VAT's enough — Godongwana's powers under scrutiny in high court challenge

The power given to the minister of finance to increase the value-added tax (VAT) rate in terms of section 7(4) of the VAT Act is an 'unconstitutional power', because only the legislature has the authority to raise taxes, the Western Cape Division of the High Court heard on Tuesday.
'Our fundamental case, particularly with regard to section 7(4) of the VAT Act, is that that is not a decision for the minister or National Treasury to make. It is a decision for Parliament to make,' advocate Michael Bishop, representing the DA, told the court.
The high court heard the urgent application brought by the DA and EFF to halt the implementation of the 0.5 percentage point VAT increase on 1 May, as announced by Finance Minister Enoch Godongwana in his 12 March Budget speech.
The DA wants an interim order suspending Godongwana's decision to raise the VAT rate, pending Part B of its application in which it argues that the finance minister's authority under section 7(4) of the VAT Act is unconstitutional because it grants him the power to raise taxes which, in terms of the Constitution, lies solely with the legislature.
A full bench of judges, consisting of Western Cape Judge President Nolwazi Mabindla-Boqwana and judges Kate Savage and Andre le Grange, presided over the matter.
'The DA's case is about who decides whether to increase the VAT rate, and ensuring that that entity – Parliament – does so lawfully. The VAT increase may be a good idea or a bad idea but VAT can only be increased when Parliament does it after following a lawful process – that is our case,' said Bishop.
However, he argued that Parliament has ' not lawfully endorsed ' the VAT increase.
'Parliament rejected an unconditional VAT hike. The only VAT hike that Parliament approved when it considered the fiscal framework was a conditional one, in the sense that it was conditional on the consideration of further alternatives and a vote in Parliament on whether to adopt those alternatives. So Parliament has not endorsed this VAT hike. The decision that Parliament did take was an unlawful decision,' he said.
Bishop argued that several judgments of the Constitutional Court held that only democratically elected representatives could decide to increase the tax rate, not the minister of finance.
The minister and National Treasury had a 'proposing role', but the 'decision-making role' always rested with Parliament.
Daily Maverick has reported that section 7(4) of the VAT Act states that if the minister makes an announcement determining that the VAT rate is to be altered, that alteration would come into effect on a date determined by him, and would apply for 12 months subject to Parliament passing legislation giving effect to that announcement.
'VAT increase is immediate and irreversible. It comes into effect before Parliament acts and it cannot be undone after Parliament acts,' said Bishop.
He said the party was not asking the court to declare, on Tuesday, section 7(4) unconstitutional. 'But we submit… that when we get to Part B, the prospects that we will win Part B are extremely high,' he said.
Unconstitutionality 'non-existent'
However, advocate Mahlape Sello, representing Godongwana, argued that the DA's case does not have prospects of success because the unconstitutionality it argues for is 'non-existent'.
She argued that section 7(4) was, in fact, not unconstitutional because although the minister can adjust the VAT rate, it is still an amendment subject to the approval of Parliament.
Le Grange asked what would happen if, come 1 May, Parliament had come to the conclusion that the VAT rate should not be increased by 0.5 percentage points. Sello replied that the 0.5 percentage point increase in VAT as announced by the minister applies until such time that Parliament enacts legislation amending it.
'What's happening is that the executive has taken over the power of the legislature, even if it's for a month. Can that be tolerated under our constitutional order?' asked Le Grange.
Sello replied: 'Indeed… We submit that it can be tolerated and it must be tolerated, because section 7(4) delegates that power, for a limited period, and subjects the exercise of that power to parliamentary oversight.
'What is happening in section 7(4) is not unconstitutional.'
'Elements of deception'
Both the DA and the EFF argued that the processes followed in the marathon session of Parliament's finance committee when it considered the fiscal framework, were procedurally irregular and unlawful.
Tembeka Ngcukaitobi, representing the EFF, further accused Godongwana of being deceitful in creating the impression in Parliament that his increase in the VAT rate could be changed, when he knew it could not be reversed.
'The process through which the VAT increase was adopted is itself irrational and unconstitutional – in fact it has elements of deception,' he said.
'That is an improper use of public power.
'The deception is the idea that this is subject to change, when they knew they had no intention of changing it – that is deceptive,' he said.
Ngcukaitobi quoted comments by ActionSA's parliamentary leader, Athol Trollip, on the party's support for the fiscal framework being conditional on Godongwana scrapping the VAT hike and considering alternatives to it. ActionSA, along with Bosa and Rise Mzansi, came to the rescue of the ANC to pass the fiscal framework in Parliament, on condition that alternatives to the VAT increase were found within 30 days.
