WV House passes amended version of Morrisey's microgrid, data center bill sans requirements for coal

The West Virginia House approved a priority bill pushed by Gov. Patrick Morrisey on Tuesday that is meant to incentivize the creation of microgrids and data centers in the state.
Members of the House voted 88-12 in support of House Bill 2014. Republican Dels. Marty Gearheart, R-Mercer; Bill Flanigan, R-Ohio and Jordan Bridges, R-Logan, joined the chamber's nine Democrats in voting against it. The bill now heads to the Senate for introduction and consideration.
The bill's passage in the House came one day before a deadline that requires all bills to be passed out of their chamber of origin in order for them to be considered by the other chamber and sent to the governor's desk by the final night of session on April 12.
HB 2014 — dubbed as the Power Generation and Consumption Act — will allow companies seeking to build data centers to create their own, independent energy grids to power them.
Data centers are large facilities that house vast computer systems used for cloud storage, artificial intelligence computing and telecommunications; the centers require massive amounts of energy and electricity to run.
Through using their own microgrids, proponents for the policy say data centers would be able to operate in West Virginia without overburdening the state's power and utility infrastructure or raising electricity rates for existing residential and commercial customers.
Under the proposed bill, the state's certified microgrid program would operate under the newly reorganized Division of Economic Development. Through approval from the division, data companies looking to operate in West Virginia would do so in 'high impact industrial business development microgrid districts.'
There, instead of being required to connect to the existing utilities in the region, they would create their own, smaller energy grids with the primary purpose of powering the data centers. Per the bill, 10% of electricity generated by the microgrids but not used by the data centers or industrial facilities would be allowed to be sold on the wholesale market to others nearby, potentially at lower rates than existing utilities currently offer.
The initial version of HB 2014 — the one specifically requested by Morrisey — included provisions that would have required electric utilities with coal fired plants to operate at 69% capacity and hold a 45-day supply of coal on hand at all times. Most coal fired power plants in the state operate at an average 40% capacity and stockpile a 30-day supply of coal.
Those provisions were meant to support the state's coal industry, but power companies — including Appalachian Power, the state's largest electric utility — said it would be difficult to meet those standards and doing so would have raised rates for existing electric customers in the state.
Through a committee substitute for HB 2014 passed by the House Energy and Public Works Committee last week, the coal-backed provisions were removed from the bill and not included in the version passed by the House on Tuesday.
In response to concerns raised by House members on the floor Tuesday regarding the potential for the bill to increase utility rates for residential customers, Del. Clay Riley, R-Harrison, said he actually believes HB 2014 could lead to savings for residents, though indirectly, through tax revenue generated locally and a fund that will be created by the legislation.
I do not believe [HB 2014] is going to increase [customer electric rates],' said Riley, a longtime proponent for data centers in the state and a sponsor of the bill. 'I think it puts more money back in the pockets of citizens of West Virginia, both in terms of ratepaying and in terms of personal income taxes and some of the other things that I think I've seen in there.'
Riley said he estimates that roughly $160 million to $200 million will be generated in tax revenue annually for a county that houses a data center and microgrid.
Following the payment of property taxes to the appropriate local agencies, other revenue from the data centers and related microgrids will be split between several statewide initiatives, including to: the Personal Income Tax Reduction Fund to offset personal income tax cuts, the Economic Development Closing and Promotion Fund to help recruit more businesses to the state, the Water Development Authority's Economic Enhancement Grant Fund for water and sewage projects, the Department of Human Services' Low Income Energy Assistance Program to help low-income families cover utility bills, the state general revenue fund and the newly created Electronic Grid Stabilization and Security Fund.
The Electronic Grid Stabilization and Security Fund, Riley said, could help utility companies cover the cost of maintenance and repairs in their infrastructure that would otherwise be — and often are — baked into customer rate increases. In other words, while that won't directly decrease power costs for residents, it could offset future expenses they would incur.
Del. Henry Dillon, R-Wayne, said in addition to limiting future increases for ratepayers, the data centers and microgrids could mean a population and employment bump for the regions they're located in. Jobs will be created while the facilities are being constructed, he said, and after that it's likely that at least some jobs will stay in the areas.
That could help decrease another major factor that often leads to utility rate increases: population loss.
