Chief Minister Stalin wanted to challenge the Waqf (Amendments) Act in SC: MP Wilson

DMK Rajya Sabha Member P. Wilson on Saturday said amendments to the Waqf Act brought about in 1995 were sufficient, and the BJP's decision to form a committee and its actions were 'oppressive'.
Speaking at the 'Save Waqf, Save Constitution' panel discussion organised by the All India Muslims Personal Law Board (AIMPLB), he said Chief Minister M.K. Stalin passed a resolution in the Assembly when the Waqf (Amendments) Act, 2025, was introduced in Parliament.
'Only the BJP opposed the resolution and staged a walkout from the Assembly. The BJP has betrayed the Muslim community and the AIADMK has formed an alliance with them. When the Bill was sent to a Joint Parliamentary Committee, the DMK appointed two of its MPs, A. Raja and M.M. Abdullah, who travelled across India for over nine months and participated in consultative meetings and opposed the amendments. The committee's objections were given in writing, and we caused a ruckus in Parliament. We debated it for 15 hours, and it was passed early in the morning. We voted against it,' he said.
He added that the Chief Minister M.K. Stalin had said that the Waqf Act should be challenged in Supreme Court. 'After it was passed in the Rajya Sabha on April 4 and became an Act on April 5, we filed a case against it on April 7.'
Former Madras High Court judge Justice D. Hariparanthaman said the latest Waqf Act amendments should be compared to the Hindu Religious and Charitable Endowments Act and compared to the rights available to the majority community.
'Section 104 of the Waqf Act which says that anyone can donate to Waqf... has been removed. Now, not even a Muslim can donate but he/she should have been a Muslim for five years. Does HR and CE Act have such a section? A Muslim, Christian, Jain is not prevented from donating to the Mylapore temple. This is the first act that prevents donation. All powers of the Waqf Act are being taken over by the Central government,' he said.
R. Vijayasankar, former Editor, Frontline, highlighted the role of the media in spreading hate against Muslims and underlined the lack of representation of Muslims, Scheduled Castes and Other Backward Communities within mainstream media.
Advocate A. Arulmozhi, retired IAS officer G. Balachandran, and Rahmathunissa, member, AIMPLB, also participated.

New Delhi: The Supreme Court has once again expressed its displeasure with an order of the Allahabad High Court for failing to apply settled legal principles while rejecting a plea for suspension of sentence in a fixed-term conviction. The observations from the top court came days after it pulled up an Allahabad High Court judge for allowing criminal proceedings in a civil dispute case. In an unprecedented order, a bench of Justices J B Pardiwala and R Mahadevan on August 4 stripped criminal matters of the roster of a Allahabad High Court judge "till he demits office" after he "erroneously" upheld summons of criminal nature in a civil dispute. The same bench came hard on the high court decision in another case. "The impugned Order is one more from the High Court of Judicature at Allahabad with which we are disappointed," it said, adding that this plea arose from an order passed by the High Court on May 29, in a criminal appeal by which the high court declined to suspend the substantive order of sentence passed by the trial court. "We are once again constrained to observe that such errors creep in at the level of the High Court and only because the wellsettled principles of law on the subject are not applied correctly. "It is very important to first look into the subject-matter. Thereafter the court should look into the issue involved. In the last the court should look into the plea of the litigant and then proceed to apply the correct principles of law," Justice Pardiwala said in an order on August 6. The apex court observed that the High Court's order was legally flawed and demonstrated a disregard for established jurisprudence. It was hearing an appeal filed by a convict who had been sentenced to four years of rigorous imprisonment under various provisions of the Protection of Children from Sexual Offences (POCSO) Act, Indian Penal Code (IPC), and the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. The sentences were ordered to run concurrently. The convict had approached the high court with an application under Section 389 of the Criminal Procedure Code, seeking suspension of his sentence. However, the high court rejected the plea solely on the ground that the offence was "heinous", without evaluating the request in light of the settled law. Setting aside the high court's order, bench cited a landmark judgment which mandates that appellate courts should adopt a liberal approach in suspending fixed-term sentences unless exceptional circumstances exist. Emphasizing the need for judicial clarity, the bench said, "It is very important to first look into the subject matter. Thereafter, the court should examine the issues involved, and only then consider the plea of the litigant before applying the correct principles of law." The apex court took particular issue with the high court's failure to analyze the application on legal grounds. "What the high court did was to reiterate the prosecution's case and the oral evidence, without engaging with the legal test for suspension of sentence in a fixed-term conviction," the bench observed. It has now remanded the matter back to the high court for fresh consideration, directing it to pass an appropriate order within 15 days. "The High Court shall keep in mind that the sentence is for a fixed term, that is four years and it is only if there are compelling circumstances indicating that release would not be in public interest, that suspension may be denied," the order clarified.

