
Atlanta sports reporter says she was pepper-sprayed and attacked by an Uber driver
Atlanta sports reporter Tabitha Turner alleges she was pepper-sprayed in the face and physically attacked by an Uber driver over the weekend following a dispute over the car temperature.
The Uber driver, identified by police as Mericole Smith, is facing charges of misdemeanor battery and simple battery after Hapeville police said a video of the Saturday incident showed that she was the aggressor and physically attacked Turner. Police said an arrest warrant would be issued for Smith.
Turner's attorney, Miguel Dominguez, said in a Wednesday press conference that the altercation occurred as Turner was being driven to her home from the Hartsfield–Jackson Atlanta International Airport.
Smith, who accused Turner of escalating the situation in a viral TikTok video, did not return a request for comment on Thursday.
According to Dominguez, Turner had requested an Uber Comfort, which allows passengers to customize the ride. Uber's website says that passengers who use this service can let the driver know if they want to talk during the ride and set a temperature preference.
Because of the scorching hot temperatures in Atlanta, Turner wanted "a cool Uber," Dominguez said. But when Smith arrived, she had the windows rolled down and the air conditioner wasn't turned on, he said.
Dominguez said that when Turner asked for the windows to be rolled up, Smith escalated the situation.
'The driver did not respond verbally, but she did put the air conditioner on, but she did not roll the windows up. And so as the ride went on, the vehicle obviously did not cool off,' he told reporters. 'My client was really hot, she was sweaty, she addressed the driver again, asking that the windows be rolled up. The response she got from the driver was not kind and was not friendly. The driver was clearly irritated by, I guess, the demands of a passenger.'
Dominguez said the driver suddenly pulled over in the emergency lane on the expressway and ordered Turner out of the vehicle. He said Turner did not get out and told the driver to either take her back to the airport, where it was safe, or call the police and refund her the money for the fare.
According to the attorney, Turner was 'completely calm.' He alleged that Smith exited the car, removed Turner's bags and then attempted to 'physically remove my client from the vehicle by grabbing the bookbag that she was carrying and getting into a struggle.'
In her TikTok video, Smith said she turned the air conditioner up after Turner commented on how hot the car was. However, she explained that she does not roll up the windows because she sometimes has passengers who are sick. Smith said the windows were only slightly cracked.
According to Smith, Turner started yelling at her, so she told Turner that she would take her back to the airport and end the trip.
'That was not good enough for her,' Smith said in her video. 'She is going off. She is irate in the back seat, tripping, so I pull over. I'm like, actually, yeah, I'm going to need you to get out right here. So I pull over in Hapeville, we're off the highway.'
In the video, Smith said she told Turner that Uber would refund her, but Turner refused to leave. Because the situation was escalating, Smith flagged down a passerby and asked that they call 911.
Smith said she then opened the car door and again asked Turner to get out. She alleged that Turner went 'in her bag to get a weapon.' According to Smith, she got back in her car and pepper-sprayed Turner 'in self-defense.'
But Dominguez said Smith pepper-sprayed his client in an unprovoked attack. In a 30-second video clip released by his office, Smith is seen telling Turner to get out of the car.
She then leans into the backseat as she curses and screams at Turner, the video shows.
The incident continued to escalate as both women exited the vehicle.
According to Dominguez, Smith physically assaulted Turner and pulled out some of her hair. Smith alleged in her video that Turner ran toward her and tried "to gouge" her eye out. Smith said in her video, which has more than two million views, that she had to get stitches on her eye.