However, Ngcukaitobi argued that in Godongwana's responding affidavit he makes it clear that the VAT increase was never subject to change.
'It is him [Trollip] who said the minister has misrepresented the truth, so I say that the minister is guilty of deception.
'Once you have a budgetary process that is so coloured by deception it is fundamentally in breach of the duties imposed on members of Parliament, especially our national executive. You cannot endorse a Budget process where the deception is so clear.'
Sello denied that Godongwana deceived MPs.
'There was no deception. What the EFF relies upon is what Mr Trollip of ActionSA supposedly communicated to the public as to what the minister said. The minister in his affidavit denies that those were his statements, and in fact… he doesn't assume responsibility for any misunderstanding that Mr Trollip may have belaboured under,' she said.
Judgment was reserved in the case, to be delivered on or before 29 April. DM

It's time to end this 'orchestrated form of systemic corruption' draining state resources, says the chairperson of Parliament's Portfolio Committee on Public Service and Administration. Parliament's Portfolio Committee on Public Service and Administration says public sector workers should report in person to prove they're not ghost employees. 'A data audit alone is not enough. We are calling on this process to begin with physical in-person human verification audits for all government employees underpinned by biometric identification. Every person drawing a public salary must appear in person and be verified,' said committee chairperson Jan de Villiers (Democratic Alliance) in a governance cluster press conference in Parliament on Monday. 'The public has the right to know the names on the payroll correspond to individuals who really exist and who serve the public.' Read more: Ghost employees who haunt payrolls are a major occupational fraud hazard Finance Minister Enoch Godongwana, in his Budget tabled last month, announced sweeping expenditure reviews of more than R300-billion in government spending since 2013, 'with the aim of identifying duplications, waste and inefficiencies'. Godongwana said the data-driven initiative would cross-reference administrative datasets to 'identify ghost workers and other anomalies across government departments'. De Villiers said the portfolio committee, following Godongwana's announcement in his Budget, had convened on 28 May to interrogate the 'persistent and deeply corrosive problem' of ghost workers in the public sector. He said the National Treasury could not tackle this challenge alone — it required a joint, coordinated strategy, which was now under way between the Treasury and the Department of Public Service and Administration (DPSA). 'We will reconvene with the Department of Public Service and Administration and the National Treasury in the third quarter of 2025 to receive a full progress report on the implementation of the joint ghost worker audit strategy. This should include details on the scope of these audits, preliminary findings and proposed enforcement measures,' said De Villiers. 'Orchestrated form of systemic corruption' Ghost employee fraud is among South Africa's most persistent public sector challenges. However, the total number of ghost workers — individuals who are fraudulently added to an organisation's payroll but do not actually work there — is unclear. In 2021, the government launched Project Ziveze to investigate and verify all Passenger Rail Agency of South Africa (Prasa) employees after material irregularities were uncovered within Prasa's ICT and payroll systems, indicating that there could be about 3,000 phantom workers. A preliminary report in November 2022 revealed that 1,480 employees could not be verified, while 1,000 others had resigned, Daily Maverick's Suné Payne reported. The agency is estimated to have saved about R200-million through the verification project. Last year, the Auditor-General of South Africa uncovered R6.4-million being paid to 'deceased and terminated' employees. The Public Servants Association (PSA) described this as a 'shocking misuse of public funds' and a 'gross violation of financial accountability'. And in May 2025, the Sunday Times reported that the Gauteng Department of Health had frozen the salaries of 230 employees who could not be verified. These are a handful of the reported cases of ghost employees. 'These are not invisible names on paper. Real people are drawing fraudulent salaries, and fraudulent money is being siphoned into the pockets of corrupt criminals,' said De Villiers. He said the department had disclosed that inserting a ghost employee into the payroll system 'requires collusion because at least three officials need to work together to create a ghost worker. This means that we are dealing not with random lapses in judgment, but with embedded criminal syndicates operating in our public institutions.' He added that the issue of ghost workers was 'not merely a payroll anomaly. It is a deliberate and orchestrated form of systemic corruption. It is organised crime within the state. And as a portfolio committee, tasked with oversight in the public service, the time for half-measures and talk shops is over. 'Let us be clear, the phenomenon of ghost workers is not an issue of administrative error. There are real people creating these ghost workers, reaping the benefits of siphoning taxpayer money into their coffers. 