
Clash among IHC judges intensifies
Clash among Islamabad High Court (IHC) judges has intensified with Justice Babar Sattar stating that a division benchled by IHC Acting Chief Justice Sardar Muhammad Sarfraz Dogarhas no authority to suspend proceedings pending before a single bench and to "frustrate" proceedings.
A single-member bench comprising Justice Sattar was hearing a case related to Department of Immigration and Passport. He had adjourned it till April 28 after its last hearing on March 26.
The petition was however not listed for hearing on April 28 in the Regular Cause List. Justice Sattar on April 25 issued a direction to the IHC deputy registrar (judicial) on the administrative side that the matter be listed for hearing on April 28 by virtue of order dated March 26.
The judge also directed that a supplementary cause list be issued to list the matter for hearing in compliance with the order dated March 26 "which had not been impugned before a court of competent jurisdiction and remained in the field".
The deputy registrar, however, informed the bench through a note that an objection application had been filed before the Divisional Bench-I challenging the order of the single-member bench dated March 26.
He noted that the division bench on March 26 admitted the appeal for regular hearing. It further ordered the registrar to club two other cases with the instant case.
However, Justice Sattar on Monday conducted the hearing of the case and later issued an 8-page order, stating that his orders dated March 26 and March 12 were interlocutory in nature and final adjudication of the subjectmatter remains pending.
He noted that the judges comprising division bench-1 were not assisted properly and competently when they were seized by ICA No 98 of 2025 that led to order dated March 26.
"Had their attention been drawn to the settled legal propositions mentioned above, it is unthinkable that they would have summoned the record of this Court or otherwise issued any direction that would thwart or frustrate the proceedings pending before this Court in its constitutional jurisdiction.
"It has been clarified by the Supreme Court in a number of recent cases that there also exists no administrative authority in the Office of the Chief Justice to interfere with a matter that is pending before a duly constituted bench that is seized of that matter and hearing it."
The order said by not listing the petition for hearing on April 28, the deputy registrar (judicial) prima facie acted in breach of order dated March 26, which was never impugned and remains in the field.
Meanwhile, The Lahore High Court Bar Association has submitted a rejoinder in the IHC judges' seniority case.
A five-member constitutional bench of the Supreme Court will resume hearing of the case today.

IHC stops FIA from harassing Farhatullah Babar
The Islamabad High Court (IHC) on Thursday stopped the FIA from harassing former senator Farhatullah Babar and issued notices to the relevant parties, seeking their replies by the last week of this month. IHC Justice Inam Amin Minhas heard the petition filed by Babar through lawyers Iman Mazari and Hadi Ali Chatha under Article 199. The Interior Ministry, the FIA and others have been made parties in the petition. The petition stated that an FIA inquiry was initiated on March 25 on the complaints of "suspected corruption, tax evasion and acquisition of illegal assets" from a citizen, whom the petitioner did not know.

Farhatullah's petition: IHC issues notices to FIA, ministry, others
ISLAMABAD: The Islamabad High Court (IHC) barred the Federal Investigation Agency (FIA) from harassing former Senator Farhatullah Babar. A single bench of Justice Raja Inaam Ameen Minhas on Thursday after hearing the initial arguments on Babar's petition issued notices to the FIA, the Ministry of Interior, and other respondents, directing them to submit replies by last week of June. During the hearing, Babar's lawyer argued that his client has been subjected to repeated illegal notices and summons by the FIA. He said the agency initiated an inquiry on March 25, following a citizen's complaint accusing Babar of tax evasion and acquiring illegal assets. The counsel argued that 'Babar does not know the complainant and was not provided a copy of the complaint when he appeared before the FIA on March 28, and on April 11, the FIA sent a detailed questionnaire comprising 12 questions via WhatsApp.' In his petition, the former Senator alleged that the FIA's conduct is 'unlawful, illegal, arbitrary, and mala fide'. Babar – a three-term senator, Hilal-i-Imtiaz recipient, and council member of the Human Rights Commission of Pakistan (HRCP) – highlighted his decades-long advocacy, including efforts to regulate intelligence agencies. The petition sought to quash an anti-corruption inquiry against him, calling it a baseless 'fishing expedition' designed to harass a critic of state institutions. The FIA's Anti-Corruption Circle (ACC) initiated an inquiry based on a private complaint by Rawalpindi resident, Touseef Abbas. Babar asserted that he received no details of allegations, complaint copies, or legal basis for the probe despite repeated requests. He also asserted that the FIA's actions target his human rights advocacy. He cited a 2023 UN report documenting threats against him linked to an alleged 'Kill List'. The petitioner argued that the FIA violated due process of law provided in Articles 4, 10A, 19, 25 of the Constitution by denying access to accusations. Therefore, he requested the court to quash the inquiry and all related notices and sought direction to FIA to disclose allegations, documents, and legal basis for the probe. ‘Al-Qadir Trust scam': IHC again defers hearing on appeals of IK, Bushra
ISLAMABAD: The Islamabad High Court (IHC), Wednesday, again deferred hearing of the Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his spouse Bushra Bibi's appeals seeking suspension of their sentence in 190 million pound case. A two-member bench of IHC comprising Acting Chief Justice Sardar Sarfraz Dogar and Justice Muhammad Asif was to conduct hearing of the case but the case was adjourned due to non-availability of Justice Asif. The IHC's decision to defer the case led the protests by PTI leaders and workers outside the court premises. The protestors included PTI lawyers, workers, Imran Khan's sisters Aleema Khan and Uzma Khan, along with PTI Punjab Chief Organizer Aliya Hamza and Senator Seemee Ezdi. The protesters demanded the suspension of sentences and bail for Imran Khan and Bushra Bibi in the 190 million pound case. Later, PTI Chairman Barrister Gohar Ali Khan and Khyber-Pakhtunkhwa Chief Minister Ali Amin Gandapur also arrived at the IHC to join the protest while they also met Secretary to IHC Acting Chief Justice for fixation of the case. In this matter, Imran Khan and his spouse Bushra Bibi have approached the IHC seeking suspension of their sentences. They have moved the court through their counsel Barrister Salman Safdar and cited the state and Chairman National Accountability Bureau (NAB) as respondents. Counsel Salman stated in the petition that the petitioners were convicted by the Accountability Court (I) Islamabad through judgment dated 17.01.2025, wherein, they were held guilty for commission of offence of corruption and corrupt practices as defined u/s 9 (a) (ii) (iv) (vi) of the National Accountability Ordinance, 1999 and Imran was sentenced u/s 10 (a) of the National Accountability Ordinance, 1999 to undergo rigorous imprisonment (RI) for 14 years and fine amounting to Rs10,00,000. Through the instant petition, they sought indulgence of this court for 'Suspension' of conviction and sentence awarded to them, till the final disposal of the main appeal already filed in the IHC.
