Tougher transshipment penalties on US imports not immediate: Report

Tougher United States trade penalties on goods originating in one country being re-shipped from another are not expected to immediately follow new US tariffs, three people in Southeast Asia with knowledge of the matter said, easing a major cause of concern.
Southeast Asian countries, including Vietnam and Thailand, have been explicitly targeted by White House officials for their alleged role in facilitating the so-called transshipment to the US of Chinese goods, which would face higher tariffs if shipped directly from China.
The administration of US President Donald Trump imposed tariffs on goods from dozens of countries from Thursday, and in an executive order, said products determined to have been illegally rerouted to conceal their country of origin would face additional duties of 40 percent. But it did not clarify what constitutes transshipment.
US imports from Southeast Asia's biggest economies, which rely heavily on exports, are now subject to tariff rates of about 19 percent, many of which have been significantly reduced from previously threatened rates.
Existing US customs guidance states that goods from countries with no free trade agreements with Washington, such as Southeast Asian nations, can be labelled as made in the country where they undergo a 'substantial transformation' of components, even if those parts entirely come from another country, such as China.
And with no new US guidance on rules of origin or specification of what transshipment means, some officials in Southeast Asia have told exporters that existing rules apply.
That effectively limits cases of transshipment to illegal activities, like the use of forged export certificates or documents obtained illicitly.
'Currently, all exported goods [from Thailand] are subject to a 19 percent rate because there are no rules on transshipment yet,' Arada Fuangtong, head of the Thai Ministry of Commerce's Department of Foreign Trade, told Reuters on Thursday.
Her message was echoed by US officials in Vietnam, who told businessmen the tariff of 20 percent would apply to Vietnamese goods, even if they are entirely made with Chinese components and only assembled in Vietnam, according to one person familiar with those talks.
Trade consultants have said rules are vague, and they have advised clients, even before the new wave of US tariffs, to have at least 40 percent of local content for their exports to the US. That is 'to be on the safe side', one of them said.
The US embassy in Vietnam did not immediately reply to a request for comment. The Office of the US Trade Representative did not immediately respond to a request for comment outside US working hours.
'Goods defined by US customs as transshipped are subject to 40 percent duties, but pending any new definition, that's limited to old definitions,' said a Vietnam-based consultant.
Both people declined to be named in order to speak more freely.
China dependence
According to the US customs guidance, repackaging does not usually cause a 'substantial transformation', but assembly may, depending on the complexity of the operations.
It is unclear if this narrow interpretation of transshipment could be enforced for other countries.
Economic ministries in Indonesia, Malaysia, the Philippines, Vietnam and Singapore did not immediately respond to requests for comment on the issue.
Manufacturers in Southeast Asia, which rely heavily on Chinese components, have been in the dark for months about what Washington would consider transshipment.
Questions remain about whether that would include goods with a large, but yet undefined, share of components or raw materials from China, even when they are legitimately transformed in Southeast Asian nations.
A strict definition of transshipment may come later, multiple investment consultants warned.
An executive order signed by Trump last week said the US will 'publish every six months a list of countries and specific facilities used in circumvention schemes'.
That will 'inform public procurement, national security reviews, and commercial due diligence', it said.
'The message from Washington is deterrence,' said Marco Forster, director for Southeast Asia at investment consultancy Dezan Shira and Associates.
'If your supply chain cuts corners, it won't be treated as a technical error. It'll be treated as fraud.'