Dillon said, at first, he shared similar concerns to others worried that this initiative could lead to lackluster results and heavy costs for existing residents.
'But throughout the process of working on this bill … I believe that the governor is going in the right direction here,' Dillon said. 'This is an attempt to innovate. This is an attempt to take a new approach to energy policy in the state, and it's not going to harm our utility companies. It's not going to harm ratepayers, it's not going to harm oil and gas. It's not going to harm coal. I believe that this is a net positive for the state.'

Democratic Rep. Jason Crow says he was first denied access to the immigration detention facility in Aurora, and now, Crow says he's being denied basic information about who is being held there. Crow and Colorado's three other Democratic U.S. House members -- Reps. Diana DeGette, Joe Neguse, and Brittany Pettersen -- visited the ICE facility Monday after giving seven days' notice under a federal policy they are suing to overturn. Crow says he was unable to get an exact head count at the facility, let alone information on who's being detained and whether they have criminal records. He was also unable to truly assess the conditions at the facility, he says, because the whole place was on lockdown for the entire visit. Crow says he's visited the Aurora facility 10 times in six years, but he says this visit was unlike any other. "This has been the most difficult visit in terms of getting information, getting answers out of the facility and employees," he said. He says ICE is now requiring members of Congress to submit any questions they have through the agency's headquarters in D.C., and anyone wanting to talk to a detainee must have a signed privacy release in advance. "So, if I want to visit my constituents in this facility, then somehow, I have to get a privacy release to them through the mail or other means," said DeGette. She says she was able to see immigration rights activist Jeanette Vizguerra, but the rest of the delegation was allowed to visit only one other detainee. The representatives say they have a duty to conduct oversight of federal operations, and ICE is making their job increasingly difficult. Last month, they were told they needed to give seven days' notice before any visit, so they sued. "If you have to give seven days' notice, they clean up pretty good," said DeGette. Still, Pettersen says, what they did see was concerning, including a lack of access to legal resources: "There is a phone, but you have to pay 15 cents a minute in order to make the calls that you need. That is a huge barrier for people." In addition to Democrats, Republican Rep. Gabe Evans has also asked ICE for more information on those being detained. Government data from June showed that about half of all detainees nationwide had been convicted or charged with crimes, while 70% of those in the Aurora detention facility had. Evans and his Democratic colleagues want to know the nature of the crimes. Neguse says they will continue to push for more access and information. "Above all else, transparency matters, oversight matters, accountability matters," he said. "You certainly can expect the Democratic members of Colorado's House delegation to continue to lean in on all fronts." As of Monday evening, a spokesperson for ICE had not yet responded to a request for comment from CBS News Colorado sent Monday morning.

President Donald Trump's rhetoric about DC echoes a history of racist narratives about urban crime

WASHINGTON — President Donald Trump has taken control of the District of Columbia's law enforcement and ordered National Guard troops to deploy onto the streets of the nation's capital, arguing the extraordinary moves are in response to an urgent public safety crisis. Even as district officials questioned the claims underlying his emergency declaration, the Republican president promised a 'historic action to rescue our nation's capital from crime, bloodshed, bedlam and squalor and worse.' His rhetoric echoed that used by conservative politicians going back decades who have denounced American cities, especially those with majority non-white populations or led by progressive politicians, as lawless or crime-ridden and in need of outside intervention. 'This is liberation day in D.C., and we're going to take our capital back,' Trump promised Monday. As District of Columbia National Guard troops arrived at their headquarters Tuesday, for many residents, the prospect of federal troops surging into the district's neighborhoods represented an alarming violation of local agency. To some, it echoes uncomfortable historical chapters when politicians used language to paint historically or predominantly Black cities and neighborhoods with racist narratives to shape public opinion and justify aggressive police action. April Goggans, a longtime Washington resident and grassroots organizer, said she was not surprised by Trump's actions. Communities had been preparing for a potential federal crackdown in the district since the summer of 2020, when Trump deployed National Guard troops during racial justice protests after the murder of George Floyd. 'We have to be vigilant,' said Goggans, who has coordinated protests and local civil liberties educational campaigns for nearly a decade. She worries about what a surge in law enforcement could mean for residents' freedoms. 