Kansas House bill strives to strip property interest from definition of university, college tenure

TOPEKA — Legislation headed to a Kansas House committee Tuesday would redefine tenure at public higher education institutions to strike the concept that faculty members earning this academic status held a property interest tied to their employment.
The bill was introduced by Salina Rep. Steven Howe, who chairs the House's higher education budget committee, at the behest of Steven Lovett, general counsel at Emporia State University. ESU is embroiled in state and federal court battles tied to the administration's decision in 2022 to fire 30 tenured or tenure-track professors.
Lovett's role in drafting or advancing the House bill could be a conflict of interest because passage had the potential to influence his prospects of success as a defendant in the federal case.
On Monday, an ESU spokeswoman Gwen Larson said it was a 'surprise to the university' Lovett had the bill introduced in the House. Larson said Lovett took that step as a 'private citizen' rather than in his capacity as a university attorney. Larson asserted all university employees had a 'constitutional right' — she didn't offer a citation from the Kansas Constitution — to present a bill to the Legislature.
'A bill submitted by Steven Lovett, which stipulates that tenure shall not be defined as an entitlement or property right, was done in his capacity as a private citizen,' Larson said. 'While submission of this bill comes as a surprise to the university, the university respects Mr. Lovett's constitutional rights and freedom of expression.'
Eleven dismissed ESU faculty filed a lawsuit in U.S. District Court challenging their firings on constitutional grounds. In addition to defending against that suit, Emporia State attorneys turned to Lyon County District Court in an attempt to prevail in the labor dispute.
Phillip Gragson, a Topeka attorney representing ESU tenured professors targeted for dismissal, said his clients were aware of the House bill.
'If it passes,' Gragson said, 'it's a death knell to the Kansas higher education system.'
The hearing on House Bill 2348 has been scheduled for 3:30 p.m. Tuesday in the House Judiciary Committee. Howe and the Kansas Board of Regents didn't respond to requests Monday for comment.
Emporia State President Ken Hush summarized the legal drama to members of Howe's higher education committee in January. Hush pointed to a federal judge's order in December that concluded faculty tenure was associated with a property right.
'That obviously means an entitlement in a job forever or until this is settled in some form,' Hush said. 'As a state agency, we're working with the attorney general on this. The other option is to correct that via legislation.'
Academic tenure in the United States is often viewed as a contractual right granted college or university educators who demonstrated a commitment over the years to teaching, research and service. Tenure evolved as a mechanism to encourage intellectual autonomy among scholars. Absence of some form of job security would likely shift the focus of researchers and teachers to noncontroversial, insubstantial topics.
Some critics of tenure have argued the system made it difficult to hold faculty accountable for on-the-job failures.
In 2022, the Kansas Board of Regents clouded the issue with a policy making it easier to terminate tenured faculty at state universities based on financial problems or declining enrollment. The policy was an outgrowth of uncertainties created by the COVID-19 pandemic.
The policy didn't eliminate standard justifications for possibly firing a tenured faculty member, such as personal misconduct, criminal offenses or violation of university policy. Only ESU implemented the streamlined policy to dispatch tenured professors.
Under the new House bill, 'an award of tenure may confer certain benefits, processes or preferences, but tenure shall be discretionary and conditional and shall not — nor shall it be interpreted to — create any entitlement, right or property interest in a faculty member's current, ongoing or future employment by an institution.'
'Surely the law can't be that a tenured professor can never be let go when a university is downsizing,' said Rep. Paul Waggoner, R-Hutchinson.
Howe, who introduced the tenure reform bill, also made a recent motion in his House committee to add $2.2 million to the ESU budget for legal expenses in the faculty firing case. He said it would be unfair if ESU had to pay court-related expenditures through internal reallocation.
'This motion is basically to support Emporia State University in their effort to create efficiencies,' Howe said.
Ron Barrett-Gonzalez, co-chair of the Kansas conference of the American Association of University Professors, said the House bill ought to be relabeled an attempt to seize property and due process rights from educators while inflicting general harm on the people of Kansas.
He said the legislation would remove employment protections held by tenured faculty across Kansas in addition of forbidding those rights from being conferred in the future.