The United States Department of Justice has accused George Washington University of deliberate indifference to anti-Semitism, making the Washington, DC-based institution the latest to find itself in the crosshairs of the administration of President Donald Trump. In a statement issued Tuesday, the Justice Department said the school violated federal civil rights by creating a 'hostile educational environment' for Jewish, American-Israeli, and Israeli students and faculty. 'The Division finds that GWU took no meaningful action and was instead deliberately indifferent to the complaints it received, the misconduct that occurred, and the harms that were suffered by its Jewish and Israeli students and faculty,' the statement says. It added that the department will seek 'immediate remediation', though no further details are given. In a letter to the university, the Justice Department accused GWU of being 'deliberately indifferent' to complaints it received from students and faculty, saying they failed to prevent or remedy abuses despite knowing of them. Dozens of universities may face investigation The Justice Department notice comes as the Trump administration has intensified pressure on institutions of higher education over allegations that they have allowed anti-Semitism to fester, particularly as pro-Palestinian protests and encampments spread across US university campuses in 2023 and 2024. Critics have accused the administration of using accusations of anti-Semitism as a fig leaf in its war against higher education. In February, the Justice Department launched a federal task force to investigate allegations of anti-Semitism at 10 university campuses: Columbia University; George Washington University; Harvard University; Johns Hopkins University; New York University; Northwestern University; the University of California, Los Angeles (UCLA); the University of California, Berkeley; the University of Minnesota; and the University of Southern California. Sixty universities were later warned by the Department of Education that they could face enforcement action against them if they do not take steps to protect Jewish students. Last, week, the Trump administration suspended $584m in federal grants to UCLA and then requested a $1bn settlement to resolve accusations stemming from the school's handling of pro-Palestine protests. Columbia University, similarly, saw $400m in grants cancelled and billions threatened; which were reversed only after it settled with the administration for $220m. Harvard University is in negotiations to unfreeze more than $2bn in grants; with the New York Times this week reporting they are nearing a $500m settlement.

Consumer prices increase in July amid tariff driven economic uncertainty

Consumer prices in the United States held steady in July, as elevated inflation sweeps through the economy. The consumer price index report (CPI) rose 2.7 percent over this time last year and follows a 2.7 percent increase in June, according to the Department of Labor report released on Tuesday. On a monthly basis, prices increased by 0.2 percent in July compared to 0.3 percent in June. The data beat analyst expectations. Economists surveyed by Dow Jones expected a 2.8 percent increase on an annual basis. The cost of energy dropped by 1.1 percent over the last 12 months. Petrol, in particular, led the decline with a 2.3 percent decrease for the year. Grocery prices fell by 0.1 percent, but the cost of eating out of the house increased by 0.3 percent. Shelter costs increased by 0.2 percent. The cost of medical care services rose by 4.3 percent. Airline prices increased by 4 percent compared with this time last year. Increases and decreases 'Today's CPI report revealed that inflation beat market expectations once again and remains stable, underscoring President [Donald] Trump's commitment to lower costs for American families and businesses,' White House press secretary Karoline Leavitt said in a statement to reporters. But a deeper look at the data tells a different story. Prices increased in areas heavily affected by tariffs, while they decreased in areas that are not affected by tariffs. 'We really are seeing a divergence in the inflation data right now between import-sensitive sectors and those that do not rely on imports,' Daniel Hornung, senior fellow at MIT and former deputy director of the National Economic Council, told Al Jazeera. Compared with this time last year, hotel prices fell by 1.3 percent and car rental prices tumbled by 2.9 percent as Americans have pulled back on discretionary travel spending. But products like tools and hardware prices ticked up 1.6 percent, car parts rose by 0.9 percent, and footwear surged 1.4 percent, all items that are imported and have to bear the levies. The latest data comes after Trump fired Erika McEntarfer, the head of the Bureau of Labor Statistics, amid recently revised jobs data showing far fewer jobs were created than originally reported. The president intends to replace her with EJ Antoni, an economist with the Heritage Foundation. He was a contributor to Project 2025, a far-right wishlist the conservative think tank put together. While on the campaign trail, Trump distanced himself from Project 2025, but he has since appointed authors of many of its chapters to several key roles in the federal government, including Brenden Carr, who now leads the Federal Communications Commission and Russell Vought to lead the Office of Management and Budget. A look ahead Hornung believes that the latest data shows the effect of tariffs and is expected to rise as rates increase on trading partners. 'The way that probably shows up in the data is not literally over one month, but a relatively steady increase over the course of several months,' Hornung said. 'It might last even longer because of the way that the tariffs are being put in place, where we're seeing in April one set of tariff announcements that take a few months to work their way through into consumer prices. Then again, in August, another set of increased incremental tariff rates that will work their way through the system over the course of the fall.' In the private sector, some of the US's largest businesses have announced a need to raise prices because of tariffs, including big box retailer Walmart, and Procter and Gamble, the world's largest consumer goods maker. Increased inflation and slowing job growth could lead to lower interest rates in September when the Federal Reserve is next set to meet, according to Hornung. On Wall Street, the markets are responding positively to the report, which showed the inflation rate increasing slightly less than expected. The Dow Jones Industrial Average is up 1.1 percent. The S&P 500 is trending upwards at 0.8 percent and the Nasdaq is also up 0.8 percent.

