Disgraced Albuquerque lawyer let off the hook in construction zone speeding case

ALBUQUERQUE, N.M. (KRQE) – He made our roads dangerous for thirty years as the mastermind behind a criminal conspiracy that involved bribing officers to get his drunk driving clients off the hook. Now, when he's caught violating a traffic law, the city is letting Thomas Clear III off the hook.

On the Albuquerque police officer's lapel camera video, you can see him use his radar gun and then frantically move his hands, telling the approaching driver to slow down. He just caught that driver speeding 14 miles per hour over the speed limit, in a construction zone. The officer approached the vehicle and found longtime criminal defense Attorney Thomas Clear III in the driver's seat. Clear was told that he was driving 39 miles per hour in a 25 miles per hour zone.
The traffic stop happened on February 11. At that point, it was known that federal agents had raided Clear's law office a year earlier, suspecting he had been paying off officers to get his drunk driving clients' cases dismissed. As the officer walked away to write up the speeding ticket, it was evident he recognized who he had just pulled over. What he didn't know was that the very next day, Clear would accept a plea deal in federal court, admitting to the suspected scheme. The longtime attorney pleaded guilty to bribing police officers over the past 30 years, in what has come to be known as the 'DWI Enterprise.'
It's a criminal conspiracy that Clear told federal investigators involved paying DWI officers from around the Albuquerque metro to either not file charges or not appear in court, allowing drunk drivers to avoid any consequences.
On April 4, the City of Albuquerque granted Clear the same relief. He requested a hearing for the speeding ticket, rather than paying it on the spot. Clear received a plea deal from the city attorney. Per the agreement, Clear is just on the hook for the court costs, $24. The ticket would've cost him an additional $60. The judge said that if he avoids any traffic or criminal violations for the next 90 days, the speeding ticket will not appear on his record.
Having helped countless dangerous drivers stay on the road, KRQE Investigative Report Ann Pierret asked the city why Clear gets to avoid any consequences when he's the bad driver. She was told a deferred sentence is not unusual in traffic cases. Clear qualified for it because he didn't have a traffic violation in the last decade.
Shortly after Clear pled guilty to nine federal charges in the DWI scheme, both the federal and state bars moved to revoke his law license. As part of his federal plea, Clear also gave up his law office to the feds. The now-disbarred Clear faces up to 130 years in prison.

Former Cowboys cornerback Kelvin Joseph is facing charges for his involvement in a fatal crash, per the Associated Press. The accident occurred on a Dallas-area freeway and resulted in the death of one female motorcyclist. It was first reported by The Dallas Morning News on Saturday. According to police in the Dallas suburb of Richardson, Joseph called Plano police to report his involvement in the crash, which occurred in the early hours on Saturday morning. Joseph was reportedly arrested and charged with driving while intoxicated and collision involving personal injury or death. The second charge is much more serious as it is a second-degree felony. Police released the name of the victim, Cody Morris of Plano, who was killed in the crash. This is not the first time that Joseph has been in trouble with the law. Joseph had another incident with police during the 2022 NFL offseason. He was the passenger in an SUV that was involved with a shooting that took place in Dallas. One victim from the attack was shot in the head during the incident. Police concluded that Joseph was not the shooter and he faced no repercussions from the NFL. It is not immediately clear that Joseph has legal representation following his arrest on Saturday. Joseph played nine games for the DC Defenders in the UFL during the 2025 season this spring. The UFL said in a statement that they are aware of Joseph's arrest but declined to comment further on the matter. The Cowboys selected Joseph in the second round of the 2021 NFL Draft. Joseph played two seasons in Dallas before he was traded to Miami. He also had brief stints in Seattle and Indianapolis before leaving the NFL. Former NFL cornerback Kelvin Joseph was arrested after he was allegedly involved in a crash that killed a female motorcyclist in Texas, police said. Richardson police announced on social media that Joseph reported his involvement in the crash that occurred in the early hours of Saturday. "Richardson Police Department Officers contacted Joseph and determined he was northbound on North Central Expressway in a BMW sedan when he was involved in a collision with the motorcycle," police said. "While speaking with Joseph, officers observed signs of intoxication. Joseph was subsequently arrested and charged with Driving While Intoxicated (Misdemeanor B) and Collision Involving Personal Injury or Death (2nd Degree Felony)." Police add that Cody Morris, a 27-year-old from Plano, died in the crash. Joseph, 25, has been playing in the United Football League with the DC Defenders this spring. The UFL acknowledged Joseph's arrest in a statement to Dallas-area TV station WFAA, but declined any further comment. Joseph was a second-round pick of the Dallas Cowboys in 2021 after playing for both LSU and Kentucky in college. He played 10 games his rookie year in Dallas (two starts) with 16 combined tackles and two passes defended over that time. However, a serious off-the-field issue occurred during the 2022 offseason. Joseph was a passenger inside a vehicle where two others with him fired shots into a group of men in Dallas, fatally striking a man in the head. Police found that Joseph wasn't the shooter, and the NFL didn't suspend him. Joseph went on to play 16 games for Dallas in 2022, totaling 20 tackles with two passes defended and one forced fumble. But he started to bounce around from there. He spent time with two teams in 2023, first with the Miami Dolphins for four games and then the Seattle Seahawks for one game. Joseph went on to play just two games as an Indianapolis Colts cornerback, which were his last in the NFL to date.
