Emergency services arrived at the scene on Watling Street at 9.03am on August 3 last year. Despite their best efforts, the youngster tragically couldn't be saved and died two days later. Ada, a Turkish and British national, was a 'keen' gymnast and swimmer, according to tributes. Her five-year-old brother was also taken to hospital following the crash. Officers drug-tested Asolo-Ogugua at the scene, which he failed. The Met Police arrested him on suspicion of causing serious injury through dangerous driving and drug-driving. Asolo-Ogugua was today sentenced at Woolwith Crown Court for causing the nine-year-old's death. The court heard he fell asleep at the wheel, after having taken cannabis the night before. He mounted the opposite pavement as Ada was riding her bike with her family. Detectives from the Met's Roads and Transport team later trawled through CCTV evidence that revealed Asolo-Oguguathe first drove the bus out of the depot at around 8.45am. They were able to capture the exact moment he fell asleep, and saw the bus swerve cross the carriageway. Asolo-Oguguathe was charged in February earlier this year with causing death by dangerous driving while under influence of drugs as well as driving while over the drug limit. He admitted both offences at Woolwich Crown Court in April. Asolo-Ogugua, of Banfield Road, Southwark, was today jailed for four years. The 23-year-old has also been disqualified from driving for seven years. 'PILLARS OF STRENGTH' Detective Sergeant Sam Miles, who led the investigation, said: 'Asolo-Ogugua will have to spend the rest of his life regretting the night he chose to stay awake before getting behind the wheel of a bus with cannabis in his system. 'It's a night that has cost him his freedom and snatched away the life of an innocent little girl. 'Ada had her whole life ahead of her. 'She lived in the area and attended a local primary school where she was a popular and happy pupil. 'In a remarkable show of courage and humility, Ada's family chose to take her life forward to help others by donating her organs. 'I can only hope today's sentence brings some closure for Ada's family who have remained a pillar of strength throughout these proceedings.' FAMILY HEARTBREAK Ada's organs were donated and she went on to help six other people following her tragic death, her family said. They also previously shared two pictures of their daughter, including one that shows her having had her hair cut for donation. The nine-year-old was a Turkish-British national that lived in Bexleyheath with her family and attended a local primary school. In a heartwrenching statement shared by the Met Police, Ada's father, Bora, said: "The images of that horrific moment remain seared into my mind. That scene replays endlessly, a constant reminder of the day my world fractured beyond repair. "This tragedy happened on my watch, a father's ultimate failure. My world has been turned upside down, and with it, the foundations of my family have crumbled. "My darling Ada. Our thanks are not enough to show our gratitude for you. We will honour your name with acts of magnitude. You will never be forgotten. "We will make this story one of love and thanks that we owe everybody. Your presence, and passing, will leave a mark in this country and we will fight to make drug driving a part of its history." 'RECKLESS AND UTTERLY SELFISH' Senior Crown Prosecutor, Miranda Jollie, of the Crown Prosecution Service, added: 'Asolo-Ogugua was reckless and utterly selfish to get behind the wheel of a bus after consuming drugs and put many lives at risk that day. 'His actions have robbed a young girl of her entire life. Our thoughts remain with Ada's family and friends as they try to come to terms with their unimaginable loss "I hope his sentence today can help to bring some closure for Ada's family and highlight the devastating consequences of drug driving.'

They had some great times there, but just decided it was time for a change. It's actually laughable for anyone to think it has anything to do with the court case. Nothing could be further from the truth. And that's shown by the fact that they are looking for a new holiday pad." The property has been listed for sale with high-end estate agents Knight Frank, carrying an impressive £9.7 million price tag. Although prices have surged in the Algarve recently, by as much as 16 per cent according to some estimates, the Vardys' villa is certainly priced on the 'optimistic side', according to one agent who spoke to MailOnline under the condition of anonymity. "It's undoubtedly a stunning and very modern property, but there are many more traditionally-styled places in that area which some people might prefer, of similar size, but priced a lot more competitively," he remarked. The villa, boasting three pools, a gym, a steam room and six bedrooms, commands a view over the 18th green of the resort's North course. Knight Frank has praised the property, stating: "This magnificent property, built over four levels, showcases meticulous attention to lifestyle details." ‌ The four-storey residence also features a cinema room, roof terrace and sauna, spread across approximately 0.64 acres. The details further reveal: 'In addition to the three external pools, which epitomise a contemporary lifestyle, the villa includes a central electro-chromic glass lift accessing each floor. "The impressively landscaped gardens complement the property's style, creating a true haven for modern living. The villa is conveniently located within walking distance of the golf course and other renowned amenities within the Quinta do Lago resort." In 2022, the couple experienced a fright when their luxury villa was threatened by nearby forest fires. A family insider disclosed to The Sun: "It's been horrifying. Their neighbours have all been evacuated, and one by one, residents are being told to leave their homes. ‌ "Becky can see smoke everywhere, and she's terrified about the kids breathing it in. The water is also down, so she's relying on bottled water, which, obviously, there is only a finite amount of at home. "Jamie and their friends and family back home have all been really worried. Things are developing by the hour, but she's praying the fire brigades, who have been brilliant, can get things back under control. She's genuinely worried. In it, she disclosed that she had played detective to uncover who had been leaking stories to the press. Rooney publicly alleged that Mrs Vardy's account was the source behind three newspaper stories featuring fabricated details she had posted on her private Instagram profile - her trip to Mexico for a 'gender selection' procedure, her plans to return to TV, and the flooding in her home's basement. Rebekah furiously denied the allegation and attempted to sue Coleen, launching a libel case that took the WAGs all the way to the High Court. The 2022 trial didn't go Rebekah 's way and the judge ruled in favour of Rooney.
