Judicial bias claims arise in Joshlin Smith appeal case

The disappearance of six-year-old Joshlin Smith from Middelpos, Saldanha Bay, returned to the Western Cape High Court on Thursday, this time with defence lawyer Nobahle Mkabayi locked in a heated exchange with Judge Nathan Erasmus over claims of judicial bias.
Joshlin's mother, Racquel 'Kelly' Smith, her boyfriend Jacques 'Boeta' Appollis, and family friend Steveno 'Steffie' van Rhyn were earlier convicted of kidnapping and human trafficking after the little girl vanished in February 2024.
The State's case centred on witness testimony and statements allegedly made by the accused, but Joshlin has not been found.
Representing Van Rhyn in his bid for leave to appeal, Mkabayi accused Erasmus of mishandling key evidence and showing prejudice against her client during the original trial.

She argued that the judge should have examined certain statements before the trial-within-a-trial to determine whether they were confessions or admissions, and that comments made from the bench discouraged Van Rhyn from testifying.
'When I was leading my client, the court said Ms Swanepoel (State prosecutor) would make a field day out of you,' Mkabayi told Erasmus, describing the remark as threatening.
Erasmus rejected her version: 'Why did you not ask for a special entry? I didn't say Ms Swanepoel was going to 'wipe the floor' with your client. Ms Heeramun was wiping the floor with Mr Harmse's client. Don't make statements that are not true.'
The back-and-forth intensified as the judge pressed Mkabayi to explain why another court would view Van Rhyn's testimony differently.
'Tell me why his testimony should have been accepted. Is there a reasonable prospect they will win in the next court?' he asked.
Mkabayi insisted her client's right to a fair trial had been compromised and said she wanted the matter heard by a different court to prove his innocence.
Erasmus stood firm: 'When the defence closed their case, all we did was manage their case. Are you saying I was biased towards your client by saying that?'
Mkabayi said yes.

The State on Monday at Durban High Court proposed to the current witness, that those figures in the tender's bid specification were provided by Allan Robert Abbu. Abbu, at the time, was the Deputy Head for cleansing and solid waste. The media is prohibited from naming State witnesses. However, Abbu's counsel, advocate Jay Naidoo SC, disputed this, saying that the previous witness X, who had drafted the tender advertisement, said Abbu gave her a document that had the figure of the number of households that needed to be serviced. Naidoo said if the State could tell him where witness X said Abbu was dictating the numbers of households to be serviced while he stood behind her, it would be different. 'Her evidence was that Abbu was in and out of her office,' he said. He said the document that contained the household numbers that Abbu gave to witness X is not disputed by the defence. The State is currently leading evidence of witness Y, who said part of her job was to confirm project budgets and estimate them. Witness Y told the court that the number of households that were in the BAC report prepared by witness X was tripled, and some were doubled.

High Court denies bail for fisherman accused of violently attacking wife on anniversary
The Western Cape High Court found the accused wife abuser would endanger the life of the complainant, and it was not in the interests of justice to have him released. Image: IOL A man who allegedly violently attacked his wife on their ninth wedding anniversary, and faces possible life imprisonment, will remain behind bars after his second bail attempt was denied by the Western Cape High Court. The 37-year-old father of four was a fisherman in Mossel Bay up until his incarceration in May last year and faces a charge of attempted murder. He sought to appeal against his bail application, which was heard and denied in the Mossel Bay Magistrate's Court. The lower court found that the man would endanger the life of the complainant, and it was not in the interests of justice to have him released. According to court documents, on May 18 last year, the couple celebrated their anniversary when the man accused his wife of infidelity and began beating her with his fists. This was then followed by him telling his wife to undress, and after she fell to the ground, he proceeded to hit her multiple times with a hammer all over her body. Video Player is loading. During his second bail hearing, the man, adamant that he could only afford R300 bail, denied the charges against him and claimed that he caught his wife in bed with another person. Court documents read: 'The State led evidence that the appellant had assaulted the complainant, including by striking her with a hammer so hard that her arm was broken. The medical evidence suggested that the injuries were life-threatening, and photographs put up by the State revealed severe harm to the complainant's face and body. 'Not only this, but evidence was led to show that he had previously assaulted the complainant, and that the complainant had been raped by the appellant's brother in the presence of the appellant and thereafter he had asked the complainant to withdraw charges against his brother. The State also adduced evidence that the complainant is very afraid of the appellant.'

Five killed in shootings in Mitchells Plain, Muizenberg
ROCKED: Rocklands neighbourhood in Mitchells Plain IN another bloody weekend for Cape Town, five people were killed in separate shooting incidents in Rocklands and Muizenberg.
