Ex-oil company exec charged with over RM400,000 in bribes

SHAH ALAM: A former transport management head at an oil exploration company pleaded not guilty in the Sessions Court here Tuesday (July 8) to 12 charges of accepting bribes amounting to over RM400,000 between 2021 and 2023.
Mohd Khairil Mohd Anuar, 41, faces seven counts of receiving RM367,000 in cash and four counts involving electronic items worth RM36,168. He is also accused of accepting RM23,000 to cover renovation costs at his home in Bandar Bukit Mahkota, Hulu Langat.
The alleged bribes were received from a company's chief operating officer and senior executive as inducement to provide technical assessments in support of payment claims. The offences were said to have taken place at several locations in Hulu Langat, Ampang and Kuala Lumpur between June 2020 and 2023.
All charges are framed under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable by up to 20 years' imprisonment and a fine of not less than five times the amount of the bribe or RM10,000, whichever is higher.
In a separate charge, Mohd Khairil also pleaded not guilty to money laundering involving RM90,000, allegedly used to purchase three land lots totalling 5.21 hectares in Hulu Perak on Nov 25, 2020, at the Pengkalan Hulu district and land office.
The charge falls under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, which carries a penalty of up to 15 years in prison and a fine of at least five times the value of the proceeds or the instrument of the offence at the time it was committed, or RM5mil, whichever is higher.
MACC deputy public prosecutor Mohd Radzi Shah Ab Razak proposed bail of RM60,000 to RM80,000 with conditions including surrendering the accused's passport and monthly reporting to MACC Putrajaya.
Defence counsel Syed Naqiuddin Shahab requested RM40,000 bail, citing his client as the sole breadwinner and cooperative during investigations.
Judge Awang Kerisnada Awang Mahmud set bail at RM70,000 with one local surety residing in Selangor or Kuala Lumpur. The accused must surrender his passport, report monthly to MACC Putrajaya and refrain from contacting prosecution witnesses.
The case is set for mention on Aug 18. - Bernama

No excuses: Nga said the law applies equally to everyone including foreign nationals found guilty of littering in public spaces. — Bernama LITTERBUGS can now be fined up to RM3,000 for repeat offences following the passing of amendments to the Street, Drainage and Building Act. Under the amended law, the fine for a first offence has been raised from RM500 to RM2,000, while second and subsequent offences will carry a penalty of up to RM3,000. The previous limit was RM1,000 for subsequent offences. Pet owners who fail to clean up after their animals would also be liable under the new law, as their waste is considered litter in public. Other new penalties is the introduction of community service as an additional punishment, allowing courts to impose up to 12 hours of unpaid work on minor offences. However, the courts are required to consider the offender's physical and mental condition and explain the consequences of non-compliance to the person. For offenders under the age of 18, subsection 47(1H) of the amended Act stipulates that community service provisions under the Child Act will apply. Clause 3 of the Bill also amends Section 48 to redefine 'child' as a person under 18, and 'community service' as any unpaid work or task aimed at maintaining or enhancing public cleanliness. Clause 4 introduces a new Section 125A, granting powers to authorised officers of local authorities to supervise the implementation of community service orders issued under subsection 47(1A). Housing and Local Government Minister Nga Kor Ming said the amendments would complement the recently passed Solid Waste and Public Cleansing Management (Amendment) Bill and the Local Government (Amendment) Bill. Under the Solid Waste and Public Cleansing Management (Amendment) Bill, failure to comply with court-ordered community service may result in fines ranging from RM2,000 to RM10,000, as stipulated in subsection 77B(6). As for the Local Government (Amendment) Bill, it will empower the Local Government Department to issue standard operating procedure to all local authorities to ensure uniform implementation of community service sentences for people convicted of littering. All these amendments collectively aim to strengthen the legal framework to combat public littering by authorising courts to issue community service orders as punitive measures, Nga said. He said the law applies equally to everyone including foreign nationals found guilty of littering in public spaces. 'Imagine if a Datuk Seri or Tan Sri is ordered to sweep the streets under a community service order. This would certainly raise public awareness on the importance of maintaining cleanliness,' he said when wrapping up the debate on the amendments. Through the enforcement of such orders, Nga expressed confidence that littering – often the cause of clogged drains and flash floods – could be significantly reduced, especially in urban areas. Nga said that the amendments are necessary to provide the Federal Government with clear legal authority to regulate the matter and empower local authorities to enforce community service penalties effectively. The Street, Drainage and Building (Amendment) Bill was passed by a majority voice vote after 10 MPs took part in the debate. Nga also announced that starting Jan 1 next year, all shopping malls nationwide will be required to provide recycling facilities at their premises in order to obtain business licences. This new condition will be enforced by local authorities as part of the government's broader push for sustainable waste management.

