
Understanding 'Yellow Envelope' bill: Labor reform or threat to business?
A contentious labor bill championed by the ruling Democratic Party of Korea is barreling toward passage. The business community, however, warns that the revision could throw the country's industrial relations into disarray.
Commonly known as the 'Yellow Envelope" bill, the proposed amendment to the Trade Union and Labor Relations Adjustment Act would broaden labor protections across all employment types while restricting companies' ability to sue for financial damages resulting from industrial action.
The bill, which has evolved dramatically from earlier drafts, takes its name from a 2014 campaign where citizens sent cash donations in yellow envelopes to support a group of SsangYong Motor workers facing massive damage lawsuits over their occupation of the company's main factory.
Five different versions of this pro-labor union bill have been submitted to parliament. The Environment and Labor Committee is expected to review all proposals, identify key provisions and negotiate to create a single, united draft for the plenary session to vote on.
While it's difficult to predict the final wording of the bill, the gist of the amendment will likely remain intact: expanding protections for workers engaged in union activities and restricting companies' ability to file damage claims against them.
What's in the bill?
Under the proposed bill, the definition of 'employer' would no longer be limited to those who have direct employment contracts with workers, but would include anyone who 'substantially and specifically controls' working conditions.
A stricter version of the draft even stipulates that if a company outsources work to another firm, it will still be recognized as an employer if the outsourced work is performed on its premises.
This change means unions representing subcontracted workers could effectively demand negotiations directly with large companies.
Another controversial provision is the broadened definition of "worker" to include anyone who joins or organizes a labor union. This extended scope would cover platform workers, self-employed individuals and freelancers, the groups that were previously excluded under the existing law. This would allow freelance associations and gig workers to operate as unions and legally go on strike.
The bill also extends the situations when strikes are legally allowed. Under current law, strikes are only permitted during negotiations over changes to employment terms such as wages and benefits. But the proposed revision would permit stirkes over employment terms that have already been decided.
One variation of the proposal goes even further. It explicitly permits workers to launch labor disputes over employment conditions affected by corporate restructuring, such as mergers and acquisitions or organizational changes. Under this framework, companies conducting layoffs during restructuring would face potential labor protests.
The proposal also imposes tighter limits on when employers can sue for damages during labor disputes. Under the revision, companies would be barred from seeking compensation for losses caused by legitimate strikes. If a labor union protests in response to an employer's unlawful conduct, the union and its members would not be held liable for resulting damages.
Additionally, if a court rules on damages, the bill requires that responsibility be assigned individually based on each person's level of fault, rather than imposing blanket liability on all union members.
While labor advocates hail the bill as a crucial step forward in protecting vulnerable workers, companies are concerned that it could handcuff their ability to manage labor disputes, disrupt workplace order and expose them to legal challenges.
South Korea's six major business organizations — Korea Enterprises Federation, Korea Chamber of Commerce and Industry, Federation of Korean Industries, Korea International Trade Association, Korea Federation of SMEs and the Federation of Middle Market Enterprises of Korea — on Monday urged lawmakers to slow the bill's passage, raising concerns that it could destabilize workplace order.
'This is not simply revising the law, but a fundamental change that could bring tremendous disruptions to our labor-management relations,' said Sohn Kyung-shik, chair of KEF and also of CJ Group, during a meeting with lawmakers. He stressed the need for broader consensus through dialogue with all stakeholders.
'The bill expands the definition of 'employer' to include anyone with substantial and specific control over working conditions, which is vague and abstract,' he said. 'If tens or hundreds of subcontractor unions demand negotiations, it would be impossible for the parent companies to respond to each one individually."
Industry officials are particularly concerned about the bill's impact on subcontracting-heavy industries such as automaking, shipbuilding and construction.
'If the bill makes companies liable for strikes by hundreds or thousands of subcontractors, when can companies operate, produce and make profit?" asked one industry official speaking on condition of anonymity.
'If this continues, companies may have no choice but to be more cautious about expanding domestic investment or employment.'
With President Lee Jae Myung backing the law, armed with his ruling Democratic Party controlling the National Assembly, it's just a matter of time before it is enacted, observers say.
'The Supreme Court has already acknowledged (the necessity) of this law. The International Labor Organization also recognizes it,' Lee was quoted as saying during a televised presidential debate in May. 'The Yellow Envelope bill is something that must be done.'
The legislation has a long history. First proposed in 2015, progressive lawmakers have attempted to revise the labor union law for many years, but have failed to pass it due to opposition from conservative parties and business groups. In 2023 and 2024, the bill passed the Democratic Party-controlled Assembly but was vetoed twice by then-President Yoon Suk Yeol.
Now, the Democratic Party is determined to pass key bills that were previously derailed by Yoon's veto. A revision to the Commercial Act, which was also vetoed during Yoon's term, was approved by the Cabinet on Tuesday and is now awaiting the final step of presidential promulgation.
Jin Sung-joon, chair of the Democratic Party's policy committee, said last week that President Lee personally urged lawmakers to expedite the passage of key bills, including the Yellow Envelope bill.
