
Roundabout chosen for intersection in Jamestown
Steele informed the City Council during committee reports on Monday, June 2, that the North Dakota Department of Transportation has also selected a five-lane road with a two-way left-turn for Business Loop West, which is similar to the existing road.
The project would reconstruct the U.S. Highway 52 and 10th Street Southeast intersection and Business Loop West from 4th Avenue Southwest to 10th Street Southeast. The two bridges on Business Loop West will also be replaced.
The project includes restriping 1st Avenue South from 7th to 10th Street Southeast to help match the configuration of the Road Diet project further north in the downtown area.
The other three alternatives for the U.S. Highway 52 and 10th Street intersection were a radial T, double crossover and displaced left turns.
The other three alternatives for the reconstruction of Business Loop West were four lanes with full intersection access at all streets with raised medians, four lanes with three-fourths intersection access with a raised median, and four-lane right-in and right-out intersection access with a raised median.
The estimated cost is nearly $9.2 million for the roundabout and about $6.5 million for the five-lane road with a two-way left-turn lane, The Jamestown Sun reported in February.
The purpose of the project is to address bridge and pavement condition, vehicular traffic operations and sidewalks for bicyclists or individuals who walk along and adjacent to the U.S. Highway 52 corridor in Jamestown from 7th Street to 4th Avenue Southwest, the Sun reported in February.
The city of Jamestown's Land Use and Transportation Plan identifies the need to improve traffic operations and pedestrian comfort at the intersection of 1st Avenue South and 10th Street Southeast, The Sun reported. The Land Use and Transportation Plan also identifies the need to address gaps in the sidewalk and trail system in the general area.
Construction on the project is scheduled for summer 2027.
The Jamestown City Council unanimously approved listing city-owned properties for sale in southeast Jamestown.
The city-owned properties are located at 301 and 401 11th Ave. SE and 1104 and 1220 Railroad Drive SE.
The properties at 301 and 401 11th Ave. SE are in the Harold P. Bensch Addition. The properties at 1104 and 1220 Railroad Drive SE are in the Kourajian Second Addition.
The request for proposals for the four properties will be advertised on June 7 with applications due on Aug. 15. The selection date and notice will be on Sept. 2-3, respectively, or as determined by the City Council.
The minimum price acceptable for each of the properties is $2 per square foot at 401 11th Ave. SE and $2.50 per square foot at 301 11th Ave. SE, according to the city of Jamestown's request for proposals. The minimum price is $2 per square foot for the property at 1104 Railroad Drive SE.
Mayor Dwaine Heinrich said the price of the property at 1220 Railroad Drive SE, which includes a building, is $151,600.
"One of the other conditions on the sale of that one with the building on it is that ... the exterior has to be refurbished because it doesn't look very good right now," Heinrich said.
The purchaser must agree to sell the property back to the city at the original purchase price if development does not occur within 30 months of the purchase in accordance with the development plan submitted as part of the original purchase proposal.
The City Council unanimously approved the annexation of property adjacent to 25th Street and 11th Avenue Southwest.
The property is about 7 acres and is located west of Walmart.
The property will be used for the construction of a housing complex, Heinrich said at the Jamestown Finance and Legal Committee meeting on May 20.
The annexation request was made by Beyond Shelter Inc. and Jtown Land LLC.
In other business, the City Council held the first reading of an ordinance to amend and reenact section 8, article 1 of the city of Jamestown's municipal code related to keeping fowl.
The ordinance would loosen restrictions on keeping fowl within city limits by eliminating a setback requirement from the applicant's residence.
The current ordinance for keeping fowl in an enclosure has a setback requirement of 100 feet at its nearest point from any residence.
"Fowl shall be kept in an enclosure not less than 60 feet at its nearest point from any other residence, including any attached structures, and must be constructed as to prevent such fowl from wandering or flying from the enclosure," the new ordinance says. "Any enclosure for the Fowl shall be not less than 30 feet from the permittee's residence and any attached structures."
The proposed number of chickens allowed is up to eight.
Heinrich said the topic will be on the agenda for the Finance and Legal Committee meeting on June 24.
"We do have some proposed changes, and I have visited with our city attorney and we know there's some other changes, but we're confident that we're not ready to go forward with that," he said before the first reading of the ordinance.
Lisa Kainz, a Jamestown resident, said the setback distance of 100 feet from a neighbor's residence is "not the best thing."
"I know my neighbors personally and they're 150 feet from me because where I live, but I also believe that if you are a minority and you don't have what I have and you receive permission from your neighbors and the majority of the people around you would like you to be able to have chickens because they would enjoy them also, they should have that right," she said.

