
Hurting the GST regime with cess
Hindustan Times reported on Monday that the next GST Council meeting is expected to consider a proposal to add two new cesses — one for health and the other for clean energy. To be sure, the proposed cesses are unlikely to lead to a hike in tax rates because they will come into effect after the existing compensation cess is done away with; the two cesses will replace the latter. While details are awaited, the idea is not very inspiring, at least in principle. Here are three reasons why.
The compensation cess was a political rather than a macroeconomic imperative. The Union government assured the states of a guaranteed 14% growth in their pre-GST revenues until July 2022 to get them to accept the rollout of GST. The compensation cess was expected to fund this guarantee. It was extended beyond 2022 to pay back the debt that was incurred to fund the shortfall because of the pandemic's impact. Once these debts are paid off, a GST cess is not needed.
The proposed new cesses, if imposed, will be among the many that add to the tax burden in the name of various objectives. In this case, it is going to be health and clean energy. Because the cesses are going to be levied on so-called sin and luxury goods, it is nothing but another tax slab from the back door. The GST regime was sold as a simple indirect tax regime with just two or three slabs. What it looks like today is anything but simple, and there is an urgent need to simplify it rather than make it more complex.
What we also do not know at the moment is whether this cess will accrue to the Centre alone or the states will also get a part of it. Given the fact that states are also represented in the GST Council, any cess which accrues exclusively to the Centre is unlikely to find much traction. If both the Centre and the states are going to share the spoils, will the division be on the lines of the latter's SGST collections or the formula for division of central taxes among states? And, will this require an amendment in the law?
Reforming GST, in the true sense of the term, needs acknowledging a larger problem. Lip service to reforms and the temptation for raising revenue collections from complicated tax regimes that make business more difficult cannot co-exist.

SC halts IAF's move to release woman officer denied permanent commission
NEW DELHI: Coming to the rescue of an Indian Air Force woman officer who was denied permanent commission, the Supreme Court on Monday, in its interim order, directed the Centre and the IAF not to release her from service until further hearing on August 6. A two-judge vacation bench of the top court, headed by Justice Ujjal Bhuyan and Justice Manmohan, referred to the May 22 order of the court in which similar directions were issued to the Centre and the IAF. The apex court passed the order after hearing a plea filed by Wing Commander Niketa Pandey and said the same directions would apply in the case of Wing Commander Kavita Bhati. Stressing that it was 'without prejudice to the rights of the parties or equity in favour of the officer', the bench posted the matter for further hearing on August 6 before a regular bench, when a batch of petitions related to the IAF would be taken up. The petitioner, Pandey — who was part of Operation Balakot and Operation Sindoor — claimed that she was denied permanent commission. 'I am unfairly treated and discriminated [against] on the issue of being granted permanent commission,' Pandey further alleged.

India in touch with students in Iran to ensure their safety, says MEA
Amid the Iran-Israel conflict, the Centre on Monday said the Indian Embassy in Tehran was continuously monitoring the security situation and engaging Indian students in Iran to ensure their safety while also relocating them to safer places in some cases. The Ministry of External Affairs' statement read, 'The Indian Embassy in Tehran is continuously monitoring the security situation and engaging Indian students in Iran to ensure their safety.' The statement continued, 'In some cases, students are being relocated with Embassy's facilitation to safer places within Iran. Other feasible options are also under examination. Further updates will follow. Separately, the Embassy is in touch with community leaders regarding welfare and safety.' The Indian embassies in Israel and Iran have issued advisories on their X handles in view of the situation. 'In view of the current situation in Iran, all Indian nationals & persons of Indian origin in Iran are requested to remain vigilant, avoid all unnecessary movements, follow the Embassy's Social Media accounts & observe safety protocols as advised by local authorities,' the Indian Embassy in Iran's post on X read. Meanwhile, PDP president Mehbooba Mufti on Monday asked the MEA to take immediate steps to ensure the safe return of Indian students stranded in Iran. Hundreds of Kashmiri students, enrolled in various universities for professional courses in Iran, are stranded due to the escalated tensions with Israel. The families of the students have appealed to Prime Minister Narendra Modi to take steps for their safe evacuation just like the government did at the time of the Russia-Ukraine War. 'If Indian students were evacuated from Ukraine within days during the war, why are our children not being rescued from Iran? They are also Indian citizens,' a worried parent said.

