Karnataka High Court sets aside single judge order on differential property fee

BENGALURU: The Karnataka High Court on Wednesday stayed the order passed by the single judge, who set aside the amendment to the Bruhat Bengaluru Mahanagara Palike Act to permit levy of fees for plan sanction, issuance of completion and occupancy certificates and ground rent, based on the guidance value or market value of the properties.
However, the division bench clarified that the amount already collected on those heads has to be refunded, if the BBMP fails in its appeal filed before the court against the single judge's order.
A division bench of Chief Justice Vibhu Bakhru and Justice CM Joshi passed the interim order after hearing the appeal filed by the BBMP questioning the single judge's order dated June 5. The single judge passed the order while disposing of the petitions filed by Sapthagiri Shelters and several individual property owners and land developers.
The single judge observed that a uniform rate can be collected depending upon the size of the plot and the extent of constructions and services related to sanction of plan for building construction rendered by the BBMP has nothing to do with the market value of the property or any logic in linking rates with the guidance value of the properties in different areas, notified by the government under the Karnataka Stamp Act for collection of stamp duty.
Declaring that the linking of the fee, leviable under Rule 37-A of the Karnataka Planning Authority Rules, 1965, to the market or guidance value for development of building or land or sanction for sub-division of plot or layout of Private Street under the Karnataka Town and Country Planning Authority Act, is illegal, the single judge had given liberty to the State Government and the BBMP to refix a standard fee after collecting empirical data.

In what is being called a major software blunder, the Bruhat Bengaluru Mahanagara Palike (BBMP) has issued over 31,000 notices to flat owners across the city, citing underpayment of property tax due to the inclusion of car parking areas in the calculation of taxable carpet area. The controversy stems from a flaw in the BBMP's e-khata software, which reportedly misinterpreted the built-up area, wrongly factoring in parking slots as part of the 'carpet area", thereby inflating the tax liability for many homeowners. Flat owners, many of whom had considered the e-khata process a step toward transparency, now find themselves facing tax demands ranging from a few thousand to several lakhs of rupees. In several cases, residents allege that these notices have been issued without any verification of original property documents. A flat owner from South Bengaluru told The Times of India that BBMP has demanded tax on a parking space nearly the size of his actual flat. 'They didn't even verify the documents. The notice just arrived out of nowhere," he said. In Yelahanka, Vijay Kumar claimed the issue goes deeper. 'When I registered my 1,700 sq ft flat under e-khata, BBMP staff told me to declare only 1,500 sq ft and hinted at a bribe of Rs 500. Now I've been slapped with a notice. How is this fair?" he asked. Another resident, Rekha Bhatt from Mysore Road, received a notice accusing her of tax evasion, stating that her reassessed tax exceeds the previous amount by over 5%, breaching the acceptable threshold. She said that she is being penalised for simply following the BBMP's own online process. The backlash has triggered widespread resentment from many property owners who argued that the fault lies not with them but with the BBMP's flawed systems and opaque procedures. Legal experts and resident welfare associations are now weighing their options. Responding to the outrage, BBMP Special Commissioner (Revenue) Munish Moudgil acknowledged the confusion and said, 'This is not about penalising anyone unfairly." He said that earlier, taxes were being paid based on carpet area as recorded in the EPID system but, when applying for e-khata, applicants included parking areas, which are legally taxable. 'We're only recovering what is legally due," he added. Flat owners, however, are demanding a rollback of the notices and an overhaul of the e-khata assessment procedure. The Karnataka High Court on Monday continued hearing appeals filed by bike taxi aggregators Ola, Uber and Rapido, along with others, challenging a single judge's April 2025 decision. The ruling stated that bike taxi services could not operate in the state unless the state government notified specific guidelines and rules under the Motor Vehicles Act. A Division Bench comprising Chief Justice Vibhu Bakhru and Justice CM Joshi addressed the matter, specifically questioning the state govt on whether it had intentionally decided to disallow bike taxis. The state's counsel argued that the Motor Vehicles Act does not permit bikes to be used as taxis. However, the Court dismissed this argument as 'thin', noting that several states allow bike taxis under the same statute applicable across India. During the hearing, Senior Advocate Uday Holla, representing Roppen Transportation Services (Rapido), contended that the single judge assumed, though not pleaded, that the state govt had a policy against bike taxis. He argued that if such a policy exists, it contravenes the statute, which permits motorbikes as taxis. Holla further highlighted that various states, including Rajasthan, Bihar, Uttar Pradesh, Uttarakhand, Madhya Pradesh, West Bengal, Haryana and Orissa, permit bike taxis. Addressing the convenience of bike taxis, Holla stated, 'Today, Bangalore Metro has just two lines (in Bangalore)...Bike taxis help commuters and are a matter of easy convenience. The single judge has also said that the State government must be alive to the changes coming in society. Now, how will commuters access motorbikes? Without aggregators, motorbikes will just be running all around. But if there is an aggregator, bikes can be made accessible. You see how convenient bike taxis are, you get one in a minute or two.' He also mentioned that earlier whiteboards were issued to bike taxis and suggested that establishing guidelines would create a regulatory framework. Emphasising the role of aggregators in ensuring commuter safety, Holla added, 'If aggregators are not there, who will check the background of the drivers? Aggregators add to the entire mechanism... They check the antecedents of the drivers.' He also claimed that bike taxis reduce traffic congestion, citing media reports indicating increased traffic following the disallowance of bike taxis in the state.

