AgustaWestland: Enforcement Directorate says Christian Michel's plea for release 'misleading'

(ED) on Tuesday informed a court that the plea of alleged middleman Christian Michel James for release in the AgustaWestland VVIP chopper case was "misleading and devoid of any merits."
Special judge Sanjay Jindal was hearing James' plea for release on the ground that he had undergone the maximum period of sentence of seven years for the purported offences.

The EDs in its reply said, "That with respect to the submissions made by the accused Christian Michel James that he has already undergone the period of maximum sentence prescribed for the offences for which he was extradited to India from United Arab Emirates, so, he is entitled to be released by virtue of the provisions of section 436 A of CrPC it is most respectfully submitted that the aforesaid submissions are misleading and devoid of any merits."
Section 436 A of the erstwhile CrPC deals with maximum period for which an under trial prisoner can be detained.
The ED reply said under the prevention of money laundering act (PMLA) provision, the the maximum sentence prescribed for the offence of money laundering was seven years.

"The date of the arrest in the present case being December 22, 2018, the maximum period of imprisonment provided for the offence has yet not expired and therefore the present entitlement sought by the accused under the provisions of section 436A of CrPC is premature and is therefore liable to be dismissed," it added.
On August 4, the ED and CBI opposed the plea of Michel's counsel Aljo K Joseph that he was entitled to be released under provisions of Section 436A of the CrPC.
James was extradited from Dubai in December 2018 and was subsequently arrested by the CBI and the ED.
He was granted bail in the CBI case by the Supreme Court on February 18 this year.
Two weeks later, he was granted bail in the ED case by the Delhi High Court.
Michel, however, has not furnished bail bonds and remains in Tihar prison, awaiting the renewal of his passport.
The ED chargesheet led against James in June 2016 alleged that he received 30 million euros (about Rs 225 crore) from AgustaWestland.

Rajasthan: CBI rescues minor girl kidnapped from West Bengal two years ago
New Delhi, Aug 9 (PTI) The CBI has rescued a minor girl from Pali, Rajasthan, who was allegedly kidnapped from West Bengal's Bardhaman two years ago, and was 'sold' twice on the pretext of marriage, officials said Saturday. The CBI has arrested five accused in the case and it suspects that the alleged kidnapping was part of a bigger human trafficking network, they said. The girl, who was kidnapped on August 9, 2023 after leaving home for a tuition class, was found to be living at the residence of one of the accused in Pali. The central probe agency was roped in by the Calcutta High Court through a order on February 16, 2024 on a plea of the victim's mother. The case was initially investigated by the West Bengal CID and was handed over to the CBI amid concerns over the girl's safety and the suspected nature of her disappearance. The CBI developed intelligence through its sources and call data record (CDR) analysis which pointed sleuths towards Rajasthan. A CBI team raided the premises in Pali on August 7, where the girl was living, they said. 'The investigation has revealed that the missing girl was a minor when she went missing and was shown as a major in the affidavits created for her marriage. She was sold twice for marriage. It is suspected that this incident could be part of a big human trafficking network," a CBI spokesperson said in a statement. The CBI arrested five accused, who were produced before a special court in Pali on Friday, which sent them on transit remand for three days to be produced before district and sessions judge at Purba Bardhaman (West Bengal), the statement said. The Delhi consumer forum has found Indigo Airlines guilty of deficiency in service for allotting an unhygienic and stained seat to a woman passenger, ordering the airline to pay ₹1.5 lakh as compensation for the discomfort, pain, and mental distress caused. In response, Indigo said it had addressed the problem by assigning her a different seat, which she accepted and used to complete her journey to New Delhi. However, in its order dated July 9, recently made public, the forum stated, 'We hold that the opposite party (Indigo) was guilty of deficiency in service.' Live Events 'As regards the discomfort and pain, mental agony suffered by her, we are of the view that she must be compensated. We accordingly direct the opposite party to pay Rs 1.5 lakh as compensation for mental agony, physical pain and harassment to her,' it added. The commission also instructed the airline to pay ₹25,000 towards litigation costs. In its observations, the forum noted that Indigo had failed to produce the Situation Data Display (SDD) report, a part of its internal operational records maintained under standard aviation protocols. 'There is no reference to this report in the written statement or in the evidence filed by the opposite party. The SDD is a crucial document used for flight operation monitoring and to record passenger-related incidents. J-K Police searches 26 houses in massive crackdown on terror ecosystem in Kishtwar
The Jammu and Kashmir Police on Saturday conducted searches at 26 houses, including that of Hizbul Mujahideen terrorist Mohammad Amin Bhat alias "Jehangir Saroori", in a massive clampdown on the terror ecosystem in the Kishtwar district, officials said. "Multiple police teams were deployed simultaneously across Kishtwar, Chatroo, Dachhan, and Atholi targeting hideouts and residential premises of terrorists and their associates," he said. "The raids were aimed at disrupting the local support network for cross-border terrorists, gathering actionable intelligence related to anti-national activities, and sending a strong deterrent message to individuals or groups engaged in supporting or sheltering such elements," the spokesperson said. During the searches, police teams examined targeted premises for electronic devices, documents, and other material evidence linked to terror financing, radicalization, and cross-border communication, he said. "Police remains firmly committed to ensuring the peace, stability, and security of the district. Any person found involved in aiding or harboring terrorists will face strict legal action," the SSP Kishtwar said, reiterating the force's zero-tolerance stance against terrorism . He said the operation forms part of a sustained counter-terror strategy aimed at dismantling terrorist infrastructure, Over Ground Workers (OGWs) network and severing logistical support channels to anti-national elements.
