Norwegian gynaecologist jailed for dozens of rapes

A Norwegian court on Friday (local time) sentenced a doctor to 21 years in prison for committing dozens of rapes over a period of almost two decades.
Arne Bye, 55, was found guilty of committing 70 counts of rape and sexual assault during gynaecological examinations of his patients between 2004 and 2022. He was also condemned for 80 instances of abuse of his position.
Bye committed the acts at his medical practice in the town of Frosta in central Norway.
The court in the city of Trondelag barred the doctor from exercising his profession indefinitely and demanded he financially compensate his victims.
Ninety-four women testified during the trial, describing how Bye committed multiple acts of non-consensual touching and digital penetration without medical justification.
The acts all constitute rape under Norwegian law.
Bye also filmed the assaults.
"The suspect's actions make this case an extremely serious one. The actions are unacceptable,"
the Adresseavisen
newspaper quoted judge Espen Haug as saying in court.
The sentence matched the one requested by the prosecution. Bye's defence had argued for a lesser sentence, recognising only 20 of the rapes.

However, for the first time in nearly 10 years, Peter Waihape has consented to be seen by a psychologist. It's the first notable steps he has taken towards rehabilitation since 2014, when he withdrew his consent to be seen by a psychologist after just seven sessions, and had received no treatment since then. But, in a report released by the New Zealand Parole Board today, Waihape has been seeing a psychologist fortnightly and has had 20 sessions. "He is considered to have made early progress," the board said, noting, however, that "he is still assessed as a high risk of violent reoffending and an above average risk of sexual reoffending". Waihape was sentenced to life in prison with a minimum non-parole period of 18 years in 2005 for the rape and murder of a 24-year-old sex worker he'd met in Christchurch. She'd agreed to go with him to a carpark before they had an argument about his refusal to wear a condom. Waihape then strangled her, bound her hands and raped her before pushing her out of the car and then running her over with his vehicle multiple times. She became trapped under the car and was pleading for her life, but Waihape took no notice and ran her over again with witnesses saying he was laughing as he did so. Waihape then later drove the woman to the Avon River and threw her body into the water. Three days before the murder, Waihape sexually assaulted a teenager whom he'd abducted off the street. Waihape drove the girl around for several hours, violated her, then dropped her off. He had been released from prison just days before. Photo / File Photo: NZ Herald Waihape first became eligible for parole in January last year, when the board noted it had serious concerns about him. At that hearing, Waihape told the board he was willing to resume work with a psychologist and complete any rehabilitative work he needed to do, despite not having done any since 2014. "For his part, Mr Waihape told us that when he was previously seen by the psychologist, he was not ready to engage. He was very entitled. He reacted inappropriately and he had recognised that since," panel convenor Neville Trendle said. "He had addressed his own conduct with others ... He said that he was now accepting that he needed help." In his latest appearance before the board last month, the psychologist he'd been seeing noted his good conduct in prison, and said that generally he interacts well but will walk away when he feels frustrated. The board said that he was articulate and spoke well, and that his psychologist had validated a lot of what he'd said, and it had a profound impact on him. "Mr Waihape believes he needs significant individual work. He told the Board that he has made changes in his thinking and his behaviour and has managed many stressful and frustrating situations by simply not engaging," the board's ruling reads. "We spoke with him about the importance of building trust with others and communicating around what is going on in his inner world." The board said that while Waihape had made progress, there was still significant work ahead and declined parole. Photo: INPHO Former mixed martial arts (MMA) fighter Conor McGregor has lost his attempt to overturn a civil jury's order that he compensate a woman who accused him of raping her, with Ireland's Court of Appeal rejecting the bid in its entirety. The plaintiff, Nikita Hand, alleged that McGregor - one of the world's highest-paid athletes - sexually assaulted her in a Dublin hotel room on 9 December, 2018. A jury last year ordered McGregor to pay her nearly €250,000 in damages . McGregor, 36, denied the allegation and said he had "fully consensual sex" with Hand. The ex-Ultimate Fighting Championship (UFC) star also denied causing bruising to the plaintiff. Hand last year said that she and a friend made contact with McGregor, who she knew, after a work Christmas party. She said they were driven by McGregor to a party in a penthouse room of a south Dublin hotel where drugs and alcohol were consumed. The verdict against McGregor was reached at the conclusion of a two-week civil trial in Ireland's high court, by a jury of eight women and four men. They handed down their decision after just over six hours of deliberations. Speaking outside the court in November last year after the initial verdict was handed down, Hand said she was overwhelmed by the support she had received and felt vindicated. "I hope my story is a reminder that no matter how afraid you might be, speak up," she said. The now-retired MMA star earnt $180 million in 2021, making him the world's highest paid athlete in 2021, according to Forbes. In March this year, McGregor was invited to the White House by United States President Donald Trump on St Patrick's Day, where the former UFC champion made various anti-immigration comments in relation to Ireland . "It's about time that America is made aware of what's going on in Ireland. What is going on in Ireland is a travesty," McGregor said, ahead of an Oval Office meeting with the US president. - Reuters

