
Kuwait's pursuit of fair global taxation
Step 1: The jurisdictional blending approach - A collective view
Unlike traditional tax systems that often look at individual companies, Pillar Two takes a jurisdictional blending approach. This means that for each country where an MNE group operates, e.g., Kuwait, the GloBE income or loss and the adjusted covered taxes of all constituent entities of that MNE group located in that specific jurisdiction are aggregated.
Why aggregate? Because the goal is to determine if the MNE's overall operations in a given country are effectively taxed below 15 percent. Aggregating allows for an average to be taken across all the group's entities in that location, preventing MNEs from manipulating the effective rate by having some high-taxed and some low-taxed entities in the same country. So, for Kuwait, an MNE group will first sum up the GloBE Income of all its entities based here, and then sum up their Adjusted Covered Taxes.
Step 2: The core formula - Calculating the Effective Tax Rate (ETR)
Once we have the aggregated GloBE income and adjusted covered taxes for a particular jurisdiction, the calculation of the Effective Tax Rate (ETR) is straightforward: Jurisdictional ETR = aggregated adjusted covered taxes for the jurisdiction aggregated GloBE income for the jurisdiction.
For example, if an MNE's constituent entities in Kuwait have an aggregated GloBE income of KD 100 million and have paid KD 10 million in adjusted covered taxes, their jurisdictional ETR would be: KD 10 million = 10 percent KD 100 million.
This 10 percent ETR is now compared against the 15 percent global minimum tax rate. But, what if the ETR is a loss or zero GloBE income?
Special rules apply if the aggregated GloBE income for a jurisdiction is a loss or zero. In such cases, if the adjusted covered taxes are positive, the ETR calculation would result in an undefined or negative rate. The GloBE rules generally treat the ETR as being below 15 percent in such scenarios, which means a top-up tax could still be triggered, but specific computations would apply to ensure fairness. The key is that the absence of taxable profit does not automatically mean immunity from the Pillar Two rules if taxes have been significantly reduced.
Step 3: Determining the top-up tax percentage - The shortfall
If the calculated jurisdictional ETR is less than 15 percent, then a 'top-up tax percentage' is determined. This simply represents the difference between the 15 percent minimum rate and the MNE's actual ETR in that jurisdiction. Top-up tax percentage = 15 percent (minimum rate). Jurisdictional ETR now, using our example where the ETR for Kuwait was 10 percent:
Top-up tax percentage = 15 percent? 10 percent = 5 percent
This 5 percent is the additional rate of tax that needs to be levied to bring the overall effective tax rate up to the 15 percent minimum.
Step 4: Calculating 'excess profit' with the substance-based income exclusion (SBIE)
Before applying the top-up tax percentage, the GloBE rules introduce a crucial element, that is the substance-based income exclusion (SBIE). This is a vital policy carve-out designed to ensure that Pillar Two taxes only 'excess profits' - those profits that are not directly attributable to real economic activities, like having employees or physical assets, in a jurisdiction. It aims to reward MNEs for genuine investment and discourage purely artificial profit shifting. The SBIE is calculated as a fixed return, i.e. a percentage, on the MNE's:
Eligible payroll costs
The payroll expenses of eligible employees performing substantive activities in the jurisdiction.
Eligible tangible assets: The carrying value of tangible assets, like property, plant, and equipment, located in the jurisdiction and used in the MNE's business. For a transitional period, starting at 9.6 percent for payroll and 7.6 percent for tangible assets, phasing down to 5 percent over ten years, a portion of income derived from these substantive activities is excluded from the profits subject to top-up tax. SBIE = (payroll carve-out percent x eligible payroll costs) + (tangible assets carve-out percent x eligible tangible assets)
The 'excess profit' for a jurisdiction is then calculated as: excess profit = aggregated GloBE income. SBIE If the GloBE income is less than or equal to the SBIE, then the excess profit is considered zero, and no top-up tax would be due even if the ETR is below 15 percent.
This is a crucial simplification for MNEs with substantial physical presence and employees.
Step 5: Computing the gross top-up tax
Now, the top-up tax percentage is applied to the excess profit to arrive at the gross top-up tax for the jurisdiction: Gross top-up tax = top-up tax percentage x excess profit. Let's continue our example: If the Aggregated GloBE income was KD 100 million, and assuming a SBIE of KD 20 million, then: excess profit = KD 100 million. KD 20 million = KD 80 million and the gross top-up tax would be: Gross top-up tax = 5 percent x KD 80 million = KD 4 million. This KD 4 million is the total top-up tax that needs to be collected to bring the MNE's effective tax rate in Kuwait up to 15 percent.
