KUALA LUMPUR: An Opposition MP has called on the government to take stern action against civil servants who hang the Jalur Gemilang upside down, regardless of whether or not it was accidental.
Dr Halimah Ali (PN-Kapar) said the government must carry out an immediate audit of all government departments, agencies and schools to ensure that civil servants are not careless when raising the national flag.
She added that incidents of flags being flown incorrectly should be subject to meaningful disciplinary action to set an example for the people.
'I just returned from China recently, and never once did I see or hear of any case of upside-down national flags in the country.
'This can be attributed to their stringent enforcement of their national flag law," she said in Parliament on Tuesday (Aug 12).
Her remarks followed public outcry reaching a peak after multiple cases of the Jalur Gemilang being flown upside-down came to light over the last few weeks.
This included a 59-year-old shopkeeper who found himself at the centre of an uproar after a 21-second video of the Jalur Gemilang upside-down outside his store went viral.

Earlier, Terengganu Umno Youth chief Tengku Haphiz Tengku Putera apologised for a mistake in a Jalur Gemilang graphic posted on its social media, which he said was made by a freelance graphic designer. On Aug 10, police arrested a 59-year-old man over the display of an upside-down Jalur Gemilang at a shop in Kepala Batas, following nationwide reports. The man has since been released.

'Umno takes the repeated offences involving the installation and flying of the Jalur Gemilang seriously. 'Firm and severe action, including prosecution, must be taken against anyone who commits this offence regardless of the reason, in line with the provisions of the law,' he said after the Umno Supreme Council meeting on Wednesday (Aug 13). The statement comes amid public concern over several recent incidents in which the national flag was displayed incorrectly, sparking debate over whether the mistakes were due to ignorance or deliberate acts. On Aug 9, a 59-year-old hardware shop owner in Kepala Batas, Penang, was investigated after the national flag was found hanging upside-down outside his shop. The shop owner claimed that it was an unintentional mistake made while measuring a flagpole, which he corrected shortly after. Umno Youth chief Datuk Dr Muhamad Akmal Saleh previously announced plans to stage a protest at the shop, but the gathering did not take place after police were stationed in the area and advised against it.

Fadil said the case is being investigated under Section 353 of the Penal Code for the use of criminal force to deter a public servant from the discharge of his duty, and Section 427 of the Penal Code for mischief. Section 353 provides for a jail term of up to two years or a fine, while Section 427 provides for a jail term of not less than a year and not more than five years, a fine, or both, upon conviction. In a statement, Fadil referenced a video on TikTok which saw participants of a gathering 'provoking and forcefully breaching' police officers who were on duty during the event at Jalan Parlimen. He said police respected the public's right to express opinions and to assemble peacefully, and were committed to playing their role as a facilitator at such events. '(But) these rights should be exercised responsibly and prudently,' he said. 'Firm action will be taken against individuals or groups who instigate chaos or engage in excessive provocation.' Earlier today, FMT reported that more than 100 plantation workers from Perak, Negeri Sembilan, Selangor, Kedah and Johor marched from Taman Tugu in the capital to Parliament to submit a memorandum on housing and a draft bill making it compulsory for estates to provide homes for local plantation workers. Police blocked the group from gathering at Parliament's gates but later allowed the workers to hand over the documents to deputy law and institutional reform minister M Kulasegaran and opposition chief whip Takiyuddin Hassan.