KUALA LUMPUR: Any individual who comes forward to provide information on any improper conduct cannot be blocked or threatened by any party, including the authorities. Deputy Minister in the Prime Minister's Department (Law and Institutional Reform) M. Kulasegaran said this was because the authorities should protect whistleblowers under the Whistleblower Protection Act 2010 (Act 711). 'I have taken note of Albert Tei's lawyer today, regarding the allegation that Albert Tei had contacted the Malaysian Anti-Corruption Commission (MACC) regarding a corruption scandal but was warned by MACC officers not to appear in public or he would face problems. 'This is a very serious allegation and is completely unacceptable... I would like to advise the individual named Albert Tei to immediately file a report regarding this issue with the Royal Malaysian Police and the MACC Complaints Committee under Section 15 of the MACC Act 2009 (Act 694) by naming the MACC officers involved in the allegation. 'I give full assurance that the MADANI Government will not compromise on issues of threats like these, and that stern action will be taken if the allegation is found to be true,' he said when winding up the debate on the Whistleblower Protection (Amendment) Bill 2025 in Parliament on Tuesday (July 22). The bill was later passed with a majority of votes in agreement after being debated by 24 Members of Parliament (MPs). During the debate on the bill, several MPs raised the issue of a media report today regarding a statement by Albert Tei's lawyer, Mahajoth Singh, who claimed that his client was warned by the MACC not to come forward before he exposed the mining scandal in Sabah. Regarding the Whistleblower Protection Committee in the amendment to the bill, Kulasegaran said the government would ensure that the committee's membership was free from conflicts of interest and of a high calibre. He said that among the proposed members would be parties with knowledge and expertise in the aspect of whistleblower protection, including non-governmental organisations (NGOs) or civil society organisations (CSOs), as well as academic experts. 'This will ensure independence, transparency, no conflict of interest, and checks and balances in the implementation of the committee. 'This Whistleblower Protection Committee is a stop-gap measure only, temporarily until a central agency is established, namely the Ombudsman Malaysia, which will take over the functions and duties of this committee with additional powers, including receiving complaints from whistleblowers covering improper and harmful conduct. 'The Ombudsman Malaysia will also monitor the results of investigations carried out by this enforcement agency, and any reporting to Parliament is very welcome for transparency purposes and will be implemented when the central agency is established,' he said, adding that standard operating procedures, including timelines will be detailed and set during the establishment of the Ombudsman Malaysia. Earlier, Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said when tabling the bill for the second reading said that the Whistleblower Protection Committee is responsible for obtaining and coordinating statistics and data related to disclosures and complaints received by enforcement agencies. She said, however, that all statistics, data or information submitted to the committee cannot include any confidential information protected under Section 8, to ensure that there is no information leakage issue. 'This directly guarantees that the identity of the whistleblower remains protected as provided for in Section 6 of this act, thus ensuring that public confidence in the whistleblower protection system continues to be maintained,' she said. She added that statistics showed that from 2011 to 2023, a total of 74,614 complaints related to improper conduct were received and investigated, while 1,139 people were recognised as whistleblowers and given protection. Entrepreneur Development and Cooperatives (Kuskop) Minister Datuk Ewon Benedick said the Government is taking steps to ensure that traders continue to earn a living while improvements are made to their work environment. At a handover ceremony on Tuesday, Ewon distributed canopies, tables and chairs to the affected traders, who will move to a temporary trading site nearby for the next few months. 'We want to ensure that even during this transition, their livelihood is protected,' he said. 'This is about providing a safer and more comfortable space for the community to trade in the long run.' The RM2.4 million upgrade is being jointly funded by the Ministry of Housing and Local Government (KPKT), City Hall (DBKK) and the Kapayan state constituency. KPKT and DBKK are each contributing RM1 million, while Kapayan Assemblywoman Datuk Jannie Lasimbang is allocating RM400,000 from her constituency fund. Ewon said planning for the project started after he was elected Penampang MP in 2022, when he and Jannie visited the site with DBKK officials to assess its condition. 'What we saw back then was that the traders needed more than just shelter from the sun and rain. The space needed proper facilities, a roof, better flooring and proper drainage,' he said. He thanked Jannie for taking the lead in pushing for the project and raising the matter with the KPKT Minister Nga Kor Ming. 'This is a good example of what can happen when local and federal leaders work together,' he said. Jannie said the upgrade was something she had been pursuing since 2019, after hearing concerns directly from the traders. She said the location has always served more than just commercial purposes. 'This space is not just about business. It's a place where people meet, talk, share food and build connection. 'Once it has a proper roof and layout, it can serve the whole community during festive seasons, government programmes or even just a normal weekend,' she said.