'Every ghost worker represents a post that could've been filled by a qualified graduate, a dedicated nurse, a teacher at a rural school or a social worker supporting the vulnerable. Every fraudulent salary paid is a step backwards in the fight for a professional, ethical and responsive state.' Widespread phenomenon De Villiers did not know how many ghost workers there were in the public service, but suggested, when looking at the known instances of ghost employees, 'that there are thousands'. He said the DPSA had confirmed before Parliament that ghost workers were present across all three spheres of government, including national, provincial and local governments, as well as government agencies and state-owned enterprises. 'The reality is every single department, state agency, level of government and state-owned enterprise that we have, probably has ghost workers on their payroll.' PSA spokesperson Reuben Maleka told Daily Maverick on Monday that the organisation supported a physical audit of ghost workers who 'rob' the public sector of its capacity to provide services to the public. 'The problem is widespread throughout the public sector — government departments, municipalities [and] government entities. The cleaning must happen across the sector,' said Maleka. In addition to calling for a physical audit, De Villiers said the committee would 'push for disciplinary and criminal action to follow every detection of ghost workers. 'We don't know how many ghost workers there are, we don't know who's involved, and not enough people have been arrested so far, to be quite frank. 'I am not aware, as committee chairperson, of a single person who has been arrested thus far in terms of the creation of ghost workers,' he said. De Villiers added that South Africa's ghost worker phenomenon was not only made possible by fraud, but by 'outdated and fragmented administrative processes and systems'. Small businesses are yet again expected to absorb the shocks of stalling growth, economic policy and diplomacy. Small businesses are expected to keep the lights on, even as South Africa stumbles through an increasingly volatile global and domestic economic environment. While a 25 basis point rate cut at month end offered some respite, it's hardly the lifeline small, medium and micro enterprises (SMMEs) need, said Miguel da Silva, executive of business banking at TymeBank in the bank's SMME forecast for June. 'Some diminishing pressure on the cost of credit' followed the South African Reserve Bank's cut, Da Silva said. Yet, he said 'the economy needs every bit of help it can get'. VAT relief with a fuel levy sting The National Treasury's decision to hold VAT steady at 15% provided some short-term relief to cash-strapped SMMEs. But the olive branch came with a thorn. As of 4 June, petrol and diesel prices jumped by 16c and 15c per litre respectively. 'With many small businesses already operating on razor-thin margins, this 16c increase will likely be passed on to consumers, potentially dampening demand in an already constrained market,' Da Silva said. This adaptation to the Budget showcases the government's strained fiscal position. In a podcast discussion on Budget 3.0, Stanlib chief economist Kevin Lings pointed out that until South Africa lifts GDP growth above 3%, pressure on public finances will persist. 'The negative revenue impact from backtracking on the VAT increases proposed in the previous version of the Budget, as well as the weaker economic growth trajectory, is counteracted… by a combination of revenue and spending adjustments,' explained Dr Elna Moolman, Standard Bank Group head of South African macroeconomic research. 'The expenditure changes are dominated by scaling back some of the new spending proposed in the previous versions of the Budget, while the revenue adjustments include both the reversal of some of the tax relief previously proposed… and unspecified future tax hikes.' The Budget foreshadows a pivot to removing the regulatory burden on businesses. Though, as Da Silva noted, no specific SME-support programmes, funding initiatives or targeted relief measures have emerged. Q1 data highlights on the scale of struggle The economic scoreboard from Q1 depicts an economy in stagnation: GDP grew by just 0.1% in Q1 2025, with agriculture (+15.8%) the only area showing growth. The National Treasury revised 2025 growth expectations downward from 1.6%, from 1.8%. Official unemployment rose to 32.9%, from 31.9%, which translates to a decrease of 54,000 in the labour force. Youth unemployment increased to 46.1% from 44.6% in the first quarter of 2024. While the SME SA Funding Summit 2025 on Thursday, 12 June is expected to explore access to finance, Da Silva stressed that a functioning, reliable environment matters more. How does this affect you? No real relief for entrepreneurs: if you're running a small business, don't hold your breath for targeted funding or tax breaks. Government promises of support remain vague. Price volatility on imports and exports: If Agoa collapses or BRICS moves away from the dollar, expect price changes in imported goods and export delays. Policy fog = business risk: If you're a customer, supplier or entrepreneur, inconsistent policy and mixed messages from government and diplomats create risk, which translates into cautious spending, higher borrowing costs and business hesitancy. Agoa and the diplomatic see-saw South Africa's trade diplomacy with the US remains complicated, but functional for now. Trade Minister Parks Tau and Agriculture Minister John Steenhuisen delivered a new framework to US Trade Representative Jamieson Greer on 19 May, laying out a new bilateral trade proposal. 