The push received another support from Kim Young-hoon, President Lee's nominee for labor minister, who formerly led the country's largest umbrella union group, the Korean Confederation of Trade Unions.
In documents submitted to the parliamentary Environment and Labor Committee last week, Kim highlighted the revision as the "most urgent."
Rejecting the claim that the bill is "bad legislation," Kim stressed that the revision is not to encourage "indiscriminate bargaining, but to clarify who bears real responsibilities of employers and to institutionally supplement a legitimate bargaining structure so that negotiations are no longer considered illegal."
Regarding the provisions on the damages for losses, Kim said the goal is to hold parties accountable for illegal acts while ensuring that damage claims are proportionate to their authority and responsibility, so that union activities are not discouraged by excessive damage claims.
The KCTU is planning mass rallies on Wednesday and Friday to demand the bill's full and immediate passage.

'Two key reforms, labor flexibility and CEO risk, are essential to improving competitiveness,' he said, urging lawmakers to 'take sufficient time to reflect industry input' ahead of Korea hosting the Asia-Pacific Economic Cooperation in the fall. The labor minister said he understood corporate concerns over the planned changes to Articles 2 and 3 of the Labor Union Act and vowed continued engagement before the law takes effect. "To help address these concerns and prevent misunderstandings, we will establish a dedicated task force with AmCham and other industry representatives to ensure continuous dialogue and incorporate industry input into policy discussions," he said. Over the next six months, the government will work with labor and management to reduce uncertainties, the minister said, adding it will issue detailed guidelines to help contractors and subcontractors strengthen partnerships, settle disputes and achieve 'sustainable growth through cooperation and mutual benefit.'

Constitutional reform set as top agenda for Lee administration
Committee proposes disbandment of Supreme Prosecutors' Office by 2030, sets AI as future growth engine The State Affairs Planning Committee, acting as a de facto transition team for President Lee Jae Myung, announced Wednesday that amending the Constitution will be the top priority among 123 agenda items in his policy blueprint. The committee added that the proposed reform aims to reinforce the constitutional principle of popular sovereignty. Also outlined in the Lee administration's blueprint were a reform of the prosecution, as well as ways to increase South Korea's potential economic growth rate to 3 percent, in large part through a wider adoption of artificial intelligence. This would be achieved by leveraging the country's human talent, along with more than 50,000 graphics processing units, a next-generation power grid and a transition to renewable energy. Some 210 trillion won ($151.8 billion) in fiscal spending will be directed over the next five years to achieving the 123 policy goals. "Ending the 1987 Constitution, (the Lee administration) will push to amend the Constitution based on citizen participation to open a new era," Rep. Lee Hae-sik of the ruling Democratic Party of Korea, a member of the committee, told a briefing to the nation held at Cheong Wa Dae, the former presidential compound in Seoul. The committee did not elaborate on the direction or a timeframe of the amendment, but Lee has previously hinted at allowing South Korean presidents to serve two four-year terms instead of the current, single five-year term. During the presidential campaign, Lee and his Democratic Party of Korea suggested introducing a new presidential system through constitutional reform that the party said would curtail the power of the South Korean president. Under the proposal, presidents would be allowed to serve two four-year terms, with the re-election contest after the first term serving as a referendum on the sitting president's performance. In addition to the change in the presidential term limit, Lee, during his presidential campaign, floated a new system of stronger constitutional checks on presidential power: Parliament would recommend candidates for prime minister, and the president's exercise of veto power would be restrained. Following his inauguration in June, Lee expressed an intent to carry out constitutional reform as South Korea marked the 77th Constitution Day in July. Lee also wrote on Facebook that the newly amended Constitution would uphold the spirit of the Gwangju Democratic Uprising in May 1980 and encompass the greater fundamental rights of each citizen and the greater local autonomy. If implemented as planned, the constitutional amendment would be the first since the current Constitution was ratified in 1987, which introduced a single five-year presidential term. Many of Lee's predecessors -- Moon Jae-in, Park Geun-hye, Lee Myung-bak and the late Roh Moo-hyun -- have floated constitutional reform, but none of their proposals bore fruit. Disgraced former President Yoon Suk Yeol also expressed a willingness to entrust his presidential powers to the then-ruling People Power Party in December, after his sudden imposition of martial law threw South Korea into political turmoil. Prosecutorial reform Also among the 123 policy goals of the Lee administration is its widely-anticipated push for a major reform to curb the power of South Korean law enforcement institutions such as the prosecution and police. By 2030, the Supreme Prosecutors' Office will be disbanded, and the organization will be split into two. One will be dedicated to investigating serious crimes while the other will be dedicated to filing indictments of criminal suspects. This is largely in line with the liberal bloc's claim that the prosecution's power to both investigate criminal cases and bring suspects to court has often led to politically motivated persecutions. The police will also strive for political neutrality in part by abolishing the police bureau at the Ministry of Interior and Safety, which was established in 2022 during former President Yoon's term, according to the committee. Also by 2030, South Korea will champion the mass adoption of AI, with the goal of becoming a "top-three AI powerhouse," according to the committee. Furthermore, an "electricity highway" will be built along the western coast of the Korean Peninsula, so that industrial complexes powered by renewable energy, aligned with initiatives such as RE100, can thrive along the new power grid infrastructure. A leap forward through such technological advancements, coupled with blueprints for inclusive economic growth and market fairness, will allow South Korea to break away from the low-growth trap and achieve a potential economic growth rate of 3 percent during Lee's term. The State Affairs Planning Committee, currently led by Lee Han-joo, a longtime aide to Lee, will wrap up its two-month run on Thursday. According to the committee, the policy accomplishment will be managed jointly through the presidential office, the Office of the Government Policy Coordination and a newly established presidential committee on national futuristic strategy.

