SC refuses to quash Pocso charges against judge, cites shocking allegations

The Supreme Court on Wednesday refused to quash proceedings under the Protection of Children from Sexual Offences (Pocso) Act against a suspended judicial officer accused of sexually abusing his daughter.
Describing the case as 'shocking', the bench of Justice Prashant Kumar Mishra and Justice Manmohan held that it was certainly not fit for quashing by any legal standard. The observations were made during the hearing of a special leave petition in Sandeep vs State of Maharashtra.
Bombay High Court order upheld
The petition was filed against the 15 April order by the Bombay High Court, which had also declined to quash the charges under the Pocso Act.
According to LiveLaw, Justice Manmohan further stated orally: 'This is a shocking case. This is a judicial officer—serious allegations of incest! Madam, this is not the case to be entertained for quashing by any standard. I don't know what legal advice you are getting, but this is not a case, certainly, by any standard. Your daughter is making the allegations, no? She must have been scarred for life.'
Petition dismissed, trial to be expedited
The bench dismissed the petition, stating, 'After hearing learned counsel for the petitioner, we are not inclined to interfere with the order impugned passed by the High Court.'
Additionally, the court directed that the name of the victim be masked wherever it appears in the paperbook of the special leave petition. The court also allowed the trial to be expedited, paving the way for faster proceedings.

Kochi: High court on Thursday directed the Vizhinjam port authorities to arrest the ship MSC MANASA F, a sister vessel of MSC ELSA 3, which capsized and sank off the Kerala coast on May 25, until an amount of Rs 6 crore is deposited towards the claim raised by three cashew importing companies for losses suffered due to the shipwreck. The order was issued by Justice Abdul Hakhim in response to petitions filed by Saji Surendran of Mangalathu Cashews, R Rajendran of RRR Enterprises and representatives of J J Trading Company. All three petitioners are members of the Cashew Export Promotion Council. In the order, HC clarified that if the shipping company produces a demand draft for Rs 6 crore, the vessel MSC MANASA F may be permitted to leave the territorial waters of the state. Following the court's direction in the Admiralty suits, MSC (Mediterranean Shipping Co SA), the owner/operator of the vessel, submitted the demand draft for the said amount to the HC by the afternoon. Accordingly, the court permitted the release of the vessel and adjourned the Admiralty suit for further hearing on the compensation claim to July 15. The petitioner companies, based in Kollam, stated in their pleas that they had purchased dried raw cashew nuts from a trading company in Dubai, which were shipped in containers bound for Tuticorin port. According to the petitioners, the consignments were expected to arrive at Tuticorin on May 24 aboard MSC ELSA 3. However, the Indian agent of the shipping company informed them via email on May 28 that the vessel had sunk on May 25 en route from Vizhinjam to Kochi, resulting in the total loss of cargo. This led the companies to file Admiralty suits seeking compensation. Mangalathu Cashews, RRR Enterprises, and J J Trading Company raised claims of Rs 1.54 crore, Rs 1.63 crore, and Rs 1.58 crore, respectively, along with interest at 18% per annum. 1 2 Hyderabad: The Telangana high court on Thursday directed the Jubilee Hills International Centre (popularly known as Jubilee Hills Club) to stop all ongoing construction at their premises till it gets building permission from the Greater Hyderabad Municipal Corporation ( GHMC ). Justice B Vijaysen Reddy gave the interim direction while hearing a petition filed by P Venugopal and N Srinivas of Jubilee Hills questioning the inaction of GHMC despite bringing to their notice the unauthorised construction at the club in survey no. 403/1, Road No.14, Jubilee Hills. Senior counsel V Ravi Kiran Rao, appearing for the petitioners, said the club was building a huge banquet hall without permission from GHMC or no-objection certificate (NOC) from fire authorities. "The club management is not responding to the notices of the GHMC officials and authorities are not taking up the issue with the required seriousness," he said. GHMC counsel Midde Arun Kumar informed the court that they had issued a show cause notice which did not yield any response. He said that the deputy commissioner then passed a speaking order directing the club to demolish the unauthorised structure on its own or face the consequences. "Now, the club management has applied for a building permission and officials are examining the record," he said. Ravi Kiran said this was proof of the audacity of the club management which applied for permission only after they were left with no option and, hence, the GHMC should not process their current application. "Otherwise, they will never follow the law," he said. Advocate on record A Raghuram said the governing council of the club was going to the extent of harassing the petitioners with FIRs for playing the role of a whistleblower and alerting authorities about the illegal structure without setbacks, parking space and fire safety measures. Gurgaon: The district town planner (enforcement) has initiated an investigation into illegal modifications in 40 houses in DLF 2. However, sources in the enforcement wing said the department suspects the number of violators may exceed the current list of 40 homes. "What has come to light is just the tip of the iceberg. More properties may be surveyed as the probe expands," an official requesting anonymity said. The list of irregularities includes additional floors constructed without approval, encroachments in front and rear setbacks, misuse of stilt parking and unauthorised alterations in balconies — all of which violate approved building plans and occupancy norms. The crackdown on rampant unauthorised construction in one of Gurgaon's most posh colonies follows a formal complaint by the maintenance agency of DLF Estate Developers Limited, which submitted photographic evidence and a detailed list of violations to the town planning department. The violations span across multiple blocks — K, J, L, M, N, Q, Gulmohar, Kesia and Madhya Marg — where homeowners are allegedly flouting building norms with impunity. Acting on the complaint, the town planner's office directed a junior engineer to survey the listed properties and submit a report within a week. "Once the report is submitted, show-cause notices will be issued, followed by restoration orders. If violations are not addressed, sealing of premises and cancellation of occupation certificates will be initiated," town planner Amit Madholia said. This action comes in the backdrop of a wider crackdown ordered by the Punjab and Haryana high court against illegal construction in DLF 1 to 5. So far, over 5,000 houses were served notices in that case. However, Supreme Court has currently stayed coercive action, with the next hearing scheduled for July. In the meantime, the town planner is continuing its departmental proceedings based on fresh complaints. Urban planning experts say the situation in DLF reflects a larger trend across upscale colonies in Gurgaon, where lack of monitoring and weak enforcement have led to systematic violations of the Gurgaon Master Plan. "The system of self-regulation by residents has completely failed. It's time the authorities made examples out of serial violators," said an architect familiar with DLF developments.
