Mangaluru court grants bail to five accused in mob lynching case

The second Additional District and Sessions Court, Mangaluru, granted bail to five persons arrested in connection with the mob lynching of 38-year-old ragpicker Ashraf, near Kudupu on the outksirts of Mangaluru, on April 27.
Bail applications of another seven persons are pending before the court.
Police had arrested 20 persons in connection with the case.
The court granted bail to Rahul, a resident of Kadri, and K. Sushanth, a resident of Kudupu, on May 31.
Bail was granted to Sachin, a resident of Kudupu; Deekshith, a resident of Padil; and Sandeep Basavarajappa Haveri, a resident of Kudupu; on June 5.
The bail applications of Saideep, Anil Kumar, Yathiraj, Viviyan Alvaris, Shri Dattha, Dhanush and Kishore Kumar are pending before the court.
On April 27 evening, Ashraf, a 38-year-old native of Wayanad in Kerala, reportedly entered a playground near Kudupu where a cricket tournament was in progress. He allegedly raised slogans in support of Pakistan. This lef to more than 25 persons, who were playing cricket, allegedly assaulting Ashraf resulting in his death.
Mangaluru Rural police arrested 20 persons for offences punishable under Sections 103 (2)b (mob lynching), 115 (2) (voluntarily causing hurt), 189 (2) (unlawful assembly), 191 (1) (rioting), 191 (3), 240 (giving false information with respect to an offence) read with Section 190 of Bharatiya Nyaya Sanhita, 2023.
In the judgment allowing applications of Rahul (accused no. 10) and Sushanth (accused no. 20), the judge observed that while the incident occurred at 3 p.m. on April 27, statements of witnesses were recorded on April 28 night, and the first information report was received by the jurisdictional magistrate on April 29 morning.
'This fact creates serious doubt regarding the manner of occurrence of the incident, involvement of the petitioners and other accused named in the FIR, and the first information statement,' the judge observed.
In a separate judgments granting bail to Sachin (accused no. 19), Deekshith (accused No. 17) and Sandeep Haveri (accused no. 16), the judge made note of the bail granted to Rahul and Sushanth. The judge said names of Sachin, Deekshith and Sandeep Haveri were not found in the compliant. Presence of the three petitioners at the time of the incident has to be proved by the investigation agency by filing a detailed charge-sheet, the judge noted.
In the hearing on separate bail applications of Saideep and six others on June 6, the court had directed the investigation officer to submit confidentially on June 9 the list of arrested persons whose voice samples are to be collected.

Rahul Gandhi NEW DELHI: Leader of opposition in Lok Sabha Rahul Gandhi on Monday asked the Election Commission to specify the exact date by which it will furnish the voter rolls of Maharashtra and Haryana legislative elections. This comes after the poll body reportedly decided to share electoral roll data for Haryana and Maharashtra from 2009 to 2024. In a social media post on X, Rahul welcomed EC's decision and said, "Good first step taken by EC to hand over voter rolls." "Can the EC please announce the exact date by which this data will be handed over in a digital, machine-readable format?" he asked. The leader of opposition in the Lok Sabha also shared the screenshot of a media report that claimed that the EC has cleared the way for sharing the electoral-roll data for Haryana and Maharashtra from 2009 to 2024, following an assurance it gave to the Delhi high court earlier in the year. This comes a day after Rahul, in an article, outlined a "step-by-step manipulation" of the 2024 Maharashtra assembly elections. "My article shows how this happened, step by step: Step 1: Rig the panel for appointing the Election Commission. Step 2: Add fake voters to the roll. Step 3: Inflate voter turnout. Step 4: Target the bogus voting exactly where BJP needs to win. Step 5: Hide the evidence," Gandhi wrote in a post on X. "It's not hard to see why the BJP was so desperate in Maharashtra. But rigging is like match-fixing — the side that cheats might win the game, but damages institutions and destroys public faith in the result. All concerned Indians must see the evidence. Judge for themselves. Demand answers," Gandhi had said. "Because the match-fixing of Maharashtra will come to Bihar next, and then anywhere the BJP is losing," the Leader of the Opposition claimed in his post. Later, the poll body issued a statement calling Rahul's allegations of "match-fixing" in the electoral process "completely absurd." "The entire nation is aware that each election process, including the preparation of electoral rolls, polling and counting etc., are all held by government staff, and that too in the presence of authorised representatives formally appointed by political parties/candidates from polling station up to constituency level," EC said. "Any misinformation being spread, by anyone, is not only a sign of disrespect towards law, but also brings disrepute to the thousands of representatives appointed by their own political party and demotivates lakhs of election staff who work untiringly and transparently during elections," it added. "After any unfavourable verdict by the voters, trying to defame the Election Commission by saying that it is compromised, is completely absurd," the statement by ECI read. In the 2024 assembly elections, the Mahayuti coalition of BJP, Shiv Sena and NCP won 235 of the 288 seats, with BJP securing 132 alone. Shinde's Sena secured 57 seats and Ajit Pawar's NCP got 41 seats. On the other hand, it was a disappointing show by the Maha Vikas Aghadi (MVA), which was hoping for a grand comeback. Uddhav's Sena got 20 seats, Congress 16 and Sharad Pawar's NCP secured 10 seats.

The Faridabad police Sunday arrested an 18-year-old after her speeding SUV allegedly hit a traffic police interceptor vehicle on the Delhi-Mumbai Expressway near the Badoli Bridge, injuring two police personnel and damaging equipment. A home guard was thrown off the bridge onto the service road approximately 25 feet below, said the police. The accident occurred around 8.15 am during a routine check and the police personnel were handing out challans to those overspending. According to the complaint filed by Traffic Constable Deepak, 25, the interceptor vehicle, a Maruti Suzuki Ertiga, was parked on the side of the expressway in accordance with the rules. Assistant Sub Inspector Narendra, 42, and Home Guard Deepak, 35, were also part of the team operating the interceptor when a green Mahindra Scorpio, driven by the accused, Kritika Garg, allegedly collided with the rear of their vehicle at high speed. Home Guard Deepak was flung off the bridge due to the impact of the collision, as per the complaint. The Scorpio's tyre burst after the collision, causing it to stop at the scene, and Garg provided her name and address when questioned, said the police. The impact severely damaged the interceptor's equipment, including an overspeed machine, laser DVR, battery monitor, printer, camera controller, and LED screen. Constable Deepak and Home Guard Deepak sustained serious injuries and were admitted to Sarvodaya Hospital. Home Guard Deepak's condition was critical, leading to his transfer to the intensive care unit, where doctors declared him unfit to give a statement. The complaint attributed the accident to Garg's negligent and high-speed driving, which, according to the police, obstructed government work. The police filed an FIR at the BPTP police station under sections 281, 125(A), 125(B), 324(4), 221, and 132 of the Bharatiya Nyaya Sanhita (BNS), citing rash driving, causing hurt by negligence, mischief causing damage, obstructing a public servant, and assault to deter a public servant. 'The accused, Kritika Garg, stays in Sector 28 in Faridabad and was driving at over 100 km per hour when she lost control and hit the home guard. Constable Deepak also sustained injuries but is stable, while ASI Narender was treated for minor bruises. The accused was returning from a gaming parlour in Sector 12 and heading to Sector 86 with four of her friends on a joyride of sorts to celebrate clearing their Class 12 exams,' Station House Officer Inspector Arvind Kumar said. He added that she was released on station bail, and the car was registered in the name of her father, Manoj Kumar.
