Repeated vandalism in Wexford playground poses danger to children – ‘It is just dreadful'
"Over the last couple of months the Medieval themed playground in the community park has been repaired time and time again to enable the children of the community to enjoy playing in the outdoors. It's very disappointing to visit it and discover the vandalism done to the slide leading from the turret,' a representative explained.
"Those responsible should be absolutely ashamed of themselves. Not alone have you damaged community property, you've left a children's play area in a dangerous condition,' they added.
Although a garda representative said they were aware of the incident but had no reports on file, there is speculation that the incident was carried out by a group of young people who were witnessed causing the damage by kicking and stamping the slide.
Given the severity of the damage to the slide, families have been instructed to keep their children away from the area to avoid potential injuries.
Cathaoirleach of Enniscorthy municipal district Barbara-Anne Murphy said it was incredibly disheartening to see.
"It is just dreadful that children can't make use of a playground that has been specifically made for them. I only realised it was repeated incidents which is terrible. The whole community work so hard together to keep the area working and tidy. That playground is cherished by so many children and to take that away is awful,' she said.
She further recognised the avoidable cost that was repeatedly being laid at the feet of the Tidy Towns group, a volunteer organisation that gives up their own time to look after the community space.
"When cleaning up something that was deliberately damaged, of course that money would have already been earmarked for something else.'
She added that it was all the more discouraging that it appeared to be older children and youths deliberately taking facilities away from younger children.

"The trouble is is that this is being done by older children and youths. I have said before that youths need more places to hang out and socialise in Enniscorthy area but that does not mean they can destroy other areas,' she said.
Although many social media users are pushing for cameras to be installed to deter future incidents, Cllr Murphy is not entirely convinced that it is the core solution.
"It takes so long to get CCTV and to get the various people to sign off on it and it's not right. I know privacy laws have a role to play but I think everyone is used to being filmed all the time now. However, I'm not sure cameras are the solution here maybe its youth diversion. Maybe the FDYS or WLD could be brought in for a solution. The FDYS do wonderful work with youngsters,' she added.

Man who illegally entered 88-year-old's home leaving him in fear has jail term doubled after failed appeal
The appeal court heard that Gerry Cash (33) with an address at Tombrack, Ferns, Co Wexford left the vulnerable pensioner, who has short term memory loss, in a distressed state after entering his Co Kildare house. Cash was convicted in the District Court of trespassing on a building in a manner that causes or is likely to cause fear in another person contrary to section 13 (1) of the Criminal Justice (Public Order) Act, 1994. He was sentenced to nine months in custody with the final six months suspended and later lodged an appeal against his conviction. However his defence counsel, Asma Saleh BL, yesterday informed the court that the case would proceed by appealing the severity of sentence only and the prosecuting garda's evidence was not contested. Garda Padraig Murphy told the District Court Appeals Court that gardai got a report on February 22, 2023 from the daughter of the injured party. He said that a neighbour alerted her that they saw a white van outside her father's house and that a man knocked on the window and the door of the house. Garda Murphy said that the man was heard shouting 'I've got you that' before entering the house. He said that the neighbour saw the man in the sitting room and he later left the property in his van. Gda Murphy said that the victim was left 'very shaken and pale' after the incident. Garda Murphy said that the man was in the care of his daughters, who left him alone for one hour a day. He said this had never happened to the man before and he had no memory of the incident due to his memory loss difficulties. Garda Murphy said that CCTV was obtained and shared with gardai allowing Cash to be identified, arrested and detained. He said that in the interview, Cash admitted to being at the scene and leaving a calling card. He was charged with trespassing and was convicted in the District Court. Ms Saleh said that Cash is 'extremely remorseful' for his actions and that he is aware it was bad behaviour. ADVERTISEMENT She said that her client's doctor reports that he suffers from anxiety, depression and low mood swings. She also said that his wife is currently pregnant after a long time in IVF treatment. The daughter of