PNB ‘fraud': CBI seeks to record statement of Nirav Modi's brother-in-law who sought to become witness
Mehta and his wife Purvi—Modi's sister—have become prosecution witnesses in the case filed by Enforcement Directorate (ED) and will be expected to depose against the accused, including Modi.
They had claimed in 2020 that they wanted to distance themselves from Modi, and could provide 'substantial and important evidence' relevant to him and his dealings.
They similarly sought to become witnesses in the CBI's case but their pleas are yet to be decided as the agency is yet to give its go-ahead.
Mehta was named an accused in the supplementary chargesheet submitted before the court by the CBI in July, with the agency claiming that he played an active role in the conspiracy along with the other accused to transfer funds received from the Punjab National Bank gained allegedly through issuance of fraudulent Letters of Undertaking.
This week, the CBI sought to record Mehta's statement under Section 164 of the Criminal Procedure Code, which is recorded before a magistrate. The court has directed Mehta to remain present before it on August 11 for recording of his statement.
If the CBI gives its no-objection to make him an approver, the court will then decide if he can be examined as a prosecution witness in the case, where his testimony including facts deposed against the accused, can be used as evidence.
On July 3, the Bombay High Court had directed that the cognizance of the supplementary chargesheet filed against Mehta not be taken till his application to turn approver is not decided. The high court directed the special court to decide on the plea expeditiously.
In its supplementary chargesheet, the CBI claimed that Mehta's role as one of the beneficiaries of the defrauded amount has surfaced. It said that in 2013, USD 81.09 million related to 43 LoUs issued by the Punjab National Bank were transferred to one company named Pacific Diamonds. The CBI alleged that in 2013, nearly 30 million USD from Pacific Diamonds were transferred to the savings account of Mehta, which he then transferred in 10 transactions to his sister Purvi. She claimed that she received these funds from Mehta as a gift. It was also claimed that Mehta was appointed nominee in accounts where transfer of funds related to the LOUs were made and had also claimed that Nirav Modi's father, Deepak Modi, had transferred USD 8.9 million to Mehta 'through their shell companies'.
The trial in both the ED and CBI cases is yet to begin. Modi is currently undergoing extradition proceedings in the UK, while those from his firms and the PNB staff are out on bail. Purvi is a citizen of Belgium, while Mehta who resides in Hong Kong, is a citizen of the UK, and works with a jewellery firm.

Robert Vadra-Linked 7 Firms In Delhi Named By ED As Accused In money Laundering Case
Businessman Robert Vadra, husband of Congress MP Priyanka Gandhi Vadra, used as many as seven firms linked to him and registered at an address in Sukhdev Vihar in Delhi in a tainted land deal in Gurugram in 2008, shows a prosecution complaint filed by the ED. All the seven firms have been named as accused in the case. In its complaint filed in a Special PMLA court, ED has shed light on Vadra's several alleged illicit acts like false statement with regards to receipt of sale consideration, under valuation of the land and loss of stamp duty caused to the state government. While alleging that Vadra received received Rs 58 crore as proceeds of crime (PoC) of the involved money laundering, the ED said its investigation led to the provisional attachment of 43 immovable properties, totaling Rs 38.69 crore, identified as direct or value equivalent to Proceeds of Crime. The Special PMLA court has fixed August 28 to take cognisance of the ED complaint filed on July 17 and issued a notice to Vadra. In the ED chargesheet, Vadra has been named as Accused Number 1 along with 10 others, including seven companies. The ED alleged that Vadra's company Skylight Hospitality Private Limited, despite having less capital, bought 3.5 acres of land in Shikohpur, Gurugram from Omkareshwar Properties Private Limited for Rs 7.50 crore. The probe agency claimed that Vadra virtually got the land for free. It said he had never issued the cheque to the seller of the land and the cheque mentioned in the sale deed did not pertain to the buyer, implying that Vadra never paid the money mentioned as sale consideration in the deed. 'Moreover, the cheque mentioned in the sale deed was much lower than the prevalent market rate which is evident from the fact that the seller itself was selling its other land in the nearby vicinity at much higher rates as compared to the rates mentioned in the sale deed dated February 12, 2008,' it said. The probe agency said that despite the application stating 3.53 acres, only 1.35 acre were available for commercial licensing, below the 2-acre minimum. 'Nevertheless, Directorate of Town and Country Planning (DTCP) officials in Chandigarh proceeded with the application by including land designated for a sector road. Statements from DTCP officials revealed pressure from higher authorities to accelerate the process. The file also showed backdating and alterations to the sector road plan to help M/s SLHPL qualify for the licence,' said the ED complaint. The other accused named in the ED prosecution complaint are: Satyanand Yajee; Kewal Singh Virk; Sky Light Hospitality Private Limited (now converted into Skylight Hospitality LLP); Sky Light Realty Private Limited, Real Earth Estates Private Limited (now converted into Real Earth Estates LLP), Blue Breeze Trading Private Limited, Artex, North India IT Parks Private Limited, Lambodar Art Enterprises India Private Limited (now converted into Lambodar Art Enterprises India LLP) and SGY Properties Private Limited (earlier known as Onkareshwer Properties Private Limited).