Govt notifies Census 2027, Cong questions 'silence' on caste enumeration
The Centre on Monday notified conducting the next Census in 2027, a massive exercise which the government had said will include caste enumeration, even as political parties of all hues indicated that the exercise and its findings would lead to intense political contestation. The last census was held in 2011. The census will be carried out with a reference date of October 1, 2026 in the snow-bound areas like Ladakh and March 1, 2027 in the rest of the country, the notification said. The exercise is estimated to cost the exchequer over Rs 13,000 crore, and will be conducted by nearly 3.4 million enumerators and supervisors and 130,000 census functionaries armed with digital devices. Union Home Minister Amit Shah reviewed the preparation for the Census with Union Home Secretary Govind Mohan, Registrar General and Census Commissioner of India Mritunjay Kumar Narayan, and other senior officials here on Sunday. According to Article 246 of the Constitution, the Census is a subject listed at 69 in the Union List in the Seventh Schedule. In the upcoming Census, caste enumeration will also be done, the first such exercise since Independence. The training process for enumerators is likely to start in October 2025. Citizens will answer around three dozen questions ranging from whether they use a telephone, internet connection and the likes; their vehicles, the cereals they consume, water source, house type, whether the head of the household is a woman, an SC or ST. Meanwhile, terming the notification on the 16th Census as a 'damp squib', Congress general secretary in-charge communications Jairam Ramesh said it was 'silent on the inclusion of caste' in the exercise and asked whether this is another 'U-turn' by the government. He also suggested that the Centre must adopt the Telangana model for not just caste enumeration but also in bringing out detailed data on socio-economic parameters caste-wise. Later in the day, Ramesh said that if one looks at history it would be very uncomfortable for the Sangh Parivar, including the BJP, which withdrew support to the VP Singh government on the Mandal Commission issue in 1990, and started the 'Kamandal agitation'. Meanwhile in Patna, the capital of poll-bound Bihar, Union minister Shivraj Singh Chouhan participated in the centenary celebrations of martyr Buddhu Nonia. Chouhan said that the government at the Centre would, once the Census data is published, consider the Nonia community's demand for Scheduled Tribe (ST) status if it comes out that 95 per cent of the community is extremely poor. The Nonia community is present in Bihar and Uttar Pradesh, and according to Bihar's caste survey of 2022, comprises 1.9 per cent of the state's population. Addressing a press conference in the national capital, Union minister Bhupendra Yadav accused the Mamata Banerjee-led West Bengal government of indulging in 'politics of appeasement' by issuing a fresh list of OBC communities that has included a large number of Muslim castes. He criticised the Congress for always betraying the OBCs pointing to the Karnataka government's decision to junk an earlier caste count and go for a fresh enumeration. On the Congress asking the Centre to adopt the 'Telangana model' for not just caste enumeration but also in bringing out detailed data on socio-economic parameters during the nationwide census, Yadav asked why the Congress did not follow the same practice in Karnataka. Congress' inner contradictions have been exposed as the party has no real commitment to social justice and resorts to such political gimmicks for electoral purposes, he said. In West Bengal, Chief Minister Banerjee asserted in the state assembly that her government was working to safeguard the interests of SCs, STs, backward castes, and Muslims, in line with the Supreme Court and High Court directives on social welfare. Karnataka Chief Minister Siddaramaiah also clarified that his government's upcoming socio-educational and caste survey is fundamentally different from the Centre's caste census. 'The Centre is only doing a caste census, while we are undertaking a comprehensive socio-educational and caste survey. The distinction is important,' he said.