'We see this bill as being fundamentally flawed,' said Barrett-Gonzalez, a professor of engineering at University of Kansas. 'This bill, if passed, will effectively take the property rights of thousands of faculty members … without compensation or due process.'
The House bill could jeopardize accreditation among engineering, medical and law schools, damage national reputations of targeted colleges and universities, make it more difficult to recruit or retain quality faculty and invite a collapse in student enrollment, Barrett-Gonzalez said.
Language in the bill indicated it would directly apply to the six public universities operated by the state Board of Regents. It could involve the state's 19 community colleges, six technical colleges and Washburn University in Topeka, said Heather Morgan, executive director of the Kansas Community College Association. She said the association didn't have a position on the bill and assumed other state laws would exempt community and technical colleges from the tenure reform.
In 2014, the Legislature and Gov. Sam Brownback approved legislation that ended tenure for K-12 public school teachers. The Kansas Supreme Court subsequently issued a decision that K-12 tenure could be deleted by state lawmakers.
Rep. Sydney Carlin, D-Manhattan, Sen. Marci Francisco, D-Lawrence, and Rep. Barbara Ballard, D-Lawrence, serve communities that host either Kansas State University or KU. All three said they were disturbed by ramifications of the bill introduced by Howe and the ESU attorney.
'It made my heart sick,' Carlin said. 'This is just another attack on educators. Tenure is really an investment in the university and the professor.'
Francisco, with a Senate district covering the KU campus in Lawrence, echoed that sentiment. She said the legislation sought to substantively and negatively alter the employer-employee relationship between higher education institutions and faculty.
'It allows people to really do harm to you without recourse,' Ballard said. 'No one gives you tenure. You earn it. Everybody, not just faculty, deserve due process.'

CHICAGO — Entering a legislative session amid questions about whether he'd run for a third term, Democratic Gov. JB Pritzker outlined an ambitious agenda that ended with mixed results. In a State of the State and budget address in February that will be remembered mainly for Pritzker invoking Nazi Germany to describe the new presidential administration, there was also a litany of policy initiatives — some of which passed and will now have a tangible impact on Illinoisans and others that went nowhere in the spring legislative session that just wrapped up. 'You don't get everything done in one year. I think the Senate president can back me up on that, and lots of people in the General Assembly,' Pritzker said Sunday at his end-of-session news conference in Springfield, flanked by Senate President Don Harmon of Oak Park. 'Sometimes they spend two years, four years, six years trying to get something big done. I think we've been hyper-successful about getting things done in a shorter period of time than expected.' But Pritzker's mixed scorecard also revealed tensions between his agenda and those in the Legislative Black Caucus. More than once, Black caucus members balked at Pritzker's plans as they didn't see their wants and needs fully addressed during a legislative session that focused heavily on fiscal issues and a tight budget. Indeed, while the governor's backing puts political capital behind any policy proposal, that didn't mean it was guaranteed to pass through the sometimes splintered Democratic supermajorities in the state House and Senate. Here are some examples of where the governor accomplished what he set out to do — and a few places where he came up short. What Pritzker said: 'This session, I'll move forward with legislation requiring all school districts in Illinois to adopt a cellphone policy that bans the use of phones during classroom instruction. More focus on learning will bring even greater success for kids across our state.' Status: Did not pass. A coalition of Illinois House lawmakers blocked the measure when it came to the House late in the session over concerns about unequal disciplinary impacts, according to bill sponsor, Democratic state Rep. Michelle Mussman of Schaumburg. Concerns about enforcement disproportionately affecting Black and brown students became more pronounced as lawmakers reviewed the phone restriction alongside another bill limiting police from ticketing students for minor misbehavior, according to Mussman. Legislators were hesitant to pass a statewide school mandate while also debating a measure meant to scale back school discipline practices, she said. Rep. Curtis Tarver, a Chicago Democrat and a member of the Black caucus, told the Tribune in February he worried about the 'unintended consequences' of a phone ban, including inequitable enforcement. The legislation against ticketing and fines passed both chambers and now heads to Pritzker's desk for his signature. A Chicago Tribune and ProPublica investigation found school districts used local law enforcement to fine students, and Black students were twice as likely to be ticketed at school as their white peers, a pattern lawmakers aimed to end. Pritzker's cellphone policy will have to wait for another session when there's more time to work out the enforcement aspect, Mussman said. The measure would have required school districts to adopt guidelines prohibiting students from