Adam Busby jailed for sexual connection with a 12yo whom he impregnated

Photo: Supplied/Open Justice A 32-year-old man invited a 12-year-old girl to his house and soon after she arrived, the pair went into his bedroom and had unprotected sex, resulting in her becoming pregnant. Today, the girl, now 13, was in New Plymouth District Court, visibly pregnant, as the unborn baby's father, Adam Busby, was sentenced to three years' imprisonment for having a sexual connection with a young person. Referring to the summary of facts, Judge Tony Greig said Busby knew the girl and approached her in the street on January 11 this year. They spoke and he asked if she would like to go to his house, in Stratford, Taranaki, later that day, to which she agreed. That night, she snuck out of her home and Busby met her outside his house and then took her into his bedroom. "You talked to each other. She told you that she was 12 and you told her that you were 32. She asked you if you had any birth control protection and you said 'no'. You then both had sex," the judge said. "She stayed a couple of hours before going back to her house." The following month, the girl went to the doctor and discovered she was pregnant. While victim impact statements were not read in court, Judge Greig said the girl reported that when in Busby's bedroom, one of the first things they spoke of was her age. "He said, 'okay'. After we talked, he asked if he could kiss me. I said, 'yes'. After we kissed, Adam asked if I'd had sex before. I said, 'no'," the judge said, reading her statement. "He asked me if I wanted to have sex. I was scared but I wanted him to like me and know what it was like. "We had sex and after he asked if I was okay. I said, 'yes', then we talked more. Then he said, 'thank you' and took me home." The girl told the court she wanted to parent her child and a social worker had been assigned to them. She had to change schools as a result of her pregnancy, her family relationships have been seriously impacted and she has had to move in with other family members. New Plymouth District Court. Photo: NZME However, the girl was no longer in school and was now doing her schoolwork online. She told the court she never wanted to see Busby again. The judge said a report from a social worker advised that the girl was particularly vulnerable because of her upbringing and the trauma she had faced. It said some family members were against the baby being raised by strangers and were committed to supporting the girl and her child. "She has a strong desire to parent her baby, claiming it's not her baby's fault. This is also reflective of a child who has been removed from her own parents' care," the judge said. "Her life has been drastically altered by becoming a mother at 13. "The stigma that the world places on teen mothers, the names this child has been called from members of the community and her family, and the subsequent breakdown of relationships because of what has happened has a far-reaching impact which may continue for the rest of her and her baby's life." Judge Greig said the harm Busby had caused could be intergenerational. "This young woman, whom you impregnated, had been removed from her parents because of the dysfunctional childhood that they caused her to have; now she is going to try and parent another child." In sentencing Busby, the judge said he had dealt with him on previous occasions. He described Busby, who has other children, as "a wild boy" and "a tearaway". His criminal history included driving, violence and dishonesty-related convictions but "nothing of this seriousness". The judge said Busby had "really let himself down". "One thing I've always respected about you is your dedication as a parent... so that's why I say you've really let yourself down here." Judge Greig said that Busby had told a pre-sentence report writer there were "a couple of discrepancies" in his and the girl's account of what had occurred. He claimed he was unaware of her age until they discussed it after they had sex, and she had snuck out of her house because she was fearful of something that was occurring in her home. Busby told the report writer he felt "a bit set up". He said he'd had at least 12 cans of bourbon premixes on the evening he met with the girl, he had no intent to have sex with her and he thought she was "around 16″. "I wasn't aroused or anything until she kept grinding on me. When I found out her age, I was devastated. I told her that my life was over. I did not know she was pregnant until I was arrested. I was surprised when I was informed she was intending on keeping the baby," Judge Greig said, reading Busby's comments. The Crown said such comments made by Busby lent themselves to victim-blaming and the judge pointed out it was not what the summary of facts, which he pleaded guilty to, stated. Judge Greig set a starting point of four years' imprisonment, according to case law, but said it "was not enough". "You should be sentenced to about twice that for the harm you have caused and will cause, as I have said, for years to come, but I am bound by the law." He allowed a 25 percent credit for Busby's guilty plea but refused to give him any further discounts, including for Busby's claimed remorse.