'Regardless of where you fall on the political scale, understand that this could be you, your children, your grandmother, your co-worker who are brutalized or have certain rights violated,' she said. According to White House officials, National Guard troops will be deployed to protect federal assets in the district and facilitate a safe environment for law enforcement to make arrests. The administration believes the highly visible presence of law enforcement will deter violent crime. It is unclear how the administration defines providing a safe environment for law enforcement to conduct arrests, raising alarm bells for some local advocates. 'The president foreshadowed that if these heavy-handed tactics take root here, they will be rolled out to other majority-Black and Brown cities, like Chicago, Oakland and Baltimore, across the country,' said Monica Hopkins, executive director of the American Civil Liberties Union's D.C. chapter. 'We've seen before how federal control of the D.C. National Guard and police can lead to abuse, intimidation and civil rights violations — from military helicopters swooping over peaceful racial justice protesters in 2020 to the unchecked conduct of federal officers who remain shielded from full accountability,' Hopkins said. Conservative lawmakers have for generations used denigrating language to describe the condition of major American cities and called for greater law enforcement, often in response to changing demographics in those cities driven by nonwhite populations relocating in search of work or safety from racial discrimination and state violence. Republicans have called for greater police crackdowns in cities since at least the 1965 Watts Riots in Los Angeles. President Richard Nixon won the White House in 1968 after campaigning on a 'law and order' agenda to appeal to white voters in northern cities alongside overtures to white Southerners as part of his 'Southern Strategy.' Ronald Reagan similarly won both his presidential elections after campaigning heavily on law and order politics. Politicians ranging from former New York Mayor Rudy Giuliani to former President Bill Clinton have cited the need to tamp down crime as a reason to seize power from cities like Washington for decades. District of Columbia Mayor Muriel Bowser called Trump's takeover of the local police force 'unsettling' but not without precedent. The mayor kept a mostly measured tone during a Monday news conference following Trump's announcement but decried the president's reasoning as a 'so-called emergency' and said the district's residents 'know that access to our democracy is tenuous.' Trump threatened to 'take over' and 'beautify' the nation's capital on the campaign trail and claimed the district was 'a nightmare of murder and crime.' He also argued the city was 'horribly run' and said his team intended 'to take it away from the mayor.' The president repeated comments he'd previously made about some of the nation's largest cities during his news conference, including Baltimore, Chicago, Los Angeles, Oakland, California, and his hometown of New York City. All are currently run by Black mayors. 'You look at Chicago, how bad it is. You look at Los Angeles, how bad it is. We have other cities in a very bad, New York is a problem. And then you have, of course, Baltimore and Oakland. We don't even mention that anymore. They're so far gone. We're not going to let it happen,' he said. Civil rights advocates see the president's rhetoric as part of a broader political strategy. 'It's a playbook he's used in the past,' said Maya Wiley, CEO of the Leadership Conference on Civil and Human Rights. The president's rhetoric 'paints a picture that crime is out of control, even when it is not true, then blames the policies of Democratic lawmakers that are reform- and public safety-minded, and then claims that you have to step in and violate people's rights or demand that reforms be reversed,' Wiley said. She added that the playbook has special potency in the capital because the district's local law enforcement can be directly placed under federal control, a power Trump invoked in his announcement. Trump's actions in Washington and comments about other major American cities sent shock waves across the country, as other cities prepare to respond to potential federal action. Democratic Maryland Gov. Wes Moore said Trump's plan 'lacks seriousness and is deeply dangerous' in a statement and pointed to a 30-year-low crime rate in Baltimore as a reason the administration should consult local leaders rather than antagonize them. In Oakland, Mayor Barbara Lee called Trump's characterization of the city 'fearmongering.' The administration already faced a major flashpoint between local control and federal power earlier in the summer, when Trump deployed National Guard troops to quell protests and support immigration enforcement operations in Los Angeles despite opposition from California Gov. Gavin Newsom and Los Angeles Mayor Karen Bass. Civil rights leaders have denounced Trump's action in Washington as an unjustified distraction. 'This president campaigned on 'law and order,' but he is the president of chaos and corruption,' said NAACP President Derrick Johnson. 'There's no emergency in D.C., so why would he deploy the National Guard? To distract us from his alleged inclusion in the Epstein files? To rid the city of unhoused people? D.C. has the right to govern itself. It doesn't need this federal coup.'