the injured party gave a victim impact statement, telling the court that she is her father's full time carer and that he used to have one hour on his own. She said when she came into her father's house that day he didn't know what had happened and was very pale. She said that he shook as she showered him and he was very upset. She said: 'that man took every bit of independence from my father'. She said that her father worked all of his life and he 'didn't deserve for that to happen to him'. Judge Dara Hayes said that the court had the power to increase the appellant's jail sentence as well as decreasing it on appeal. He said that the original sentence of nine months in custody with the final six months suspended was 'lenient under the circumstances'. He said that it was clear from the injured party's reaction that he was put in a position of some distress. The judge said that whatever independence the man had was taken away and that the injured party was entitled to be unmolested in his own home. Judge Hayes decided to keep the sentence of the District Court of nine months in custody but only suspended the final three months. This represents an increase from an effective three months in custody in the original sentencing, to six months in custody after appeal. He said that he would suspend the final three months for the period of 12 months on the condition that Cash keeps the peace and does not contact the injured party or his family again. Garda convicted of assaulting teenage boy in Temple Bar four years ago
A garda has been convicted of assaulting a teenager in Temple Bar four years ago following a trial at Dublin Circuit Criminal Court. Lorcan Murphy, 32, of Pearse Street Garda Station, pleaded not guilty to two counts of assault causing harm under section 3 of the Non-Fatal Offences Against the Person Act, 1997. The assaults on the then 17-year-old took place on Essex Street, Dublin 2, and Pearse Street Garda Station on June 1, 2021. After four hours and 20 minutes of deliberation, the jury returned unanimous verdicts of guilty on both counts. There was complete silence in the court after the jury delivered its verdict. Judge Pauline Codd thanked the jurors for their service. She adjourned the matter for sentencing until November 3 next, in order to prepare a probation report and a victim impact statement. She remanded Murphy on continuing bail. The trial heard the complainant had been 'drinking that day' and had also been 'smoking weed'. He also said that he 'could have been' carrying alcohol. He went to meet his girlfriend in Temple Bar and said the last thing he remembered was walking past McDonald's on Grafton Street. He said 'waking up in James' Hospital' was the next thing he remembered. Someone in the hospital told him he was involved in an incident with the gardaí. He said he ran out of the hospital as he 'freaked out', and thought nothing was wrong with him. He woke up with a pain in his head, then went to the Mater Hospital before being transferred to Beaumont Hospital, where he stayed for five days. He said he had headaches but has no issues with his memory. The complainant agreed during cross-examination he had no recollection of the incident, due to a head injury, but accepted alcohol and cannabis could have contributed to his lack of memory. In his evidence, Mr Murphy said he went to assist a colleague, who was dealing with the complainant. He instructed the complainant to remove his hands from his pockets, then noted the young man tense up. Mr Murphy said the complainant produced a glass bottle in such a way that he believed he was at risk of being struck with the bottle. Mr Murphy said he managed to take hold of the complainant's second hand, and he was handcuffed. He said the complainant was spitting towards him. Mr Murphy said he felt unsafe both for himself and the arrested complainant. He said he had his hand on the complainant's back and felt him shift his weight, and Mr Murphy then performed a leg sweep. The side of the complainant's body and head made contact with the ground. Mr Murphy checked him visually and said at no stage was he unconscious. He requested prisoner transport and that a doctor be called to Pearse Street Garda Station. In his closing speech, prosecuting counsel John Gallagher BL told the jury the prosecution's case was that excessive force was used in the leg sweep, which resulted in the complainant's head impacting the ground. He submitted the level of force used to bring the complainant to the ground after his initial arrest was not reasonable, inherently dangerous and likely to cause injury to the complainant. Mr Justin McQuade, BL, defending, said the force used was a leg sweep, and it was an 'unfortunate secondary impact' when the complainant hit his head on the ground, adding his client 'did not have the luxury of picking a softer landing point'. Mr McQuade suggested if gardaí were going to be criminalised for using force, they may be slower to use it in the future and that benefits no one.