Step 6: Reducing the top-up tax with Kuwait's QDMTT
This is where Kuwait's strategic decision to implement a qualified domestic minimum top-up tax (QDMTT) becomes immensely beneficial. As discussed, the QDMTT ensures that any top-up tax calculated for MNE entities located in Kuwait is paid directly to the Kuwaiti tax authorities. The final top-up tax amount that would be allocated to other jurisdictions, under the IIR or UTPR, is reduced by the amount of QDMTT paid in Kuwait. Allocable top-up tax (to other jurisdictions) = gross top-up tax?
QDMTT paid in Kuwait
If Kuwait collects the full KD 4 million under its QDMTT, then there would be no remaining top-up tax for other countries to collect from this MNE's Kuwaiti operations. This guarantees that the revenue stays within our national borders. Importance for MNEs in Kuwait: For multinational enterprises operating in Kuwait, understanding these computations is not merely an academic exercise. It directly impacts their future tax liabilities and compliance requirements. They will need:
Robust data systems: To accurately track and report GloBE income and adjusted covered taxes for all their Kuwaiti entities.
Scenario planning: To model the potential impact of Pillar Two on their effective tax rates and overall tax burden in Kuwait.
Expert guidance: To navigate the complexities of these calculations and ensure compliance with Law 157/2024 and its executive regulations.
A fairer share for Kuwait
The calculation of the effective tax rate and the resulting top-up tax is the operational core of Pillar Two. By establishing a clear, step-by-step process, the GloBE Rules ensure transparency and consistency in determining if an MNE is paying its fair share. For Kuwait, the meticulous design of its QDMTT means that our nation is not just a participant in this global tax reform, but an active beneficiary. By capturing the top-up tax arising from economic activity within its jurisdiction, Kuwait secures vital revenue, fosters a more equitable business environment, and reinforces its commitment to modern, fair international taxation. This intricate dance of numbers ultimately leads to a stronger, more prosperous future for all in Kuwait.

Asset quality remained robust with the Group's non-performing loan (NPL) ratio maintained at a healthy 1.35 percent while loan loss coverage ratio held firm at 447 percent, underscoring the stability of ABK's credit metrics. He added, 'We hold provisions amounting to KD 218 million, which exceed IFRS 9 requirements and are in accordance with Central Bank of Kuwait guidelines, reflecting our continued prudent provisioning policy.' The net interest margin (NIM) increased to 2.2 percent driven by improved asset yields and stable funding costs while return on average equity (ROAE) improved to 9.2 percent in H1 2025, showcasing stable earnings and long-term shareholder value. Liquidity and funding remained a key strength for ABK supported by a liquidity coverage ratio of 230 percent and a net stable funding ratio of 108 percent, both comfortably above regulatory thresholds. Customer deposits stood at KD 4.3 billion, representing 67 percent of our total liabilities, highlighting the continued client confidence and the resilience of ABK's funding profile. Soonawalla shared, 'The Group's operational performance advanced significantly in H1 2025 with an 18 percent uplift in operating profit, reflecting improved income generation and tighter cost control. This demonstrates our stronger efficiency and core business growth.' Commercial Banking continued to lead operating income during H1 2025, contributing 51 percent, followed by Retail Banking at 37 percent and Treasury and Investments at 12 percent. Asset allocation also remained strategically balanced, with 56 percent allocated to Commercial Banking, 13 percent to Retail Banking and 31 percent to Treasury and Investments. He continued, 'Our cost to income ratio improved to 42.2 percent in H1 2025, reflecting the success of our focused cost management efforts which delivered a 3 percent year-on-year reduction in operating expenses.' As of H1 2025, total assets expanded to KD 7.2 billion, delivering strong year-on-year growth of 8 percent. In addition, net loans and advances increased by 5 percent to KD 4.7 billion, demonstrating healthy lending activity and prudent balance sheet expansion. Strategic priorities On his part, Jawad affirmed that ABK has continued to execute against its strategic priorities, delivering steady growth across key customer segments, including Kuwaitis, privilege banking and youth. Targeted initiatives focused on product development, digital engagement and service excellence contributed to loan growth that beat market growth. 'We remain disciplined in our underwriting approach while maintaining a healthy risk-adjusted return profile,' he affirmed. In addition to its financial performance, ABK achieved meaningful recognition from leading international institutions. During the first half, the Bank was honored with the Best Digital Transformation Initiative award by MEED and the Elite Quality Recognition award from J.P. Morgan. He said, 'These recognitions reflect the progress we have made in advancing our digital capabilities, strengthening operational delivery and our ongoing efforts to enhance client experience across channels.' Egypt and the UAE Jawad shed light on the business' continued strong performance in Egypt where it obtained PCI-DSS certification, reinforcing digital security standards. Kuwait relief campaign for Gaza raises over KD 6.5m
