Mangaluru court grants bail to five accused in mob lynching case

The second Additional District and Sessions Court, Mangaluru, granted bail to five persons arrested in connection with the mob lynching of 38-year-old ragpicker Ashraf, near Kudupu on the outksirts of Mangaluru, on April 27.
Bail applications of another seven persons are pending before the court.
Police had arrested 20 persons in connection with the case.
The court granted bail to Rahul, a resident of Kadri, and K. Sushanth, a resident of Kudupu, on May 31.
Bail was granted to Sachin, a resident of Kudupu; Deekshith, a resident of Padil; and Sandeep Basavarajappa Haveri, a resident of Kudupu; on June 5.
The bail applications of Saideep, Anil Kumar, Yathiraj, Viviyan Alvaris, Shri Dattha, Dhanush and Kishore Kumar are pending before the court.
On April 27 evening, Ashraf, a 38-year-old native of Wayanad in Kerala, reportedly entered a playground near Kudupu where a cricket tournament was in progress. He allegedly raised slogans in support of Pakistan. This lef to more than 25 persons, who were playing cricket, allegedly assaulting Ashraf resulting in his death.
Mangaluru Rural police arrested 20 persons for offences punishable under Sections 103 (2)b (mob lynching), 115 (2) (voluntarily causing hurt), 189 (2) (unlawful assembly), 191 (1) (rioting), 191 (3), 240 (giving false information with respect to an offence) read with Section 190 of Bharatiya Nyaya Sanhita, 2023.
In the judgment allowing applications of Rahul (accused no. 10) and Sushanth (accused no. 20), the judge observed that while the incident occurred at 3 p.m. on April 27, statements of witnesses were recorded on April 28 night, and the first information report was received by the jurisdictional magistrate on April 29 morning.
'This fact creates serious doubt regarding the manner of occurrence of the incident, involvement of the petitioners and other accused named in the FIR, and the first information statement,' the judge observed.
In a separate judgments granting bail to Sachin (accused no. 19), Deekshith (accused No. 17) and Sandeep Haveri (accused no. 16), the judge made note of the bail granted to Rahul and Sushanth. The judge said names of Sachin, Deekshith and Sandeep Haveri were not found in the compliant. Presence of the three petitioners at the time of the incident has to be proved by the investigation agency by filing a detailed charge-sheet, the judge noted.
In the hearing on separate bail applications of Saideep and six others on June 6, the court had directed the investigation officer to submit confidentially on June 9 the list of arrested persons whose voice samples are to be collected.

She stepped out of our house around 7pm on August 18 and was found near Nithora village around 10pm. She told us some unidentified person raped her near a tubewell at Nithora village,' the woman's father stated in the FIR. Police denied social media posts suggesting she was gangraped. 'The woman is not able to speak or hear properly. She was not able to convey the sequence. We have now requested an expert to speak to her,' said ACP (Loni circle) Siddharth Gautam. 'So far, we have come to know that she came home walking on her own, and midway she also tried to call up her family from a phone of a passerby. But the sequence of events is unclear. An investigation is on,' the ACP added.

A group of armed suspects assaulted two students and torched their scooter on suspicion of spying with drones, a rumour that later turned out to be false, Faridabad police said on Wednesday. The victims, Ayush, a third-year engineering student, and his friend Avi Kumar, a first-year BBA student, suffered bruises and cuts in the assault. Police said the attack took place between 8.30pm and 9pm on Monday inside Triveni Society in Sector 78, where the duo had gone for a shoot. Inspector Arvind Kumar, station house officer of BPTP police station, said the students were working on a college project based on artificial intelligence. 'For that, they were clicking photos inside one of the abandoned buildings of the society. It was the flashes of the cameras that attracted the attention of Khatana and a few of his associates from a distance. They spread a rumour in their village that drones were being flown in their area for spying,' he said. The SHO said Khatana then gathered men from his village, armed with sticks and batons, and confronted the students. 'They assaulted the two students… The suspects also torched the scooter and their equipment,' he added. Police said someone alerted the control room, following which an emergency response vehicle reached the spot. Three policemen tried to shield the victims when the mob attacked them, injuring a constable. Some officers managed to record a video of the incident and overpowered Khatana before calling reinforcements. Both students and the injured constable were taken to a government hospital for treatment. Based on Ayush's complaint, an FIR was lodged at BPTP police station on Tuesday against at least 15 suspects for assault, rioting, deterring a public servant from duty, and other provisions under the Bharatiya Nyaya Sanhita. Police said the remaining suspects will be arrested soon.

A dental and eye clinic in Sector 52 illegally carrying out pregnancy termination was busted on Tuesday, police said. The main accused who runs the centre has been booked but is currently at large. A health department official said Sarkar was carrying out pregnancy termination of women illegally, putting their lives at risk, while also selling medical termination of pregnancy (MTP) kits to the women at exorbitant prices. 'We had received information from a person about suspicious activities at the clinic following which a team was formed on the direction of the civil surgeon of Gurugram for carrying out the raid,' he said. Twenty MTP kits were recovered from the clinic, some of which were used, making it clear that he was carrying out pregnancy termination at the spot, the health official said. To be sure, MTP kits can only be purchased on the basis of prescriptions from certified gynaecologists. Officials said a certificate issued in the name of the accused running the centre was also found on the spot, mentioning that he was a certified optician. Sandeep Kumar, public relations officer of Gurugram police, said further investigation was underway to ascertain how many women had reached there for pregnancy termination. 'We were trying to nab the suspect as soon as possible,' he said. On complaint of the Jai Parkash, the nodal officer under the Pre-Conception and Pre-Natal Diagnostic Technique Act, an FIR was registered under various sections of the Bharatiya Nyaya Sanhita and the Medical Termination of Pregnancy Act at Sector-53 police station on Wednesday.
