NPA and DJ Sumbody's family welcome court's decision to deny Katiso Molefe bail

The National Prosecuting Authority (NPA) and the family of DJ Sumbody (Oupa Sefoka) have welcomed the ruling made by the Alexandra Magistrate's Court, which on Wednesday denied the bail application made by the alleged murder-for-hire accused, Katiso Molefe.
Molefe, accused of masterminding the violent killings of popular musicians DJ Sumbody and DJ Vintos, as well as Armand Swart and Don Tindleni, has been described as a danger to society, with the means to use his bail to interfere with witnesses and the ongoing investigation.
The 61-year-old briefly appeared in the Alexandra Magistrate's Court on Wednesday for the 2022 murder case of DJ Sumbody and his two bodyguards, who were killed in a hail of bullets in Woodmead.
Molefe is alleged to have hired Michael Pule Tau, Tiego Floyd Mabusela, and Musa Kekana as the alleged hitmen to carry out hits on the victims on Molefe's instructions.

The four murder accused are also charged with the April 2024 murder of Vereeniging engineer Swart, killed in an alleged case of mistaken identity after his company blew the whistle on tender corruption.
They are also implicated in the March 2023 murder of a man identified as Don Tindleni on the N1 near the N17 offramp.
While the State has argued that Molefe ordered the hit, Molefe has maintained that he could not be linked to the charges brought against him.
Magistrate Reneir Boshoff rejected Molefe's bail plea, saying the accused might interfere with ongoing investigations if he is released on bail, adding that the alleged mastermind also failed to prove exceptional circumstances to justify his release on bail, citing previous convictions and the ongoing murder case of Swart as some of the reasons.
"The applicant's personal circumstances are before the court. Significantly, the applicant has a previous drug-related conviction in the UK... He also has a fraud conviction relating to his stay in the UK. What is of concern is the fact that he used a false Lesotho passport together with a false name or alias, David Tembo Lebitsa... Another concern this court has is the large amounts that were paid into the applicant's company's account in the absence of an explanation, strongly suggesting unidentified sources of income," stated Boshoff.
Reacting to the court's decision, NPA spokesperson Phindi Mjonondwane echoed the magistrate's sentiments, saying: "We have cited in court that the accused person is a danger to society. He knows that if convicted, he faces a lengthy imprisonment term, which is an incentive for him to evade his trial.
"Also, we believe that the interest of justice does not permit his release on bail, considering that he is a danger to society and could tamper with the ongoing investigation."
On the prospect of their case, Mjonondwane said the State has strong evidence, which has already been cited by the court, that Molefe is indeed the alleged mastermind with bank transactions, WhatsApp messages, and other communications at the centre of the State's case.
Chad Thomas, speaking on behalf of DJ Sumbody's family, who attended the case on the watching brief for the family, said that despite the damage caused by the contract killing to the family, the family feels relieved by the ruling.
"As the Sefoka family, we are satisfied with this outcome, and we believe that a lot of people are going to sleep easier tonight knowing that the purported mastermind of the murder-for-hire syndicate remains behind bars. The most important thing for us now is to see the NPA and law enforcement agencies work tirelessly to bring a stop to what has become a norm in South Africa, where people hire izinkabi (hitmen). This is something that should not be tolerated," he said.
Molefe is expected to return to court alongside his co-accused on September 18 for the indictment process.

Durban High Court hears evidence of discrepancies in waste collection audit in DSW matter