'We met and had a very cordial and constructive meeting with Ambassador Greer… We had a very open and frank exchange about how we can ensure mutually beneficial trade between South Africa and the United States of America,' said Steenhuisen. He further noted that 'the importance of both markets for each other, and obviously a lot of emphasis from the American side [on] wanting to rebalance some of the trade… and from our side, wanting to retain market access'. With Agoa set to expire in September 2025, a renewal is looking uncertain. Da Silva said that 'the complex challenge of either finding alternative markets or restructuring their operations' looms large for SMME suppliers in US markets. 'While the US is not our largest trading partner, it is an important one, with 8% of our exports destined for its shores,' said Maarten Ackerman, chief economist at Citadel. 'Of that 8%, a third is excluded from tariffs, but citrus exporters are likely to be hardest hit.' BRICS Summit brings new questions Then there's the BRICS Summit in Brazil in early July, where stakeholders are expected to discuss mechanisms to alleviate dependency on the dollar. 'For SMEs, particularly those in export-oriented sectors, this diplomatic tightrope walk translates into very real business planning challenges,' Da Silva explained. Navigating dual allegiances between BRICS and the West 'requires SMEs to develop strategies that can withstand diplomatic volatility while capitalising on emerging opportunities', Da Silva said. DM

South Africans have mixed views over former Democratic Alliance (DA) leader Helen Zille's potential bid to become Joburg's next mayor next year. While the outspoken political leader – dubbed 'Godzille,' – won the World Mayor of the Year in 2008 for governing the city of Cape Town, many believe the two cities are worlds apart in comparison. Dada Morero is the current mayor of Johannesburg, the latest in a long list of short-lived stints by various candidates. One of them is the DA's Mpho Phalatse. Last week, Helen Zille confirmed that she was contemplating the monumental task of running for mayor of Johannesburg. The 74-year-old told the media: 'I have been approached to put my hat in the ring for mayor. I am still considering it and consulting my family.' 'GodZille' – who has been critical of the state of Joburg and its local government – revealed that she would have to make the move alone, as her family is settled in Cape Town. Helen Zille will have until 15 June to make her formal application. On social media, South Africans have been on the fence about Helen Zille possibly being Joburg's next mayor. Some, like author Khaya Dlanga, have urged the country to give her a chance to 'turn things around'. He posted: 'Let me tell you now, if she does, she will win. And not by accident. Like it or not, she has a proven record of turning a city around. Just look at Cape Town. 'You can debate her politics all you want, but she gets things done. Joburg, as it stands, is crying out for that kind of leadership. They want working traffic lights, clean streets, functioning municipalities, not endless excuses. Right now, everyone is complaining about what the ANC has done to the city. Zille offers a real, visible alternative.' However, others argued with Khaya that the DA had failed to govern Johannesburg and even Tshwane, whose mayor, Cilliers Brink, was ousted last year. X user @KobeMalebo posted: 'The DA has actually run all the key metros in Gauteng before and botched it!'. @luphumlongcayis replied: 'The DA or Zille is not some governance miracle. Just look at the City of Tshwane. Under DA leadership, the city fell into chaos: coalition collapse, unpaid workers, budget paralysis, and service delivery failure, especially in black communities and black working-class areas'. Some even pointed to Cape Town's vast divide between the rich and poor, and how the DA under Helen Zille failed to adequately address it. @papizwane2 shared: 'It's so easy to service wealthy people/areas. The true judge of service delivery is what you do for POOR people. So with that being said, how are Khayelitsha, Gugulethu, and the Cape Flats doing? Have their living standards turned around and doing better?' Another, @NkoTengimfene replied: 'The Cape Town you speak of is not the Cape Metro of the poor and working class' And @NolwAzi_Tusini added: 'What metrics are you using to judge Zille's 'success' in Cape Town when that city is so blatantly anti-poor? While many are backing Helen Zille to'save' Mzansi's financial hub, it's clear many South Africans – who reside in both Joburg and Cape Town – believe that the latter is not the benchmark for success. The public complaints around the DA-governed city and tourist hotspot are centred around the following issues… The widening gap between the wealthy and the poor. Poor service delivery in disadvantaged communities. Influx of illegal immigrants. Prevalence of crime and gang violence in townships.