Proposed Cho Kuk pardon a two-edged sword for Lee
President Lee Jae Myung faces a political dilemma over whether to grant a Liberation Day pardon to Cho Kuk, the former justice minister and leader of the minor Rebuilding Korea Party, as he returns from a weeklong summer break. On Thursday afternoon, the Justice Ministry's Pardon Review Committee convened to discuss recommendations for pardons. Former Rebuilding Korea Party leader Cho Kuk and his wife, former Dongyang University professor Chung Kyung-shim, are widely believed to be included on the list. Cho was convicted of fabricating official documents to help his children's academic careers, as well as illegally interfering in a government audit. Chung was convicted of several charges related to fraudulently helping her children and financial crimes. The final call now lies with Lee, but reports that the committee had decided to include Cho has already sparked a significant backlash. Lee is scheduled to review and approve the special pardon list at a Cabinet meeting on Aug. 12. And Lee will announce the beneficiaries of presidential pardon on Aug. 15, National Liberation Day. South Korean presidents have issued pardons to commemorate important national holidays, such as the Liberation Day celebrating Korea's 1945 independence from Japanese colonial rule, to reward the good behavior of offenders and foster national harmony. Cho, who served as a senior aide to former President Moon Jae-in and as justice minister in 2019, began his two-year prison term in December after the Supreme Court upheld his conviction on charges of academic fraud involving his children and unlawful interference in a government inspection. The mooted pardon for the minor progressive party leader is seen as a double-edged sword. Should Lee decide to pardon Cho, it could boost support from left-leaning voters. But clemency toward a man who illegally helped his children get university places could also undermine Lee's commitments to fairness in society, potentially sapping the momentum of his administration in its early stages. Multiple progressive lawmakers and religious leaders, including the Ven. Jinwoo — president of the Jogye Order of Korean Buddhism — publicly called for the pardon of Cho, as they view him as a victim of prosecutorial manipulation. Rep. Jeon Yong-gi of the ruling Democratic Party of Korea also backed Cho's pardon, explaining that Cho and his family suffered greatly from a political 'witch hunt' led by former President Yoon, who was prosecutor general at the time of the investigation. With former President Moon also publicly calling for Cho's pardon after a meeting with Woo Sang-ho, senior presidential secretary for political affairs, on Tuesday, a ruling party official reportedly said that unity among the Democratic Party of Korea and Rebuilding Korea Party could be achieved with the pardon. And Lee could face significant repercussions if Cho is not pardoned. The anonymous official was quoted by the Korean-language daily Chosun Ilbo as saying that refusing to grant the presidential pardon was likely provoke strong criticism from the ruling party's support base and that this risk could not be ignored. Split on Cho Pardon The main opposition People Power Party's interim leader Song Eon-seog expressed his anger at the suggestion of pardoning Cho. 'We are outraged that Cho, who has been widely condemned by the public, was included in the Liberation Day special pardon (list),' Song told the reporters in a press briefing on Thursday. Rep. Joo Jin-woo of the People Power Party also put pressure on Lee after posting an online message, claiming Lee's administration will be labeled as unjust government if Cho's pardon is approved. As Cho's convictions include using his influence to receive academic favors for his children, his rumored inclusion on the ministry list sparked outrage among some parents and students, especially Suneung test-takers. Suneung is South Korea's nationwide college entrance exam. An online post titled 'They're not going to pardon someone involved in academic fraud, right?' uploaded in a local student-based online community Pnmath Mathematic Lab, received multiple comments opposing Cho's pardon. A poll on the issue suggests the public sentiment does not lean clearly for or against pardoning Cho. In a three-day poll conducted by local polling company Jowon C&I and media outlet Straight News from Aug. 2 involving 2,018 participants, 48 percent of the people reportedly supported the special pardon for Cho, while 47.6 percent opposed it. The presidential office, meanwhile, remained tight-lipped about whether Cho would be granted a pardon. 'It is difficult to know until the president makes his final decision. The special pardon list will likely be available when the list is finalized after the Cabinet meeting,' presidential spokesperson Kang Yu-jung said during a press briefing Thursday.
