
Ex-IT officer pleads guilty to offensive Facebook post
Ariff Zulkarnain Ameer Mohd Imam, 50, entered the plea after the charge was read before Judge Meor Sulaiman Ahmad Tarmizi.
According to the charge, he allegedly used the Facebook application through the account 'Ariff Zulkarnain Mohd Imam' at the link https://www.facebook.com/ariff.zulkarnainmohdimam to knowingly make and initiate a transmission using a communication service.
He was accused of posting a comment on an article titled 'Khatib enggan baca teks khutbah disediakan keterlaluan, jangan dibiarkan - Sultan Nazrin', published on the Facebook page of Harian Metro at the link https://www.facebook.com/share/1BZZzGje6L/?mibextid=wwXlfr.
The offence was allegedly read at the Complaints Counter of the Central Police Station at the Ipoh District Police Headquarters at about 5.45 pm on Feb 25.
For the offence, he was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998 and punishable under Section 233(3) of the same Act, which provides for a maximum fine of RM500,000 or imprisonment for up to two years, or both. An additional fine of RM5,000 for each day or part of a day the offence continues after conviction may also be imposed, upon conviction.
His lawyer, M. Saravanan from the National Legal Aid Foundation (YBGK), appealed for time or a later date to allow the accused to raise funds in case a fine is imposed, noting that the offence was serious as it involved the Sultan of Perak.
Deputy public prosecutor Nasrul Hadi Abdul Ghani said he had no objection to sentencing being set for a later date, but offered bail of RM30,000 with two sureties. He also requested that the accused report to the nearest police station once a month and surrender his passport to the court.
Deputy public prosecutor Nurul Hidayu Zakaria also conducted the prosecution.
Saravanan then appealed for a lower bail amount, saying the accused was 50 years old, his wife was unemployed, and he had lost his job at the media company as a result of his actions. He added that the accused had no stable income and pledged to comply with all imposed conditions.
The judge then set July 30 as the sentencing date and fixed bail at RM10,000 with one surety. The accused was also ordered to surrender his passport to the court by noon on June 20, until sentencing is concluded.

‘I am not okay to give my statement'
KUALA LUMPUR: A businessman who was robbed at his home recently said he was too 'traumatised' to testify in the corruption trial involving former Penang chief minister Lim Guan Eng. Datuk Seri G. Gnanaraja, a key prosecution witness, expressed his fears when asked to continue reading his witness statement. 'I am not here to accuse anyone, but I am not okay to give my statement because I feel threatened. 'I request protection first ... I want the police to ensure my safety,' the 37th prosecution witness told Sessions Court Judge Azura Alwi. On Aug 6, it was reported that Gnanaraja was attacked by a group of men during a robbery at his home in Petaling Jaya, and sustained injuries. During his brief time on the stand, Gnanaraja addressed questions about his Datuk Seri title, which had been reinstated by the Pahang palace after his acquittal in a separate case in Shah Alam. 'Many are not aware that I got back everything that was seized from me,' he said. Gnanaraja also produced a court order about the reinstatement of his title. The court then took a break with DPP Mahadi Abdul Jumaat saying his client was not 'mentally ready' to continue. Gnanaraja will now continue when the hearing resumes on Aug 27 and 28. Earlier, defence lawyer RSN Rayer raised concerns about the prosecution's statements to the media about the robbery, referring to them as contempt. Fellow defence lawyer Ramkarpal Singh also urged the prosecution to clarify whether witness protection would be sought. Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin had told the media earlier that he would consult the Malaysian Anti-Corruption Commission chief commissioner Tan Sri Azam Baki about witness protection. Ramkarpal then questioned Wan Shaharuddin's need to consult Azam, suggesting it implied a connection between his client and the robbery. This led to a heated exchange between the defence lawyers and the DPP. After deliberations, it was confirmed that no application for witness protection or recusal would be filed. Lim, 64, is facing an amended charge of using his position as then chief minister to solicit RM3.3mil in bribes as an inducement to assist Datuk Zarul Ahmad Zulkifli, a former director of Consortium Zenith Construction Sdn Bhd, in securing the undersea tunnel project worth RM6.34bil. Lim allegedly committed the offence at the Penang Chief Minister's Office, Level 28, Komtar, George Town, between January 2011 and August 2017. In the second amended charge, Lim is accused of soliciting a 10% profit from the company as gratification to secure the project. The offence was allegedly committed near The Gardens Hotel, Lingkaran Syed Putra, Mid Valley City here, in March 2011. Lim, who is Bagan MP, faces two further charges of causing two plots of land worth RM208.8mil, belonging to the Penang government, to be disposed of to two companies linked to the project.

