Loss of cargo: After ‘arrest', owner deposits 6cr, Kerala HC allows ship's release
Kochi: High court on Thursday directed the Vizhinjam port authorities to arrest the ship MSC MANASA F, a sister vessel of MSC ELSA 3, which capsized and sank off the Kerala coast on May 25, until an amount of Rs 6 crore is deposited towards the claim raised by three cashew importing companies for losses suffered due to the shipwreck.
The order was issued by Justice Abdul Hakhim in response to petitions filed by
Saji Surendran
of Mangalathu Cashews, R Rajendran of RRR Enterprises and representatives of J J Trading Company. All three petitioners are members of the Cashew Export Promotion Council.
In the order, HC clarified that if the shipping company produces a demand draft for Rs 6 crore, the vessel MSC MANASA F may be permitted to leave the territorial waters of the state.
Following the court's direction in the Admiralty suits, MSC (Mediterranean Shipping Co SA), the owner/operator of the vessel, submitted the demand draft for the said amount to the HC by the afternoon. Accordingly, the court permitted the release of the vessel and adjourned the Admiralty suit for further hearing on the compensation claim to July 15.
The petitioner companies, based in Kollam, stated in their pleas that they had purchased dried raw cashew nuts from a trading company in Dubai, which were shipped in containers bound for Tuticorin port.
According to the petitioners, the consignments were expected to arrive at Tuticorin on May 24 aboard MSC ELSA 3. However, the Indian agent of the shipping company informed them via email on May 28 that the vessel had sunk on May 25 en route from Vizhinjam to Kochi, resulting in the total loss of cargo.
This led the companies to file Admiralty suits seeking compensation.
Mangalathu Cashews, RRR Enterprises, and J J Trading Company raised claims of Rs 1.54 crore, Rs 1.63 crore, and Rs 1.58 crore, respectively, along with interest at 18% per annum.

State to install smart power meters in phased manner
Panaji: The state electricity department, through its contractor Digismart Networks Pvt Ltd, has begun implementing the smart meter project for the state, where 7.5 lakh electrical meters will be replaced with smart meters. The first smart meter is likely to be installed after six months, electricity department superintending engineer Mayur Hede told TOI . In the first phase, the electricity department's transformers and feeders' meters will be replaced, followed by govt offices and govt quarters. In the next phase, industrial and commercial consumers' meters will be replaced, followed by domestic consumers — the largest chunk of users in the state. The smart meters will function in a prepaid mode and will mark the end of the era of monthly bills for consumers. Consumers will be sent a reminder to recharge when their charge is getting over. 'There will be no concept of monthly bills. A consumer-friendly app will send regular notifications to the public. The benefits to consumers and the department will be multifold,' he said. 'Users will be able to check the actual consumption, sitting anywhere in the world. Consumers will also have access to daily, weekly, and fortnightly consumption records on the app. The app will alert the user in case the load increases above the sanctioned load and if one needs to apply for an increase in load,' Hede said. During power failure, the restoration time will be cut as the blackout will be communicated directly to the central server, he said. The system will also inform the department about the voltage profile of consumers in case of low or high voltage and help improve the quality and reliability of power. It will also help the department accurately forecast the load requirement, which will help in better load scheduling, the superintending engineer said. 'As we buy power from the power exchange, we have to be very accurate. If we ask for more power, we have to pay for it even if we don't consume it. Similarly, if we ask for less power, we will have to pay charges for overdrawal.' First a survey will be conducted to check the feasibility of installing the meters depending on the location. ATS, Pakur police seize huge cache of explosives, 1 held
1 2 3 4 Dumka: The anti-terrorist squad (ATS) from Ranchi in a joint operation with Pakur police seized a huge cache of explosive materials from a house in Domangadiya village under the Pakudiya police station of Pakur district on Friday. Acting on a tip-off, the security forces raided the house of one Raja Miyan and seized 9,335 pieces of gelatin and 2,160 pieces of detonators, which were kept in dozens of cartons. The forces also arrested Miyan's son identified as Samsul Hasan. "The owner of the house and a few others managed to escape after seeing the security forces," said a police official, adding that the arrested man confessed to indulging in the practice of selling the explosive materials to owners of stone quarries for blasting purposes. Informing about the incident, the officer in charge of Pakudiya police station, Amit Kumar Singh, said, "The ATS had inputs about the illegal stock of explosives, prompting us to conduct the raid." He further said an investigation to identify other key players of the case was on. Singh added, "The arrested person confessed to supplying the explosives to the different stone quarries operating in the district." The practice of supplying illegal explosives to such an extent, however, has sparked a sensation in the district, which is famous for the stone industry, as its recovery also suggests the operation of illegal stone quarries on a large scale.