KUWAIT: The Ministry of Social Affairs announced on Wednesday that its urgent humanitarian relief campaign in support of the Palestinian people in the Gaza Strip has concluded, collecting a total of KD 6,546,078 (approximately $21.4 million) over the three-day initiative. Ministry spokesperson Yousef Saif told KUNA that the campaign — launched in cooperation with the Ministry of Foreign Affairs, the Kuwait Red Crescent Society (KRCS), and numerous Kuwaiti charitable associations and foundations — witnessed broad participation and generous contributions from across the country. He noted that one of the largest donors was the General Secretariat of Endowments, which contributed KD 500,000 to the campaign, launched under the slogan 'Kuwait By Your Side – A Response to Gaza.' Donations through the ministry's electronic link totaled KD 2,515,795 (approximately $8.2 million) from 63,501 individual donors. Among the key contributors, the Patients' Aid Fund donated KD 476,010 (over $1.5 million), the Direct Aid Society contributed KD 1.318 million (approximately $4.3 million), while the Islamic Heritage Revival Society donated KD 235,440 (around $770,300). Saif affirmed that the initiative is part of Kuwait's steadfast humanitarian policy and reflects the country's firm commitment to supporting the Palestinian people in their time of need. The campaign focused primarily on providing essential food supplies to affected families in the Strip. In line with Cabinet Resolution No 1461, in-kind food donations were accepted under regulated procedures, with food items procured exclusively from the Kuwait Flour Mills and Bakeries Company. The KRCS is overseeing the delivery of the relief aid in coordination with accredited humanitarian agencies in Egypt, Jordan and Palestine. Full military occupation The Zionist military will have to execute any government decisions on Gaza, the defense minister said Wednesday after reported disagreements over the prospect of a full occupation of the Palestinian territory. Signs of a rift over strategy emerged as Prime Minister Benjamin Netanyahu prepared to announce a new phase in the war, after he said Zionist entity must 'complete' the defeat of Hamas in order to secure the release of hostages still held in Gaza. The press, citing officials speaking on condition of anonymity, has predicted an escalation of operations, including in densely populated areas where hostages are believed to be held, such as Gaza City and refugee camps. The reports also said Netanyahu and his cabinet would order a full military occupation of Gaza, sparking dissension from the army's Chief of Staff, Eyal Zamir. On Tuesday, Netanyahu held a restricted three-hour meeting with security chiefs to discuss options for the continuation of the war, his office said in a statement. At the meeting, Zamir reportedly warned that a full occupation would be like 'walking into a trap,' according to public broadcaster KAN. The army chief suggested alternatives to a full occupation, such as an encirclement of specific areas where Hamas is believed to be hunkering down, according to the Channel 12 broadcaster. But Defense Minister I Katz hit back with a clear message. 'It is the right and duty of the Chief of Staff to express his position in the appropriate forums,' he wrote on X. 'But once decisions are made by the political echelon, the IDF will execute them with determination and professionalism... until the objectives of the war are achieved,' he added, using an acronym for the Zionist military. Netanyahu is expected to convene the security cabinet on Thursday to finalize a decision on the expansion of the offensive, local media reported. US President Donald Trump told reporters on Tuesday he was not aware of reported plans to occupy the entire Gaza Strip, but said that such a decision would be 'up to (Zionist entity)'. The UN Security Council held a special session on Tuesday to discuss hostages in Gaza, as the country seeks to keep the issue on top of the global agenda. On Tuesday, Trump described a recent video released by Hamas of emaciated hostage Evyatar David purportedly digging his own grave as 'horrible.' In parallel, international criticism has surged over the suffering of over two million Palestinians, who the UN warns are at risk of widespread famine. 'Dangerous routes' In the besieged Gaza Strip, where humanitarian aid has only been trickling in, the civil defense agency said on Wednesday that at least 22 people had been killed in an overnight incident involving an aid truck that overturned onto a crowd of aid seekers. 'The truck overturned while hundreds of civilians were waiting for food aid in the Nuseirat area' of the Gaza Strip, civil defense agency spokesperson Mahmud Bassal told AFP. 'The truck had been forced by the army to take dangerous roads,' in poor condition after being bombed, he added. Kuwait finalizes logistics for Gaza aid shipments
