Karnataka High Court criticises conduct of officials of Nirmithi Kendra in denying information under RTI Act

The High Court of Karnataka has criticised the conduct of officials of the Nirmithi Kendra in attempting to suppress transparency by claiming that the Right to Information (RTI) Act is not applicable to the kendra, even though it is sponsored and controlled by the State government through the Rural Development and Panchayat Raj (RDPR) Department.
The court has also imposed a cost of ₹50,000 on the Nirmithi Kendra, Chitradurga, for denying information under the RTI Act by claiming that it is not a public authority but a private society.
Justice Suraj Govindaraj passed the order, while dismissing a petition filed by the project director of Nirmithi Kendra, Chitradurga, who had questioned the State Information Commission's 2017 direction for providing information sought by some persons under the RTI Act.
The court noted that the government had set up Nirmithi Kendras for developing low-cost technology alternatives for rural housing, and its control and supervision is under many top officials of the zilla panchayats and the district administrations belonging to the cadre of the Indian Administrative Service and the Karnataka Administrative Service,
Besides, these kendras are being funded by HUDCO, which is a government entity, and contracts are given to the kendra by the State government, and there is a preference for these kendras to carry out works of the government, the court pointed out.
A perusal of Section 2(h) of the RTI Act would indicate that it is not only funding, but also control, which would have to be considered to determine whether it is a public authority or not, the court said, while pointing out that not only the funding for these kendras is provided by the government, but the works carried out by them are also considered government's works.
'The attempt made by the officers of Nirmithi Kendra to suppress such transparency leaves much to be desired and does not inspire confidence. By way of such conduct, the Nirmithi Kendra, Chitradurga, has successfully avoided disclosure of information and details,' the court said, while declaring that Nirmithi Kendras as public authorities under the provisions of the RTI Act.

The Supreme Court on Wednesday ordered an SIT probe into alleged irregularities in payment of compensation to land owners by Noida Authority, which in several cases was 'exorbitant' highlighting the nexus between senior officials and land owners. A bench of Justice Surya Kant and Justice Joymalya Bagchi ordered a new special investigation team (SIT) of three Indian Police Service (IPS) officers, replacing the earlier SIT, which highlighted the irregularities in the land acquisition compensation payouts. The apex court also directed that there will be no project development in Noida without prior Environmental Impact Assessment and approval by the court's green bench, which hears environmental cases. In January this year, the court had constituted an SIT of three senior IPS officers from the UP cadre to investigate the 'overall functioning' of Noida Authority. The SIT report found that in at least 20 cases, land compensation paid to certain beneficiaries exceeded legal entitlements. It also named errant Noida Authority officials and raised concerns about potential collusion, centralised power, and a lack of transparency in the administrative operations of the authority. The court is currently hearing the anticipatory bail plea of a law officer of Noida over charges of 'release of huge amount of compensation in favour of some land owners who, it was alleged, were not entitled to seek such a higher compensation for their acquired land.' The new SIT, formed by the court on Wednesday, is directed to register preliminary enquiries and, if they find credible evidence of wrongdoing, escalate to FIRs under appropriate legal provisions. The court said that this process must be overseen by a police officer of at least Commissioner rank, who will also file periodic status reports to the court. The court has also told the Uttar Pradesh Chief Secretary to place the findings before the Council of Ministers and appoint a Chief Vigilance Officer (from IPS cadre or deputed from the Comptroller and Auditor General) within four weeks. Additionally, a citizen advisory board is to be constituted within the same timeframe. The matter has been adjourned for eight weeks, during which the SIT's report must remain under strict judicial supervision.

Agency: PTI Bengaluru, Aug 13 (PTI) The Karnataka High Court on Wednesday dismissed two petitions challenging the state government's decision to mandate the installation of smart pre-paid electricity meters for new consumers, despite concerns over their high cost compared to neighbouring states. Justice M Nagaprasanna, who reserved orders on July 22, noted that a Public Interest Litigation (PIL) raising similar issues is already pending before a division bench. 'Judicial discipline demands hierarchy, and propriety requires this court to show judicial hands off to the present petitions. Therefore, the subject petitions are not entertainable," the judge said. The court also recorded an earlier submission from Advocate General Shashi Kiran Shetty that the state would not compel the petitioners to install smart meters in their residences since these were not new connections. During earlier hearings, the bench had remarked on the stark price difference between Karnataka and other states, observing, 'Everywhere else it is Rs 900 for the same smart meter, here you are charging Rs 8,900 — where will poor people go? You have outsourced the work; this is dangerous. You are squeezing the poor." An interim order had been issued then, preventing the state from making smart meters compulsory in situations not covered by the Karnataka Electricity Regulatory Commission (Pre-paid Smart Metering) Regulations, 2024. Representing one of the petitioners, Senior Advocate Lakshmy Iyengar argued that the policy would eventually affect all consumers, questioning the tender process and highlighting the financial burden when other states offer the same meters at a fraction of the cost. Advocate General Shetty, however, maintained that the requirement applies only to new households, not to existing electricity consumers. KOCHI: The Kerala High Court on Wednesday ruled that all washrooms at petrol pumps located along National Highways must remain accessible to the public round the clock. For fuel outlets in other areas across the state, the court directed that washroom facilities should be made available to all customers and transit travellers, subject to safety and security considerations. Justice C.S. Dias issued the order while modifying an earlier interim directive from 17 June, which had restrained authorities from insisting that petrol pump washrooms be opened to the general public. The fresh ruling came in response to a petition filed by the Petroleum Traders Welfare and Legal Service Society, along with retail outlet dealers from Thiruvananthapuram and Thodupuzha. The petition challenged attempts by local self-government bodies to portray or convert privately maintained toilets at fuel stations into public toilet facilities. The court strongly criticised this approach, questioning how the government could transfer its responsibility under the Swachh Bharat Mission (SBM) to private dealers. 'It is the duty of the government to provide toilets under the Swachh Bharat Mission. How can the government compel someone else to open their toilets?' the court remarked. The state government presented SBM-Urban guidelines and a Ministry of Road Transport and Highways circular dated 26 December 2013, which mandates that drinking water and toilet facilities at fuel stations and rest area complexes along National Highways must be accessible to the public 24x7. The circular also calls for clear signage at such outlets indicating the availability of these amenities.
