Setback to lenders: NCLT replaces RP in Anil Ambani's loan guarantee case

.
NCLT appointed Prashant Jain as the new RP.
In Sept 2016, Ambani had given a personal guarantee for a Rs 1,385-crore loan, which was retrospectively classified as an NPA effective late Aug 2016. Kothari was appointed RP in Aug 2020. A few days after his appointment, the RP sought multiple details from Ambani, including details of a case in a British court. The insolvency action had been challenged in Delhi HC and the SC.
In May 2021, the RP filed his report in NCLT, recommending admission of company petition for insolvency resolution despite Ambani's lawyer seeking more time, citing restricted mobility due to Covid. A few days later, Ambani's lawyer wrote that the RP can only seek information from SBI. Meanwhile, the businessman's writ petition in SC was tagged along with one Surendra Jiwarajka, which was finally decided in Nov 2023.
Ambani has accused the RP of "acting in undue haste and denying him fair and proper opportunity" to provide information. Besides, the RP is accused of exceeding the mandate under IBC in seeking "unrelated information". The RP denied the charges and SBI supported it, while arguing that the matter had been pending with NCLT for a long time and the case was being delayed.
In its order on July 15, the benchsaid that in light of Covid-related disruptions, Ambani should have been given "a fair opportunity" to provide information to the resolution professional.
"Instead, we note that the RP didn't even wait for adjudication of his application pending before this Tribunal seeking relaxation of 10 days' timeline and a cross application of the applicant before this Tribunal requiring more time in view of Covid restrictions.
"
"Though, we do not find any negligence or explicit bias on part of the RP in this case, however, we are of considered view since the insolvency resolution process after commencement has to be run in close coordination of debtor and RP," it said.

Amit Shah comes to Lok Sabha armed with proof on Pahalgam attackers
NEW DELHI: The three Pakistani terrorists who gunned down 26 civilians, including 25 tourists, in J&K's Pahalgam in front of their horror-struck families, were cornered and killed on Monday in a joint operation by the Army, CRPF and police in Dachigam area on the outskirts of Srinagar, home minister Amit Shah disclosed in Lok Sabha on Tuesday. Participating in the debate on Operation Sindoor, Shah identified the three attackers killed in 'Operation Mahadev' as Suleman alias Faizal Jatt alias Anas alias Usama Markaz; Hamza Afghan; and Jibran, all Pakistanis and affiliated to the Lashker-e-Taiba (LeT). Suleman, a top-grade LeT commander and the mastermind of the April 22 Pahalgam attack, was also involved in the Oct 2024 attack at the Z-Morh construction site in Gagangir, in which six labourers and a local doctor were killed, he said. Both Hamza and Jibran were also 'A-grade' LeT terrorists. The three were identified by family members of two locals arrested on June 22 by NIA - Parvaiz and Bashir. The duo had provided food and shelter to them at their 'dhok (seasonal hut)' some 2km from Baisaran prior to the attack. A source said they were paid around Rs 3,000 by the terrorists. The neutralisation of all three Pahalgam attackers marks the culmination of a massive manhunt, which started with Shah's instructions to the forces at a security meeting on April 23 to not allow them to escape to Pakistan. As many as 1,055 eyewitnesses and suspects were questioned by NIA and other agencies over 3,000 hours, and sketches of the terrorists were prepared. Shah said it was on May 22 that human intelligence on presence of the assailants in Dachigam area was received. Technical surveillance was mounted by the Army and Intelligence Bureau to capture 'Ultra' signals of communications between the terrorists and their handlers in Pakistan. "IB, Army and CRPF personnel traversed on foot in cold and high altitudes to receive the signals. On July 22, we got success through sensors, and the location of the terrorists was confirmed. Himachal makes dope testing for ‘Chitta' mandatory in police recruitment
Days after Himachal Pradesh Governor Shiv Pratap Shukla expressed concern about the drug menace in the State, Chief Minister Sukhvinder Singh Sukhu on Tuesday said his government has adopted a zero-tolerance policy towards the drug menace, even as it decided to introduce mandatory dope testing for 'Chitta' (heroin) during police recruitment. He made the remark during the Cabinet meeting held under his chairmanship in Shimla. The Departments of Police, Social Justice and Empowerment, and Health elaborated the steps being taken to combat drug abuse in Himachal Pradesh. 'The State government has adopted a zero-tolerance policy towards the drug menace and is fully committed to protecting the youth from falling victim to drug abuse,' said Mr. Sukhu, adding that there's an urgent need of coordinated actions to dismantle drug networks to protect the youth of the State from addiction. The Cabinet decided to introduce mandatory dope testing for 'Chitta' (heroin) during police recruitment. Besides, all new government employees will be required to submit an undertaking confirming they do not consume 'Chitta', said an official statement, adding that strict action would be taken against any government employees found involved in drug-related activities. 'It was informed during the meeting that the drug abuse situation in Himachal Pradesh remains under control, with Narcotic Drugs And Psychotropic Substances (NDPS) Act, 1985 cases accounting for nine percent of total cases, significantly lower than Punjab's 20%. Under the tenure of the present government, 45 cases were registered, and properties worth Rs 42.22 crore belonging to individuals involved in drug-related activities were attached. This marks a more than two-fold increase in the number of cases and a three-fold increase in the value of properties seized as compared to previous periods,' it added. The Chief Minister directed the Health Department to intensify its efforts in capacity building, awareness generation, treatment, counseling, follow-up, and rehabilitation of individuals affected by drug addiction. Besides, he emphasized the need for a coordinated approach, asking all concerned departments to work jointly in waging a comprehensive war against substance abuse. He also stressed the importance of regular interstate border monitoring to prevent drug trafficking.
