HC upholds PhD for scholar pursuing part-time tabla diploma

Chandigarh: The Punjab and Haryana high court has dismissed an appeal by Maharishi Dayanand University (MDU), Rohtak, upholding a single bench's decision that a PhD research scholar cannot be denied a doctoral degree for simultaneously pursuing a part-time diploma in 'tabla'.
The court further ruled that the scholar is entitled to receive his degree without refunding a university scholarship.
"We have carefully perused the PhD ordinance as well as the University Research Scholarship (URS) ordinance... It has been correctly held that such part-time evening courses (tabla course) do not interfere with PhD studies," a division bench comprising Justice Lisa Gill and Justice Sudeepti Sharma held in its order released on Monday.
The bench further noted that the university failed to point out any illegality, infirmity, or irregularity in the impugned order passed by the single bench.
The ruling came as the court dismissed MDU's appeal against a Feb 11 order. That order had granted relief to Pradeep Deswal, who had sought directions for the university to award him his PhD degree.
The primary contention in the case revolved around MDU vice-chancellor's decision to grant Deswal his PhD only upon the refund of Rs 4,95,833, the full amount of the University Research Scholarship he had received.

The university's counsel argued that while MDU had no objection to granting the degree, Deswal needed to repay the scholarship due to his enrolment as an advocate and his pursuit of the tabla course during his PhD studies.
The university maintained that Deswal failed to disclose his enrolment as a lawyer and the tabla course, and the vice-chancellor's refund requirement was "fair and balanced".
After examining the matter, the division bench observed that it was the specific case of the petitioner (Deswal) that as he was active in politics apart from regular studies, a complaint was filed against him due to extraneous considerations.
Though he enrolled with the Bar Council in 2011, he filed his first power of attorney in a court of law in 2020, having concentrated solely on his studies prior to that. The division bench noted that Deswal's averment regarding his delayed legal practice was not specifically refuted by the university.
The court observed, "Counsel for appellants was unable to point out any bar, which may be applicable upon the writ petitioner to pursue his PhD while being enrolled as an advocate."
Regarding the tabla diploma, the bench reiterated that Deswal undertook the course on a part-time basis in the same university, specifically in evening classes. "It has been correctly held by the learned single bench that such would not interfere with the studies of the writ petitioner in so far as his pursuit in the doctorate in laws was concerned. Thus, in our considered opinion, the order dated February 11 has been correctly passed, and the writ petitioner is indeed entitled to a degree in doctorate in the programme of laws without insistence upon refund of the scholarship amount," the high court ordered.

BENGALURU: The Directorate of Enforcement (ED), Bengaluru, has filed a complaint against fashion etailer Myntra, and its related entities under the Foreign Exchange Management Act (FEMA), 1999, for allegedly violating foreign investment rules to the tune of Rs 1654,35,08,981 (Rs 1,654.35 crore) under the guise of wholesale trading. The complaint was filed under Section 16(3) of FEMA. In another case, ED filed a complaint under Section 16(3) of FEMA against Bengaluru-based 'One Sigma Technologies Pvt Ltd' (SIMPL) and its director Nithya Nand Sharma, for contravention to the tune of Rs 913,75,88,062 (Rs 913.75 crore). The company is behind the popular Buy Now Pay Later (SIMPL) app, which allows customers to buy now and pay later in instalments. In an official release on Wednesday, the ED stated that inquiry into Myntra's books was initiated on the basis of 'credible information that Myntra Designs Private Limited (Myntra) and its related companies are doing Multi Brand Retail Trade (MBRT) in the guise of 'Wholesale Cash & Carry', allegedly in violation of the extant Foreign Direct Investment (FDI) policy'. The ED investigation revealed that Myntra had 'declared that they were engaged in the business of wholesale cash & carry and invited and received FDI from foreign investors equivalent to Rs 1,654.35 crore, and that they sold a majority of their goods to Vector E-Commerce Pvt Ltd (which sold the goods in retail to the ultimate customer). Vector E-Commerce and Myntra are related parties and belong to the same group or group of companies'. 'Vector was created and continued to be used as a corporate entity to bifurcate the B2C (business to customer i.e Myntra to retail customers) transaction into B2B (Myntra to Vector) and then B2C (Vector to retail customers),' the ED added.

CHENNAI: Following directions from the Madras High Court, the Tamil Nadu State Marketing Corporation (Tasmac) has begun implementing its empty bottle buyback scheme across the state in a bid to curb the environmental impact of discarded liquor bottles. As part of the initiative, tenders have been floated in 17 districts including Chennai, Kancheepuram, Tiruvallur, Villupuram, Madurai, Tirunelveli, Tenkasi, Thanjavur, and Dindigul. Tasmac officials said the tenders are likely to be finalised before the second week of August. 'The bottle buyback scheme has been fully implemented in nine districts, including Perambalur, Ariyalur, and the Nilgiris. It has also been introduced partially in seven more districts. Under the scheme, nearly 95-97% of empty bottles are now being recovered from consumers. So far, we have collected about Rs 450 crore and refunded Rs 350 crore. The rest of the amount is maintained in separate account,' a senior official told TNIE. Currently, the scheme is active in around 1,200 of Tasmac's 4,829 retail outlets. The official added that the scheme will be rolled out across all districts by November. Under the scheme, customers are charged an additional Rs 10 per bottle, which is refunded when the bottle is returned. Once tenders are finalised, bottles will carry stickers indicating the shop number for tracking the initiative aims to reduce environmental damage, workers at Tasmac outlets say implementation challenges remain. 'Customers hand over used bottles directly to us. We are forced to receive them without any safety gear like gloves. Several staff have developed skin infections, but no action has been taken,' said a Tasmac employee on condition of anonymity. 'Each outlet is supposed to have 500 sq ft for storage, but many shops, especially in congested areas, operate in much smaller spaces. We request authorities to allot more space for storing the empty bottles,' said another worker.