Stock Market today: Broader markets witnessed a decline on Wednesday after Reserve Bank of India (RBI) governor Sanjay Malhotra's rate pause decision failed to impress D-street investors. The RBI MPC maintained the repo rate at 5.5 per cent and retained a 'neutral' policy stance. At 10:40 AM, Nifty Midcap 100 was trading at 56,688.75, down by 0.91 per cent. Coforge, BHEL, Prestige Estates, Bharti Hexacom and Housing and Urban Development Corp. (Hudco) were among the top laggards from Nifty Midcap. Nifty Smallcap experienced a sharper drop, down by 1.07 per cent, quoting 17,674. The index was dragged by Redington, Reliance Power, Kaynes tech, PG Electroplast and Piramal Pharma. Meanwhile, BSE Sensex was trading at 80,526.68 level, down by 184 points or 0.23 per cent. Whereas, Nifty50 was trading at 24,570.35 level, down by 79 points or 0.32 per cent. All sectoral indices were trading in red as investor sentiment remained jittery post the RBI's interest rate decision. Nifty Realty was the worst-performing index, down by 2.34 per cent, trading at 886 level. Nifty IT followed suit and was down by 1.53 per cent, trading at 34,497 level. Analysts noted that the central bank's move was more of a non-event for the markets, with uncertainty surrounding tariffs having a greater impact on investor sentiment. On top of this, the GDP growth projection for FY26 now stands at 6.5 per cent, slightly lower than the previous estimate of 6.7 per cent. "(RBI's rate stance) This cautious approach reflects concerns over global trade uncertainties, particularly the US's 25 per cent tariffs on Indian exports. This policy decision is largely a non-event for markets, which are now expected to shift focus to U.S. tariff impacts, upcoming U.S. economic data, and foreign institutional investor (FII) flows," said Santosh Meena, head of research at Swastika Investmart. Trump tariff Uncertainty Besides the RBI's rate pause decision, what is adding to the D-street's nervous sentiment is Trump's recent comments on a tariff hike. The US president has threatened the imposition of "substantially" high tariff rates on Indian imports in the next 24 hours. 'India is not only buying massive amounts of Russian Oil, they are then, for much of the Oil purchased, selling it on the Open Market for big profits. They don't care how many people in Ukraine are being killed by the Russian War Machine. Because of this, I will be substantially raising the Tariff paid by India to the USA,' Trump wrote in a social media post. This has further impacted the overall market mood as India, in a worst-case scenario, might face a higher tariff rate as compared to its peer nations, incase a trade deal is not reached between both nations. Inflation risk still looms While inflation levels are well below the central bank's target, Malhotra pointed out that upside risk still lingers owing to geopolitical uncertainty playing in the background, coupled with uneven weather patterns. Moving forward, D-street analysts believe that the RBI's tone will likely remain cautious. "The central bank has rightly highlighted the upside risks to inflation from global crude prices, erratic monsoons, and supply-side uncertainties, even as the domestic macro backdrop remains resilient. With core inflation moderating and economic activity holding up—evident from robust GST collections, credit growth and PMI readings—the RBI is likely to remain data-dependent and cautious," said Sonam Srivastava, founder and fund manager at Wright Research PMS.