Furthermore, the audit report supporting this figure may have been inaccurate. The Durban Solid Waste (DSW) tender fraud case involves former eThekwini Municipality mayor Zandile Gumede, who is one of the 21 accused. They face multiple charges, including fraud, racketeering, corruption, money laundering, and violations of the Municipal Finance Management Act and the Municipal Systems Act, all related to the R320 million DSW tender. A state witness, who worked at the solid waste unit in 2017, compared the number of households requiring waste services as reflected in the closed tender drafted in December 2017 with the number indicated in the audit report. She noticed a significant difference of 86,431 households between the tender and the audit report. Allan Robert Abbu, the fourth accused, was the deputy head of the Solid Waste Unit at that time. In her evidence-in-chief, the witness mentioned that she could not explain the source of the additional numbers. The defence challenged the State's assertion that Abbu dictated these additional numbers to a contract administrator who drafted the December tender document. Advocate Jay Naidoo SC, counsel for Abbu, pointed out that the contract administrator who testified did not support this claim. During his cross-examination, Naidoo, who also represents Gumede, examined the audit report with the witness. He read a page that included a declaration made by the auditors, highlighting a column labelled "Accuracy and Validity Risk." Naidoo quoted, "Data on the measurement/payment certificates indicating the percentage of households with access to a basic level of solid waste removal may be invalid or inaccurate." He then asked the witness what this meant. The witness confirmed that the report was compiled by the city's internal auditors and noted that the aerial photographs used were taken in 2011. Image: YouTube Screenshot via SABC News Murder-accused Katiso 'KT' Molefe, charged with the killing of Oupa Sefoka, also known as DJ Sumbody, and his two bodyguards, was denied bail on Wednesday, 20 August 2025, at the Alexandra Magistrate's Court. Magistrate Reneir Boshoff delivered a 12-minute bail judgment where he listed a slew of reasons and concerns why Molefe was denied bail. Molefe is alleged to have plotted the execution-style murder the of DJ Sumbody who was killed on 22 November 22 together with his two bodyguards, Sibusiso Mokoena and Sandile Myeza. He was murdered following a performance at News Café in Woodmead, Johannesburg. It's alleged Molefe and DJ Sumbody were feuding over a multimillion-rand drug deal around the time the music producer was gunned down. Boshoff cited other pending cases and convictions against Molefe including the killing of Philip Swap in April 2024 and the pending murder case of DJ Sumbody together with three other accused. He further highlighted incidents of drug dealing and fraud committed by the accused. 'It is significant he was convicted of drug trafficking in the UK for the possession of cannabis. He was charged with fraud related to his stay in the UK. 'What is really concerning is that he used a fake passport with an alias, David Tabbor Leita. While this may have happened way back in 2004, it raises concern about what the applicant is capable of,' said Boshoff. Boshoff alluded to Molefe being a flight risk when expressing concern over the large bank deposits into Molefe's business bank account. This, he said, points to a source of income. 'The applicant suggest that the State's case against him is extremely weak and circumstantial by nature. It is true that the evidence against the applicant because of his role in the killings will be distant as he was not physically present during the (killing). The absence of direct evidence does not mean that an inference of guilt can't be deducted,' said Boshoff. The magistrate indicated that contact between Molefe and three other accused in this murder case, via WhatApp and cellphone communication formed part of the evidence in the State's case against Molefe. The magistrate further commented on the allegations by the State of Molefe paying the three accused large sums of cash following DJ Sumbody's murder. 'The cellphone records after these so-called hits between the respective accused are indeed very interesting. Accused one frantically trying to reach the applicant moments after the Sandton hit on DJ Somebody. He made no less than eight calls to the applicant,' said Boshoff. Boshoff also spoke of concerns by the State that witnesses lives may be endangered should Molefe be released on bail. This comes in the wake of messages sent via WhatsApp by Molefe to the other accused's family members when he was initially released on bail. Some of the messages suggested that Molefe could arrange his release from prison. 'Although bail was granted in the High Court regarding the case, this court is of the respectful opinion that a lot has changed since then. The current counts are of a very serious nature and can definitely increase the risk to abscond. Very important, the evidential link between the four accused persons in this case appears to have increased,' said Boshoff. According to the magistrate several facts are taken into consideration when such judgments are made. These include: the freedom of the individual, his right to be innocent until proven guilty and the interest of justice. 'There's also the statutory framework requiring that the accused must on a balance of probabilities show the existence of exceptional circumstances to permit his release on bail,' said Boshoff. In this regard, Molefe has not proven his innocence stated the magistrate. 'Considering all the relevant facts and circumstances, the court makes a value judgment and finds the applicant failed to put exceptional circumstances justifying his release on bail…As I highlighted there are a number of concerning aspects, not only linking the applicant to the crimes, but his circle of influence and capabilities.