using wireless devices, such as cellphones and smartwatches, during instructional time, while providing secure and accessible storage for the devices, before the 2026-2027 school year. The legislation also included a few exceptions, such as permitting students to use phones in emergencies. In the end, negotiations around the measure came down to a 'dance' between ensuring local school boards had control over their own policies while also protecting students from 'inequitably applied' policies, Mussman said. Moreover, representatives were unsure how to implement guidance on 'how a phone might be returned if it was confiscated, or what to do if anything was lost or broken,' she added. Also not quite making the mark: Pritzker's push to expand so-called evidence-based funding for K-12 schools by $350 million. The final plan would boost funding by $307 million, cutting $43 million that usually would go to a grant program designed to help school districts with high property tax rates and low real estate values. What Pritzker said: 'I'm proposing that we allow community colleges to offer four-year baccalaureate degrees for in-demand career paths — like nursing, advanced manufacturing, early childhood education, and beyond.' And: 'I propose we pass the Public University Direct Admission Program Act introduced by Majority Leader Kimberly Lightford last year. It would allow students to know before they apply whether they qualify for admission to any or all of our state's public universities.' Status: One for two. The Pritzker-led initiative to let community colleges offer four-year degrees didn't make it to the finish line even after the sponsor, Democratic Rep. Tracy Katz Muhl of Northbrook, filed a significant amendment following months of negotiations. The bill was intended to create more paths for students to get affordable, accessible bachelor's degrees in areas that need more workers. However, it initially faced opposition from existing four-year schools that warned it could duplicate degree offerings. Toward the end of the session, Tarver told a Senate committee that the Black caucus had 'significant issues with the bill,' including how it would affect four-year institutions serving a high proportion of Black and minority students, such as Chicago State University. A proposal on direct university admissions, however, passed, meaning high school students and eligible community college students starting in the 2027-2028 school year will automatically be offered admission to public universities if they meet specific GPA standards. What Pritzker said: 'We're going to stop insurance companies from blocking access to mental health. We can do that by banning prior authorization for all behavioral health care. And for rural Illinois families and those who live far away from certain medical care, we'll require insurance reimbursement for reasonable travel costs associated with medical appointments' for some distances. Status: Passed. Building on sweeping health care legislation last year, the General Assembly this session voted on a bill to expand a ban on prior authorization for outpatient behavioral health care, meaning patients will no longer need permission from insurance companies before receiving mental health treatment in many more cases. The same legislation also puts insurers on the hook for travel costs in some instances where closer options aren't adequate. What Pritzker said: 'I'm introducing the Prescription Drug Affordability Act to rein in the unfair practices of PBMs.' Status: Passed. Critics often blame large so-called pharmacy benefit managers, such as CVS Caremark and UnitedHealth Group-owned Optum Rx, for inflating prescription drug costs while pushing independent pharmacies out of business, and Pritzker was largely successful this session in barring these practices, as a bill carrying language to restrict PBM costs passed the legislature with broad bipartisan support. The bill now heading to Pritzker's desk would prohibit PBMs from charging insurance companies more for drugs than they are paid by pharmacies and pocketing the difference; prohibit them from giving better reimbursement rates to pharmacies that the same company owns; and require them to pass along rebates negotiated with drugmakers to health plans and patients. Pritzker indicated Saturday that he would sign the measure, which would also require PBMs to submit annual reports on pricing and other practices to the Illinois Department of Insurance. The measure would charge PBMs an annual $15-per-patient fee, with the first $25 million collected going to a grant fund to support local pharmacies. Supporters of PBMs during the session argued Pritzker's plan was flawed, as they see PBMs as saving patients and employers money partly by negotiating with drugmakers. What Pritzker proposed: As part of the package of policies he announced in February, Pritzker said he'd push several other initiatives, including funding to remediate dilapidated state sites and an easier path for voters to reduce or eliminate local township governments. Status: State site funding passed; township idea stalled. Pritzker received his requested $500 million in state capital funds for two key programs on state sites, including $300 million to remake five or more largely abandoned properties, which would help develop properties 'sitting idle' in areas that are 'ripe' for economic growth, according to his budget proposals. The state's previous investments in site readiness have generated over $1.5 billion in private investment and the now-passed initiatives could attract more than $4.7 billion in investment, the governor's office said in February. Yet an effort to consolidate smaller townships across the state did not gain much traction as neither bill in the House nor the Senate made it out of committee. Pritzker's office said in February that many of the more than 1,400 townships operating across the state — which levy over $750 million in property taxes — provide services that are duplicative or could be managed more efficiently by municipalities or counties. Townships often provide maintenance and services for rural areas, such as road maintenance and transportation for seniors. Still, several Illinois townships have been tangled with corruption, such as the recent federal investigation of Dolton Mayor and Thornton Township Supervisor Tiffany Henyard over improper spending of taxpayer dollars. The idea of consolidating townships has faltered for a century, partly due to opposition from politicians seeking to preserve their power, as well as concerns that downstate rural areas could lose their civic identity. ____

WASHINGTON – President Donald Trump ordered an investigation of former President Joe Biden's alleged "cognitive decline" to determine who decided his signature should be applied to official documents by autopen. Trump's directive to the White House counsel, David Warrington, in consultation with Attorney General Pam Bondi, ratchets up the pressure behind Trump's longstanding criticism of Biden's mental ability. The probe comes amid similar inquiries at the Justice Department and in a House committee. "This conspiracy marks one of the most dangerous and concerning scandals in American history," Trump wrote in his order. "The American public was purposefully shielded from discovering who wielded the executive power, all while Biden's signature was deployed across thousands of documents to effect radical policy shifts." In a statement in response to Trump's order, Biden said he "made the decisions about the pardons, executive orders, legislation, and proclamations" during his presidency. "Any suggestion that I didn't is ridiculous and false," Biden added. "This is nothing more than a distraction by Donald Trump and Congressional Republicans who are working to push disastrous legislation that would cut essential programs like Medicaid and raise costs on American families, all to pay for tax breaks for the ultra-wealthy and big corporations." Biden has replied in a series of recent public appearances that he was in command of his faculties. He has also been critical of Trump, arguing that his successor was taking a hatchet to the Social Security Administration. "They are wrong,' Biden said of his alleged cognitive decline on ABC's "The View." Trump directed the investigation to cover whether Biden's aides coordinated to shield the public from information about Biden's mental and physical health. A new book, "Original Sin," describes aides shielding Biden from Cabinet secretaries and limiting his access. Biden recently revealed his diagnosis of prostate cancer. Trump also directed the investigation into how Biden took executive actions during his final years in office, to determine who ordered the autopen for granting clemencies or other presidential actions. Presidents have used automated pens to mimic their signatures on documents for decades, often when away from the office, when Congress completed urgent legislation. Justice Department memos in 2002 and 2005 confirmed that a president could direct an aide to use an autopen to sign legislation that remains valid under the Constitution. "This memorandum confirms and elaborates upon our earlier advice that the President may sign a bill in this manner," the 2005 memo said. Biden pardoned his brother, James Biden, and other relatives for unspecified crimes during his final days in office. Biden had previously pardoned his son, Hunter Biden, after gun and tax convictions. At the Justice Department, pardon attorney Ed Martin said he would investigate Biden's pardons and use of the autopen. Congressional Republicans have long argued that the president profited from his son's and brother's overseas business deals, which the family denied. The chairman of the House Oversight and Accountability Committee, Rep. James Comer, R-Kentucky, asked former Biden aides to sit for transcribed interviews about his mental fitness for office. Trump's order highlights a particular sore point involving the different treatment of him and Biden in retaining classified documents after leaving office. Justice Department special counsel Jack Smith charged Trump with unlawfully retaining more than 100 classified documents at his Florida estate, Mar-a-Lago, where they were retrieved 18 months after he left office during an FBI search. The charges were dropped when Trump was elected to a second term under a policy against prosecuting a sitting president. Special counsel Robert Hur decided against charging Biden for classified documents found at his Delaware home and a Washington, D.C., office during a search Biden invited. Hur concluded jurors would have found Biden "a sympathetic, well-meaning, elderly man with a poor memory.' "For years, President Biden suffered from serious cognitive decline," Trump wrote. "The Department of Justice, for example, concluded that, despite clear evidence that Biden had broken the law, he should not stand trial owing to his incompetent mental state."