The woman, of Howie Crescent, Rosneath, was informed she was under arrest and an officer tried to lean into the passenger side window to arrest her. "McPhail got out and leapt onto the back of the officer," fiscal depute Mandy Robertson told Dumbarton Sheriff Court. A second officer tried to pull her off, causing them to fall back. The first officer straddled McPhail on the ground, and the woman struck out to their face with an open palm. McPhail pleaded guilty in May to assaulting one officer by striking her to the head, seizing her on the arm and digging her fingernails into the arm and trying to bite her. She admitted assaulting a second officer by spitting on his body. And she pleaded guilty to directing a sexual remark at a third officer for the purposes of obtaining sexual gratification or of humiliating, distressing or alarming him. The charge was under the Sexual Offences (Scotland) Act. The incidents all happened on September 5 last year. At sentencing on June 20, defence solicitor Jonathan Paul said his client was "ashamed of her actions". "She has very little recollection of what happened," he said. "She had drunk a lot of alcohol and was severely intoxicated." Mr Paul said the "root cause" was alcohol abuse, which she felt "can be managed". But she accepted she would have to give it up. Sheriff Sean Lynch said: "What I have heard about is quite frankly disgraceful behaviour and when I take that together with your record, there's no doubt the threshold of custodial sentence is met here." As a direct alternative to custody, she will be supervised by social workers for 12 months. She must also stay within her home from 7pm to 7am for the next four months. Because her comment to the officer was under the Sexual Offences (Scotland) Act, she had to go on the sex offenders register. Previously, that would mean she was on the sex offenders register for a year. The High Court recently decided it should be five years when a case has more than one aspect of punishment, such as supervision and curfew.

One motive under consideration by police is revenge by the family or close circle of her ex-boyfriend, who died in 2022 in unclear circumstances. Fabiola - originally from Barquisimeto, Venezuela - left her country in 2022, when she was 16. She was accompanied by her then-boyfriend Mayner Yoffrey Giménez Castrillo, who was 21 years older than her. Their journey - according to Fabiola's family - was voluntary but illegal. Mace-fueled catfight erupts in Uber after TV presenter asked Atlanta driver to roll up windows in 90F heat
A sports reporter claims she was violently assaulted and pepper-sprayed after asking her Uber driver to roll up the car windows during 90-degree heat. Tabitha Turner, an Atlanta based NBA and WNBA presenter, was travelling in the back of Mericole Smith's vehicle Saturday afternoon when the mace-fueled fight broke out. She asked Smith to roll up the windows and turn on the air conditioning, but the driver refused and demanded she exit the vehicle on the side of the highway, Turner claims. Video captured by the reporter shows how she pleaded with Smith, saying she 'just wanted a cool Uber', as the driver repeatedly said 'get out'. Smith said she always kept the windows of her car open so passengers who felt sick could vomit out of them instead of soiling her upholstery. 'Call the cops or refund my money,' the reporter told the visibly annoyed driver. The argument quickly became heated with Turner explaining how she 'requested a cool Uber' in the app. 'Get the f*** out of the car,' Smith yelled back, before she reached into the backseat and physically attacking Turner. Smith allegedly tried to physically pull her out of the vehicle and the pair struggled on the side of the road. A passerby witnessed the scene and stopped to help. Police arrived shortly thereafter. Smith, who says she was 'covered in blood', was taken to a nearby hospital for treatment. The driver took to TikTok later that night to share her side of the story. Smith claimed she was 15 minutes away from Turner's requested drop-off destination when the reporter told her 'it's hot in here'. 'No, but I actually want you to get out of the car. Can you please get out of the car? You're escalating this s*** for no reason.' She says that's when Turner 'goes into her bag to get a weapon', prompting her to get back inside the vehicle and sit in the driver's seat. Turner then continued to threaten her, Smith claims, so 'I proceeded to grab my mace and I maced the f*** out of her in self-defense.' She then revealed her bruised face and swollen left eye, which was originally hidden from view, to the camera, claiming that Turner 'tried to gouge my eye out'. Turner claims the allegations in Smith's video are not true and have caused her to receive violent threats. 'This is so hurtful that this is happening,' she said told press conference Wednesday, during which she was accompanied by her attorney. Turner explained she wanted a 'cool ride', like she had requested in the app, and that she did not exit the vehicle because she felt unsafe doing so in traffic. 'People questioning my character because of what she's saying,' she told WSB, noting the backlash from the incident has impacted her career opportunities. 'I just wanted to go home after work and see my daughter,' she added. Smith, however, says that she is being 'punished' even though she was 'the one that has to go to the hospital'. 'See the bruises on my body?' she told reporters. 'I have to relive this over and over and over again.' A warrant for Smith's arrest was issued Wednesday.