Cautionary tale: Chong speaking at a press conference about the double scam alongside Liau. — LOW LAY PHON/The Star KUALA LUMPUR: A scam victim who was desperate to seek legal help got scammed again – this time by a bogus lawyer, says Datuk Seri Michael Chong. The MCA Public Services and Complaints Department head said it all started when the victim, known as Liau, 55, joined a fake investment platform on April 10. 'He had responded to an advertisement by a so-called investment learning platform which lured him with the promise of investing in a purported China-Hong Kong Initial Public Offering (IPO),' Chong said in a press conference at Wisma MCA here yesterday. Tempted by the offer, Liau used his Employees Provident Fund and loans from family members to buy the purported shares. Chong said Liau had been pressured to continue purchasing the so-called shares every time the platform purportedly secured a new IPO, even though he could no longer afford it. In the end, he lost a total of RM390,000 and lodged a police report at the Wangsa Maju police station. Desperate, the victim turned to a 'lawyer' for help through a Facebook advertisement. The lawyer, who claimed to be based in Hong Kong, told the victim that his RM390,000 was detected at a casino in Macau and insisted that the only way to recover the money was to win it back at the online casino. Trusting the story, the victim handed over more money each time the bogus lawyer demanded it under various pretexts. 'I did not think it would be a scam, as I was too desperate to get back the money I had lost,' Liau said. In total, he ended up giving the fraudulent lawyer RM61,500. 'I never imagined I would be scammed twice,' he added. Chong said that this was not the first case involving fake lawyers. Meanwhile, MCA Publicity Bureau chairman and lawyer Chan Quin Er said that Liau was seeking assistance, and the scammer took advantage of his desperation in his bid to regain his losses.

Akmal to be charged with causing public fear

PETALING JAYA: Umno Youth chief Datuk Dr Muhamad Akmal Saleh will be charged at the Bukit Mertajam Magistrate's Court this Friday with making statements likely to cause fear or alarm to the public. He said that he was informed of the charge via a call from the police as he was performing umrah in Mecca yesterday. 'I have been contacted by the police that I will be charged in court under Section 505(b) of the Penal Code. 'Therefore, I will shorten my umrah and return home to face the charge this Friday at the Bukit Mertajam Magistrate's Court at 8am,' he said in a Facebook post yesterday. If convicted, a person can be punished with up to two years imprisonment, a fine, or both. While he did not mention why he was being charged, he stressed that he would not back down. 'If this is the price I must pay to uphold the sovereignty of the nation, I will not retreat even an inch. 'See you in court this Friday,' Dr Muhamad Akmal added in his post. The Attorney-General's Chambers (AGC) in a statement last night confirmed that it would charge Dr Muhamad Akmal over a Facebook post under the name 'Akmal Saleh'. It also revealed others to be charged, namely, Bersatu Youth chief Muhammad Hilman Idham over a TikTok post under the account ' Chandrasegaran Subramaniam over a statement made on TikTok under the account 'cikguchandra3' and a statement made by Siti Hajar Aflah Sharuddin on the TikTok account 'SHA_Abrienda'. The AGC said based on the evidence and statements obtained, charges would be filed against Dr Muhamad Akmal, Muhammad Hilman and Siti Hajar Aflah under Section 505(b) of the Penal Code while Chandrasegaran would be charged under Section 233(1)(a) of the Communications and Multimedia Act 1988. All charges will be filed in the Magistrate's Court, said the AGC. The AGC, however, did not specify the social media content in question.