Charities submit requests to Kuwait Flour Mills; KRCS volunteers to accompany flights KUWAIT: The Kuwait Red Crescent Society (KRCS) is standing by for official clearance to begin airlifting critical humanitarian supplies to the Gaza Strip. The airlift is part of a nationwide relief campaign aimed at supporting Palestinians facing catastrophic conditions under the Zionist entity 's ongoing assault and blockade. 'We're now awaiting confirmation from the Ministry of Defense and the Ministry of Foreign Affairs of when the airlifts will begin,' said Fawaz Al-Mazrouei, Director General of KRCS, in an interview with KTV news channel. Launched under the directives of Kuwait's top leadership, the aid campaign has mobilized government bodies, civil society groups, and the public in what officials describe as a coordinated national response to the Zionist entity's genocidal war on Gaza. On Wednesday, the Ministry of Social Affairs announced the conclusion of the donation drive, confirming that it raised KD 6,546,078 (approximately $21.4 million) in total. That includes KD 2.5 million through an online fundraiser, KD 1.5 million from Insan Charity Society, KD 1.3 million from Direct Aid Society, KD 500,000 from the Awqaf Secretariat General, and other contributions from local organizations. All funds collected will be fully allocated to the purchase of relief materials through the Kuwait Flour Mills Company. The decision, said Al-Mazrouei, was settled upon following several meetings. 'All charitable organizations are in direct contact with the Kuwait Flour Mills Company, submitting their requests based on each organization's capacity,' said Al-Mazrouei. 'Based on that, we at the Red Crescent — acting as the liaison — coordinate with all the charities and organize the entire program. And, God willing, that process is now underway.' Once flight schedules are confirmed, KRCS will finalize preparations for the aid shipments and oversee the distribution of materials, in line with the requests submitted by each charity through the Flour Mills. Supervising aid delivery Al-Mazrouei added that preparations are underway to assign volunteers to accompany each relief flight. 'According to the dates of each flight, volunteers are assigned to accompany the plane,' he said. 'They will transport all the requested items to the airport, where they are loaded from vehicles onto the aircraft for departure.' Each plane will include a team of volunteers to supervise the handover of aid, he said. 'They will supervise delivery upon arrival and ensure handover to the Egyptian Red Crescent and the storage facilities, confirming that all items have been received,' Al-Mazrouei explained. 'The Egyptian Red Crescent will then deliver the goods into Gaza, God willing, under the supervision of all parties involved.' Assistant Foreign Minister for Development and International Cooperation Hamad Suleiman Al-Mashaan had told the press last month that part of the aid supplies will be delivered to Gaza through Jordan. But no information on delivery to Jordan was provided by Al-Mazrouei. 'All efforts today are focused on one goal — supporting and aiding the Palestinian people,' he said, noting that the Red Crescent was tasked with leading the campaign based on its experience in delivering aid internationally. Al-Mazrouei praised the Defense Ministry for its role in preparing the air bridge, highlighting the enthusiasm of air force crews involved in the mission. 'They are always among the first to respond,' he said. 'When we meet with each flight crew, they're genuinely happy to be delivering aid to any country. This is truly humanitarian work, and everyone is seeking the reward from Allah.' 'Relief on the way' The campaign's urgency comes as the humanitarian crisis in Gaza deepens. According to Gaza's Health Ministry, the Zionist entity's nearly two-year war on Gaza has killed at least 61,158 Palestinians, including 193 who have died from hunger, among them 96 children. The ministry also reported that 87 Palestinians were killed and 570 wounded while attempting to access humanitarian aid. Since late May, 1,655 people have died and more than 11,800 have been injured while trying to obtain food or supplies. The Zionist entity has maintained a blockade on Gaza for 18 years and has closed all border crossings since March 2. As of August, the enclave's 2.4 million residents have received only 843 aid trucks since July 27, far fewer than the 6,000 trucks needed over 10 days to meet basic needs, according to Gaza's Government Media Office. Kuwait's campaign is one of many aiming to help Gazans. 'To the people of Gaza: Relief is on the way, God willing. The people of Kuwait stand with you and will not fall short, God willing,' said Al-Mazrouei This campaign marks the first authorized charitable fundraising drive since a nationwide suspension was imposed in April 2025. The suspension followed authorities' discovery of several unauthorized campaigns operating through unofficial websites and social media. The Ministry of Social Affairs said the freeze was necessary to protect donor funds and restore accountability. The suspension was lifted in late June, paving the way for a coordinated and transparent campaign to support Gaza. The Kuwaiti people have responded with overwhelming generosity.
