HC asks NIA to file chargesheet in Jiribam case within 30 days

Imphal: Manipur high court directed the
NIA
to file within one month the charge sheet in the killing of three women and three children in Jiribam in Nov last year.
A division bench comprising Chief Justice K Somasekhar and Justice Ahanthem Bimol Singh gave the direction while hearing a PIL on Thursday.
"Subsequent to recording of the FIR, law was set into motion but till today, no specific report has been submitted for filing of charge sheet against culprits/accused," the HC said.
It noted that the counsel for the Centre has informed "that investigation has been carried out by the investigating agency and even it is in the process of completion of the investigation and filing of charge sheet against the culprits/accused."
The Centre's counsel placed before the court two sets of sealed covered envelopes, containing a detailed progress report on the investigation, the order noted, "The two sealed covered envelopes said to contain the detailed progress report are taken on record.
"
"Keeping in view the status in this matter, one month's time is granted for submitting the detailed report in terms of charge sheet under Section 173 of CrPC and corresponding provision of BNSS Act, 2023," the HC said.
"It is made clear that if there is no progress made, the matter would be viewed seriously," it added. PTI

A Delhi court has refused to release Christian Michel James, the alleged middleman in the controversial AgustaWestland VVIP chopper deal, ruling that he has not yet served the maximum sentence for the charges levelled against him. Special Judge Sanjay Jindal, in an order dated 7 August, dismissed Michel's application for release under Section 436A of the Code of Criminal Procedure (CrPC). The court stated that since Michel faces serious charges under Section 467 of the Indian Penal Code (IPC) — which carries the possibility of life imprisonment — he cannot claim to have completed the maximum period of custody applicable to his case. Michel, who was extradited from Dubai in December 2018, argued that he had been in judicial custody for nearly seven years — a period he claimed was sufficient under Section 436A CrPC, which permits undertrial prisoners to seek release if they have served more than half of the maximum sentence for their alleged offences. However, the court ruled that this provision does not apply to him, given the nature and severity of the allegations. The judge added that the question of whether the forgery charge under Section 467 IPC stands against Michel will be decided at the charge-framing stage — and cannot be dismissed at this point. Yes. The court also noted that Michel's plea for release had already been reviewed and rejected by both the Supreme Court of India and the Delhi High Court. His argument for relief under Section 436A CrPC had been 'categorically' turned down earlier, citing the inclusion of non-bailable offences that attract longer terms of imprisonment, including charges under the Prevention of Corruption Act. Interestingly, Michel remains in Tihar Jail, even though he was granted bail in both the CBI and Enforcement Directorate (ED) cases earlier this year. The Supreme Court granted him bail in the CBI case in February 2025, followed by bail in the ED case from the Delhi High Court just two weeks later. According to reports, he has not yet furnished bail bonds, reportedly due to passport-related formalities that remain unresolved. The CBI alleges that Michel acted as a key intermediary in the 2010 AgustaWestland VVIP helicopter deal, which led to a loss of approximately €398.21 million (around ₹ 2,666 crore) to the Indian exchequer. Separately, the ED's chargesheet, filed in June 2016, claimed Michel received €30 million (around ₹ 225 crore) as kickbacks from the deal — money allegedly routed through a complex network of companies.

Mumbai: A special CBI court is likely to record on Monday the statement of Maiank Mehta, brother-in-law of fugitive diamantaire Nirav Modi , in the over Rs 13,000 crore Punjab National Bank (PNB) loan fraud case. On Thursday, the court directed the Hong Kong-based British national to remain present before it after the CBI moved a plea seeking to record his statement. The move could help the investigating agency decide if Mehta can turn approver and depose as a prosecution witness against Nirav. The statement will be recorded under Section 164 of the Criminal Procedure Code (CrPC), which involves confessions by accused and statements by witnesses. CBI recently submitted a supplementary chargesheet against Mehta and his wife Purvi Modi, a Belgian national. The court decided to postpone taking cognisance of the chargesheet against Purvi, citing reasons related to her application to become an approver. Purvi, the court noted, did not contest the provisional attachments by ED of seven out of eight assets, including a bank account in Mumbai and Marathon House in London owned by her, worth approximately Rs 60 crore. ED submitted that various bank accounts and trusts in her name were used to launder proceeds of crimes. Both said they "distanced" themselves from Nirav. They expressed their willingness to be examined as witnesses and to make a "full and true disclosure". Their case was that their "entire personal and professional life has now been brought to a standstill because of Nirav's alleged criminal activities." There was a red corner notice issued by Interpol in force against the couple. The court invoked the power under section 307 of the Criminal Procedure Code on the grant of pardon, which can be done at any time before judgment is passed in a trial, to a person considered to be directly or indirectly concerned in or privy to any offence. The Delhi High Court on Friday granted bail to one of the sons of Hizb-ul-Mujahideen chief Syed Salahuddin while denying the relief to another in a terror funding case. A bench of Justices Navin Chawla and Shalinder Kaur dismissed the bail plea of Salahuddin's son Shahid Yusuf saying the court cannot ignore the larger conspiracy brought forth by the prosecution. Considering prosecution's allegation of the use of hawala channels to route terror funds into Jammu and Kashmir, the court said Yusuf was allegedly part of this network. "The nature of the allegations and the material placed on record prima facie establish the appellant's involvement in this conspiracy and his direct contact with known members of the proscribed terrorist outfit." The order said he was allegedly received money from co-accused Aijaz Ahmad Bhat alias Aijaz Maqbool Bhat, knowing the funds would be used to further terrorist activities. The possibility of Yusuf being a flight risk, the high court said, couldn't be ruled out, particularly given that he reportedly travelled on a passport with a falsified parental identity previously and destroyed the document later. There exists a real likelihood of his tampering with evidence and influencing witnesses, the bench said. While granting bail to Syed Ahmad Shakeel, the court said he has already suffered prolonged incarceration of 6.11 years without any certainty of the trial concluding within a reasonable time. The court said the mainstay of the prosecution against Shakeel was the receipt of money and not its use for any terrorist activity. He was observed to be a government servant, working as a senior lab technician in the Department of Microbiology at Sher-i-Kashmir Institute of Medical Sciences, Soura. "Keeping in view the role assigned to the appellant (Shakeel), continued detention of the appellant at this stage would not serve the ends of justice," the bench said. He was granted him bail on a personal bond of Rs 1 lakh with two sureties of the like amount. Shakeel was arrested by the NIA on August 30, 2018 from his residence in Srinagar in relation to a terror funding case lodged in 2011. According to the NIA, the case relates to the transfer of funds through hawala channels by the terrorists based in Pakistan to Jammu and Kashmir, in a criminal conspiracy hatched with some operatives in India, to fuel and fund the secessionist and terrorist activities in J&K. Yusuf was arrested in October, 2017 on the allegations of receiving funds from Hizb-ul-Mujahideen from abroad and was chargesheeted in 2018. Shakeel was alleged to have received money through Western Union from absconding accused Aijaz Ahmad Bhat and his name had also surfaced in raising, receiving and collecting funds from the terrorist organisation through cadres from Saudi Arabia. Syed Salahuddin, designated as a "global terrorist" by the United States, is the self-styled commander of Hizb-ul-Mujahideen.
