Bengaluru: The high court has called for stringent laws to deter and punish bikers performing life-threatening stunts on roads, while hearing a petition of a rider from Koppal district's Gangavati taluk.
Echoing the concerns, legal experts have welcomed the court's observation. Declining bail to the 29-year-old rider, the HC's Dharwad bench noted: "It's the duty of the state and its law-enforcement agencies to legislate legal provisions and take stringent measures to suppress the perilous activity. The legislature has to take into consideration that existing statutory provisions are hardly sufficient to curb the menace. To fill this vacuum, suitable and stringent provisions are to be incorporated by amending the Indian Penal Code and
Motor Vehicles Act
to complement each other."Justice
V Srishananda noted that increasing fatal accidents caused by wheelie incidents have shaken the citizens' confidence. The prosecution agencies are facing difficulties in charging offenders with severe penalties that would effectively prevent such incidents, the court added.Dr Aruna Shyam, senior advocate and former additional advocate general, said although Sections 184 and 189 of Motor Vehicles Act and Section 281 of Bharatiya Nyaya Sanhita contain provisions to address wheeling, rash, and negligent driving — which are cognizable and bailable offences — these laws must be enforced more rigorously to deter such dangerous behaviour.
The legislature must also take into account that the existing legal framework is largely inadequate to effectively curb the growing menace of reckless and negligent driving.P Prasanna Kumar, special public prosecutor for NIA and CBI, said the HC has pointed to gaps in motor-vehicle laws and cited examples from several US states which specifically ban stunt-riding and incrementally impose higher penalties and impound licence and the vehicle too.He said: "In the US, specifically in states such as Florida, performing a wheelie is clearly defined and penalised. The law states: 'A person shall ride upon a motorcycle or moped only while sitting astride the seat, with both wheels on the ground at all times, facing forward, and with one leg on each side of the motorcycle or moped'."The law, according to Prasanna Kumar, slaps a penalty of $1,000 for the first offence, not less than $2,500 and suspension of driving licence for a second offence, and $3,500 and seizure of vehicle for a third offence. "It's time amendments to the Motor Vehicles Act and the BNS were brought in here," he added.Senior advocate MS Shyamsundar said the HC's observation should serve as an eye-opener to the lawmakers to make harsher laws to deal with those "who disturb tranquil civic society" since basic civic laws are "apparently a neglected area"."It is the knowledge and fear of law and penalty that keeps mischief makers in check," he said, citing the example of Bengaluru-Mysuru Expressway where stricter penalties are imposed for violating speed limit.GR Mohan, an advocate, said the relevant law requires it to be amended as the wheeling is usually performed by minors and their parents must be booked with higher penalty and imprisonment.Box 532 CASES IN 2024According to Bengaluru traffic police, 283 cases were booked against persons performing wheelie stunts in 2022. The number fell to 219 in 2023 but suddenly rose to 532 in 2024. At least, 23 minors were booked in 2022. The number soared to 74 in 2023 and hit 121 in 2024.Similarly, 22 parents/guardians/vehicle owners were booked in 2022, 71 in 2023 and 79 in 2024.What happens if caught performing wheelies?* Police file FIR for rash driving, riding on a public way. "However, in Bengaluru, we have booked some parents or guardians under the Juvenile Justice Act for neglecting their wards. Some cases have been chargesheeted," he said.BIKE IMPOUNDED UP TO A MONTHThe two-wheeler seized from offenders will be parked at the police station for a week. "We release them after offenders pay a fine. Normally, it takes about 10 days for the offender to reclaim his bike. Further, if there are modifications made to the vehicle, the regional transport office will have to inspect it and file a report. At such times, it may take a month to get the bike back," police said.

