IHC allows NAB to auction Bahria Town properties

ISLAMABAD: The Islamabad High Court (IHC), Tuesday, allowed the National Accountability Bureau (NAB) to proceed with the auction of Bahria Town properties.
A division bench comprising Chief Justice Sardar Mohammad Sarfraz Dogar and Justice Muhammad Asif turned down the petitions filed against the auction of Bahria Town properties.
The IHC short order stated; 'Writ Petitions are hereby dismissed. The injunctive orders issued by this Court vide order dated 15.04.2025 passed in W.P No.1368 of 2025 and order dated 04.06.2025 passed in W.P No.2248 of 2025 are hereby recalled.'
During the hearing, Farooq H Naik appeared on behalf of Bahria Town, while prosecutor Rafay Maqsood represented the NAB.
Naik argued that NAB's auction notice was illegal, deceptive, and issued with malafide intent. He said that Bahria Town was not a party to the plea bargain case and had been wrongfully targeted. He added that Malik Zain, who had pledged Bahria Town properties as collateral, had applied for cancellation of his plea bargain, and that application was still pending. 'If the plea bargain is under judicial scrutiny, NAB cannot lawfully proceed with the auction,' Naik submitted.
He contended that NAB's move to attach and auction Bahria Town's properties lacked legal basis, as the company itself had not been declared an accused in any reference related to the £190 million case.
The NAB prosecutor rejected Bahria Town's position, stating that Malik Riaz and his son had entered into a plea bargain with NAB but failed to pay the agreed-upon amount. The NAB decided to auction the properties to recover the outstanding amount under Section 33E of the NAB Ordinance, 1999.
Maqsood stated that a similar plea had earlier been dismissed by a trial court, after which the petitioners approached the IHC, which issued the stay order on June 12, on the day of the auction. The NAB, subsequently, filed an application to vacate the stay order.
The NAB prosecutor pointed out the Lahore High Court's Rawalpindi Bench had directed the petitioners to approach the auction committee, and that attempts to invoke the IHC's stay order before that bench had been rejected.
Bahria Town's counsel described the move as a violation of due process, warning it would damage investor confidence and the business environment.
The NAB prosecutor said that Bahria Town granted bail and when the accused is an absconder, action would be taken against the guarantor. This application of Bahria Town is not even admissible.
After the arguments of the parties were completed, the court had reserved the decision.

LAHORE: The National Accountability Bureau (NAB) continues to demonstrate its unwavering commitment to safeguarding state assets and interests of the general public and recovering funds belonging to the national exchequer. The Bureau's relentless efforts are evident through recovery of Rs 456.3 billion during the second quarter of 2025, marking a substantial increase of Rs. 365.29 billion compared to Rs. 91.01 billion recovered in the first quarter of the same year. Out of said recoveries of Rs. 547.31 billion for the first two quarters of 2025, movable and immovable properties worth Rs. 532.33 billion have been disbursed/ handed over to different ministries and departments of federal and provincial governments, as well as, financial Institutions; whereas, 12,611 affectees of different cheating public at large cases have also been compensated. In the past two years, NAB has recovered a staggering total of Rs. 5,854.73 billion (Rs. 5.854 trillion), which is 700 percent more that of Rs. 839.08 billion recovered since the Bureau's inception. This exceptional achievement underscores the hard work and commitment of NAB officers across various regions, who have successfully retrieved billions of rupees from corrupt and unscrupulous elements. Key recoveries and achievements in Quarter 02 of 2025: NAB Rawalpindi recovered 51 kanals of valuable state land worth Rs. 29 billion located in Sector E-11, Islamabad, which has been handed over to the Capital Development Authority (CDA). In a major cheating public at large case (B4U), NAB secured Rs. 3 billion which will be disbursed to 17,214 affectees while, an additional tranche of Rs. 4 billion is expected in the current quarter. In another case of Banker's City, 640 kanals & 11 marlas land of significant value has been transferred to NAB, with proceeds to be distributed among the affected individuals. NAB Sukkur successfully recovered a land worth Rs. 25.079 billion belonging to the National Highway Authority. The Bureau has also recovered 127 kanals & 15 marlas of land valued at Rs. 895.160 million, belonging to the Education and Literacy Department, Government of Sindh. From an impressive recovery portfolio, Rs. 384.270 billion worth of forest land was recovered in the quarter ending June 2025, contributing to a total forest land recovery value of Rs. 1,487.77 billion. NAB Lahore disbursed a tranche of Rs. 3.2 billion, recovered in the Eden case, to 11,880 affectees of the society. In Pak Arab case, eight properties valued at Rs. 3.9 billion were surrendered by the accused and are in the process of transfer to NAB. Proceeds from these assets will be disbursed to 2,500 affectees of the case. A plea bargain amounting to Rs. 2.181 billion is under way with owners of Elite Town Housing Society, with recovered funds intended for disbursement among 1,789 affectees. Currently, NAB is actively coordinating with the revenue departments of all provinces to recover state assets and properties unlawfully held by corrupt elements. Preliminary estimates indicate that state land worth approximately Rs. 5 trillion is under illegal possession and will be reclaimed. NAB's sustained focus on accountability and justice reflects its promise to the nation to protect public resources and deliver tangible benefits to affected citizens. A NAB spokesperson stated that a substantial portion of this amount — assets worth over Rs532 billion — has been handed over to government. 'Beyond just statistics, these recoveries reflect real progress in holding corrupt elements accountable and returning wealth to the state,' the spokesperson said. 'Thousands of victims who were defrauded in various scams have also been compensated.' So far, more than 12,000 individuals affected by public fraud schemes have received financial restitution. The Bureau's total recoveries over the past two years now stand at Rs5.85 trillion — over seven times the amount it had recovered since its inception in 1999. 'This is not just a number. Among high-profile recoveries, NAB Rawalpindi retrieved state land worth Rs29 billion in Islamabad's Sector E-11, which was handed over to the Capital Development Authority. In the B4U scam, Rs3 billion was recovered and is set to be distributed among more than 17,000 affectees, with an additional Rs4 billion expected in the current quarter. NAB also facilitated the transfer of land under a housing scheme to ensure long-awaited compensation for investors. In another case, NAB Sukkur reclaimed land worth over Rs25 billion previously held by private entities, marking a significant success in efforts to recover public assets. In Lahore, Rs3.2 billion was disbursed to nearly 12,000 victims in the Eden Housing case. In the Pak Arab case, eight properties worth Rs3.9 billion were surrendered and are currently being processed for transfer. Separately, a plea bargain amounting to Rs2.18 billion is under negotiation with the owners of Elite Town Housing Society. The proceeds are intended for distribution among approximately 1,800 affectees. Looking ahead, NAB has shifted its focus to the recovery of encroached state land. In collaboration with provincial revenue departments, the Bureau has identified illegally occupied properties estimated to be worth nearly Rs5 trillion. 'NAB is unwavering in its mission to recover every last rupee of national wealth and to bring justice to those who have looted public funds,' the spokesperson said.