Ukraine sends reserves to stop Russian advance in east amid diplomatic push

Ukraine's military has sent reserves to stem Russian advances near two key cities in the eastern Donetsk region, as Moscow attempts to gain more territory before a meeting between its leader Vladimir Putin and United States President Donald Trump in Alaska Friday, where land swap issues to end the war will be focal. The Ukrainian General Staff said on Tuesday that its forces were involved in 'difficult' fighting close to Pokrovsk and Dobropillia, with the extra soldiers needed to block attacks by small groups of Russian troops. The development suggests intensifying struggles in the eastern Donetsk area, where Moscow-backed separatists have mainly held sway since conflict there erupted there 2014, instigated by the Kremlin and deepened by Russia's 2022 invasion of Ukraine. Some of the advancing clusters of Russian soldiers had been destroyed, while others were still being engaged in combat, it added. Russia's advance is one of the most dramatic in the past year, with its soldiers infiltrating 17km (10 miles) past Ukrainian lines over the last three days, according to Pasi Paroinen, a military analyst with the Finland-based Black Bird Group. Moscow, which has further isolated the destroyed town of Kostiantynivka, one of the last remaining urban areas Ukraine holds in the Donetsk, hopes to encircle the nearby city of Pokrovsk. 'A lot will depend on availability, quantity and quality of Ukrainian reserves,' Paroinen wrote on X Monday. Ukraine's DeepState blog, which has close connections to the Ukrainian military, described the situation as 'quite chaotic', as Russian troops are 'infiltrating deeper, trying to quickly consolidate and accumulate forces for further advancement'. The Institute for the Study of War, a US-based research group, said Moscow's advances in the Dobropillia area did not yet amount to 'an operational-level breakthrough'. The Russian advance in eastern Ukraine comes as Europe hopes to rally Trump to Ukraine's cause at an emergency virtual summit on Wednesday. Organised by the German Chancellor Friedrich Merz, the meetings are due to be attended by EU leaders, Trump and Ukrainian President Volodymyr Zelenskyy. Ahead of the talks, the EU said on Tuesday that it welcomed the US president's efforts 'towards ending Russia's war of aggression against Ukraine', but emphasised that 'the path to peace in Ukraine cannot be decided without Ukraine' and 'international borders must not be changed by force'. Trump had earlier disappointed his European allies by saying that Ukraine and Russia will have to accept land swaps if peace is to be achieved. Meanwhile, Zelenskyy has warned that Russia is 'not preparing to end the war', despite Friday's scheduled meeting between Putin and Trump in Alaska. 'On the contrary, they are making movements that indicate preparations for new offensive operations,' he wrote on X. In other developments, Ukraine's SBU intelligence agency said it had successfully targeted a building in Russia's Tatarstan region, 1,300 km (800 miles) from Ukraine, which contained long-range Shahed drones. Videos shot by local residents confirmed that the facility was hit, the SBU added, noting that it was the second such strike from distance in four days.