He then uploaded the videos to his email ID and posted them on porn sites The Central Bureau of Investigation (CBI) has apprehended a differently-abled man in Haryana's Hisar district on charges of rape and sexual exploitation of minor girls. According to the CBI, the accused, identified as Somnath (40), is a resident of Garhi Azima in Hisar district. His parents died nearly 30 years ago. He is a graduate and used to run a Common Service Center (CSC) in the village. The accused was also reportedly involved in searching for child exploitation material on the Internet, which brought him under the radar. According to the CBI, the accused had a habit of collecting such material, creating videos and photos himself, sharing them with others, and uploading them online. The CBI registered a case against the accused on May 29. On Tuesday, a six-member CBI team arrested Somnath from his village following a search of his residence. The Central Bureau of Investigation (CBI) said it used Interpol's International Child Sexual Exploitation (ICSE) database and Cyber Tipline reports generated by Google and submitted to the Indian Cyber Crime Coordination Center (I4C) to trace the content and identify both the victims and the accused. Before the CBI traced the material and uncovered the role of the accused, no victim or their family had approached the police with a complaint. A CBI spokesperson stated that electronic devices containing objectionable material were seized from his residence during the search operation. The recovered content helped identify several child victims who were raped and sexually abused over the past few years and were exploited for pornographic purposes through threats and coercion. Sources reported that Somnath allegedly lured children to his shop by offering food items at the CSC. He enticed young girls with toffees and chocolates and then engaged in inappropriate behavior with them. According to the sources, Somnath raped the victims and recorded these incidents on video. He subsequently used these recordings to blackmail and further exploit them. Eventually, he uploaded these videos to his email account and posted them on pornographic websites. According to villagers, Somnath has been physically challenged since birth, with both legs affected. He has two sisters who lived in an orphanage and were married after reaching adulthood. The accused was known for his friendly behavior in the village, so no one ever suspected him. Somnath's cousin, Virendra, said that he lived alone at home after losing his parents at a young age. According to Virendra, Somnath generally behaved well but would avoid talking to anyone when his mood was off. A few days ago, he had an altercation with a woman over some issue, which had even reached the police station. However, the matter was resolved with mutual apology. Virendra also mentioned that Somnath lost the use of both his legs due to polio when he was four or five years old. Bengaluru (Karnataka) [India] June 5 (ANI): Following the death of 11 people in a stampede on Wednesday near the Chinnaswamy Stadium in Bengaluru, Aam Aadmi Party advocate Lokith has submitted a complaint to the Police Commissioner of Bengaluru seeking the registration of an FIR against Karnataka State Cricket Association (KSCA) on Wednesday. The complaint alleges that KSCA's negligence led to the tragedy. A formal letter has been submitted demanding that an FIR be registered against KSCA. The incident occurred on Wednesday during the Royal Challengers Bengaluru's (RCB) IPL winning celebrations near the iconic M Chinnaswamy Stadium when thousands of fans gathered to catch a glimpse of their favourite players. Social activist Snehamayi Krishna also filed a complaint at the Cubbon Park Police Station to register a case under Section 106 of the Indian Penal Code against Chief Minister Siddaramaiah, Deputy Chief Minister D.K. Shivakumar, and office bearers of the Karnataka State Cricket Board for negligence. Karnataka Chief Minister Siddaramaiah stated at a press conference that 11 people died in the incident while 33 others were injured. IPL chairman Arun Dhumal expressed condolences on behalf of the BCCI to the families who had lost their members in the stampede. 'We express condolences to the families of the deceased. A title win was to be celebrated; rather, the loss of lives is being mourned,' he said. Arun Dhumal said the BCCI-organised IPL concluded on Tuesday. He said the local administration will look into the reasons for the stampede and take the required steps. He said that after learning of the stampede, and that a felicitation event was being held, he conveyed that the event should stop. Answering a query, Dhumal said they were not aware that an event was being held and that they had no information on whether the cricket fans were invited or came on their own. 'This is a very unfortunate incident... We had no information that such an event was being planned... If such events are planned in the future, then proper arrangements should be made... Those who were sitting inside the stadium had no information about the incident,' Arun Dhumal told ANI. Siddaramaiah also expressed his deep sorrow over the incident. 'A major tragedy occurred during the victory celebrations. It happened near the Chinnaswamy Stadium. The government has announced a compensation of Rs 10 lakh for the deceased. The government will provide free treatment to the injured. Eleven people died and 33 were injured in the stampede. This tragedy should not have happened. The government expresses deep sorrow over this incident.' (ANI)

New Delhi [India], June 5 (ANI): The Delhi High Court has recently quashed an FIR against a man for staring at a woman on an Indore to Delhi flight in 2024. The High Court quashed the FIR given the settlement reached between the accused and the complainant woman. An FIR was registered in May 2024. Justice Ravinder Dudeja quashed the FIR on May 30 after considering the facts that the petitioner and the complainant had settled. 'Given the aforesaid circumstances and the fact that parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR of 29.05.2024. Under section 509 of the Indian Penal Code registered at Police Station (P.S.) IGI Airport, along with all the other consequential proceedings emanating therefrom,' Justice Dudeja ordered. According to the allegations, on May 28, 2024, the complainant, while flying from Indore to Delhi, alleged that a co-passenger stared at her persistently, causing discomfort. Upon landing, she submitted a written complaint to the police. Based on the complaint, an FIR under Section 509 IPC was registered on 29.05.2024 at PS IGI Airport. Advocate Sanjeev Malik submitted that the parties have amicably resolved their disputes and executed a Settlement Agreement on December 16, 2024, with the help of well-wishers. The copy of the Settlement Agreement was also placed on record. Counsel for the complainant submitted that the matter has been settled with the petitioner without any force, fear, or coercion, and she further submits that she has no objection if the FIR is quashed. Given the settlement between the parties, the Additional Public Prosecutor for the State submitted that he has no objection if the FIR along with the charge sheet is quashed. (ANI)