Water shutoff notices resume in Arvada, Colorado after COVID-era pause
Homeowners in Arvada who are behind on their water bills can once again expect shutoff notices, as the city reinstates its policy suspended during the COVID-19 pandemic. "Water is an essential resource," said Connor Drew. Sitting in a local park with his dog Mala, Drew said he can't imagine not having access. "That would be heavy — not being able to take a hot shower or drink clean water," he said. That necessity is part of why the city originally paused water shutoffs. "It was important at that time to make sure everyone had water for handwashing and hygiene purposes," said Jacqueline Rhoades, director of infrastructure for the city. Now, five years later, the city says it's time to return to standard practices. City Council voted in July to resume issuing shutoff notices starting this month. At that time, Arvada had more than $600,000 in unpaid water bills. "The city was relying on a lien process — once a year, we would go in and lien for nonpayment," Rhoades said. "Over time, those bills start to accumulate, and what we found is a trend where that is becoming increasingly expensive — both to us and to customers who have to wait until the end of the year when balances are higher." The number of liens issued has risen significantly — from just 30 in 2020 to more than 300 last year. "We want to make sure all the dollars from our water rates are reinvested into our aging system," Rhoades said. "So, we are trying to be very smart about those investments." Resident Ian Cowart said he understands the city's position but hopes officials will continue to be flexible with residents who are struggling. "People are figuring out what they can pay and what they can't," Cowart said. "Water is a right — that's how I see it. Be flexible." The Arvada City Council approved the change with one member voting against. Officials say the new policy gives them an opportunity to reach out to customers sooner and offer support when needed. Regina's mayor settling into role, eager to begin furthering new city initiatives
Eight months and one city budget down, Mayor Chad Bachynski says Regina's almost-all-new city council is starting to find its footing. Bachynski expressed those sentiments when he sat down with the Regina Leader-Post for a recent check-in interview to see how things are going in the first year of his four-year term. 'It's been a lot to learn and I think that continues on,' he began. 'But there's definitely elements that are obviously feeling more comfortable.' Bachynski unseated former mayor Sandra Masters in the November municipal election, joined by a new council that includes just two holdovers out of 10 councillor positions: Shanon Zachidniak (Ward 8) and Jason Mancinelli (Ward 9). The mayor says city council's work so far has largely been focused on projects and initiatives begun by the last council, but Bachynski hinted that he's now looking ahead to start introducing new business in the coming months. In fact, he teased that a report on the city's strategic direction may be coming to council chambers soon, as well as a new action plan to improve downtown safety. 'From our perspective, we're absolutely getting our feet under us, learning as quickly as we can,' Bachynski says. 'I'm really looking forward to putting our direction in on what we do next.' The first few months of his mayorship haven't shifted Bachynski's initial priorities, such as addressing Regina's $900-million infrastructure deficit, exploring 24-hour construction and bolstering civic pride. But his short time in office has also heightened the focus on long-standing issues like affordability, downtown vibrancy and the homelessness crisis. All feed into Bachynski's vision for how Regina is to become a more enticing city — socially and economically. He expressed confidence that progress is being made on each issue. 'It is so encouraging that we have all the potential, all the right pieces in place,' Bachynski says. 'Some of the decisions that we're making may not be evident now as to the benefits, but we are looking out for the future.' Bachynski acknowledges that spending on big projects is difficult for taxpayers to swallow. That includes a 7.33 per cent mill rate increase this year, the highest in at least 10 years for Regina. But the new mayor says he stands by the philosophy that investment to increase the city's tax base is necessary to lessen the tax burden on individual residents. 'The more we grow, the more we actually increase our revenue, and that's actually the way forward,' Bachynski explains. He also hinted at continuing to lobby the provincial and federal governments for financial help with Regina's infrastructure backlog, and to invest in homelessness supports in line with a housing-first structure. 'I felt there was more finger-pointing previously, and that's a different style,' notes Bachynski. 'But my approach is to try to be more collaborative and provide a solution at the table.' Bachynski says he's also been working to promote 'alignment' between city council and administration, and to foster public trust in the work happening inside city hall. 'We have to have that trust that we have an administration that is full of experts,' he adds. Des Moines firefighters win holiday time dispute
An arbitrator recently ruled in favor of Des Moines firefighters in a compensation dispute, concluding that the city must provide extra time off to those who work overtime on holidays. Why it matters: The decision could greatly influence the fire department's funding and staffing choices. It comes at a time when budgets are tight, with city officials last month discussing the idea of removing a rig from service. Catch up quick: The case focuses on firefighter Nathan Jones, who worked a 24-hour shift on July 4, 2024. He received double-time pay for 17 hours considered overtime, but he did not additionally accrue those hours for future time off, unlike the seven hours that were part of his regular shift. Zoom in: The city argued that the union contract didn't entitle Jones to both double pay and time off for overtime hours, with fire chief John TeKippe saying that at least one instance where another firefighter was paid for both on a Christmas Day shift may have been "an error in an entry." Yes, but: Arbitrator Marsha Ternus, a former Iowa Supreme Court justice, ruled on July 25 that the contract's language does not support the city's interpretation, determining that Jones — and others in similar roles — are eligible for the extra holiday hours. What they're saying: Joe Van Haalen, president of Des Moines Professional Firefighters IAFF Local 4, told the City Council this month that the arbitration cost the union more than $30,000 in legal fees that were avoidable. "At best, it was a gross misjudgment. At worst, it represents a pattern of hostility toward the workforce that should concern every member of this council," Van Haalen said during an Aug. 4 City Council meeting. The other side: The city believes that the ruling does not reflect the intent of the union agreement, city manager Scott Sanders wrote in an Aug. 5 email to council members. Axios' request to speak to TeKippe about the issue was denied, with city spokesperson Devin Perry saying the city's legal department prefers employees not to comment on litigation or labor matters. Between the lines: The city did not spend money on outside counsel during the arbitration process but was still gathering information Tuesday to estimate costs associated with the decision, Perry said. The intrigue: A separate legal battle is unfolding in West Des Moines, where a group of firefighters is suing the city, claiming they were misclassified under federal law and denied proper overtime pay, the Iowa Capital Dispatch reports. What's next: The overtime time-off calculations begin immediately for Labor Day, Thanksgiving, Christmas, New Year's Day, Memorial Day and Independence Day.