Kolkata, Aug 7 (UNI) In a blistering attack on the Election Commission of India (ECI), All India Trinamool Congress (AITC) national general secretary Abhishek Banerjee today accused the poll body of acting as an 'extended arm of the BJP' and grossly overstepping its constitutional jurisdiction by interfering in the affairs of the West Bengal government well ahead of the assembly election announcement. Banerjee alleged that the ECI was interfering in the functioning of the West Bengal government nearly a year ahead of the state assembly elections which he claimed was aimed at crippling the elected administration and benefiting the ruling party at the Centre. 'The ECI is acting beyond its jurisdiction. Its responsibility begins only when the Model Code of Conduct comes into effect. After that, it can take over the state's civil and criminal/police administrative machinery to ensure that the election is free, fair, and the work they have started for the past 3–4 months,when the election is still 10–11 months away, clearly shows that since they will not allow an elected government to function, they have done this. It has been done to give favours and advantages to the BJP,"Banerjee said at the city airport. He alleged that they (Centre) have denied Bengal its rights and, at the same time, misused the judiciary. "They have used a section of the media to defame Bengal by using a case like Sandeshkhali. Now they are using the ECI so that genuine Bengalis cannot exercise their right to vote. The ECI has taken on this shameless role so that they can snatch away the voting rights of these people. This is not within the ECI's jurisdiction anymore. They should have informed the State about their actions because this is an elected government,"Banerjee continued. Banerjee, the nephew of Chief Minister Mamata Banerjee, said that the people had voted the TMC to power in 2021, and the government was accountable only to them and not to any political party or the Centre. 'We respect the judiciary, but since 2021, over 50 CBI investigations have been conducted through different benches of the Calcutta High Court, using the Centre's influence to undermine Bengal and keep AITC under pressure,' he pointed out. He said the state was also defamed and attacked nationally over the RG Kar case. But when the CBI took over, it failed to improve upon what the Kolkata Police had already achieved within 24 hours. 'Those who are trying to belittle Bengal have been answered in the past and will be taught a lesson again. But the BJP never learns from its have stopped all funds under the Jal Jeevan Mission. All the money has been blocked. Water is life. Even that has been stopped. How will the people survive?' said Banerjee, who has been named the leader of the AITC Parliamentary Party. He also charged Prime Minister Narendra Modi with a foreign policy failure after the Donald Trump administration imposed a 50 percent tariff on Indian goods exported to the USA. When asked about the 50 percent tariff, Banerjee responded:'Ask these questions to the one who has pictures with him. Ask these questions to the one because of whom Donald Trump came here to campaign, and to those who went to Texas in 2019 to campaign for Trump. "A 50 percent tariff has been imposed on India, and it will have consequences. Exports will be affected, especially in three industries — IT, pharmaceuticals, and textiles. The services around these sectors will also be impacted. Employment will decline, and the Indian economy will suffer. I believe this is a diplomatic failure, and India should respond firmly to this," Banerjee said. 'Those who want to weaken India and create pressure, how did they suddenly become so powerful? The government, which used to boast about its '56-inch chest,' has been snubbed by China, the US, and many other countries,' the Diamond Harbour MP said. 'Neither Mamata Banerjee nor Trinamool invited Donald Trump. We did not go and campaign for him. I am quoting PM Modi: 'I present to you, my friend and India's friend, Donald Trump.'