India should weigh benefits of Russian oil after US tariff hike: Banerjee
India should consider whether the cheap oil imports from Russia are 'worth it' after the Trump administration announced an additional 25 per cent tariff on Indian goods, Nobel laureate Abhijit Banerjee has said. Last week, US President Donald Trump signed an executive order, slapping an additional 25 per cent levy on India for New Delhi's purchases of Russian oil, bringing the total duties to 50 per cent -- among the highest imposed by the US on any country in the world. The additional 25 per cent duty will come into effect on August 27. "We need to think hard about whether Russian oil imports are worth it and then go back to the US to say that, you know, will they take it (tariff) off, if we stop importing Russian oil," Banerjee told PTI on the sidelines of an event organised by BML Munjal University. Since the steep tariffs are likely to hit the USD 27 billion of non-exempt exports that India does to the US, there has been chatter around stopping or curtailing oil imports from Russia. "It is not crazy to think about it. At a 25 per cent tariff, some of our exports are already not competitive, so maybe 50 per cent (tariff) does not matter," the eminent economist said. India is the largest importer of Russian crude, purchasing 1.6 million barrels per day in July. However, it has not placed any orders for August and September, mainly because the discounts that initially encouraged Indian refiners to import oil from the Black Sea have decreased to about USD 2 per barrel. In terms of volume, India imported 88 million tonnes from Russia in FY25, out of the total shipment of 245 million tonnes. With such a minimal price advantage compared to other internationally available oil, Indian refiners did not place any orders for August and September. Oil companies typically secure import contracts about two months in advance, meaning the supplies for August and September were arranged before Trump's August 7 announcement of higher tariffs. The bilateral trade deal between the US and India has been stuck over the US demand for greater access to India's agricultural and dairy market. Asked if India should lift curbs on investments from China, Banerjee said, "Maybe we should combine that with trade negotiations with China". "I think it is a good moment to do it. The Chinese also need to think of how they will deal with the US, and what leverage points they have," Banerjee added. Following the Galwan clash in 2020, India took a hard stance on China and its companies operating in the country. Under Press Note 3 of 2020, the government has made its prior approval mandatory for foreign investments from countries that share land borders with India. These countries are China, Bangladesh, Pakistan, Bhutan, Nepal and Afghanistan. Following the decision, FDI proposals from these countries need government approval for investments in any sector in India. Asked whether India should join the ASEAN trading block, he said, "Maybe, I think we need to. I think China is much more important than ASEAN". Responding to a question on how he sees the Indian economy doing this year amid geopolitical tensions and trade uncertainties, Banerjee said, "Not as good as we expected". He pointed out that the middle class is actually hurting, and for the past few years, private investments have also not picked up. "Companies like TCS are not hiring, the salary of IT employees is not increasing... These are all issues we have not dealt with, and we are sitting on them, so we need to kind of embrace the fact," he said.
