Family seeks justice after drunk driver charged lightly in marathon runner's death

The late Sue Lynn.
KOTA KINABALU (Aug 12): The family of marathon runner Sue Lynn is urging authorities to reinstate a more serious charge against a driver accused of causing her death in a drunk-driving incident.
On 29 January 2025, at about 6am, the 44-year-old athlete was fatally struck by a Honda City while running towards Donggongon Shopping Mall. The driver, a 21-year-old man, was alleged to have been intoxicated.
Police initially investigated the case under Section 44(1) of the Road Transport Act — drunken driving causing death — but the driver was later charged only under Section 45A, which covers drunken driving without causing harm or death.
Through legal counsel M.S. Shah & Associates, the family is seeking to have the charge amended back to Section 44(1).
The case was first mentioned at the Magistrate's Court here on 11 July 2025, with the second mention set for 21 August 2025.
Sue Lynn, a mother and dedicated athlete, had been training for upcoming marathons with hopes of competing internationally. Her death has prompted calls for stronger road safety measures and better protection for joggers in Sabah.
The family is appealing for public support in sharing her story, media coverage to raise awareness, and for authorities to ensure justice is served.

Two secondary schoolgirls charged with assault and unlawful confinement in Sungai Petani

SUNGAI PETANI: Two 13-year-old girls pleaded not guilty in the Magistrate's Court here today to charges of assault and unlawful confinement of a schoolmate. The Form One students denied the joint charges read before Magistrate Mohamad Azlan Basri. Lawyer N Nagaratnam, representing both accused, confirmed the first charge involved injuring the victim in a school toilet on July 14. The charge falls under Section 323 of the Penal Code, punishable by up to one year in jail, a RM2,000 fine, or both. The second charge alleges wrongful confinement of the victim at the same location and time. This offence is under Section 342 of the Penal Code, carrying similar penalties. Deputy public prosecutor Nur Hazwani Md Nor sought RM4,000 bail for each accused. Nagaratnam requested a reduction, citing the students' status. The court set bail at RM2,000 each with one surety and barred contact with the victim. The case will be mentioned again on September 23. Earlier reports indicated a Form One student was allegedly bullied by schoolmates. The victim was found in a school toilet with hands and feet tied and mouth gagged. In a separate case, two 15-year-old boys admitted to assaulting a 16-year-old schoolmate. Lawyer Farah Azlinda Zahari stated the offence occurred on July 21 at a school here. They were charged under Section 323 of the Penal Code. Sentencing was deferred pending character reports, with the next hearing on October 28. Bail was set at RM1,000 each with one surety. Nur Hazwani Md Nor prosecuted the case. - Bernama

Arsonist for Singapore loan shark nabbed after fatal Johor blaze

JOHOR BARU: A Singapore-based loan shark's hired arsonist has been arrested for a house fire that killed a 72-year-old woman in Segamat last month. Johor police chief Commissioner Ab Rahaman Arsad said the 21-year-old suspect and his 19-year-old girlfriend were detained in Subang Jaya, Selangor, about a week after the incident on July 25. Investigations showed the man was paid RM1,000 to hurl a Molotov cocktail at the intended victim's home in a debt-related intimidation attempt. The blaze destroyed five houses and caused an estimated RM1.2 million in losses. The intended victim was not home, but the fire spread to a neighbouring house, trapping and killing the elderly woman. "We seized a car, mobile phones, clothing, face masks, gloves, a lighter, pieces of cloth, and a petrol container believed to have been used in the crime," Ab Rahaman said at a press conference at the Johor police contingent headquarters today. The woman was released on bail as a prosecution witness. Her boyfriend will face 13 charges, including murder without intent under Section 304B of the Penal Code, arson under Section 436, and four counts of criminal intimidation under Section 507. Nine charges will be filed in the Segamat Magistrate's Court tomorrow, with the remainder in Johor Bahru. Police believe the suspect had been active in Johor and Selangor since July, targeting debtors on behalf of the syndicate, which is based in Singapore but operates locally.
